Additional Comments:
This application is a request to modify condition ‘g’ of Z2023014 
which required connection to a municipal sewer system. The 
original proposal was presented to the Planning and Zoning 
Commission utilizing septic and was changed due to negotiations 
between the owner and adjacent neighbor land use attorneys prior 
to the Board of Supervisors hearing on November 6, 2024. The 
applicant’s attorney approached the Town of Gilbert who refused 
sewer connection. The modification of condition is a request to 
remove the requirement for sewer connection. There are 3 letters 
of opposition citing issues with breaking agreements. One neighbor 
attended the Commission hearing and spoke in opposition to the 
removal of the condition and cited concerns with agreements not 
being met by the owner. There are no outstanding concerns from 
reviewing agencies.
Commission 
Recommendation:
On 5/8/25, the Commission voted 10-0 (motion by Commissioner 
Whitney D3, seconded by Vice-Chair Curley D3) to adopt a motion 
recommending the Board of Supervisors approve SU250014 
subject to conditions ‘a’ – ‘x’ as follows: 
a.
Development of the site shall be in substantial conformance with the site plan entitled 
“White Barn Wedding Venue“, consisting of 8 full-size sheets, dated June 24, 2023 and 
stamped received October 2, 2023 except as modified by the following conditions.

b.
Development of the site shall be in substantial conformance with the narrative report 
entitled “White Barn Events Center”, consisting of 8 pages, dated March 20, 2024 and 
stamped received March 20, 2024 except as modified by the following conditions.
c.
This special use permit shall expire on June 12, 2034, or upon termination of the use for 
a period of 90 or more consecutive days, whichever occurs first. All site improvements 
associated with the SUP shall be removed within 90 days of such expiration or termination 
of use.  
d.
The applicant shall submit a status report to the Maricopa County Planning and 
Development Department every two years from the date of Board approval. The status 
report shall detail how the applicant has complied with all conditions of the SUP approval. 
The Department may accept and administratively approve the status report or schedule 
the matter for consideration of SUP amendment or revocation by the Board with 
recommendation from the Planning and Zoning Commission.
e.
The project shall be in compliance with the following development regulations in the Town 
of Gilbert Land Development Code:
1.
Development shall meet or exceed the dimensional standards of the Community 
Commercial zoning district as outlined in Table 3.4.4.B.1.
2.
All refuse and recycling enclosures shall be screened from public view.
f.
Events shall be limited to weddings and no more than two corporate events per month 
only.
g.
DELETED
h.
The project shall require an  8’ CMU wall on the north, east and south property lines for 
noise attenuation purposes, except where adjacent to Life Church property.
i.
All seating and gathering areas shall be setback at a minimum 20’ from any property line.
j.
A continuous row of large canopy 36” box trees shall be placed along the north, east, and 
south perimeter of the property at a minimum 30-feet on center, except where adjacent to 
the Life Church property.
k.
All outdoor lighting shall be shielded so that illumination does not trespass onto 
neighboring properties and is directed downward at a minimum 20-degree angle beneath 
the horizontal plane of the bottom of the shielding 
l.
All commercial outdoor activity shall be moved indoors by 9:00 PM. 
m.
All events shall cease by 11:00 pm.  
n.
Events with over 75 invitees shall provide for a traffic control officer from either the 
Maricopa County Sherriff’s Office, town of Gilbert Police Department, or other authorized 
third-party traffic control specialist to manage attendees exiting an event and ensure any 
non-resident vehicles are not utilizing the local roadways (i.e. Frye Road and Fairview

Street). All local residents shall be given priority through any controlled access point. All 
traffic control and/or right-of-way permits shall be obtained when necessary.
o.
Amplified music and dancing are prohibited in outdoor areas. Further, any amplified noise 
must conform to Maricopa County Noise Ordinance (P-23) that was adopted February 15, 
2006 and is regulated by the MCSO. Section IV Noise:
C. Radios and Sound Amplification Devices
It shall be unlawful for any person to operate any radio, loudspeaker, musical instrument, 
or other sound producing, sound reproducing, or sound amplification equipment that 
emits noise that can be heard from within closed residential structures located within 500 
feet of the boundary of the property from which such noise emanates.   
p.
All Outdoor sound system speakers shall be permanently ground mounted, facing inward. 
No portable speakers shall be permitted for use outdoors.
q.
Noise resulting from any activities on the premises shall be limited to no more than 50 
decibels (dB) along the north, east and south property lines. A noise study indicating the 
expected noise levels along the perimeter of the property, as well as the mitigation 
measures that will be implemented to accomplish a maximum of 50 dB along the 
perimeter shall be completed prior to issuance of any site plan approval or building 
permits.
r.
Noise monitors shall be installed every 30 feet along the north, east and south property 
line of the premises. The property owner shall keep records of the decibel levels from such 
noise monitors throughout the duration of the SUP and make the data collected available 
upon request. Repeated instances of noise levels exceeding 50 dB resulting from activities 
on the premises may result in the renovation of this SUP.
s.
Signs shall be posted around the parking area and outdoor gathering areas notifying 
attendees to be mindful and respectful of adjacent neighbors. Signs shall read “Notice: 
this venue is located in a residential neighborhood. Please be mindful and respectful of 
neighboring residents. Keep all noise to a minimum while outdoors.” The signs shall be a 
minimum of 36 inches by 36 inches. The sign text shall be at minimum 3 inches in height.
t.
Prior to issuance of initial building permits, all parcels shall be combined to create a single 
parcel matching the SUP area.
u.
The following Planning Engineering conditions:
1.
Unpermitted walls/fences on the subject property shall be addressed with the 
submittal for building permits for the site development. It shall be demonstrated that 
the walls/fences do not create an adverse drainage impact to the site or surrounding 
properties.
2.
Prior to the issuance of building permits for development of the site, the 
owner/applicant must provide evidence that the Town of Gilbert has approved the 
Traffic Report.
3.
Access to the parking lot shall be via a one-way entrance (north) and one-way exit 
(south), or as otherwise approved by the Town of Gilbert.

