Chair Naber called the meeting to order at 4:03pm.

PUBLIC HEARING ITEMS
1.
VAR24-18 Cebreros Sanchez Residence Attached and Detached Garage:
A request by Sam Fattohy of IGF Design on behalf of Jesus Cebreros Sanchez to allow an
increased height of nineteen feet (19’) where fifteen feet (15’) was approved and a decreased
setback of six feet (6’) where fifteen feet (15’) was required for a detached garage
constructed in 2023. The owner also requests a reduction of the west building setback to ten
feet (10’) where twenty-five feet (25’) is required for a proposed attached RV garage. The site
is located at 5615 North 83rd Avenue, in the Yucca Council District.

Chair Naber polled the board for questions.
Board Member Dagostino inquired about the narrative which stated that there was a
miscommunication between the owner and the builder. Shouldn't the builder have read the
blueprints?
Ms. Schwenner deferred to the client.
Board Member Feiner asked to see the opposing properties on the map.
Ms. Schwenner brought up the map and showed the locations.
Board Member Gee asked what the height of the stable directly south of the property was.
Ms. Schwenner stated that the neighboring structures were not measured, but she was
present when the client's structure was measured. The neighbor's structure appeared to be
lower than the clients.
Board Member Gee asked for all differences in height and set back between the construction
documents and the built structure.
Ms. Schwenner stated it was the height.
Board Member Gee asked if the height was over at the peak or eave of the roofline?
Ms. Schwenner replied both.
Board Member Gee asked what the height difference was.
Ms. Schwenner stated four feet.
Chair Naber asked if the Board was considering two separate requests or one.
Ms Schwenner replied that the board could do either.
Deputy City Attorney Russ Romeny asked if the board would like them separated.
Chair Naber affirmed they would like the votes separate.
Chair Naber asked the client if they would like to present.
The client declined.
Chair Naber opened the public hearing.

VAR25-02 Kramer Residence: A request by Donald Kramer to reduce the front building
setback from fifteen feet (15’) to ten feet (10’) for a livable addition. The site is located at the
southeast corner of 55th Avenue and Greenway Road, 5350 West Acapulco Lane, in the
Sahuaro District.

Chair Naber polled the Board for questions.
Board Member Dagostino asked if the use was going to be for ADA/disability occupants?
Ms. Tirella stated that the plan is to be built in compliance with ADA standards for future use.
Board Member Feiner asked what the accessory structures on the property were.
Ms. Tirella stated that one was a pergola and the other a storage shed.
Board Member Gee asked about the lot coverage. The staff report states it does not exceed
40%, but what is it.
Ms. Tirella replied that the property is currently at 32% coverage; the 400-square-foot
addition would put it at 37%, which is comparable to homes in the neighborhood.
Chair Naber asked the applicant to present.
Mr. Kramer presented.
Chair Naber polled the board for questions from the applicant.
Board Member Dagostino asked to verify the square footage.
Mr. Kramer stated the addition would be 23 feet by 20 feet.
Chair Naber opened the public hearing.
Two attendees spoke in favor of the request.
Chair Naber closed the public hearing.
Chair Naber polled the board for any final questions.
Board Member Dagostino asked about the square footage, stating the project details list the
addition to be 650 square feet and the client stated 23 X 20, which would be 460 square
feet.
Mr. Kramer confirmed the request was for a 23 X 20 or 460 square-foot addition.

VAR25-04 Barnes Residence: A request by Kevin Barnes to reduce the minimum West
side accessory structure setback from ten feet (10’) to five feet (5’) and reduce the minimum
rear accessory structure setback from fifteen feet (15’) to eleven feet (11’) in the A-1
(Agricultural) zoning district. The site is located at the northeast corner of 55th Avenue and
Greenway Road, 5336 West Beck Lane, in the Sahuaro District.

Chair Naber polled the board for questions.
Board Member Dagostino asked what the height requirements were in this area.
Ms. Tirella stated the zoning on this property is 20 feet. The request is lower than the
requirement.
Board Member Feiner asked what the benefit to the applicant was for changing the setbacks.
Ms. Tirella deffered to the applicant.
Chair Naber asked if there were any structures in the neighborhood with similar setbacks.
Ms. Tirella stated that there are similar structures in the area with varying setbacks that
predate the adoption of the UDC code.
Chair Naber asked the applicant to present.
The client presented.
Chair Naber polled the board for questions to the client.
There were no questions for the applicant.
Chair Naber polled the board for final questions.
Board Member Gee asked if this application had been submitted before the adoption of the
UDC would a variance have been needed.
Ms. Tirella stated that she did not know, because she did not know the eave height of the
proposed structure.
Mr. Barnes added that the setback would have been five feet.
