AN ORDINANCE OF THE MAYOR AND COUNCIL OF THE CITY OF GOODYEAR, MARICOPA 
COUNTY, ARIZONA, APPROVING THE TRANSFER OF APPROXIMATELY 1.501 ACRES OF 
RIGHT-OF-WAY, GENERALLY LOCATED WITHIN THE NORTH HALF OF THE WEST 
ROOSEVELT STREET ALIGNMENT WEST OF NORTH CITRUS ROAD, APPROVING THE 
TRANSFER OF SUCH RIGHT-OF-WAY, AND EXTENDING AND INCREASING THE 
CORPORATE LIMITS OF THE CITY OF GOODYEAR.

WHEREAS, Arizona Revised Statutes ("A.R.S.") § 9-471(O) provides that as an alternative to 
annexation procedures a county right-of-way or roadway may be transferred to an adjacent city 
or town by mutual consent of the governing bodies of both the county and the city; and, 
WHEREAS, the right-of-way consists solely of county right-of-way or roadway and the entire 
length of the right-of-way is adjacent to the corporate boundaries of the city of Goodyear; and,  
WHEREAS, the right-of-way to be transferred pursuant to this Ordinance is fifteen (15) feet in 
width, generally located within the north half of the West Roosevelt Street alignment and west of 
North Citrus Road, for approximately 1.501 acres, and is legally described in Exhibit A and 
depicted on Exhibit B, attached hereto and incorporated herein by this express reference; and, 
WHEREAS, pursuant to A.R.S. § 9-471(O), the transfer of the right-of-way and annexation to the 
city of Goodyear is subject to approval by the Maricopa County Board of Supervisors at a future 
public meeting and upon approval by the city of Goodyear and the Maricopa County Board of 
Supervisors the property so transferred shall be treated as though it were newly annexed territory; 
and, 
WHEREAS, this Ordinance has been acted upon as published agenda item at a regular public 
meeting of the Council. 
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF 
GOODYEAR, MARICOPA COUNTY, ARIZONA, AS FOLLOWS: 
SECTION 1. 
TRANSFER AND ANNEXATION 
That the approximately 1.501 acres of right-of-way, generally located within the 
north half of the West Roosevelt Street alignment and west of North Citrus Road 
described in Exhibit A – Legal Description and depicted in Exhibit B – Annexation 
Map, (the “Property”) both of which are attached hereto and incorporated herein, 
is hereby annexed into the city of Goodyear; and, upon approval of the transfer 
by the Maricopa County Board of Supervisors in conformance with the 
requirements of A.R.S. § 9-471(O), the corporate limits of the city of Goodyear 
are hereby extended and increased to include within the corporate limits of the 
city of Goodyear the Property, and said Property is hereby declared to be part of 
the city of Goodyear, Arizona. 
SECTION 2. 
COUNTY CONSENT 
A certified copy of this Ordinance and exhibits shall be filed with the Board of 
Supervisors of Maricopa County, Arizona for the Board of Supervisors’ action on

the transfer pursuant to A.R.S. § 9-471(O). The city clerk shall, upon the approval 
of the transfer by the Maricopa County Board of Supervisors, take all appropriate 
and necessary actions to finalize the annexation/transfer of the right-of-way 
approved hereby. 
SECTION 3 
RECORDING 
A copy of this ordinance and all exhibits referred to herein, shall be filed and 
recorded in the office of the County Recorder of Maricopa County, Arizona and 
a copy of this Ordinance and all exhibits referred to herein shall be provided to 
the Clerk of the Board of Supervisors of Maricopa County, Arizona. 
SECTION 4. 
SEVERABILITY 
If any section, subdivision, sentence, clause, phrase or portion of this Ordinance 
is for any reason held invalid or unconstitutional by any court of competent 
jurisdiction, such portion shall be deemed a separate, distinct, and independent 
provision and such holding shall not affect the validity of the remaining provisions 
of the ordinance or parts thereof. 
SECTION 5. 
EFFECTIVE DATE 
This Ordinance shall become effective as prescribed by law.
