except as modified by the following conditions. Staff may determine slight refinements to

amendments to the site plan will be determined in accordance with Chapter 3 of the
Maricopa County Zoning Ordinance.
b.
Development of the site shall be in substantial conformance with the Narrative Report
entitled “Cardinals Nest Rezone”, consisting of five pages, dated March 26, 2025, and
stamped received March 28, 2025, except as modified by the following conditions.

Any amendments to the Plan of Development shall be processed administratively through
a new Plan of Development application with Maricopa County Planning & Development.
d.
The following Planning Engineering conditions shall apply:

Engineering review of planning and/or zoning cases is for conceptual design only.
All development and engineering design shall be in conformance with Section
1205 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards;

and current engineering policies, standards and best practices at the time of
application for construction.
2.
Based on the conceptual design nature of the information submitted, changes to
the site layout and/or a reduction in the number of buildings lots may be
necessitated by the final engineering design of the subdivision drainage
infrastructure.
3.
Retention basins to drain within 36 hours.
4.
The site is not located in a Special Flood Hazard Areas (SFHAs). The Flood Control
District has no comments on this application.
5.
The subject site is presently located within the County’s Urbanized Area, but site
disturbance appears less than one (1) acre. A Storm Water Pollution Prevention
Permit (SWPPP) from the County (PND) is not required. This does NOT preclude
the requirement to obtain a Construction General Permit (CGP) Notice of Intent to
Discharge (NOI) from the State (ADEQ), as may be required.

Non-Compliance with any Maricopa regulations will be grounds for possible revocation of

The property owner/s and their successors waive claim for diminution in value if the
County takes action to rescind approval due to noncompliance with conditions.

The granting of this change in use of the property has been at the request of the applicant,
with the consent of the landowner. The granting of this approval allows the property to
enjoy uses in excess of those permitted by the zoning existing on the date of application,
subject to conditions. In the event of the failure to comply with any condition, the property
shall revert to the zoning that existed on the date of application. It is, therefore, stipulated
and agreed that either revocation due to the failure to comply with any conditions, does
not reduce any rights that existed on the date of application to use, divide, sell or possess
the property and that there would be no diminution in value of the property from the value
it held on the date of application due to such revocation of the Zone Change. The Zone
Change enhances the value of the property above its value as of the date the Zone Change
is granted and reverting to the prior zoning results in the same value of the property as if
the Zone Change had never been granted.

Project Summary:
1.
The applicant is requesting a zone change from R1-6 to R-4 to accommodate multi-family, known
as Cardinals Nest. The site is located approximately 620’ north of the NEC of Glendale Ave. and
80th Ave. in the Glendale area, parcel 142-27-051, and is comprised of 22,019 square feet (0.51
acres). Concurrent with the Zone Change the applicant is requesting a Plan of Development.
2.
The site is proposed to be developed with 7 two story units to be fully equipped with kitchen –
living room open concept, with 3 bedrooms, 2 bathrooms, and a ½ bathroom. The units are
proposed to each be 804 square feet in size. The first floor will be developed with the kitchen,
living room, a ½ bathroom, and a 264 square foot garage, with direct interior entrance to the unit.
The main entrance to each unit will be through the front porch, there will be a rear sliding door
that will provide access to a private paved porch. The 2nd floor of each unit will be developed with
a master bedroom with a private bathroom and 2 10’ x 10’ additional bedrooms with an additional
bathroom.

The exterior of the units is proposed to vary in color, trim and accents to provide a unique exterior
design. The units are proposed to be within 4 buildings. The northern portion of the site will be
developed with 2 duplex buildings, while the southern portion will be developed with 1 duplex and
a stand-alone unit. The site will also feature common areas like barbeque grills, open green areas,
and sitting areas for the tenants and their guest.

The Maricopa County Zoning Ordinance Section 1102 requires the multiple family units provide 2
parking spaces per unit, with 20% being reserved for guest, and 5% being designated for ADA.
Each unit is proposed with a garage for one vehicle that will serve as private/assigned parking
space for each unit. Six additional parking spaces are provided on the eastern portion of the site
for guest, along with 1 handicapped parking space. A total of 14 parking spaces is provided that
complies with the zoning ordinance. In addition, sidewalks are proposed to be provided
throughout the site to allow for easy pedestrian access to units, parking areas, the trash area, or
onto 80th Avenue.
5.
The applicant is proposing on obtaining water and sewer from the City of Glendale, a “Will Serve”
letter was obtained from the city confirming that utilities will be provided to the site for 7 units.

Staff Analysis:

Staff recognizes that the general area surrounding the subject site has been developed with multi-
family residential homes including a mobile home park to the east within the City of Glendale. The
parcels adjacent to the south are zoned R-4. The City of Glendale has provided a will serve letter
for water and sewer for the multi-family development. Staff finds the proposed R-4 zoning district

to be appropriate for the site as it would facilitate the development of multi-family in keeping with
the surrounding land uses and will provide more housing to the area.
Recommendation:

Staff recommends the Commission adopt a motion recommending that the Board of Supervisors
approve Z240017 subject to the following conditions ‘a’ – ‘g’:

Purpose of Request
This request is for a zone change and Plan of Development for 22,019 square feet (0.51 acres), for parcel
142-27-051 located north of Glendale Avenue. The property is currently zone R1-6 for single family
residence, the rezone request is to change the zoning district to R-4 to develop the site as mulƟ-family,
which will be known as Cardinals Nest. The property will be developed with 7 two-story units.
DescripƟon of Proposal
The proposed zone change will facilitate the development of the site for mulƟ-family, which will provide
addiƟonal housing opportunity in a growing area. We are proposing to rezone the site from R1-6 Single
Family Residence to R-4 MulƟple Family ResidenƟal which allows 1 dwelling unit per 2,000 square feet.
The proposed 7 units will be fully equipped with kitchen – living room open concept, with 3 bedrooms. 2
bathrooms, and a ½ bathroom. The units are proposed to each be 804 square feet in size and 2 stories in
height. The first floor will be developed with the kitchen, living room, a ½ bathroom, and a 264 square
foot garage, with direct interior entrance to the unit. The main entrance to each unit will be through the

RelaƟonship to Surrounding ProperƟes
The property is within the Maricopa Countys jurisdicƟon, it is a county island within the City of
Glendale’s planning area and designated MDR 5 – Medium Density ResidenƟal 3.5 – 5.0 du/ac on City of
Glendale’s General Plan. The area surrounding the property is developed with mulƟple different uses
within Maricopa County and the City of Glendale from residenƟal, commercial, and civic properƟes that
vary in age, character, condiƟon, scale, and density. The parcels directly to south and west (across 80th
Avenue) are zoned R-4 and developed as mulƟple family ranging in densiƟes. Adjacent to the east is
Glendale West, a mobile home park within the City of Glendale; adjacent to the north is vacant land that
is also within the City of Glendale.
The request is driven by the site’s prime locaƟon and a strong demand for mulƟ-family rental units in the
area. The proposed project is a natural fit and compliments the extend of exisƟng land uses and zoning
districts withing that area. It will be promoƟng an integrated, sustainable character, with a strong live,
work, and play component.
Development of this property will add to the conƟnued revitalizaƟon of the surrounding community,
providing aƩracƟve new housing opƟons. It will be a catalyst for future redevelopment in the area which
is criƟcal in this mature area of the city for its future success.
Compliance with City of Glendale General Plan
This request meets the general plan of the City of Glendale, as previously menƟoned the property is
within the City’s planning area and designated MDR 5 – Medium Density ResidenƟal 3.5 – 5.0 du/ac. The
MDR 5 designaƟon is set to provide a suburban lifestyle with a density of 3.5 – 5 dwelling units per acre.
The proposed project meets the goals and policies set for the planning area within the City of Glendale.
Water and sewer is proposed to be obtained from the City, they have provided a Will Serve leƩer
confirming they will provide those services, as that area is meant for the proposed use.
LocaƟon, Accessibility, and CirculaƟon System (On & Off site)
The property is located along 80th Avenue, a 40-foot right of way, which provides access to the property.
A 30 foot driveway is proposed for ingress/egress, which leads to 80th Avenue and requires traffic to
travel south onto a main arterial road known as Glendale Avenue; where traffic can turn west or east.
A well-planned vehicle and pedestrian circulaƟon system is proposed within the property in order to
provide safe and convenient access to all the units and ameniƟes. The proposed project will not have a
high impact on traffic, as traffic that travels on to 80th street is specifically for the residenƟal uses along
the right of way as the road is a dead end near the site.
A traffic Impact Study Waiver was obtained from MCDOT and no new access points or modificaƟons to
the exisƟng infrastructure would be required based on the nature of the development and remote
locaƟon. It is esƟmated that proposed development would not generate any significant volume that
would impact county roadways and faciliƟes in the vicinity of the property.

Engineering Review has reviewed the 3rd plan and report routed for review on
06/05/2025, for the subject application and has no further objections subject to the
following conditions:
The following stipulations will apply:
1. Engineering review of planning and/or zoning cases is for conceptual design
only. All development and engineering design shall be in conformance with
Section 1205 of the Maricopa County Zoning Ordinance; Drainage Policies and
Standards; Floodplain Regulations for Maricopa County; MCDOT Roadway
Design Manual; and current engineering policies, standards and best practices
at the time of application for construction.
2. Based on the conceptual design nature of the information submitted, changes
to the site layout and/or a reduction in the number of building lots may be
necessitated by the final engineering design of the subdivision drainage
infrastructure.
3. Retention basins to drain within 36 hours
4. The site is not located in a Special Flood Hazard Areas (SFHAs). The Flood
Control District has no comments on this application.
5. The subject site is presently located within the County’s Urbanized Area, but
site disturbance appears less than one (1) acre. A Storm Water Pollution
Prevention Permit (SWPPP) from the County (PND) is not required. This
does NOT preclude the requirement to obtain a Construction General Permit
(CGP) Notice of Intent to Discharge (NOI) from the State (ADEQ), as may be
required.

The Maricopa County Environmental Services Department (MCESD) has completed review
for the Cardenales Nest planning case(s). Please note the following MCESD requirements for
site development:
Subdivision and Infrastructure –
An Approval to Construct application is required and must be submitted to MCESD’s
Subdivision & Infrastructure Program for water, reclaimed water and/or wastewater system
infrastructure.
A will serve letter issued by the Utility is required and must be submitted to MCESD’s
Subdivision & Infrastructure Program if the site/development will be provided with water
and/or reclaimed water by a Utility. A capacity assurance letter issued by the Utility is
required to MCESD’s Subdivision & Infrastructure Program if the site/development
wastewater service is being provided by a Utility.

*It should be noted that this document does not approve the referenced project. Comments are provided
for the benefit of the applicant for MCESD permit requirements and as an advisory to Maricopa County
Planning and Development Department. Other Maricopa County agencies may have additional
requirements. Final review and approval will be made through Planning and Development Department
procedures. Applicant may need to submit separate applications to the Maricopa County Environmental
Services Department for approval of proposed facilities regulated by the Department. Review of any such
application will be based on current regulations at the time of application.
