RESOLUTION NO. R24-67 A RESOLUTION OF THE COUNCIL OF THE CITY OF GLENDALE, MARICOPA COUNTY, ARIZONA, AUTHORIZING AND DIRECTING THE ENTERING INTO OF A LICENSE AND USE AGREEMENT WITH “HEART FOR THE CITY” FOR USE OF CITY REAL PROPERTY LOCATED AT APPROXIMATELY 6850 WEST BETHANY HOME ROAD FOR THE PURPOSE OF A COMMUNITY GARDEN IN GLENDALE, ARIZONA. WHEREAS, the City of Glendale has real property located at approximately 6850 West Bethany Home Road; and WHEREAS, the City of Glendale and Heart for the City previously entered into a License and Use Agreement, C19-0606, on June 25, 2019, for use of City real property located at 6850 West Bethany Home Road (“the Property”) for a community garden; and WHEREAS, the prior License and Use Agreement expired on June 26, 2024; and WHEREAS, the City of Glendale and Heart for the City wish to enter into a new License and Use Agreement for use of the Property. BE IT RESOLVED BY THE COUNCIL OF THE CITY OF GLENDALE as follows: SECTION 1. That it is deemed in the best interest of the City of Glendale and its citizens to enter into a License and Use Agreement with the Heart for the City for the Property’s use as a community garden. The License and Use Agreement providing for such use is on file in the office of the City Clerk of the City of Glendale. SECTION 2. That the City Manager be authorized and directed to execute and deliver said agreement on behalf of the City of Glendale at his discretion, and to extend the term in accordance with the provisions of the License and Use Agreement, if such an extension is deemed to be in the City’s best interests.