4.
Access to and from eh site shall only be provided along Greenfield Road north of the 
site. All traffic shall be directed away from the American Leadership Institute driveway 
located south of the site. Directional signage shall be posted on site to direct 
attendees to the appropriate exit to the Greenfield Road (north).
5.
Owner/applicant shall coordinate with the Town of Gilbert for any offsite 
improvements, ROW requirements and access. Provide County of TOG approved 
offsite improvement plans during building permit phase. 
6.
SWPP provided during building permit phase. 
7.
Engineering review of planning and/or zoning cases is for conceptual design only. All 
development and engineering design shall be in conformance with Section 1205 of 
the Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain 
Regulations for Maricopa County; MCDOT Roadway Design Manual; and current 
engineering policies, standards and best practices at the time of application for 
construction.
8.
Based on the conceptual design nature of the information submitted, changes to the 
site layout may be necessitated by the final engineering design of the site’s drainage 
infrastructure.
9.
Detailed Grading and Drainage (Site Infrastructure) Plans and Drainage report must be 
submitted with the application for Building Permits.
v.
Noncompliance with any of the conditions assigned to the approval of this SUP by the 
Maricopa County Board of Supervisors may be grounds for revocation in accordance with 
the requirements and procedures as set forth in the Maricopa County Zoning Ordinance. 
w.
The granting of this change in use of the property has been at the request of the applicant, 
with the consent of the landowner.  The granting of this approval allows the property to 
enjoy uses in excess of those permitted by the zoning existing on the date of application, 
subject to conditions.  In the event of the failure to comply with any condition, and at the 
time of expiration of the SUP, the property shall revert to the zoning that existed on the 
date of application.  It is, therefore, stipulated and agreed that either revocation due to the 
failure to comply with any conditions, or the expiration of the Special Use Permit, does not 
reduce any rights that existed on the date of application to use, divide, sell or possess the 
property and that there would be no diminution in value of the property from the value it 
held on the date of application due to such revocation or expiration of the SUP.  The SUP 
enhances the value of the property above its value as of the date the SUP is granted and 
reverting to the prior zoning results in the same value of the property as if the SUP had 
never been granted.
x.
  Prior to issuance of a building permit, written confirmation will be required from the 
emergency fire protection jurisdiction having authority that the facility has been designed 
in accordance with their regulations and requirements, and that emergency fire protection 
service will be provided to the facility. Prior to issuance of the certificate of occupancy, 
local fire protection jurisdiction review and approval will be required

Project Summary:
1.
On November 6, 2024 the Maricopa County Board of Supervisors approved Z2023014 by a vote 
of 5-0 for a Special Use Permit (SUP) to allow a wedding and events venue on an approximate 
2.36 acre parcels in the Rural-43 zoning district subject to condition ‘a’ - ‘x’. The subject request 
is to delete specifically condition ‘g’: 
g.
An on-site septic system shall be prohibited. The project shall be served by the Town of 
Gilbert sewer system.
The applicant proposes wastewater disposal via onsite septic system. 
2.
The original application and site plan for Z2023014 was submitted with the intention of 
developing on a septic system. The case was heard before the Maricopa County Planning and 
Zoning Commission on May 9, 2024 and was recommended for approval. At that time the 
proposal was for wastewater disposal via onsite septic system. The Commission voted 7-1 
(Commissioner Hernandez D4 dissenting) to recommend approval to the Board of Supervisors 
(BOS). Between the Commission and the BOS hearing the case garnered significant local 
neighbor opposition. Prior to the Board hearing, the applicant and opposition legal counsel met 
and agreed upon a new set of conditions that included condition ‘g’ requiring connection to the 
Town of Gilbert sewer system. The applicant requests to remove the condition is due to difficulty 
obtaining a water/sewer ‘will serve’ letter from the Town of Gilbert .

majority of the Greenfield Rd. 
Public Participation Summary:

The applicant posted the site in two locations and sent notification to all neighbors within 300’ of 
parcel boundary lines. Staff has received three letters from neighbors stating the original 
conditions were negotiated at great financial cost and that they do not wish to see the conditions 
changed from what is agreed upon.  
Outstanding Concerns from Reviewing Agencies:

Staff routed the subject request to the Town of Gilbert, but to date has not received a response. 
There has been no comment from reviewing agencies.

Staff Analysis:
8.
Staff and the Commission recommended approval of the original SUP with wastewater service 
via onsite septic system. There is no technical concern with the event venue on septic. The 
condition for sewer connection was negotiated between the applicant and neighborhood 
opposition.  This was not due to any technical concern with wastewater (included at the Board 
hearing to address concerns raised by adjacent property owners and the applicant. MCESD 
evaluated the SUP based upon septic and had no objection.  Given that staff supported the use 
on septic, it would not be logical to oppose removal of condition ‘g’ with the continued adherence 
to all remaining agreed upon conditions of approval.  In the following recommendation paragraph 
all conditions have been carried forward from Z2023014 with notation that ‘g’ is deleted.
Recommendation:

Staff recommends the Commission adopt a motion recommending that the Board of Supervisors 
approve SU250014 to remove condition ‘g’ with relabeling the conditions associated with 
Z2023014 subject to the following conditions ‘a’ – ‘x’:
a.
Development of the site shall be in substantial conformance with the site plan entitled 
“White Barn Wedding Venue“, consisting of 8 full-size sheets, dated June 24, 2023 and

INTRODUCTION: 
 
The White Barn Event Center is an approved (under Z2023014) events center on 
approximately 2.36 acres (~102,803 square feet) located just east of the Loop 202 San 
Tan Freeway near the intersection of Greenfield Road and San Tan Village Parkway in 
the Gilbert area of unincorporated Maricopa County. The location is also identified with 
an address of 16835 South Greenfield Road, Gilbert, and as Maricopa County Assessor 
Parcel Numbers 304-47-046A and 046B (the “Property”).  
 
