The like City zoning would be R-4 and R1-6. The applicant proposed a multifamily development that would not require rezoning. No one wished to speak. Mayor Weiers closed the public hearing. Mr. Gibson said the request was to adopt an ordinance setting the primary property tax rate at $0.3328 per $100 of assessed valuation for FY2024-2025 (FY24-25) and the secondary property tax rate at $1.1597 per $100 of assessed valuation for FY24-25. The total property tax rate would decrease from $1.5626 to $1.4925. Mayor Weiers asked how many years the City had not increased the property tax. Mr. Gibson said it was the 9th year of the City decreasing the property tax rate. O24 -24 AN ORDINANCE OF THE COUNCIL OF THE CITY OF GLENDALE, MARICOPA COUNTY, ARIZONA, AUTHORIZING THE SALE OF LAND BY THE CITY GENERALLY LOCATED AT THE NORTHWEST CORNER OF MONTEBELLO AVENUE AND 91ST AVENUE, TOTALING 8.25 ACRES TO VAI RESORTS, LLC, AND DIRECTING THE CITY MANAGER TO EXECUTE ALL NECESSARY DOCUMENTS FOR THE SALE AND DIRECTING THE CITY CLERK TO RECORD A CERTIFIED COPY OF THIS ORDINANCE. Presented by: Don Bessler, Director of Engineering City Council Meeting Minutes - June 25, 2024 Page 13 of 17 Ms. Bower read the ordinance by title. Mr. Bessler said the proposed ordinance would authorize the sale of approximately 8.25 acres of City-owned property on the northwest corner of Montebello Avenue and 91st Avenue to VAI Resorts LLC for a parking garage. The City would receive approximately $7,546,770 for the transfer. The exact parcel size and payment would be determined prior to closing. The sale price was $21 per square foot. Councilmember Malnar asked how the property value was determined. Mr. Bessler said it was consistent with property values in the area. Mr. Gruber requested Council make the following amendments to the agreement: Paragraph 8 – add “Seller agrees to reimburse purchaser for the costs incurred for bringing City utilities to the site.” Paragraph 35(F) – add “In the event seller receives an offer from a third party to purchase the remaining approximately 11.45 acres of land, seller will provide written notice of such offer to purchaser. Purchaser will have 30 days to provide written notice to seller that purchaser will exercise its right of first refusal to purchase the remaining approximately 11.45 acres of vacant land. In the event purchaser does not respond within 30 days, purchaser is deemed to have elected not to exercise its right of first refusal.” Paragraph 35(G) – strike the paragraph. A motion was made by Councilmember Joyce Clark, seconded by Councilmember Lauren Tolmachoff to adopt Ordinance No. O24-24 with the amendments proposed by the City Attorney to Paragraph 8, Paragraph 35(F) and Paragraph 35(G). The following people spoke in opposition to the item: Taylor Lincoln, Cactus District resident Ana Martinez, Cactus District resident Morningstar Bloom, Phoenix resident Mr. Phelps said the City was not entering into a Government Property Lease Excise Tax (GPLET) with Vai Resort. The land value was predicated upon comparable sales in the area. As the scope of the resort had increased over the past two years, the resort required additional parking to support its operation. The current economic impact to the public benefit in new revenue was $32.5 million per year. The sale was in the interest of the citizens. The development was 100% privately funded. Councilmember Hugh asked what other entities would receive a benefit from the resort development. Mr. Phelps said over the next 25 years, for schools, transportation, county and state, it was almost an additional $2 billion of tax revenue. Prior to development, the property had been used as a farm and generated $2,000 of annual property tax. It was a significant and positive development for citizens. Councilmember Malnar said the sale was not tied to any "give away." The resort needed City Council Meeting Minutes - June 25, 2024 Page 14 of 17 additional parking to be successful. The property was being sold at market value and there would be a $32 million annual benefit to the City. There was no give away to Vai Resort. Councilmember Tolmachoff said the property had been listed for sale for the past two years. There was no lack of transparency. Vai Resort was paying market rate. There had been public meetings and public discussion regarding the property. It made sense because Vai did need parking. Councilmember Turner said it was a good solution and opened the opportuinty for tax revenue and good, high-paying construction jobs and jobs for all segments of the community. There was community opportunity that offset any downside to selling the property. Vice Mayor Hugh agreed that the resort would create jobs. The largest portion of the tax would go to the school districts. Councilmember Malnar reminded residents that fireworks that went into the air or made loud noises were illegal. Councilmember Tolmachoff reminded Cholla District residents that a meeting was being held to present two options for Sierra Verde Park on July 9th at 5:30 p.m. at the Foothills Library. Councilmember Tolmachoff said Council received dozens of complaints regarding fireworks. There were restrictions on both the types of fireworks allowed and the hours during which fireworks could be City Council Meeting Minutes - June 25, 2024 Page 16 of 17 shot off. She asked everyone to follow the law and be safe. Councilmember Turner said fireworks that launched into the air or exploded were illegal. The police did not need to catch people in the act of lighting off illegal fireworks. He asked everyone to have respect for their neighbors. He suggested residents contact their state legislators with any complaints regarding fireworks. Vice Mayor Hugh encouraged everyone to celebrate the 4th of July but refrain from shooting fireworks into the air. Mayor Weiers said there would be a free fireworks show at Westgate on July 4th. CITIZEN COMMENTS James Deibler, Phoenix resident, commented on an abandoned house. Roberto Ramos, Yucca District resident, commented on mobile vendors. Dave Goitia, President of the Glendale Fraternal Order of Police, commented on Council's support of law enforcement. Dianna Guzman, Yucca District resident, commented on the approval of the funding for the design of the Heroes Regional Park aquatic and recreation center. She was running for the Glendale City Council for the Yucca District to continue the good work that Council was doing.
