Urban Camping Ordinance Amendments Rick St. John, Deputy City Manager Camping Prohibited Ordinance 2 We are seeking Council consensus on changes to the Camping Prohibited ordinance based on a recent US Supreme Court ruling. Camping Prohibited Ordinance 3 Chapter 25 (Nuisances) Sec 25-1(Definitions) – Amend definition for “Camp or Camping” to better clarify what is not allowed – Add a definition for “Camping Paraphernalia” Camping Prohibited Ordinance 4 Chapter 25 (Nuisances) Sec 25-90 (Camping Prohibited) – Amend 25-90 a. stating a violation of this section is a Class 1 Misdemeanor – Add 25-90 c. making a violation of this section a Class 3 Misdemeanor Camping Prohibited Ordinance 5 Chapter 25 (Nuisances) Sec 25-90 (Camping Prohibited) – Amend the language in 25-90 b. 1, 2, and 3 to better clarify what is permissible camping within the City – Amend 25-90 b. 4 removing the language stating enforcement of the ordinance was not legal when no alternative shelter is available (US Supreme Court ruling) – Add language to 25-90 b. 4 to include temporary structure or camps set up by a government agency Camping Prohibited Ordinance 6 We are seeking Council consensus on changes to the Camping Prohibited ordinance based on a recent US Supreme Court ruling.