 
PURPOSE OF REQUEST: 
 
The related Special Use Permit (in the underlying Rural-43 zoning district), under 
Maricopa County Case Number Z2023014, was approved for the White Barn Event 
Center by the Maricopa County Board of Supervisors on November 6, 2024, subject to 
conditions ‘a’ through ‘x’. A copy of the approval letter from Maricopa County, dated 
November 12, 2024, is attached as Exhibit ‘A’ to this Narrative Report. 
 
Condition ‘g’ of this approval states as follows: 
 
"g. An on-site septic system shall be prohibited. The project shall be served by 
the Town of Gilbert sewer system." 
 
This condition was agreed to because the Town of Gilbert had issued a “Will Serve” 
letter, dated April 16, 2024, agreeing to provide sewer. A copy of this “Will Serve” letter 
is attached as Exhibit ‘B’ to this Narrative Report. 
 
Mr. Brian Skinner, through his attorney, Mr. Paul Gilbert, requested a number of 
stipulations to the SUP for the White Barn.  The applicant, Ms. Adriana Uchityl, agreed 
to nearly all of the stipulations as requested, in an effort to achieve a mutual 
understanding with her adjacent neighbor, Mr. Skinner.  As a part of that effort, Ms. 
Uchityl agreed to the requested stipulation g, prohibiting the use of any septic system at 
the White Barn site, and requiring connection to the Town of Gilbert’s sewer system. 
Normally, agreeing to such a stipulation would be ill-advised, but in this case, the Town 
of Gilbert had issued a Will Serve letter, dated April 16, 2024, apparently signed by Mr. 
Tom Condit, Town Engineer.  In reliance upon that Will Serve letter, the applicant 
agreed to the requested stipulation g. 
 
Unfortunately, in December, 2024 (after approval of the Special Use Permit), the Town 
of Gilbert notified the applicant that the Town would not honor the Will Serve letter.  In a 
January 22, 2025 meeting with Gilbert Mayor, Scott Anderson, and the Development 
Services Director, the Town Engineer, and the Assistant Town Attorney, applicant was

informed that Mr. Condit did not sign the letter, that someone on his staff had done so, 
and that the Town would not honor its promise to serve sewer to the White Barn. 
The applicant has attempted to persuade the Town of Gilbert by offering to annex into 
the Town, provided the development and use rights granted under the County SUP are 
protected, but the Town will not do so.  The Town refuses to honor the County’s SUP 
and will require the applicant to return to square one to seek commercial zoning in the 
Town of Gilbert once it is annexed.  Of course, this is simply not workable.  The Town of 
Gilbert’s Zoning Ordinance is unwieldy -  it has no SUP mechanism, and the Town 
refuses to use its PAD category for the White Barn.  Thus, the White Barn would be 
forced to seek a broad commercial zoning which could not be tailored as the County 
SUP has been tailored to protect the neighborhood.  Moreover, there would be no 
guarantee at all that the White Barn would successfully obtain the needed zoning to 
operate, once annexed. 
 
The White Barn therefore has no choice but to request the elimination of stipulation g, 
as there is no alternative but to install and use a septic system for the White Barn. 
 
This is a question of justice, not of use.  The White Barn Wedding Reception and Event 
use has already been reviewed carefully and approved by the Maricopa County Board 
of Supervisors, following a 7-1 vote by the Planning & Zoning Commission to 
recommend approval, and pursuant to a recommendation of approval by Maricopa 
County Staff.   
 
Given that : 
1) the Town of Gilbert has chosen to dishonor its Will Serve Letter;  
2) the applicant relied upon that Will Serve Letter in agreeing to stipulation g.; 
3) the applicant, prior to Maricopa County BOS SUP approval, informed Maricopa 
County Staff and Mr. Gilbert, for his client, Mr. Skinner, that the applicant would 
have to seek a stipulation amendment if the Town, for any reason did not honor 
the Will Serve Letter;  
4) the Town will not take any measures to protect the County’s SUP approval for 
the White Barn; and 
5) all of the parties insisting the White Barn not be allowed septic use septic 
systems themselves— 
the only just outcome of this stipulation amendment request is to eliminate stipulation g., 
allowing the applicant to install and use a septic system.  
 
 
The Remainder of this Narrative, except for the reference to the septic system 
below, is identical to the Narrative connected with the SUP approved by the 
Maricopa County BOS in November, 2024.  It is included to ensure the Narrative 
stays intact, but since the use was already approved, what follows is not relevant 
to the stipulation amendment requested.

DESCRIPTION OF PROPOSAL: 
 
The White Barn is a proposed events center, designed with a rural architectural theme, 
catering to wedding ceremonies and receptions. The venue will consist of two structures, 
a 9,089 square foot barn building (the “Barn”) and a 1,527 square foot chapel building 
(the “Chapel”). Both buildings are designed to promote the agricultural heritage of the 
area and to be an ideal destination for brides seeking a beautiful rustic setting. 
 
A Site Plan, Landscape Plan and Elevations are included with this resubmittal. 
 
On the western parcel of the Property (APN 304-47-046B) there is an existing residence 
and accessory structure which will be removed/modified as part of this development. The 
eastern parcel (APN 304-47-046A) is presently vacant and used for agricultural purposes. 
 
The Property presently serves as a buffer / transition due to its placement between the 
single largest retail, entertainment, multi-family residential and office complex in the 
State of Arizona (“San Tan Village”), a public park and the Loop 202 / San Tan Freeway 
– all to the west of the Site – and an existing rural, single-family neighborhood to the 
east. The Site is nearly fronted by the San Tan Parkway, which feeds the Loop 202 / 
San Tan Freeway, also nearly adjacent to the Site. San Tan Village occupies hundreds 
of acres on the immediate west side of the San Tan Freeway. 
 
On the south side of Pecos, directly south of and just a few hundred feet from the Site, is 
the LDS Gilbert Arizona Temple. On the north side of Pecos, directly south of and one 
parcel removed from the Site, is the American Leadership Academy (the “School”), home 
to over 2,000 students. To immediate north of the Site is the Life Church (the “Church”). 
 
