A RESOLUTION OF THE COUNCIL OF THE CITY OF 
GLENDALE, 
MARICOPA 
COUNTY, 
ARIZONA, 
DIRECTING 
THE 
ENTERING 
INTO 
OF 
AN 
INTERGOVERNMENTAL 
AGREEMENT 
WITH 
THE 
FLOOD CONTROL DISTRICT OF MARICOPA COUNTY 
FOR THE BETHANY HOME ROAD STORM DRAIN 43RD TO 
51ST AVENUE PROJECT. 
 
WHEREAS, in 1997, the Maryvale Area Drainage Master Study (ADMS) identified flooding 
upstream of Grand Avenue; and 
 
WHEREAS, this project will begin the final element identified in the Maryvale ADMS to 
alleviate flooding caused by Grand Avenue and the elevated BNSF railroad; and 
 
WHEREAS, the flooding issues detrimentally affect the safety of the citizens and businesses 
along Bethany Home Road and Grand Avenues. The commercial businesses have experienced flooding 
numerous times with substantial damage to vehicles and structures; and 
 
WHEREAS, the City submitted a letter of Intent to the Flood Control District of Maricopa 
County resulting in the District including the project in their Capital Improvement Project Plan; and 
 
WHEREAS, the Board of Directors of the Flood Control District of Maricopa County adopted 
Resolution FCD 98-12B (C-69-99-036-6-002) authorizing the cost-share, of which, will be fifty 
percent (50%) in the project associated with design, right-of-way acquisition, and utility 
relocations; and 
 
WHEREAS, in November 2020 the City of Glendale adopted a resolution (R20-156) to 
approve entering into an Intergovernmental Agreement with the Flood Control District of 
Maricopa County (IGA FCD 2020A020) for design, right-of-way acquisition, and utility relocation 
of the Bethany Home Road Storm Drain 43rd to 51st Avenue Project. 
 
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF GLENDALE as follows: 
 
SECTION 1. That it is deemed in the best interest of the City of Glendale and the citizens 
thereof that an Intergovernmental Agreement between the Flood Control District of Maricopa 
County (IGA FCD 2024A011) and the City of Glendale for construction, construction 
management, operation and maintenance of the Bethany Home Road Storm Drain 43rd to 51st 
Avenue Project with the district funding 65% of the project construction cost (estimate 
$14,079,000) be entered into, which agreement is now on file in the office of the City Clerk of the 
City of Glendale.

SECTION 2.    That the Mayor or City Manager and the City Clerk be authorized and 
directed to execute and deliver said agreement on behalf of the City of Glendale.
