The applicant, Mr. Rodney Jarvis, and Mr. Paul Gilbert, who represents some of the neighborhood opposition are in agreement with these modified conditions. Staff had concern with two of the new conditions ‘d’ and ‘e’. The latter references the Town of Gilbert Land Development Code, Table 3.4.4.B.1. The applicant has indicated their proposed site plan is consistent with the referenced code. The former calls for the Board to hold a meeting to review the SUP every two years. Staff spoke to both gentlemen regarding new condition ‘d’ and they’ve agreed to replace it with the following language: d. The applicant shall submit a status report to the Maricopa County Planning & Development Department every two years from the date of Board approval. The status report shall detail how the applicant has complied with all conditions of SUP approval. The Department may accept and administratively approve the status report or schedule the matter for consideration of SUP amendment or revocation by the Board with recommendation from the Planning and Zoning Commission. Additionally, the applicant has submitted 181 additional signatures of support bringing the total to 337 members of the public in support. To date staff has received comment or signatures from 337 individuals in support and 278 names in opposition with an additional 128 names on a change.org petition opposed. Three appeal forms have been provided by residents within the 300’ buffer, staff notes a Super-Majority vote has been triggered with this case. All refuse and recycling enclosures shall be screened from public view. f. Events shall be limited to weddings and no more than two corporate events per calendar month only. c.g. An on-site sepƟc system shall be prohibited for this SUP. The project shall be served by the Town of Gilbert sewer system. h. The project shall require a 6’ 8’ CMU wall on the north, east and south property lines for noise atenuaƟon purposes, except where adjacent to the Life Church property. i. All seaƟng and gathering areas shall be setback at minimum 20’ feet from any property line. d.j. A conƟnuous row of large canopy 36” box trees shall be placed along the north, east, and south perimeter of the property at minimum 30-feet on center, except where adjacent to the Life Church property. e.k. Events with over 75 invitees shall provide for a traffic control officer from either the Maricopa County Sherrif’s Department, Town of Gilbert Police Department, or other authorized third-party traffic control specialist to manage atendees exiƟng an event and ensure any non-resident vehicles are not uƟlizing the local roadways (i.e., Frye Road and Fairview Street). All local residents shall be given priority through any controlled access point. All traffic control and/or right-of-way permits shall be obtained when necessary. o. Amplified music and dancing are prohibited in outdoor areas. Further, any amplified noise must conform to Maricopa County Noise Ordinance (P-23) that was adopted February 15, 2006 and is regulated by the MCSO. SecƟon IV Noise: C. Radios and Sound AmplificaƟon Devices It shall be unlawful for any person to operate any radio, loudspeaker, musical instrument, or other sound producing, sound reproducing, or sound amplificaƟon equipment that emits noise that can be heard from within closed residenƟal structures located within 500 feet of the boundary of the property from which such noise emanates. p. All outdoor sound system speakers shall be permanently ground mounted, facing inward, at the four corners of the outside areas. No portable speakers shall be permited for use outdoors. q. Noise resulƟng from any acƟviƟes on the premises shall be limited to no more than 50 decibels (dB) along the north, east, and south property line. A noise study indicaƟng the expected noise levels along the perimeter of the property, as well as the miƟgaƟon measures that will be implemented to accomplish a maximum of 50 dB along the perimeter shall be completed prior to issuance of any site plan approval or building permits. r. Noise monitors shall be installed every 30 feet along the north, east, and south property line of the premises. The property owner shall keep records of the decibel levels from such noise monitors throughout the duraƟon of the SUP and make the data collected available upon request. Repeated instances of noise levels exceeding 50 dB resulƟng from acƟviƟes on the premises may result in the revocaƟon of this SUP. g.s. Signs shall be posted around the parking area and other outdoor gathering areas noƟfying atendees to be mindful and respecƞul of the adjacent neighbors. Signs shall read “NoƟce: this venue is located in a residenƟal neighborhood. Please be mindful and respecƞul of neighboring residents. Keep all noise to a minimum while outdoors.” The signs shall be a minimum of 36 inches by 36 inches. The sign text shall be at minimum 3 inches in height. h.t. Prior to issuance of iniƟal building permits, all parcels shall be combined to create a single parcel matching the SUP area. i.u. The following Planning Engineering condiƟons: 1. Unpermited walls/fences on the subject property shall be addressed with the submital for building permits for the site development. It shall be demonstrated that the walls/fences do not create an adverse drainage impact to the site or surrounding properƟes. 