As the Property is surrounded with these intense uses, it is no longer viable for single- 
family residential uses; it is much more appropriate as a buffer use that provides a 
transition from the intense uses to the west, south and north, to the rural residential 
uses to the east. This proposal addresses that unique location with a use that responds 
to its intense surroundings positively, while maintaining a rural and quiet atmosphere for 
the neighbors to the east. 
 
The White Barn will accommodate up to 300 guests with approximately 6,800 square feet 
of assembly space and 3,000 square feet of support space between the two buildings. 
The two buildings will only be used by one group at any given time, never overlapping. 
 
Receptions, dinners, and dancing will be indoors only, in the Barn, containing sound 
indoors. The Barn is designed with ample acoustic insulation in the walls (STC 55) and 
windows (STC 35), ensuring that there will be no sound impacts to adjacent neighbors. 
Outdoor activities will be used only for ceremony celebrations (with only unamplified string 
instruments and vocalists—officiant and bridal couple may utilize microphones), family

photographers, and one hour for cocktails following ceremonies. There will never be any 
dancing or amplified music outdoors. 
 
All outside activities will end by 9:00 pm. Receptions will be held only inside the Barn. 
Office hours are for planning and sales purposes and will generate a minimal number of 
visitors and staff at the following times: Sundays & Mondays closed, Tuesdays through 
Thursdays from 11:00 am to 7:00 pm, Fridays and Saturdays from 10:00 am to 1:00 pm. 
Event Hours are mainly on weekends between 5:00 pm to midnight. 
 
Event traffic is off-peak; thus, what traffic the White Barn creates will not be a burden to 
the existing infrastructure. One of the aspects of the Property that makes it attractive for 
the proposed use is that it has direct access to Greenfield Road and the Loop 202 / San 
Tan Freeway, without the need for guests to travel on neighborhood streets. Indeed, 
because Invitees will almost always be guided by GPS apps, the invitees to White Barn 
events will be guided to the Property via the San Tan Parkway, and not from 
neighborhood streets. 
 
All vendors will be instructed to avoid use of the neighborhood streets. At the conclusion 
of Site events, temporary signs will be posted, directing exiting traffic back out to San 
Tan Parkway; additionally, a Site employee will be posted at the exit and the Northbound 
stop sign at Greenfield Road, directing traffic back out to the San Tan Parkway, away 
from the neighborhood. If the Town of Gilbert allows it, traffic cones will be used in 
Greenfield Road to direct exiting vehicles to San Tan Parkway as well. 
 
A Traffic Statement is included with this resubmittal. 
 
The White Barn will not seek nor obtain a liquor license. The Arizona Department of Liquor 
License and Control does not require a liquor license if the venue will not sell nor profit 
from alcohol. Customers will be allowed to provide their own alcohol to their guests only 
if it is served by a licensed and insured bartender company, not connected with the White 
Barn. 
 
The Barn and Chapel will have complementary country-style architecture. Both have 
textured white walls with light wood doors and window frames. Both the Barn roof peak 
and the Chapel steeple will not exceed the residential zoning maximum height of 30-feet, 
and both are placed so as to preserve views of the LDS Gilbert Arizona Temple from 
adjacent residential properties. 
 
The proposed development of the Property conforms to the development standards of 
the underlying Rural-43 zoning district. 
 
The landscape design includes a substantial green screen for the neighbors, with 
seventy-two (72), 36-inchbox trees, an artificial pond, and full-height privacy fencing on 
the north and south sides of the Site. The Town of Gilbert has requested an 8-foot-high

privacy wall; this will be provided if allowed by Maricopa County. Artificial turf or 
decomposed granite will cover all non-hardscaped surfaces, ensuring a dust-free, fully 
finished landscape. The green screen landscape buffer and tree-lined paths will isolate 
the Chapel and garden from the neighbors. 
 
The 101 parking spaces provided for White Barn are far above the required 49 spaces 
as required by Maricopa County Zoning Ordinance. All parking and onsite circulation 
areas will be paved for air quality control. 
 
Development lighting will be dark-sky compliant. Light fixtures will be compliant with 
Maricopa County requirements and will be low-elevation, low-intensity and have 
shielding so that there is zero bleed-over at the lot line. There will be sufficient lighting to 
ensure safe egress at the building exits and low-level path lighting to the parking area. 
 
Signs will conform to Maricopa County requirements. 
 
 
RELATIONSHIP TO SURROUNDING PROPERTIES: 
 
The Property is located in the central Town of Gilbert area within an unincorporated area 
of Maricopa County and is immediately adjacent to the Town of Gilbert to the west (west 
of the Greenfield Road frontage road). 
 
The use and zoning of the surrounding properties are as follows: 
 
North:  
Life Church and single-family residential, all within the jurisdiction of Maricopa 
County and all zoned Rural-43. 
 
East:  
Single-family residential, within the jurisdiction of Maricopa County and zoned 
Rural-43. 
 
West:  
Immediately across the Greenfield Access Road frontage road is Discovery 
District Park, a major park and retention area managed by the Town of Gilbert 
and located on State-owned land, which is located within the boundary of the 
Town of Gilbert and is zoned Public Facilities/Institutional (PF/I). Further to 
the west is San Tan Village, which is the 
single-largest 
retail, 
entertainment, multi-family residential and office complex in the State of 
Arizona. 
 
South:  
Single-family residential within the jurisdiction of Maricopa County and zoned 
Rural-43. Further to the south is the American Leadership Academy school, 
which is located within the boundary of the Town of Gilbert and is zoned SF-
35 (Single-family Residential - Detached; 35,000 square foot minimum net lot 
size). On the south side of Pecos, directly south of and just a few hundred

As mentioned previously, the Property serves as a buffer, or transition, from San Tan 
Village and the Loop 202 / San Tan Freeway, located to the west of the Site, and the 
existing rural, single-family residential uses to the east. 
 
As the Property is surrounded by these intense uses, it is no longer viable for single-
family residential uses; it is much more appropriate as a buffer use as a transition from 
the intense uses to the west, south and north, to the rural residential uses to the east. 
This proposal addresses that unique location with a use that responds to its intense 
surroundings positively, while maintaining a rural and quiet atmosphere for the 
neighbors to the east. 
 
