The buildout of the proposed Fry’s Fuel Station development would represent an approximate 
1.9% decrease in the available capacity of Gavilan Peak Parkway. 
 
PROPOSED DRIVEWAY SPACING 
Section 7.9.2 of MCDOT’s Roadway Design Manual, effective March 27, 2024, states the 
following regarding driveway spacing:  
 
‘The distance between adjacent driveways must be adequate to allow driveway vehicles to 
safely queue, accelerate, decelerate, and cross conflicting traffic streams without excessive 
interference with through traffic, or traffic using adjacent driveways. 
 
The minimum distance between driveway centerlines along arterial roadways shall be at 
least 360 feet.’  
 
A total distance of 190-feet is provided between the centerline of King Drive and the proposed 
centerline of the limited access driveway located along Gavilan Peak Parkway. The proposed 
right-in/right-out driveway along Gavilan Peak Parkway makes the proposed Fry’s Fuel Station 
more efficient and accessible to drivers traveling south on Gavilan Peak Parkway. 
 
Additionally, due to the nature of the proposed right-in/right-out driveway, less conflicting 
traffic streams will be crossed as no left turns will be permitted. The proposed 190-feet 
distance between centerlines will be adequate to allow for safe queuing, acceleration, and 
deceleration without interference of through or adjacent traffic.  
 
Section 7.9.4 of MCDOT’s Roadway Design Manual, effective March 27, 2024, provides the 
following table of specifications regarding minimum corner clearance requirements for 
intersections:  
 
 
 
Classifications A-E refer to different scenarios of driveway location, with classification B 
referring to a right-in/right-out access upstream of an intersection. Thus, the minimum corner

clearance required for the proposed right-in/right-out access along Gavilan Peak Parkway is 
180-feet, with 190-feet provided. 
 
The corner clearance requirements specified in Section 7.9.4 are intended for roadways with a 
posted speed limit of 40 mph or greater. Gavilan Peak Parkway has a posted speed limit of 35 
mph, and therefore is not required to conform to these corner clearance requirements. 
 
TURN LANE REQUIREMENTS 
The proposed driveway along Gavilan Peak Parkway is under the jurisdiction of the Maricopa 
County Department of Transportation (MCDOT). Thus, the 2024 MCDOT Roadway Design 
Manual Section 7.15 turn lane warrants were utilized to analyze the access along Gavilan Peak 
Parkway. 
 
Right Turn Lane – MCDOT 
The 2026 proposed traffic along Gavilan Peak Parkway during the AM and PM peak hour are 
480 and 500 trips, respectively. 
 
According to Table 7.6 of the MCDOT 2024 Roadway Design Manual roadways with two (2) 
through lane in each direction of travel, a speed limit greater less than 45 mph, a right turn lane 
is NOT warranted.

SUMMARY 
The proposed Fry’s Fuel Station development is comprised of 10 vehicle fueling positions and a 
walk-up convenience kiosk. 
 
Pass-by trips are attracted from the existing traffic passing the site on an adjacent street or 
roadway that offers direct access to the generator. These trips are not considered to add new 
traffic to the adjacent street network and may be reduced from the total external trips 
generated by the proposed development.  
 
Accounting for pass-by trips, the proposed site is anticipated to experience a total of 1,720 daily 
trips, with 103 trips occurring in the AM peak hour and 139 trips occurring in the PM peak hour. 
The proposed Fry’s Fuel Station is anticipated to generate a net new total of 689 weekday trips, 
with 38 occurring during the AM peak hour and 60 occurring during the PM peak hour. 
 
With the installation of the traffic signal at the intersection of Gavilan Peak Parkway and King 
Drive, all movements operate at a level of service B or better during the AM and PM peak hours 
for the build condition. 
 
Conservatively assuming all new daily site trips (689 trips) utilize Gavilan Peak Parkway to 
access the site, the average daily traffic (ADT) along Gavilan Peak Parkway would increase to 
9,475 vpd.  
 
The buildout of the proposed Fry’s Fuel Station development would represent an approximate 
1.9% decrease in the available capacity of Gavilan Peak Parkway.  
 
In conclusion, the proposed Fry’s Fuel Station development is anticipated to result in minimal 
traffic impacts to the existing roadway network and the surrounding area.

This property is within the Daisy Mountain Fire Department jurisdiction.  DMFD has “no 
objection” to the proposed Zone Change, Z240027.  DMFD has adopted the 2018 IFC with 
amendments.   DMFD has the following preliminary comments for this project: 
1. Fuel tanks shall be designed, permitted and installed per ADEQ 
2. Fuel tanks and LPG Tank Merchandiser shall be in accordance with DMFD Fire Code and 
require separate DMFD permits. 
3. Driveways shall be designated, designed and constructed as Fire Lanes for emergency 
access.   
4. The Required Fire Flow shall be as determined in Fire Code, Appendix B.   If developers 
are requesting a reduced required fire flow, then fire sprinkler design calculations for the 
largest/greatest sprinkler design area/building are required PRIOR to approval.   
5. Fire hydrant(s) shall be provided capable of providing required fire flow.   Coordinate 
locations with DMFD, upon development of site plan. 
6. Automatic Fire Sprinklers may be required as per DMFD 2018 Fire Code adoption with 
amendments.  The sprinkler system shall be designed and installed in accordance with 
NFPA 13.  Each Building/system requires separate permit.   
a. Fire Alarm system shall be designed and installed in accordance with NFPA 72. 
Fire Sprinklers shall be monitored by an approved central station. System shall 
monitor and supervise fire sprinkler system, provide occupant notification, 
monitor/supervise other fire protection systems (CO2 gas detection, Commercial 
Cooking systems, etc).    Each Building/system requires separate permit. 
7. An approved FD Knox key box shall be provided for each building.

Let me share my concerns, that may be of value. 
1.  So close to the school , that it can become a hang out as well as the young clients may not pay 
attention to there surrounding ie. bike, scooter electric bikes etc. with traffic. 
2.  Traffic, the church traffic on the weekends is enormous. The fact is due to increasing attendance the 
church had to add another service on Monday Night.

In closing this not an objection of having the gas station but a concern on safety.

Since the publication of the staff report for the referenced case, staff received three notices of 
opposition from a married couple who are homeowners in Desert Hills. The couple’s property is 
located approximately three miles from the subject site of the case. 
 
The authors are opposed to changing the use of the land from a drive-through coffee shop to a 
gas station, as there are supposedly enough gas stations already present in the immediate area, 
including two Circle Ks. They are also concerned with the site’s proximity to several nearby 
schools and the problems that could arise with increased traffic. 
 
Staff notes that the subject site is currently vacant, but a previous zone change with overlay 
(Z2022100) limited the allowed use onsite to a drive-through coffee shop. The proposed major 
amendment would rescind this limitation and entitle development of any use allowed in the C-1 
zoning district, including the Fry’s fuel station proposed with the concurrent POD.