2. Prior to the issuance of building permits for development of the site, the owner/applicant must provide evidence that the Town of Gilbert has approved the Traffic Report. Access to the site parking lot shall be via a one-way entrance (north) and one-way exit (south), or as otherwise approved by the Town of Gilbert. 4. Access to and from the site shall only be provided along Greenfield Road north of the site. All traffic shall be directed away from the American Leadership InsƟtute driveway located south of the site. DirecƟonal signage shall be posted on site to direct atendees to the appropriate exit to the Greenfield Road (north). 3.5. Owner/applicant shall coordinate with the Town of Gilbert for any offsite improvements, ROW requirements and access. Provide County of TOG approved offsite improvement plans during building permit phase. 4.6. SWPP provided during building permit phase. 5.7. Engineering review of planning and/or zoning cases is for conceptual design only. All development and engineering design shall be in conformance with SecƟon 1205 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain RegulaƟons for Maricopa County; MCDOT Roadway Design Manual; and current engineering policies, standards and best pracƟces at the Ɵme of applicaƟon for construcƟon. 6.8. Based on the conceptual design nature of the informaƟon submited, changes to the site layout may be necessitated by the final engineering design of the site’s drainage infrastructure. 7.9. Detailed Grading and Drainage (Site Infrastructure) Plans and Drainage report must be submited with the applicaƟon for Building Permits. j.v. Noncompliance with any of the condiƟons assigned to the approval of this SUP by the Maricopa County Board of Supervisors may be grounds for revocaƟon in accordance with the requirements and procedures as set forth in the Maricopa County Zoning Ordinance. k.w. The granƟng of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granƟng of this approval allows the property to enjoy uses in excess of those permited by the zoning exisƟng on the date of applicaƟon, subject to condiƟons. In the event of the failure to comply with any condiƟon, and at the Ɵme of expiraƟon of the SUP, the property shall revert to the zoning that existed on the date of applicaƟon. It is, therefore, sƟpulated and agreed that either revocaƟon due to the failure to comply with any condiƟons, or the expiraƟon of the Special Use Permit, does not reduce any rights that existed on the date of applicaƟon to use, divide, sell or possess the property and that there would be no diminuƟon in value of the property from the value it held on the date of applicaƟon due to such revocaƟon or expiraƟon of the SUP. The SUP enhances the value of the property above its value as of the date the SUP is granted and reverƟng to the prior zoning results in the same value of the property as if the SUP had never been granted. l.x. The following Planning Engineering conditions: 1. Unpermitted walls/fences on the subject property shall be addressed with the submittal for building permits for the site development. It shall be demonstrated that the walls/fences do not create an adverse drainage impact to the site or surrounding properties. 2. Prior to the issuance of building permits for development of the site, the owner/applicant must provide evidence that the Town of Gilbert has approved the Traffic Report. 3. Access to the site shall be via a one-way entrance (north) and one-way exit (south), or as otherwise approved by the Town of Gilbert. 4. Owner/applicant shall coordinate with the Town of Gilbert for any offsite improvements, ROW requirements and access. Provide County of TOG approved offsite improvement plans during building permit phase. 5. SWPP provided during building permit phase. 6. Engineering review of planning and/or zoning cases is for conceptual design only. All development and engineering design shall be in conformance with Section 1205 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual; and current engineering policies, standards and best practices at the time of application for construction. 7. Based on the conceptual design nature of the information submitted, changes to the site layout may be necessitated by the final engineering design of the site’s drainage infrastructure. 8. Detailed Grading and Drainage (Site Infrastructure) Plans and Drainage report must be submitted with the application for Building Permits. j. Noncompliance with any of the conditions assigned to the approval of this SUP by the Maricopa County Board of Supervisors may be grounds for revocation in accordance with the requirements and procedures as set forth in the Maricopa County Zoning Ordinance. k. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, and at the time of expiration of the SUP, the property shall revert to the zoning that existed on the date of application. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions, or the expiration of the Special Use Permit, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation or expiration of the SUP. The SUP enhances the value of the property above its value as of the date the SUP is granted and reverting to the prior zoning results in the same value of the property as if the SUP had never been granted. l. Prior to issuance of a building permit, written confirmation will be required from the emergency fire protection jurisdiction having authority that the facility has been designed in accordance with their regulations and requirements, and that emergency fire protection Formal Meeting Minutes 11/06/2024 Page 12 of 62 service will be provided to the facility. Prior to issuance of the certificate of occupancy, local fire protection jurisdiction review and approval will be required. (C-44-25-013-X-00) Tom Ellsworth, Planning and Development Director and Darren Gerard, Planning Division Manager, came forward to present on item 11. Chairman Sellers announced that each side, in favor or in opposition, would be given 10 minutes each to present their case. Mr. Ellsworth gave an overview of White Barn Event Center, saying it is a Special Use Permit (SUP) within the rural 43 zoning district. Mr. Ellsworth explained in more detail the location and surrounding neighborhood. Formal Meeting Minutes 11/06/2024 Page 13 of 62 Mr. Ellsworth said the applicant would like this wedding event center to include a reception hall and chapel with parking to accommodate approximately 100 vehicles. He said this request has received significant attention with 337 individual letters of support and 278 individual letters in opposition. The opposition included a petition to appeal the Planning and Zoning Commission’s decision. Mr. Ellsworth said that due to the opposition numbers within the 300 feet, a Super Majority vote is triggered to approve this SUP. Formal Meeting Minutes 11/06/2024 Page 14 of 62 The opposition focused on traffic, noise, lighting, public safety, and general compatibility of the land use. The Planning and Zoning Commission voted in favor with several conditions. The applicant and a land use attorney hired by some of the property owners, met and came up with stipulations that would help mitigate some of the issues stated. A copy of those stipulations was provided to the Board and Mr. Ellsworth read from the document, some of the conditions. Rod Jarvis, applicant, Greenfield Properties LLC, spoke about the importance of working together and he thanked the Board and all involved parties for their time. He said there has been an agreement reached and he would not make a presentation but would be available for further questions that people might have. The Clerk said she had 20 speaker slips in opposition who wished to speak and 12 speaker slips in opposition who just registered their position. The Clerk read the 12 names: Melissa Jorgensen, Barbara Payne, Donna Bradshaw, Aaron Bradshaw, Alena Skinner, Brandi Galvan, Laurie Jarvis, Jason Connor Payne, Colton Payne, Kaden Payne, Traci Payne, Elena Silk. Scott Henderson, resident and neighbor, spoke in opposition stating traffic concerns. Amanda Gallagher, resident and neighbor, expressed her opposition for a variety of reasons. She stated the Board was not listening to the people who it will impact the most. Woman, did not state her name, second generation homeowner, stated her opposition and asked to keep the residential properties, residential. Linda Payne, resident and neighbor, spoke in opposition and quoted the Arizona Constitution, and was concerned about the negative impact on children in the neighborhood. Stacy Epperson, resident, spoke in opposition. She said her family has lived in this neighborhood for generations and would like to raise her kids here without the commercial influence. Formal Meeting Minutes 11/06/2024 Page 15 of 62 Mr. Jarvis, returned to the podium to speak. He acknowledged the concerns that were stated and said the stipulations have addressed those concerns. Chairman Sellers said he was not initially enthusiastic about this project and has since had a change in his thinking because of the numerous concessions that have been made. Chairman Sellers asked for more clarification on sound and what constitutes too loud in terms of decibels. An explanation followed that included comparisons with everyday sounds that people are familiar with. Mr. Jarvis said the amplified sounds (music) will be indoors in the reception hall and will be able to be monitored more closely. The following motion was made by Supervisor Bill Gates: Motion to approve item 11 in accordance with modified conditions outlined in the staff memorandum handed out this morning. I understand the applicant’s counsel and an opposition counsel agree with these conditions. The conditions will mitigate potential adverse impacts on nearby residences. The site is appropriate for a public assembly land use. AQ-2024-006-RULE 510 (AIR QUALITY STANDARDS) Convene a public hearing, as required by Arizona Revised Statutes (A.R.S.) § 49-479(b), to solicit comments on incorporating the recently revised primary annual PM2.5 National Ambient Air Quality Standard (PM2.5 NAAQS) into Maricopa County Air Pollution Control Regulations, Rule 510 (Air Quality Standards) and the associated proposed revision to the Arizona State Implementation Plan (SIP). Following the public hearing, the Board is requested to adopt the proposed revision to the rule and to approve submission of the revised rule as a revision to the Arizona SIP.