Additionally, the presence and proximity of the existing LDS Gilbert Arizona Temple 
lends the Property to accommodating uses such as the proposed White Barn Event 
Center. 
 
 
LOCATION & ACCESSIBILITY: 
 
As noted above, the Property has excellent accessibility. The site has direct frontage 
along the west to the Greenfield Access Road frontage road, which provides access to 
Greenfield Road (which becomes San Tan Village Parkway further to the north) and has 
a partial interchange with the Loop 202 / San Tan Freeway. Greenfield Access Road is 
maintained by the Town of Gilbert. Greenfield Road also provides access to Pecos 
Road. Full access interchanges are near to the Property at Val Vista and Williams Field 
Roads. 
 
Two driveways are proposed onto Greenfield Access Road frontage road; a Traffic 
Statement is provided with this resubmittal. 
CIRCULATION: 
 
As noted above, the Property has excellent accessibility with direct frontage along the 
west to the Greenfield Access Road frontage road, which is a two-lane paved roadway 
that extends from Greenfield Road to the north. The Greenfield Access Road frontage 
road has an undetermined right-of-way width.  
 
The Town of Gilbert has indicated that full-street improvements (curb, gutter, paving, 
right turn lanes, etc.) will be required on Greenfield Access Road with this development, 
and that an inbound right-turn lane installation at the Greenfield Road intersection will 
be required due to potential peak traffic impacts from the event center.  
 
The proposed offsite Improvement Plans for the Greenfield Access Road have been 
submitted to the Town of Gilbert, and the applicant team continues to work with the 
Town of Gilbert to design the offsite street improvements. The Town of Gilbert has

asked that the plans be revised and re-submitted to the Town of Gilbert. This will be 
completed as required by MCDOT / Maricopa County. 
 
Roadway improvements and/or right-of-way for the Greenfield Road frontage road, and 
any offsite improvements, will be as agreed to or required by MCDOT and/or the Town 
of Gilbert. 
 
Two driveways are proposed onto the Greenfield Road frontage road as indicated on 
the Site Plan included with this resubmittal. Driveway location and the number of 
driveways, including secondary access remoteness requirements, shall in accordance 
with MCDOT / Town of Gilbert requirements.

the Northbound stop sign at Greenfield Road, directing traffic back out to the San Tan 
Parkway, away from the neighborhood. If the Town of Gilbert allows it, traffic cones will 
be used in the Greenfield Road to direct exiting vehicles to San Tan Parkway as well. 
 
A Traffic Statement is provided with this resubmittal. 
 
As noted previously, the 101 parking spaces provided for White Barn are far above the 
required 49 spaces as required by Maricopa County Zoning Ordinance. We also have a 
Parking Agreement with the American Leadership Academy school located to south of 
the Property if the need arises for overflow parking for either the White Barn Event 
Center or the school.  
 
All Internal circulation and parking areas will utilize a “dust-free” surface as required by 
MCDOT. 
 
 
DEVELOPMENT SCHEDULE: 
 
At the present time, the Property is proposed to be developed in one (1) phase.

COMMUNITY FACILITIES AND SERVICES: 
 
As this project is non-residential in nature, no community facilities or services are 
necessary or are to be provided other than those that support the intended uses on the 
site. 
 
PUBLIC UTILITIES AND SERVICES: 
 
Police protection will be provided by the Town of Gilbert / Maricopa County Sheriff’s 
Office. Fire protection will be provided by the Town of Gilbert, as it currently does. 
 
Wastewater will be addressed via an onsite septic treatment system. In the event of 
failure of the proposed septic system, a new system will be installed per Maricopa 
County requirements in effect at that time. This method is consistent with adopted 
policies and procedures of Maricopa County. Dry sewer for connection to the Town of 
Gilbert’s wastewater system is not contemplated but can be provided if and when the 
Town would allow connection without annexation. 
 
Water service is already provided by the Town of Gilbert.  
 
Refuse collection will be provided by a private company. 
 
Electric service is provided by SRP (Salt River Project). Telecommunications services 
(phone, cable, internet) are available from Cox Communications, CenturyLink 
Communications and other providers. 
 
The Property is located within the Higley Unified School District. As a non-residential 
development, no impact to the school district is anticipated. 
 
A Preliminary Drainage Report was included and approved with the submittal of the 
initial Special Use Permit under Z2023014. All retention and drainage will meet 
Maricopa County Flood Control District (MCFCD) requirements as approved through 
this zoning application.

This special use permit shall expire on June 12, 2034, or upon termination of the use for a 
period of 90 or more consecutive days, whichever occurs first. All site improvements

The applicant shall submit a status report to the Maricopa County Planning and Development 
Department every two years from the date of Board approval. The status report shall detail 
how the applicant has complied with all conditions of the SUP approval. The Department 
may accept and administratively approve the status report or schedule the matter for 
consideration of SUP amendment or revocation by the Board with recommendation from the 
Planning and Zoning Commission. 
 
e. 
The project shall be in compliance with the following development regulations in the Town 
of Gilbert Land Development Code: 
 
1. Development shall meet or exceed the dimensional standards of the Community 
Commercial zoning district as outlined in Table 3.4.4.B.1. 
 
2. All refuse and recycling enclosures shall be screened from public view. 
 
f. 
Events shall be limited to weddings and no more than two corporate events per month only. 
 
g. 
An on-site septic system shall be prohibited. The project shall be served by the Town of 
Gilbert sewer system.  
 
h. 
The project shall require an  8’ CMU wall on the north, east and south property lines for noise 
attenuation purposes, except where adjacent to Life Church property.

All seating and gathering areas shall be setback at a minimum 20’ from any property line.

A continuous row of large canopy 36” box trees shall be placed along the north, east, and 
south perimeter of the property at a minimum 30-feet on center, except where adjacent to 
the Life Church property.

All outdoor lighting shall be shielded so that illumination does not trespass onto neighboring 
properties and is directed downward at a minimum 20-degree angle beneath the horizontal 
plane of the bottom of the shielding

All commercial outdoor activity shall be moved indoors by 9:00 PM.

