El Mirage Rd El Mirage, AZ 85335 Re: Request for Cox’s Uniform Video Service License in accordance with A.R.S. §§ 9- 1401 through 9-1452 Dear Mr. Nilles, I am writing to request that, as required by Arizona’s uniform video service licensing statute, A.R.S. §§ 9-1401 through 9-1452, the City of El Mirage issue to Cox a video service license in the form prescribed by statute. Cox is excited about the opportunity that the uniform video licensing process affords us to continue providing improved and expanded services to your residents, schools, hospitals and businesses, while preserving the City of El Mirage’s authority over its local public rights of way. As you may know, in 2018, the Arizona Legislature passed SB 1140, codified in A.R.S. §§ 9-1401 through 9-1452. The new law simplified the local video service licensing process and enacted uniform license terms and conditions for video service providers in Arizona that use public rights of way. Pursuant to A.R.S. § 9-1415(A), “not later than forty five days” after the date of filing an application and affidavit for a license, the local government “shall issue a uniform video service license” and the attendant agreement between Cox and the City of El Mirage submitted with the application “shall be considered complete and issued to the applicant in the form submitted,” absent a notice of deficiency from the local jurisdiction within that time period (emphasis added). Cox submitted the required application for a uniform video service license in the City of El Mirage, authorized under A.R.S. §§ 9-1401 through 9-1452, on February 25, 2020, to obtain a uniform video service license and thereby terminating Cox’s existing cable license. A copy of that application, including the required agreement, and affidavit is attached. More than forty-five days have elapsed since Cox’s submission, the City of El Mirage has not notified Cox of any deficiency in its application. The application is thus effective by operation of law. As a long-time licensee and cable provider in the City of El Mirage, Cox would like to memorialize its license in writing before operating under the uniform video service license’s statutory effective date of April 10, 2020. Cox would therefore appreciate the City of El Mirage’s issuance of the completed agreement by June 19, 2020. 1550 W.
