R25-01 A RESOLUTION OF THE COUNCIL OF THE CITY OF GLENDALE, MARICOPA COUNTY, ARIZONA, ADJUSTING SOLID WASTE FEES PURSUANT TO GLENDALE CITY CODE; AND SETTING FORTH EFFECTIVE DATES. Presented by: Michelle Woytenko, Director, Field Operations Councilmember Conchas requested a separate vote on the item. He said the increase would have a negative impact on Ocotillo District residents. It would disproportionately impact low income and fixed income households. The timing of the increase was concerning given the broader economic pressures on residents. O25-01 AN ORDINANCE OF THE COUNCIL OF THE CITY OF GLENDALE, MARICOPA COUNTY, ARIZONA, AMENDING THE GLENDALE CITY CODE, CHAPTER 25 (NUISANCES) AND SETTING FORTH AN EFFECTIVE DATE. Presented by: Rick St. John, Deputy City Manager Ms. Bower read the ordinance by title. Mr. St. John said the proposed ordinance would change the definition for camping, would add a definition for camping paraphernalia, revise some of the language to make it more clear and eliminate the provision that an officer had to demonstrate there was available bed space prior to making an arrest. Mr. St. John said the City continued to pay for available bed space at the Central Arizona Shelter Service’s Human Services Campus and that would not change. Vice Mayor Tolmachoff said the practice had not changed with regard to bed space. Mr. St. John said that was correct. Rory Goree, Ocotillo District resident, commented on the need to work with the state to address homelessness issues. City Council Meeting Minutes - January 14, 2025 Page 9 of 15 A motion was made by Councilmember Bart Turner, seconded by Vice Mayor Lauren Tolmachoff to adopt Ordinance No. O25-01. Councilmember Conchas said he was originally opposed to the ordinance because of the criminalization of homelessness. However, the violation was reduced to a Class 3 Misdemeanor and the City would still provide bed space so he would be supporting the ordinance. Vice Mayor Tolmachoff said a recent proposition allowed property owners to hold cities financially responsible for nuisances created by urban camping. That was one of the reasons cities were passing similar ordinances. Mayor Weiers said the City had tried to do the right thing for citizens who were less fortunate and had been working on the issue for many years. Mr. Bailey said item 34 had been removed from the agenda. RESOLUTIONS 35. RESOLUTION NO. R25-08 A RESOLUTION OF THE COUNCIL OF THE CITY OF GLENDALE, MARICOPA COUNTY, ARIZONA, ORDERING AND CALLING A SPECIAL ELECTION TO BE HELD ON MAY 20, 2025, IN AND FOR THE CITY OF GLENDALE, ARIZONA AND DESIGNATING THE PURPOSES FOR SAID ELECTION; PROVIDING THE ISSUANCE OF A PUBLICITY PAMPHLET; PROVIDING THE DEADLINE FOR FILING ARGUMENTS FOR AND AGAINST BALLOT MEASURES; PROVIDING THE DEADLINE FOR VOTER REGISTRATION; PROVIDING THE TIMES FOR MAILING OF BALLOTS; AUTHORIZING A CONTRACT FOR COUNTY ADMINISTRATION OF THE ELECTION AND ELECTION EXPENDITURES; PROVIDING FOR THE CANVASSING OF ELECTION RESULTS; PROVIDING THE DEADLINE FOR THE MAIL BALLOT ELECTION REPORT TO THE LEGISLATURE; AND City Council Meeting Minutes - January 14, 2025 Page 10 of 15 AUTHORIZING THE CITY CLERK TO TAKE ALL NECESSARY ACTION TO FACILITATE THE ELECTION. Presented by: Julie K. Bower, City Clerk Ms. Bower read the resolution by title. She said on December 20, 2024, Worker Power PAC filed two referendum petitions with the City Clerk's Office to refer the adoption of Resolution No. R24-131 and Ordinance No. O24-46 to Glendale voters. The petitions were found to have a sufficient number of valid signatures to place the questions on the ballot at the May 20, 2025, election. Ballots would be mailed to each registered voter on Wednesday, April 23, 2025. The City was required by statute to mail a publicity pamphlet with information about the election to every household containing a registered voter. Arguments supporting or opposing the Ballot Measures must be filed electronically by email with the City Clerk’s Office by 5:00 p.m. on February 19, 2025. REVIEW AND CONSIDER AMENDMENT NO. 2 TO THE STANDARD FORM OF AGREEMENT BETWEEN THE OWNER AND DESIGN PROFESSIONAL (CONSTRUCTION MANAGER AT RISK) WITH HOLLY STREET STUDIO, LLC, FOR THE DOWNTOWN CAMPUS REINVESTMENT PROJECT Presented by: Don Bessler, PWLF, Director, Engineering Ms. Bower read the item by title. Mr. Bessler said item 36 and 37 both related to the Velma Teague Library. He said staff was there to take any additional comments or direction from Council. Councilmember Baldenegro supported bringing a state-of-the-art library to downtown Glendale. At the time the item was adopted, there was an opportunity to move the library to the Promenade location and the window for the opportunity was very small. He realized that he should be listening to everyone. Councilmember Baldenegro had since had conversations with residents who did not agree with the plan for the library. It came at a time when he needed to hear it. The issue was creating divisions within the community. Councilmember Baldenegro moved that the City Manager be instructed not to enter into City Council Meeting Minutes - January 14, 2025 Page 11 of 15 Amendment No. 2 for item 36. Vice Mayor Tolmachoff asked for a point of order. She was told this was a reconsideration and she wanted to know the process for how the item was brought before the Council at tonight’s meeting. Councilmember Turner had requested a Council Item of Special Interest on the Velma Teague Library that had not been brought back to Council. Vice Mayor Tolmachoff said she was told by Mr. Phelps