RESOLUTION NO. R25-08 A RESOLUTION OF THE COUNCIL OF THE CITY OF GLENDALE, MARICOPA COUNTY, ARIZONA, ORDERING AND CALLING A SPECIAL ELECTION TO BE HELD ON MAY 20, 2025, IN AND FOR THE CITY OF GLENDALE, ARIZONA AND DESIGNATING THE PURPOSES FOR SAID ELECTION; PROVIDING THE ISSUANCE OF A PUBLICITY PAMPHLET; PROVIDING THE DEADLINE FOR FILING ARGUMENTS FOR AND AGAINST BALLOT MEASURES; PROVIDING THE DEADLINE FOR VOTER REGISTRATION; PROVIDING THE TIMES FOR MAILING OF BALLOTS; AUTHORIZING A CONTRACT FOR COUNTY ADMINISTRATION OF THE ELECTION AND ELECTION EXPENDITURES; PROVIDING FOR THE CANVASSING OF ELECTION RESULTS; PROVIDING THE DEADLINE FOR THE MAIL BALLOT ELECTION REPORT TO THE LEGISLATURE; AND AUTHORIZING THE CITY CLERK TO TAKE ALL NECESSARY ACTION TO FACILITATE THE ELECTION. WHEREAS, referendum petitions were filed with the Glendale City Clerk’s Office referring Resolution No. R24-131, that approved amending the General Plan Map by approving General Plan Amendment GPA23-02 for property located south of Cardinals Way between 95th Avenue and 94th Avenue and Ordinance No. O24-46 that approved amending the VAI Resort Centerpoint Planned Area Development for 66.31 acres located at the southeast corner of Cardinals Way and the Loop 101 Freeway, amending the Zoning Map and providing for an effective date; and WHEREAS, both referendum petitions were found to have sufficient signatures as required by law for placement on the ballot; and WHEREAS, the City of Glendale Charter, Article IX, Section 1 provides that elections, other than primary elections and general elections, may be held as special elections; and WHEREAS, the City of Glendale Charter, Article IX, Section 10, provides that the council shall provide the time, manner and means of holding any special election; and WHEREAS, the City of Glendale Charter, Article X, Section 1, provides that the constitution and general laws of this state relating to referendum applies to the City so far as such provisions are not in conflict with the City Charter; and WHEREAS, the next available consolidated election date to hold a special election is May 20, 2025 pursuant to A.R.S. § 16-204 and the election may be conducted as a “mail ballot” election as authorized by A.R.S. § 16-409. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF GLENDALE as follows: SECTION 1. Designation of Election Date; Purpose; Form. That the following referendums relating to Resolution No. R24-131 and Ordinance No. O24-46 (“Ballot Measures”) are hereby referred to the qualified electors of the City of Glendale for their approval or rejection at a special ballot-by-mail election to be held on May 20, 2025 (“Special Election”): [See Exhibit A attached hereto and incorporated herein by reference.] SECTION 2. Publicity Pamphlet. A publicity pamphlet shall be mailed to each household within the City that contains a registered voter by the earliest date for receipt of a ballot for the Special Election. If the pamphlet is not mailed by such date, the City Clerk shall provide a notice for when the pamphlet will be mailed and accessed or viewed. The pamphlet shall contain the Ballot Measures as they will appear on the ballot along with the arguments supporting or opposing the measure. Materials shall be translated into Spanish as required by the Voting Rights Act of 1965. SECTION 3. Pro/Con Arguments. Arguments supporting or opposing the Ballot Measures must be filed electronically by email with the City Clerk’s Office, at cityclerk@glendaleaz.com by 5:00 p.m. on February 19, 2025, as provided by A.R.S. § 19-141(C). Arguments must include a sworn statement from the person sponsoring the argument, two executive officers for an organization, or the chairman and treasurer for a political action committee pursuant to A.R.S. § 19- 124(A). Each argument must be submitted in an electronic format to the City Clerk and be accompanied by a $100.00 deposit to offset the proportional costs of printing. This payment requirement shall not be waived. SECTION 4. Conduct of Election. The Special Election shall be held, conducted, and canvassed in conformity with the general election laws of the State of Arizona and the City of Glendale Charter, Article IX, Sections 2 and 10, except as otherwise provided by law. A voter in the Special Election must be a qualified elector of the City (as defined under state law and City of Glendale Charter, Article IX, Section 3). Maricopa County registration and voting lists will be used for the Special Election as required by City of Glendale Charter, Article IX, Section 3. SECTION 5. Voter Registration. In order to be qualified to vote in the Special Election, a person must be registered to vote by midnight on Monday, April 21, 2025. SECTION 6. Delivery and Return of Ballots. Ballots will be mailed to each registered voter on Wednesday, April 23, 2025, as required by A.R.S. § 19-141(B). The postage-paid return affidavit envelope containing the ballot must be (a) placed in the U.S. mail, (b) placed in a Maricopa County drop box located 5752 W. Glenn Drive, or (c) hand-delivered to Maricopa County located at 510 S. 3rd Avenue. Ballots must be received by Maricopa County by 7 p.m. on Election Day. SECTION 7. Election Contract and Expenditures. The City Clerk is authorized and directed to contract with Maricopa County for the administration of the Special Election. All expenditures as may be necessary to order, notice, hold and administer the Special Election are hereby authorized, which expenditures shall be paid from current operating funds of the City. SECTION 8. Canvassing of Election Returns. The official returns from the Special Election shall be made to the Mayor and Council of the City within twenty (20) days from the date of the Special Election and the Special Election shall be canvassed and the results certified by the Mayor and Council of the City at a meeting to be held within twenty (20) days after the date of the Special Election, as provided by law. SECTION 9. Report to Legislature. The City Clerk shall submit a mail-ballot election report to the President of the Senate and the Speaker of the House by January 1, 2026 as provided in A.R.S. § 16-409(B). SECTION 10. The City Clerk is hereby authorized to take all necessary action to facilitate the Special Election.