All events shall cease by 11:00 pm.

Events with over 75 invitees shall provide for a traffic control officer from either the Maricopa

vehicles are not utilizing the local roadways (i.e. Frye Road and Fairview Street). All local 
residents shall be given priority through any controlled access point. All traffic control and/or 
right-of-way permits shall be obtained when necessary. 
 
o. 
Amplified music and dancing are prohibited in outdoor areas. Further, any amplified noise 
must conform to Maricopa County Noise Ordinance (P-23) that was adopted February 15, 
2006 and is regulated by the MCSO. Section IV Noise: 
C. Radios and Sound Amplification Devices 
It shall be unlawful for any person to operate any radio, loudspeaker, musical instrument, or 
other sound producing, sound reproducing, or sound amplification equipment that emits 
noise that can be heard from within closed residential structures located within 500 feet of 
the boundary of the property from which such noise emanates.    
 
p. 
All Outdoor sound system speakers shall be permanently ground mounted, facing inward. 
No portable speakers shall be permitted for use outdoors. 
 
q. 
Noise resulting from any activities on the premises shall be limited to no more than 50 
decibels (dB) along the north, east and south property lines. A noise study indicating the 
expected noise levels along the perimeter of the property, as well as the mitigation measures 
that will be implemented to accomplish a maximum of 50 dB along the perimeter shall be 
completed prior to issuance of any site plan approval or building permits. 
 
r. 
Noise monitors shall be installed every 30 feet along the north, east and south property line 
of the premises. The property owner shall keep records of the decibel levels from such noise 
monitors throughout the duration of the SUP and make the data collected available upon 
request. Repeated instances of noise levels exceeding 50 dB resulting from activities on the 
premises may result in the renovation of this SUP. 
 
s. 
Signs shall be posted around the parking area and outdoor gathering areas notifying 
attendees to be mindful and respectful of adjacent neighbors. Signs shall read “Notice: this 
venue is located in a residential neighborhood. Please be mindful and respectful of 
neighboring residents. Keep all noise to a minimum while outdoors.” The signs shall be a 
minimum of 36 inches by 36 inches. The sign text shall be at minimum 3 inches in height. 
 
t. 
Prior to issuance of initial building permits, all parcels shall be combined to create a single 
parcel matching the SUP area. 
 
u. 
The following Planning Engineering conditions: 
 
1. Unpermitted walls/fences on the subject property shall be addressed with the submittal 
for building permits for the site development. It shall be demonstrated that the

walls/fences do not create an adverse drainage impact to the site or surrounding 
properties. 
 
2. Prior to the issuance of building permits for development of the site, the owner/applicant 
must provide evidence that the Town of Gilbert has approved the Traffic Report. 
 
3. Access to the parking lot shall be via a one-way entrance (north) and one-way exit 
(south), or as otherwise approved by the Town of Gilbert. 
 
4. Access to and from eh site shall only be provided along Greenfield Road north of the 
site. All traffic shall be directed away from the American Leadership Institute driveway 
located south of the site. Directional signage shall be posted on site to direct attendees 
to the appropriate exit to the Greenfield Road (north). 
 
5. Owner/applicant shall coordinate with the Town of Gilbert for any offsite improvements, 
ROW requirements and access. Provide County of TOG approved offsite improvement 
plans during building permit phase.  
 
6. SWPP provided during building permit phase.  
 
7. Engineering review of planning and/or zoning cases is for conceptual design only. All 
development and engineering design shall be in conformance with Section 1205 of the 
Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain 
Regulations for Maricopa County; MCDOT Roadway Design Manual; and current 
engineering policies, standards and best practices at the time of  
application for construction. 
 
8. Based on the conceptual design nature of the information submitted, changes to the site 
layout may be necessitated by the final engineering design of the site’s drainage 
infrastructure. 
 
9. Detailed Grading and Drainage (Site Infrastructure) Plans and Drainage report must be 
submitted with the application for Building Permits. 
 
v. 
Noncompliance with any of the conditions assigned to the approval of this SUP by the 
Maricopa County Board of Supervisors may be grounds for revocation in accordance with 
the requirements and procedures as set forth in the Maricopa County Zoning Ordinance.  
 
w. 
The granting of this change in use of the property has been at the request of the applicant, 
with the consent of the landowner.  The granting of this approval allows the property to enjoy 
uses in excess of those permitted by the zoning existing on the date of application, subject 
to conditions.  In the event of the failure to comply with any condition, and at the time of 
expiration of the SUP, the property shall revert to the zoning that existed on the date of 
application.  It is, therefore, stipulated and agreed that either revocation due to the failure to 
comply with any conditions, or the expiration of the Special Use Permit, does not reduce any 
rights that existed on the date of application to use, divide, sell or possess the property and 
that there would be no diminution in value of the property from the value it held on the date 
of application due to such revocation or expiration of the SUP.  The SUP enhances the value 
of the property above its value as of the date the SUP is granted and reverting to the prior 
zoning results in the same value of the property as if the SUP had never been granted. 
 
X. 
  Prior to issuance of a building permit, written confirmation will be required from the 
emergency fire protection jurisdiction having authority that the facility has been designed in 
accordance with their regulations and requirements, and that emergency fire protection 
service will be provided to the facility. Prior to issuance of the certificate of occupancy, local 
fire protection jurisdiction review and approval will be required

asking? We are the ones that live in the county island; he and his clients do not. We should get more

Comments: 
The frontage ROW is within the Town of Gilbert’s jurisdiction.  
Engineering condition ‘h-2’ stipulates the applicant must receive the 
Town’s approval of the traffic report prior to building permits.  
 
The Town commented they would prefer the applicant annex to and 
develop in the Town. This would include full frontage street 
improvements with a turn lane and connection to the Towns sewer 
system as opposed to proposed onsite septic system.  
 
Prior to the Commission hearing, staff received an additional three 
letters in opposition representing two directly adjacent parcels. 
Staff also received a letter of support from the adjacent church and 
a petition with 127 names in support representing an unknown 
area.  
 