that one Councilmember had asked for a reconsideration. It was not the same body that had approved the item. Mr. Bailey said the original agreements were drafted in such a manner that allowed the City to expand or minimize the scope of work. In this case, the scope was being minimized. It was not a reconsideration. It was to seek direction from Council, based on the scope that was approved in December, to amend the agreements to remove the work regarding the library. Vice Mayor Tolmachoff asked if Council was establishing a precedent where a single Councilmember could bring something back to Council because they wanted to change his or her vote. Mr. Phelps said he had received a request from the Mayor’s Office to put the two items on tonight’s agenda. The Mayor, or three Councilmembers had the ability to put items on the agenda. Councilmember Malnar believed a Councilmember could request something to be reconsidered if he or she was on the prevailing side. Mr. Bailey said Council was not bound by Robert’s Rules of Order but because Council did not have a rule regarding reconsideration, it looked to Robert’s for guidance. Reconsideration was available only during the same meeting at which it was considered. Councilmember Malnar did not agree with Mr. Bailey. Councilmember Turner asked Mayor Weiers why the request was made. Mayor Weiers said after listening to the conversations and public comments, although he believed the way he voted was fine, Council represented all residents. Councilmember Baldenegro was concerned and wanted it to be brought back. It gave everyone a chance to support it or deny it. Councilmember Turner understood there were discussions with the City Manager and more than one Councilmember. He had not supported it and was more than happy to have it brought back. He was concerned about the process used to do so. It should be transparent, consistent and should comply with the Charter. Information should be shared with all of Council. Councilmember Turner said when the items were approved in December, there were Councilmembers who wanted to wait until the new Councilmembers were seated before making a decision. Those Councilmembers were ignored and now Council was right back where it started. He had a Council Item of Special Interest that should be coming forward to take back into consideration the options for Velma Teague Library. Councilmember Baldenegro apologized if he had broken protocol. He wanted to change his vote and keep things as they were and have further discussion. Mr. Bailey suggested that the motion be to direct the City Manager to enter into an amendment to the respective contract that excluded any reference to construction activity regarding the Velma Teague Library. Councilmember Turner asked if there was such an amendment. Mr. Bailey said the motion was directing the City Manager to enter into an amendment with the library language removed. Councilmember Guzman clarified that the City was no longer moving forward with the demolition of the Velma Teague Library and that the issue would be brought back for further discussion. Mayor Weiers said that was correct. Vice Mayor Tolmachoff asked if it was coming back as Councilmember Turner’s Council Item of Special Interest. Mr. Phelps said if Council approved the motion, staff would remove the scope related to the Velma Teague Library and bring back a modified amendment that had a limited scope regarding the Downtown Campus Reinvestment Project. He said staff was still working on Councilmember Turner’s Council Item of Special Interest regarding options for the library. Councilmember Conchas thanked Councilmember Baldenegro for bringing the item back to the Council. When Council listened to the community, it made good decisions. Guzman Councilmember Ray Malnar Councilmember Bart Turner Passed COUNCIL COMMENTS AND SUGGESTIONS Councilmember Baldenegro apologized for any confusion he caused with items 36 and 37 and thanked Martha Dennis. Councilmember Conchas invited residents to the Cactus District Townhall on January 23rd from 5:00 to 7:00 p.m. at the Glendale Womans’ Club. It was part of his initiative to create a citizen’s advisory council for the Cactus District. Councilmember Conchas was deeply shaken by the tragic events that took place last week at Horizon Park. His thoughts were with the families of all those affected by the tragedy. The public’s trust must be earned and maintained through honesty and transparency. Councilmember Turner commented on the passing of retired Glendale City Court Presiding Judge Elizabeth Finn. Judge Finn retired in March 2021 and was the longest sitting judge in the state of Arizona, serving in Glendale and Phoenix. She was a founding member of the Chair of the Supreme Court Committee on the Impact of Domestic Violence and the Courts. She implemented several specialty courts in the City. Judge Finn would be missed by the community. She was a remarkable woman and a champion of justice. Vice Mayor Tolmachoff extended her condolences to the family of Judge Finn. CITIZEN COMMENTS Rory Goree, Ocotillo District resident, commented on a presentation provided by the Glendale Fire Department. Kim Thomas, Cactus District resident, thanked Council for listening to residents regarding the Velma Teague Library. Sandra Netkin, Phoenix resident, commented on the Glendale Police Department and mental health issues. Pedro Paredes, Phoenix resident, commented on the incident at Horizon Park. Lorraine Zomok, Ocotillo District resident, commented on Glendale Glitters and Glendale Founder's Day.
