DRAFT REGULAR MEETING OF THE COMMON COUNCIL OF THE CITY OF EL MIRAGE EL MIRAGE CITY COUNCIL CHAMBERS 10000 N. EL MIRAGE ROAD 6:00 PM -TUESDAY, JUNE 2, 2020 Minutes 1. ROLL CALL Present: Mayor Alexis Hermosillo; Vice Mayor Roy Delgado; Councilmember Monica Dorcey; Councilmember Anita Norton; Councilmember David Shapera; Councilmember Donna Winston; Councilmember Kallimayor Richards 2. CALL TO ORDER - The meeting was held online and publicly with limited access; called to order at 6:00 pm. Pledge of Allegiance Moment of Silence 3. PRESENTATION 1. Administering the Oath of Office and seating of the newly appointed Councilmember Kallimayor Richards completing the Council vacancy through December 2020. (City Clerk) Mayor Hermosillo introduced new Councilmember Kallimayor Richards by providing his background information and welcoming him to the City of El Mirage Council. City Clerk Antes gave the Oath of Office to newly appointed Councilmember Kallimayor Richards and he was seated at the dais. 4. CALL TO THE PUBLIC Citizens desiring to speak on any issue within the jurisdiction of the public body may do so at this time. Comments shall be limited to three (3) minutes per person and shall be addressed to the City Council as a whole. At the conclusion of the Call to the Public, individual City Council Members may (1) respond to criticism made by those who have spoken, (2) direct staff to review or follow up on the matter, and/or (3) direct that the matter be put on a future agenda. Youngtown resident Danita Manning of Youngtown's Engaging Life Center identified staff members from the clinic and outlined the services provided (medical, outpatient treatment, physical health, behavioral health, adult and children court-ordered evaluations, UI Screening, weight loss programs, immunizations and COVID-19 testing). Ms. Manning petitioned the City of El Mirage for contributions towards the health and welfare of the community by offering COVID-19 testing either at their facility or utilizing their mobile unit. "John" (with the protestors in downtown Phoenix) addressed his concerns regarding the recent exposure at the City of El Mirage Court building and his belief there was a lack of timely transparency regarding potential citizen exposure to COVID19 and the subsequent closure of the Court for cleaning. 5. CONSENT AGENDA All items listed under the Consent Agenda will be voted on with one motion. If discussion is desired regarding any Consent Agenda Item, that item will be removed from the Consent Agenda and voted on separately. 1. Consideration and action to approve the minutes of the Regular Council meeting held Tuesday, May 19, 2020. (City Clerk) 2. Consideration and action to enter into a Service Agreement between Battelle Memorial Institute and the City of El Mirage for Decontamination of Personal Protective Equipment. (Fire) 3. Consideration and action to enter into an Emergency Base Station Agreement between Banner Boswell Medical Center and City of El Mirage Fire Department for administrative medical control and online medical direction. (Fire) 4. Consideration and action to enter into Emergency Medical Services Restocking Agreement between Banner Health and City of El Mirage Fire Department for replenishment of pharmaceutical and other medical supplies in an amount not to exceed $7,000. (Fire) 5. Consideration and action to approve a contract with Sunland Asphalt for routine maintenance of the recharge basins at the City's water reclamation facility in an amount not to exceed $47,000. (Public Works) 6. Consideration and action to approve an agreement with APS for the installation of an electric vehicle (EV) charging station as part of APS' "Take Charge" program. (Public Works) 7. Consideration and action to authorize the City Manager to enter in budgeted goods and services contracts to allow Public Works to perform their duties during FY 20/21. (Public Works) 8. Consideration and action to recommend Vice Mayor Delgado to serve as the primary committee member and Councilmember Norton to serve as the alternate committee member on the Community Development Advisory Committee (CDAC) for FY2020-2022. (Grants) 9. Consideration and action to adopt a notice of intent to change certain fees which could include adding, deleting, increasing or decreasing fees not sooner than 60 days from the date of posting the notice pursuant to A.R.S. Section § 9-499.15. (Finance) 10. Consideration and action to approve the adoption of the Financial Policies. (Finance) 11. Consideration and action to authorize the Finance Department to make budget adjustments for FY2020-2021 to adjust the balance of FY19-20 