During the P&Z hearing, eight residents spoke in opposition with an 
additional resident in opposition choosing not to speak (9 
opposed). Two Speakers appeared who spoke in favor for the 
proposal with an additional 14 people in favor who choose not to 
speak (16 supported).  
 
To date staff has received a total of two items of support with one 
being a petition representing 127 individuals.

Staff has received written comments from 55 individuals in 
opposition, a petition with 159 additional verifiable signatures, a 
neighborhood survey indicating 64 local residences are in 
opposition and an change.org internet petition indicating 128 
names in opposition. Five of the written comments are within 300’ 
of the subject site.   
 
Staff has calculated the support and opposition received, and notes 
that a Super Majority Vote has been triggered. The trigger is when 
20% or more of property owners within a 300’ radius of the subject 
site, by number and area register opposition to the case. The 
opposition received accounts for 3 property owners with an area of 
300 sq. ft.  
 
 
The calculations for The White Barn Events Center are as follows:  
 
32% opposed parcel acreage within 300’ buffer 
25% opposed parcel numbers within 300’ buffer 
 
After 
hearing

Commission’s 
recommendation was for a 10-year SUP validity period (whereas 
the staff report included condition ‘c’.  for a 15-year SUP):  
c. This special use permit shall expire on June 12, 2039 2034, or 
upon termination of the use for a period of 90 or more consecutive 
days, whichever occurs first. All site improvements associated with 
the SUP shall be removed within 90 days of such expiration or 
termination of use. 
 
Commission  
 
Recommendation: 
On 5/9/24, the Commission voted 7-1 to adopt a motion 
recommending the Board of Supervisors approve Z2023014 
subject to conditions ‘a’ – ‘l’:  
 
a. 
Development of the site shall be in substantial conformance with the site plan entitled 
“White Barn Wedding Venue“, consisting of 8 full-size sheets, dated June 24, 2023 and 
stamped received October 2, 2023 except as modified by the following conditions. 
 
b. 
Development of the site shall be in substantial conformance with the narrative report 
entitled “White Barn Events Center”, consisting of 8 pages, dated March 20, 2024 and 
stamped received March 20, 2024 except as modified by the following conditions. 
 
c. 
This special use permit shall expire on June 12, 2034, or upon termination of the use for 
a period of 90 or more consecutive days, whichever occurs first. All site improvements 
associated with the SUP shall be removed within 90 days of such expiration or termination 
of use.   
 
d. 
The project shall require a 6’ CMU wall on the north, east and south property lines for noise 
attenuation purposes.

All outdoor lighting shall be shielded so that illumination does not trespass onto 
neighboring properties and is directed downward at a minimum 20-degree angle beneath 
the horizontal plane of the bottom of the shielding

All commercial outdoor activity shall be moved indoors by 9:00 PM.  
 
g. 
Amplified music and dancing are prohibited in outdoor areas. Further, any amplified noise 
must conform to Maricopa County Noise Ordinance (P-23) that was adopted February 15,

It shall be unlawful for any person to operate any radio, loudspeaker, musical instrument, or 
other sound producing, sound reproducing, or sound amplification equipment that emits 
noise that can be heard from within closed residential structures located within 500 feet of 
the boundary of the property from which such noise emanates.

Prior to issuance of initial building permits, all parcels shall be combined to create a single 
parcel matching the SUP area.

The following Planning Engineering conditions: 
 
1. Unpermitted walls/fences on the subject property shall be addressed with the 
submittal for building permits for the site development. It shall be demonstrated that 
the walls/fences do not create an adverse drainage impact to the site or surrounding

2. Prior to the issuance of building permits for development of the site, the 
owner/applicant must provide evidence that the Town of Gilbert has approved the 
Traffic Report. 
 
3. Access to the site shall be via a one-way entrance (north) and one-way exit (south), or 
as otherwise approved by the Town of Gilbert. 
 
4. Owner/applicant shall coordinate with the Town of Gilbert for any offsite 
improvements, ROW requirements and access. Provide County of TOG approved 
offsite improvement plans during building permit phase.  
 
5. SWPP provided during building permit phase.  
 
6. Engineering review of planning and/or zoning cases is for conceptual design only. All 
development and engineering design shall be in conformance with Section 1205 of 
the Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain 
Regulations for Maricopa County; MCDOT Roadway Design Manual; and current 
engineering policies, standards and best practices at the time of  
application for construction. 
 
7. Based on the conceptual design nature of the information submitted, changes to the 
site layout may be necessitated by the final engineering design of the site’s drainage 
infrastructure. 
 
8. Detailed Grading and Drainage (Site Infrastructure) Plans and Drainage report must be 
submitted with the application for Building Permits.

Noncompliance with any of the conditions assigned to the approval of this SUP by the 
Maricopa County Board of Supervisors may be grounds for revocation in accordance 
with the requirements and procedures as set forth in the Maricopa County Zoning 
Ordinance.  
 
k. 
The granting of this change in use of the property has been at the request of the 
applicant, with the consent of the landowner.  The granting of this approval allows the 
property to enjoy uses in excess of those permitted by the zoning existing on the date of 
application, subject to conditions.  In the event of the failure to comply with any 
condition, and at the time of expiration of the SUP, the property shall revert to the zoning 
that existed on the date of application.  It is, therefore, stipulated and agreed that either 
revocation due to the failure to comply with any conditions, or the expiration of the 
Special Use Permit, does not reduce any rights that existed on the date of application to 
use, divide, sell or possess the property and that there would be no diminution in value of 
the property from the value it held on the date of application due to such revocation or 
expiration of the SUP.  The SUP enhances the value of the property above its value as of 
the date the SUP is granted and reverting to the prior zoning results in the same value of 
the property as if the SUP had never been granted. 
 
l. 
Prior to issuance of a building permit, written confirmation will be required from the 
emergency fire protection jurisdiction having authority that the facility has been 
designed in accordance with their regulations and requirements, and that emergency fire 
protection service will be provided to the facility. Prior to issuance of the certificate of

Project Summary: 
 
1. 
The applicant is requesting a SUP to allow a 300-guest wedding venue / events center on a pair 
of parcels within the Rural-43 zoning district located in the Gilbert area located north of the 
northeast corner of Greenfield Rd. and Pecos Rd. The Maricopa County Zoning Ordinance (MCZO) 
under Article 1301.1.11 (Special Uses) describes the following: “Land use involving large 
assemblage of people”.  The subject site is approximately 2.36 acres.   
 
