D R A F T MINUTES BOARD OF ADJUSTMENT - WORKSHOP GLENDALE CIVIC CENTER BOARDROOM 5750 W GLENN DR. GLENDALE, ARIZONA 85301 DECEMBER 14, 2023 4:00 P.M. Present: Cathy Cheshier, Chair Benjamin Naber, Vice Chair Timothy Carson, Commissioner Lawrence Feiner, Commissioner Tammy Gee, Commissioner Also Present: Tabitha Perry, Deputy Director - Development Services Russ Romney, Deputy City Attorney Sydney Tirella, Planner K. John Kazmerski, Recording Secretary 1. CALL TO ORDER Ms. Cheshier called the workshop to order at 4:26pm. 2. STAFF REPORTS a. Procedures and Guidance for Public Hearing Items. Ms. Cheshier turned the meeting over to Ms. Perry. Ms. Perry told the board this workshop was called in reflection of last month's meeting. VAR23-01 was denied by a split vote. The applicant expressed concerns about the handling of the case by staff and the board. Ms. Perry stated as she researched the case she was able to determine items that staff could improve on and had taken appropriate action. Ms. Perrry explained the applicants' concerns about the board were; showing up late, not understanding the site plan and comments made during the meeting. In response, Ms. Perry stated traffic cannot be controlled, and it was appropriate for the chair to delay the meeting. In the future, staff will provide more detailed information. Whether factual or not, comments made by the board can be perceived negatively. As a reminder, Ms. Perry stated that an appeal of this board's decisions will go directly to Superior Court. Ms. Cheshier stated that each board member has the ability to explain their vote. She asked when it was appropriate to do so? Mr. Romney stated board members can express their opinions of the findings during the discussion period. An explanation of the vote should be done right before each member votes. Ms. Cheshier asked about the even number of members present statement in the script. When is it appropriate to read? Mr. Romney stated it would be appropriate for any meeting with an even number of members. He reminded the Chair that it is not necessary and is just a courtesy. Ms. Perry introduced Theresa Warren, a new addition to the administrative staff. 3. BOARD COMMENTS AND SUGGESTIONS There were none. 4. NEXT MEETING - THERE ARE NO SCHEDULED WORKSHOPS AT THIS TIME The next regular meeting of the Board of Adjustment is scheduled for January 11, 2024, at 4:00 p.m., in the boardroom of the Glendale Civic Center, located at 5750 W. Glenn Drive, Glendale, Arizona, 85301. 5. ADJOURNMENT Ms. Cheshier called for a motion to adjourn. Mr. Carson motioned to adjourn. Mr. Fiener seconded. All vote "Aye" meeting adjourned at 4:54pm.