carryforward projects. (Finance) 12. Consideration and action to authorize the Finance Department to make transfers as necessary for FY2019-20 to adjust fund and department balances to comply with state law. (Finance) Vice Mayor Delgado moved to approve Consent Agenda Items 1 through 12 as presented; seconded by Councilmember Shapera. Vote: 7 - 0 Passed - Unanimously 6. REGULAR AGENDA 2 Regular Meeting - Council Minutes June 2, 2020 1. Consideration and action to approve Resolution R20-06-09 authorizing an agreement for data sharing, collaboration and exploration of West Valley regional solutions to address homelessness between the City of El Mirage, City of Surprise, City of Peoria, City of Glendale, Maricopa County, and the Maricopa Regional Continuum of Care Governing Board. (Grants) Grants and Special Programs Administrator Autumn Grooms explained West Valley cities meet regularly to discuss trends, issues and responses regarding homelessness. The number of homelessness continues to increase and this proposed resolution will allow for data sharing, collaboration, and exploration of West Valley Regional Solutions. Participants include the Cities of El Mirage, Glendale, Peoria, and Surprise as well as Maricopa County. This resolution builds on the 2019 regional I-Help resolution passed by El Mirage, Surprise, and Youngtown Councils. Vice Mayor Delgado asked if a building or shelter was planned and how would it be implemented. Dr. Grooms responded this was to allow for information sharing to continue through meetings between municipalities. Councilmember Norton stated she liked the idea and wanted to know if Council would be kept apprised of the discussions held. Dr. Grooms answered yes and explained this builds on the East Valley resolution in light of growing numbers in the West Valley and the City of El Mirage was included in group discussions with this Consortium. Vice Mayor Delgado moved to approve Resolution R20-06-09 authorizing an agreement for data sharing, collaboration and exploration of West Valley regional solutions to address homelessness between the City of El Mirage, City of Surprise, City of Peoria, City of Glendale, Maricopa County, and the Maricopa Regional Continuum of Care Governing Board; seconded by Vice Mayor Shapera. Vote: 7 - 0 Passed - Unanimously 2. Consideration and action to approve Resolution R20-06-10 annexing 6.369 acres of real property on Northern Parkway at the quarter mile west of Dysart Road and declaring the Resolution and attached Exhibit “A” as a public record. (Community Development) Community Development Director/City Engineer Jorge Gastelum presented by stating this annexation involves 6.369 acres of land owned by John F. Long Properties and located a quarter mile west of Dysart Road on Northern Parkway. He stated the City of Glendale has already taken action and de-annexed the parcel from the City of Glendale. The owner's request is to annex the parcel into the City of El Mirage requiring ratification by the Maricopa County Board of Supervisors pursuant to ARS $9-471.02. The 2010 General Plan designates this area as part of the Commerce/ Industry Park Planning Area and is compatible with the General Plan Land Use. The property is currently zoned agriculture (RU-43) with a proposed land use for Employment/Industry/Light Manufacturing (E/I). Vice Mayor Delgado moved to approve Resolution R20-06-10 annexing 6.369 acres of real property on Northern Parkway at the quarter mile west of Dysart Road and declaring the Resolution and attached Exhibit "A" as a Public Record; seconded by Councilmember Shapera. Vote: 7 - 0 Passed - Unanimously 3. Consideration and action to approve Ordinance O20-06-03 annexing 6.369 acres of real property on Northern Parkway a quarter mile west of Dysart Road and declaring a public record by reference in Resolution R20-06-10, including Exhibit A, and as provided for publishing in A.R.S. § 9-802. (Community Development) Community Development Director/City Engineer Jorge Gastelum stated with the approval of Resolution R20-06-03 this Ordinance by reference to the resolution can be published without the attachments, per state law, thereby providing a substantial savings to the City for publishing costs. Councilmember Shapera asked if the City of Glendale was de-annexing the parcel prior to the City of 3 Regular Meeting - Council Minutes June 2, 2020 El Mirage annexing the parcel. Mr. Gastelum responded the City of Glendale had already de-annexed the parcel and this request was to annex the parcel into the City of El Mirage. Vice Mayor Delgado moved to approve Ordinance O20-06-03 annexing 6,369 acres of real property on Northern Parkway a quarter mile west of Dysart Road and declaring a public record by reference in Resolution R20-06-10, including Exhibit A, and as provided for publishing in A.R.S. $9-802; seconded by Councilmember Shapera. Vote: 7 - 0 Passed - Unanimously 4. Consideration and action to hold a public hearing to permit any taxpayer to be heard in favor or against any proposed expenditure or tax levy. (Finance) Mayor Hermosillo opened the public hearing. Finance Director Robert Nilles presented both the tax levy expenditure and final budget review under this public hearing. The Primary levy is $2,368.618 with one hundred percent of the levy applied to Public Safety per Council Resolution. The proposed budget of $85,783.500 is identical to the tentative budget. He reviewed pie charts of revenue sources and Citywide expenditures by category and fund. The General Fund Budget was identified with final budget items addressed. Mr. Nilles provided updated State Shared Revenue information, estimating an overall reduction in State shared income tax numbers to be between $3.5 and $4 million dollars over the next couple of years. Mr. Nilles acknowledged receipt of notice and stated the City would be receiving $4.1 million dollars from the CARES Act Funds El Mirage resident Rickey Rodriguez asked how citizens would benefit with the increase in Public Safety funds. Mayor Hermosillo responded that only statements are to be made during this public hearing and asked if Mr. Rodriguez had a statement; he did not have a statement. Hearing no further comments, Mayor Hermosillo closed the Public Hearing. Councilmember Norton stated she was pleased with the information provided by Mr. Nilles regarding balancing the loss of State shared revenue and the notice of funds the City will be receiving from the CARES Act. 5. Consideration and action, in accordance with Truth in Taxation legislation, to levy the increased FY2020-2021 Primary Property Tax equal to the amount of $2,368,618. (Finance) Vice Mayor Delgado moved to levy the increased FY2020-2021 Primary Property Tax equal to the constitutional legal limit of $2,368.618; seconded by Councilmember Shapera. Required Roll Call Vote: AYE: Vice Mayor Delgado, Councilmember Dorcey, Councilmember Norton, Councilmember Richards, Councilmember Shapera, Councilmember Winston, and Mayor Hermosillo. Vote: 7 - 0 Passed - Unanimously 6. Consideration and action to convene in a Special Meeting to finally determine and adopt estimates of proposed expenditures pursuant to A.R.S. 42-17105. SPECIAL MEETING OF THE COMMON COUNCIL OF THE CITY OF EL MIRAGE EL MIRAGE CITY COUNCIL CHAMBERS 10000 N. EL MIRAGE ROAD TUESDAY, JUNE 2, 2020 Consideration and action to finally determine and adopt the FY 2020-2021 proposed spending limitation and budget pursuant to Resolution R20-06-11. (Finance) No discussion (see Mr. Nilles' presentation under Regular Agenda Item 6.4). Vice Mayor Delgado moved to finally determine and adopt the FY2020-2021 proposed spending limitation and budget pursuant to Resolution R20-06-11; seconded by Councilmember Shapera. CITY MANAGER'S COMMENTS & SUMMARY OF CURRENT EVENTS The City Council may not act upon any matter in the City Manager's summary but may have general comment or questions. City Manager Dyches introduced Community Development Director/City Engineer Jorge Gastelum to present proposed City of El Mirage welcome signage pursuant to Council inquiry. Mr Gastelum reviewed proposed locations for the welcome signage and reviewed three samples of City of El Mirage welcome signage for Council to select. Councilmember Shapera stated he brought the welcome signage to the City Manager's attention because of the new business growth within the City in mind and a need for uniformity on Grand Avenue. Mayor and Council concensus was the welcome signage labeled C with a few minor tweaks. 8. MAYOR'S COMMENTS and COUNCIL SUMMARY OF CURRENT EVENTS The Mayor and City Council may not discuss or act upon any matter in the summary unless the specific matter is properly noticed for legal action. Vice Mayor Delgado expressed his gratitude to the Police Chief for El Mirage PD assisting during the Westgate unrest and protests that are going on nationwide. Councilmembers Norton, Winston, and Mayor Hermosillo expressed their gratitude to the Police Chief for the Police Department's social media posts regarding what the City Police were doing during the recent civil unrest to put residents at ease. They felt it showed great leadership within the Police Department. Councilmember Richards thanked everyone for welcoming him and echoed Mayor and Councils statements. 9.