2. 
Surrounding uses include residential homes to the east – and along the Greenfield Rd. frontage 
a church directly to the north and a school to the south. There is a frontage road along Greenfield 
Rd. that provides direct access to the site, the church, the school and a single-family residence.  
 
3. 
The development of the wedding / events venue, to be known as “The White Barn”, would remove 
the existing single-family home and replace it with a 9,089 sq ft barn building and a 1,527 sq. ft. 
chapel building. A dynamic white theme has been chosen, which will be incorporated throughout 
the entire site, has been comprehensively designed to utilize the entire lot with no undeveloped 
space. Landscaping has been incorporated into the design to brighten as well as add additional 
sources of neighbor buffering.   
 
4. 
The site proposes two driveways with a one-way drive though configuration. The site plan 
proposes 100 parking spaces with 5 ADA spaces. The applicant is proposing Monday through 
Sunday operation with the majority of events taking place on weekend nights estimated between 
5pm and Midnight. The applicant is proposing to cease all outdoor activity by 9 pm daily.

Public Participation Summary:

Prior to application, the applicant held two separate in-person neighborhood meetings on April 27 
& June 27, 2022. Subsequent to the application, the applicant completed the required 300’ 
notification requirement as well as the 2 required site postings. Staff heard from one neighbor 
who requested additional information but declined to comment. Staff has not received any 
additional comments from any members of the public or the surrounding businesses.

Outstanding Concerns from Reviewing Agencies: 
 
10. 
The Town of Gilbert has provided written notification opposing the proposed development within 
the county. The Town would like for the applicant to annex the site and develop within the Town 
utilizing the Town’s guidelines and potential infrastructure connections. The Town has concerns 
regarding neighborhood traffic, light generation and adjacent roadway improvements. The Town 
would like the project to develop with a connection to the local sewer infrastructure as opposed 
to the planned septic use.  
 
11. 
The Town of Gilbert additionally owns and maintains the majority of right-of-way that comprises 
the Greenfield access roadway. The Town has indicated full roadway improvements will be 
necessary along the Greenfield access road with additional improvements to the intersection of 
Greenfield Rd and the Greenfield access Rd.  
 
12. 
The applicant has indicated they will abide by any roadway improvements dictated by the Town 
of Gilbert. The sewer/septic system issue was addressed by the applicant by indicating they 
would be responsible for the waste management system and that they would rebuild any future 
broken or insufficient systems without the need to attach to a municipal system. The applicant 
has indicated that they will inform all hosts and guests of noise requirements as well as 
implement a notification system that will direct patrons away from utilizing the neighborhood 
roadways for site access.  
 
Staff Analysis: 
 
13. 
Staff is generally supportive of the proposed use at this location due to the growing intensity of 
the area and the location using the access road away from the surrounding neighborhood. Staff 
sees the use as comparable to the nearby church and school in relative use intensity. The 
immediate area along Greenfield Rd. frontage has high traffic volume generating uses. A use for 
the large assemblage of persons is appropriate in this location if potential adverse impacts on 
the residential neighborhood to the east can be mitigated, which staff believes has been 
accomplished though subsequent conditions of approval.  
 
14. 
Staff recognizes and shares the Town of Gilbert’s neighborhood concerns and supports 
conditions for noise and light attenuation practices as well as an outdoor use curfew of 9pm. 
 
15. 
Staff agrees with the Town of Gilbert’s infrastructure improvement requirements and has 
conditioned that the Town must sign off on all transportation improvements prior to the issuance 
of any site building permits.   
 
15. 
Staff agrees that sewer must be made available to this site prior to ultimate Commercial zoning.  
 
16. 
Staff understands the Town of Gilbert’s comments regarding the desired appropriate zoning 
designation for the use. A SUP is the appropriate avenue of approval within Maricopa County as 
assemblages of large groups of people are a required SUP use. Staff takes solace in the 
understanding that the SUP will be conditioned to revisit the approval with a 10-year expiration 
date. Staff does believe that as this segment of Greenfield Rd. continues build-out transitioning 
to commercial/public assembly uses that Commercial zoning will ultimately be appropriate for 
this site.

17. 
Staff recommends the Commission adopt a motion recommending that the Board of Supervisors 
approve Z2023014 subject to the following conditions ‘a’ – ‘l’: 
 
a. 
Development of the site shall be in substantial conformance with the site plan entitled 
“White Barn Wedding Venue“, consisting of 8 full-size sheets, dated June 24, 2023 and 
stamped received October 2, 2023 except as modified by the following conditions. 
 
b. 
Development of the site shall be in substantial conformance with the narrative report 
entitled “White Barn Events Center”, consisting of 8 pages, dated March 20, 2024 and 
stamped received March 20, 2024 except as modified by the following conditions. 
 
c. 
This special use permit shall expire on June 12, 2039, or upon termination of the use for 
a period of 90 or more consecutive days, whichever occurs first. All site improvements 
associated with the SUP shall be removed within 90 days of such expiration or termination 
of use.   
 
d. 
The project shall require a 6’ CMU wall on the north, east and south property lines for noise 
attenuation purposes.  
 
e. 
All outdoor lighting shall be shielded so that illumination does not trespass onto 
neighboring properties and is directed downward at a minimum 20-degree angle beneath 
the horizontal plane of the bottom of the shielding  
 
f. 
All commercial outdoor activity shall be moved indoors by 9:00 PM.  
 
g. 
Amplified music and dancing are prohibited in outdoor areas. Further, any amplified noise 
must conform to Maricopa County Noise Ordinance (P-23) that was adopted February 15, 
2006 and is regulated by the MCSO. Section IV Noise:
