ROLL CALL - LISTA
The Board of Supervisors of Maricopa County, Phoenix, Arizona, convened in Formal Session at 
9:30 AM on Wednesday, June 8, 2022, in the Supervisors' Auditorium, 205 W. Jefferson Phoenix, 
AZ 85003, with the following members present:  Bill Gates, Chairman, District 3; Clint Hickman, 
Vice Chairman, District 4; Thomas Galvin, Supervisor, District 2; Steve Gallardo, Supervisor, 
District 5 (entered late). Absent:  Jack Sellers, Supervisor, District 1. Also present: Juanita Garza, 
Clerk; Joy Rich, County Manager; Andrea Cummings, Legal Counsel (remote); Kelly Gardiner, 
Minutes Coordinator.

INVOCATION - INVOCACIÓN
Chairman Gates introduced Supervisor Sellers’ guest from District 1, OD Harris, 
Councilmember, City of Chandler. Chairman Gates shared Councilmember Harris’ 
many accomplishments and said Supervisor Sellers admired him for his energy and 
inclusive approach to Chandler’s very diverse community. Councilmember Harris 
offered the invocation.
3.
PLEDGE OF ALLEGIANCE - JURO FIDELIDAD A LA BANDERA
Councilmember Harris led the assemblage in the Pledge of Allegiance to the flag.
PRESENTATION - PRESENTACIONES
Chairman Gates acknowledged 25 years of service by Joy Rich, County Manager, to 
Maricopa County. A brief video created by the Board members was projected in the 
auditorium, expressing their appreciation for all she had done for each of them and 
Maricopa County.
Supervisor Gallardo noted that Ms. Rich approached government in a similar way as 
he does by saying the answer is “yes” unless a “no” is necessary. He remarked she 
responds in a positive manner to anything she is asked to accomplish and has helped 
the Board navigate the politics of Maricopa County.
Supervisor Galvin added that what he has seen in his six months as a Supervisor is 
how much Ms. Rich cares about the employees of Maricopa County.
Supervisor Hickman stated he often reflects on how difficult it must be to have five 
bosses. He said he is proud to have been part of the decision to hire Ms. Rich and 
acknowledged the sacrifices she has made for the benefit of Maricopa County.
Chairman Gates noted how well Ms. Rich understands politics and does a great job as 
County Manager. He said the bottom line is that Ms. Rich is the CEO of this 
organization, and he particularly appreciates the way Ms. Rich leads and motivates the 
County employees.
Joy Rich stated that 25 years ago when she was hired at Maricopa County, she thought 
she was just passing through. When she realized how much the County does and the 
amazing people she has had the opportunity to work with, she knew it was a once in a 
lifetime opportunity. She added she is very proud to work for this Board and often 
shares with people outside of the County how proud she is to work for this elected 
Board.

Supervisor Gallardo added that Ms. Rich is the first woman to serve as the County 
Manager and she also has an all-female leadership team.
The Chairman presented Ms. Rich with a 25 year pin and a group picture was taken in 
front of the dais.

John Reynolds with Animal Care and Control introduced Cole, a year-and-a-half old 
dog that loves to go on walks and meet new people. Cole is a little nervous around 
other dogs, so it would be important to have a slow introduction or professional dog 
training to help Cole transition smoothly. He is neutered, vaccinated, and registered all 
for a $25 adoption fee.
Chairman Gates asked the Clerk if there were any announcements or corrections to the 
agenda.
The Clerk said there were none.

Request:
Military Compatibility Permit (MCP) with Plan of Development (POD) for an 
RV and boat storage facility in the C-2 MAAMF zoning district 
Site Location:  Generally located at the southeast corner of 137th Ave. and Glendale Ave. 
(APN#501-57-933D)
Commission Recommendation:  On 5/12/22, the Commission voted 9-0, to recommend 
approval of MCP2020003 subject to conditions ‘a’ – ‘k’:    
a. Development of the site shall be in substantial conformance with the Site Plan entitled, 
“Freedom RV & Boat Storage” consisting of three full-size sheets dated March 17, 2022, and 
stamped received April 2, 2022, except as modified by the following conditions.
b. Development of the site shall be in substantial conformance with the Narrative Report 
entitled, “Freedom Boat & RV Storage”, consisting of 14 pages, dated, revised March 28, 
2022, and stamped received April 2, 2022, except as modified by the following conditions.
c. Development of the site shall be in substantial conformance with the Landscape Plan, 
consisting of 6 pages, entitled “Freedom Boat & RV Storage” dated December 7, 2021, and 
stamped received April 2, 2022, except as modified by the following conditions.
d. The Military Compatibility Permit shall be limited to the following uses: 
1. Recreational vehicle and boat storage facility with associated office space
2. Mini warehouse self-storage facility
e. The following Planning Engineering conditions shall apply: 
1. At the time of the Building Permit, retention basins must drain within 36-hours.
2. At the time of application for building permits, the owner/applicant must demonstrate that 
Retention Basin C and the existing underground retention basin contains the required 
volume to store the runoff from their contributory areas.  The construction plans must 
demonstrate how runoff enters the underground retention basin via Retention Basin C.
3. At the time of the Building Permit, the plans must be updated per the Traffic Study for the 
current MCP with POD.  
4. At the time of the Building Permit, the steepest side slopes of the retention basin is 4:1. 
Update the contour lines around the headwall in Retention Basin B to be 4:1.  The pipe length 
may need to be extended.
5. The length of longest flow path for the ration method could not be duplicated.  In the 
Building Permit Review, re-evaluate the length of longest flow path and provide them on the 
On-Site Map.  
6. At the time of the Building Permit, the curb openings must be sized according to the 100-
year peak flow rate.
7. Any work within the City of Glendale R/W will require a City of Glendale R/W Permit.
8. Drainage review of planning and/or zoning cases is for conceptual design only and does 
not represent final design approval nor shall it entitle applicants to future designs that are not

in conformance with Section 1205 of the Maricopa County Zoning Ordinance and the 
Maricopa County Drainage Policies and Standards.
9. All development and engineering design shall be in conformance with Section 1205 of the 
Maricopa County Zoning Ordinance and current engineering policies, standards and best 
practices at the time of application for construction.
f. All buildings are subject to noise attenuation as per ARS § 28-8482(B). 
g. The following Military Airport and Ancillary Military Facility Overlay Zoning District 
standards shall apply: 
1. Lot Width – 30’
2. Screening – A solid wall, not less than 6’ in height, shall be required along and adjacent 
to any side or rear property line abutting any rural or residential zone boundary except sides 
abutting property boundaries interior to the site
3. Landscaping – 5’ landscaping strip not required with approval of landscaping plan
4. Loading Spaces Required – None required
h. Artisan Holdings, LLC shall notify future occupants/tenants that they are located within the 
High Noise or Accident Potential Zone of Luke Air Force Base with the following language:
Luke Air Force Base executes an average of approximately 165 overflights per day. Although 
Luke’s primary flight paths are located within 20 miles from the base, jet noise will be 
apparent throughout the area as aircraft transient to and from the Barry M. Goldwater 
Gunnery Range and other flight areas.
Luke Air Force Base may launch and recover aircraft in either direction off its runways 
oriented to the southwest and northeast. Noise will be more noticeable during overcast sky 
conditions due to noise reflections off the clouds.
Luke Air Force Base’s normal flying hours extend from 7:00 a.m. until approximately 
midnight, Monday through Friday, but some limited flying will occur outside these hours and 
during most weekends.

Planning and Development Department.”
i. Noncompliance with any Maricopa County Regulation shall be grounds for initiating a 
revocation of this Military Compatibility Permit as set forth in the Maricopa County Zoning 
Ordinance. 
j. The property owner/s and their successors waive claim for diminution in value if the County 
takes action to rescind approval due to noncompliance with conditions. 
k. The granting of this change in use of the property has been at the request of the applicant, 
with the consent of the landowner.  The granting of this approval allows the property to enjoy 
uses in excess of those permitted by the zoning existing on the date of application, subject 
to conditions.  In the event of the failure to comply with any condition, and at the time of 
expiration of the Military Compatibility Permit, the property shall revert to the zoning that 
existed on the date of application.  It is, therefore, stipulated and agreed that either revocation 
due to the failure to comply with any conditions, or the expiration of the Military Compatibility 
Permit, does not reduce any rights that existed on the date of application to use, divide, sell 
or possess the property and that there would be no diminution in value of the property from

the value it held on the date of application due to such revocation or expiration of the Military 
Compatibility Permit.  The Military Compatibility Permit enhances the value of the property 
above its value as of the date the Military Compatibility Permit is granted and reverting to the

Site Location:  Approximately 530’ east of the SWC of German Rd and Lindsay Rd in the 
Gilbert area
Commission Recommendation:  On 5/12/22, the Commission voted 9-0, to recommend 
approval of Z2021118 subject to conditions ‘a’ – ‘h’:
a. Development of the site shall be in substantial conformance with the Zoning Exhibit 
entitled “Shappell & Germann Road”, consisting of 1 full-size sheet, dated November 4, 
2021, and stamped received November 23, 2021, except as modified by the following 
conditions. 
b. Development of the site shall be in substantial conformance with the Narrative Report 
entitled “Rezone with Overlay Narrative for Germann 4”, consisting of 7 pages, dated 
February 2022, and stamped received February 8, 2022, except as modified by the following 
conditions.
c. CUPD Overlay shall prohibit the following uses:
1. Adult oriented facilities
2. Bars
3. Drive-in or drive-thru restaurants
4. Retail sales of gas (butane or propane)
5. Liquor stores
6. Recreation centers with pool halls or billiards

1. Drainage review of planning and/or zoning cases is for conceptual design only and does 
not represent final design approval nor shall it entitle applicants to future designs that are not 
in conformance with Section 1205 of the Maricopa County Zoning Ordinance and the 
Maricopa County Drainage Policies and Standards.  No entitlement is inferred by this review.
2. All development and engineering design shall be in conformance with Section 1205 of the 
Maricopa County Zoning Ordinance and current engineering policies, standards and best 
practices at the time of application for construction.
3. Any site development must include a grading and drainage plan prepared by a licensed 
civil engineer in accordance with Drainage Review Requirements for Precise Plans (Planning 
Phase) and the Engineered Plan Submittal Requirements (Building Phase).
4. The site is not located in a Special Flood Hazard Area.  The Flood Control District has no 
comments on this application.
5. A Traffic Impact Study to address traffic impacts and roadway improvements required to 
support the proposed development must be submitted with the Plan of Development 
application(s) or other future entitlement applications.  Applicant to contact the Town of 
Gilbert to coordinate any offsite improvements within their jurisdiction along Germann Road.
6. The subject premise is NOT located within the County’s Urbanized Area.  A Storm Water 
Pollution Prevention Permit (SWPPP) is not required for the development of this site.
e. Prior to the initial precise plan of development approval, the applicant shall provide the 
Maricopa County Planning and Development Department with an executed pre-annexation 
service agreement with the  Town of Gilbert that identifies the detail for when the proposed 
project will be annexed and the provision of water and sewer service.  In lieu of pre-
annexation service agreement the developer must provide a ‘will serve’ letter from the 
certificated water and sewer provider(s).
f. Approval of a Plan of Development will be required prior to approval and issuance of 
construction permits to develop and establish use of the site. Prior to issuance of any building 
permit, written confirmation will be required from the emergency fire protection jurisdiction 
having authority that the facility has been designed in accordance with their regulations and 
requirements, and that emergency fire protection service will be provided to the facility. Prior 
to issuance of the certificate of occupancy, local fire protection jurisdiction review and 
approval will be required.
g. Noncompliance with any Maricopa County Regulation shall be grounds for initiating a 
revocation of this Zone Change as set forth in the Maricopa County Zoning Ordinance. 
h. The granting of this change in use of the property has been at the request of the applicant, 
with the consent of the landowner.  The granting of this approval allows the property to enjoy 
uses in excess of those permitted by the zoning existing on the date of application, subject 
to conditions.  In the event of the failure to comply with any condition, the property shall revert 
to the zoning that existed on the date of application.  It is, therefore, stipulated and agreed 
that either revocation due to the failure to comply with any conditions, does not reduce any 
rights that existed on the date of application to use, divide, sell or possess the property and

Chairman Gates announced just prior to item 16 that item 6 would be reconsidered 
because there was a misunderstanding in technology and a representative from the 
Town of Gilbert would like to speak.

Thomas Galvin.

Kyle Mieras, Development Services for the Town of Gilbert, spoke in opposition. Mr. 
Mieras said town staff was opposed to the rezoning request because it is in opposition 
to the Town of Gilbert’s General Plan which is a future annexation of this property into 
the Town for commercial development. If the Board does approve the rezoning, the 
Town of Gilbert respectfully requests that billboards not be allowed on the site.
Supervisor Hickman expressed concern with this turn of events and knows it is 
important for District 1 Supervisor Sellers to be present and part of this process.
Motion to continue item 6 to the June 22, 2022, meeting by Supervisor Clint Hickman, 
seconded by Supervisor Thomas Galvin

ARLINGTON VALLEY SOLAR ENERGY

Special Use Permit (SUP) Modification of Conditions of case Z2009063, as 
amended via Z2012043, Z2013102 and Z2016059, to modify condition ‘j’ to preserve ROW 
for 395th Ave, and modify condition ‘x’ to extend the SUP to 5/11/2027 
Site Location:  Generally located 7,900 feet south of the SWC of Elliot Rd. & 387th Ave. in 
the Arlington area.
Commission Recommendation:  On 5/12/22, the Commission voted 9-0, to recommend 
approval of Z2022015 subject to conditions ‘a’ – ‘bb’: 
a. Development of the site shall be in substantial compliance with the Site Plan entitled 
"Arlington Valley Solar Energy, LLC", consisting of twelve (12) full-size sheets, dated 
February 22, 2022, and stamped received February 28, 2022, except as modified by the 
following conditions. Staff may determine slight refinements to remain in substantial 
conformance with the approved site plan. Minor and major amendments to the site plan will 
be determined in accordance with Chapter 3 of the Maricopa County Zoning Ordinance.

b. Development of the site shall be in substantial conformance with the Narrative Report 
entitled "Arlington Valley Solar Energy project Narrative Report", consisting of 35 pages, 
dated February 11, 2022, and stamped received February 28, 2022, except as modified by 
the following conditions.
c. Any special events as described in the narrative report shall be limited to 30 people. The 
groundbreaking event will exceed this maximum number; however, the developer will make 
provisions for off-site parking and shuttle service.
d. Prior to zoning clearance for any permit, legal access documentation shall be provided for 
both the main and emergency access points.
e. To the extent possible, the applicant shall accommodate Maricopa County's regional trail 
system which traverses their site generally along the 387th Ave. alignment adjacent to 
Winters Wash as may be deemed necessary by Maricopa County Parks.
f. Any existing vegetation along 395th Avenue shall be maintained through construction and 
revegetation efforts shall be generally consistent with the vegetation along the west side of 
said alignment.
g. Revegetation along and within Winters Wash shall be consistent with the US Army Corps 
of Engineers permitting requirements. In the event that this permit is not pursued, 
revegetation along Winters Wash shall be consistent with the Arlington Valley Energy Land 
Management Plan approved with CPA200004.
h. All trees shall be double staked when installed.
i. All transformers, back-flow prevention devices, utility boxes and all other utility related 
ground mounted equipment shall be painted to complement the development and shall be 
screened with landscape material where possible. All HVAC units shall be ground-mounted 
or screened with a continuous parapet.
j. Preservation of a right-of-way area to bring the total half-width to 65’ for 395th Ave. shall 
be maintained in project design.
k. Prior to zoning clearance, the applicant/property owner shall obtain the necessary 
encroachment permits from the Maricopa County Department of Transportation [MCDOT) 
for landscaping or other improvements in the right-of-way.
l. The following Maricopa County Environmental Services [MCESD) stipulations shall be met:
1. Prior to issuance of the first facility building permit, all required permits for any required 
drinking water, sanitary, and industrial wastewater permits by MCESD and ADEQ must be 
submitted to the appropriate agency.
2. No facility operation can begin prior to the approval of the above permits (issuance of an 
Approval to Construct) and a construction approval (Approval of Construction) of the required 
facilities signed by MCESD.
m. All outdoor lighting shall conform to the Maricopa County Zoning Ordinance.
n. Development of the site shall· be in compliance with all applicable Maricopa County Air 
Quality rules and regulations.

o. An archeological survey shall be submitted to and approved by the Arizona State Historic 
Preservation Office prior to issuance of a grading permit. The applicant must contact the 
State office prior to initiating disturbance of the site. The applicant shall provide the Planning 
and Development Department with written proof of compliance with this stipulation prior to 
zoning clearance for any building permits.
p. All development and engineering design shall be in conformance with Section 1205 of the 
Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain 
Regulations for Maricopa County; MCDOT Roadway Design Manual; and current 
engineering policies, standards and best practices at the time of application for construction. 
q. As part of the building permit process, a Floodplain Use Permit will need to be obtained 
from the Floodplain Management and Services Division of the Flood Control District.
r. Development and use of the site shall comply with requirements for fire protection 
measures as deemed necessary by the Arizona Fire & Medical Authority. Prior to issuance 
of zoning clearance, the applicant shall seek review and comment from the applicable fire 
protection agency, and shall provide written confirmation that the site will be developed in 
accordance with their requirements. 
s. The applicant or his successor shall obtain approval of any development plans from the 
applicable Fire Marshall prior to any construction. 
t. This Special Use Permit shall expire forty (40) years from the date of approval by the Board 
of Supervisors, or upon expiration of the lease to the applicant, or upon termination of the 
use, whichever occurs first. All of the site improvements shall be removed within 90 days of 
such termination or expiration. 
u. The applicant shall submit an annual written report from the date of approval by the Board 
of Supervisors. The status report shall be reviewed by staff to determine whether the Special 
Use Permit remains in compliance with the approved stipulations including maintenance of 
drainage facilities. 
v. Amendments to the site plan and narrative report shall be processed as a revised 
application in accordance with Maricopa County Zoning Ordinance Article 304.9.
w. Noncompliance with the conditions of approval will be treated as a violation in accordance 
with the Maricopa County Zoning Ordinance. Further, noncompliance of the conditions of 
approval may be grounds for the Planning and Zoning Commission to take action in 
accordance with Chapter 3 (Conditional Zoning). 
x. If a building permit for the facility has not been issued by May 11,2027, this SUP and the 
related Comprehensive Plan Amendments (CPA200808, CPA2009016, CPA200917, and 
CPA200919) will be scheduled for public hearing by the Maricopa County Board of 
Supervisors, upon recommendation by the Maricopa [County] Planning and Zoning 
Commission, to consider reverting the zoning to Rural-190 and the related land use 
designations to Open Space and Rural respectively. Additionally, in the event of reversion, 
the Land Management Plan associated with CPA200004 shall be implemented.
y. The granting of this change in use of the property has been at the request of the applicant, 
with the consent of the landowner. The granting of this approval is temporary and allows the 
property to enjoy uses in excess of those permitted by the zoning existing on the date of 
application, subject to conditions and stipulations. In the event of the failure to comply with 
any condition or stipulation, and at the time of expiration of the Special Use Permit, the 
property shall revert to the zoning that existed on the date of application. It is, therefore,

stipulated and agreed that either revocation due to the failure to comply with any conditions 
or stipulations, or the expiration of the Special Use Permit, does not reduce any rights that 
existed on the date of application to use, divide, sell or possess the property and that there

application due to such revocation or expiration of the Special Use Permit. The Special Use 
Permit enhances the value of the property above its value as of the date the Special Use 
Permit is granted and reverting to the prior zoning results in the same value of the property 
as if the Special Use Permit had never been granted.
z. Non-compliance with the regulations administered by the Maricopa County Environmental

neighbors on a modified project with a lower density.  On February 18, 2022 the applicant 
requests another request of continuance for these cases until the March 9, 2022 BOS 
Hearing.  On February 23, 2022, the Board voted to continue DMP2021001 and Z2021050 
to the March 9, 2020 BOS Hearing.  On March 8, 2022, the applicant requested another 
continuance for these cases to the June 8, 2022 to provide additional time to review the 
proposed changes to ensure the development continues to be compatible with the 
surrounding area, work with County Staff, and continue working with the neighbors.  On 
March 9, 2022, the Board voted to continue DMP2021001 & Z2021050 to the June 8, 2022 
BOS Hearing.
January through April of this year, the applicant met with opposition leaders to discuss the 
proposed project modifications including a reduced lot yield from the Commission 
recommended 770 (3.14 du/ac) to 654 (2.63 du/ac). 
In review of the modified Phase 3 amendment, staff offers the following modifications to the 
Commission recommended DMP2021001 conditions ‘a’ – ‘v’ with revisions to conditions ‘a’, 
‘f’ and ‘i’:  
a. Development shall comply with the Development Master Plan Narrative Report  entitled 
“White Tank Foothills”, dated May 10, 2022, and stamped received May 11, 2022, including 
all exhibits, maps, and appendices, except as modified by the following conditions.
b.  Changes with regard to use and intensity, or changes to any of the approved conditions 
shall be processed as a revised application with approval by the Board of Supervisors upon 
recommendation by the Maricopa County Planning and Zoning Commission. Revised 
applications shall be in accordance with the applicable Development Master Plan Guidelines, 
subdivision regulations, and zoning ordinance in effect at the time of application(s) 
submission. The Maricopa County Planning and Development Department may approve 
minor changes as outlined in the Maricopa County Development Master Plan Guidelines in 
effect at the time of amendment. Non-compliance with the narrative report, maps, and 
exhibits, or the conditions of approval will be treated as a violation in accordance with 
Maricopa County Procedures. 
c. The master developer shall be responsible for the construction of all public and private on-
site roads within the Development Master Plan. Further, the applicable homeowner’s 
association shall be responsible for the maintenance and upkeep of all private roads, public 
open spaces and facilities, washes, parks, roadway median landscaping, landscaping within 
public rights-of-way, and all pedestrian, bicycle, and multi-use paths. 
d. Landscaping of all common areas and open spaces, except for identified recreational 
areas shall consist of indigenous and or low water use species.
e. The Development Master Plan shall be developed sequentially as depicted on the phasing 
diagram contained in the narrative report. 
f. The total number of residential dwelling units of White Tank Foothills Phase 3 shall not 
exceed 654 dwelling units.  Overall, the total number of residential dwelling units for the 
entire White Tank Foothills master community shall not exceed 1,621 dwelling units. To help 
ensure compliance, the cumulative number of dwelling units completed to date, in relation to 
the identified limit, shall be identified on all plats.

g. The master developer shall notify all future residents that they are not located within an 
incorporated city or town, and therefore will not be represented by, or be able to petition a 
citizen-elected municipal government. Notification shall also state that residents will not have 
access to municipally managed services such as police, fire, parks, water, wastewater, 
libraries, and refuse collection. Such notice shall be included on all final plats, be 
permanently posted on the front door of all home sales offices on not less than an 8-½ by 
11-inch sign, and be included in all homeowner association covenants, conditions, and 
restrictions (CC&Rs).  
h. All park facilities shown on plats shall be completed concurrently with residential 
development. Park facilities and amenities shall be identified on all applicable plats. 
i. Not less than 50.36 acres shall be reserved for active and passive open space. Further, 
the project shall have not less than five pocket parks and one off-site park as depicted on 
the parks plan exhibit in the narrative. Further, not less than six pocket parks and off-site 
park shall be provided. At the time of each preliminary plat submission, the master developer 
shall include a description of the status of the cumulative open space acreage and park 
numbers with respect to the requirements of this condition. A description of the types of 
recreational amenities that will be included in the pocket parks and off-site park shall be 
submitted with all preliminary plats. 
j. Unless otherwise agreed to in writing by the applicable school districts, not less than 15-
acre school site and a minimum of 15 acres shall be reserved. Said school shall not front on 
to arterial streets. 
k. Development phasing shall assure two access points are provided. 
l. Bike lanes shall be required on all arterial and collector streets as specified in the Maricopa 
County Bicycle Transportation System Plan. 
m. Prior to approval of the final plat, a total half-width 65-foot right-of-way shall be dedicated 
for Citrus Rd. and Northern Ave. 
n. Prior to approval of the final plat, a total half-width 55-foot right-of-way shall be dedicated 
for Perryville Rd. with a ten-foot roadway and utility easement shall be provided adjacent to 
the right-of-way. 
o. Prior to approval of each applicable final plat of any subdivision within a phase containing 
Olive Ave., the developer will be obligated to construct (or post the necessary financial 
assurances) the ultimate half-width roadway for the extent of Olive Ave. in that phase. 
p. Prior to approval of each applicable final plat of any subdivision within a phase containing 
Citrus Rd., the developer will be obligated to construct (or post the necessary financial 
assurances) the ultimate half-way width roadway for the extent of Citrus Rd., in that phase. 
q. Prior to approval of each applicable final plat of any subdivision within a phase containing 
Perryville Rd., the developer will be obligated to post a five-year performance bond (in the 
amount of the total estimated construction costs) for a half-width roadway for the extent of 
Perryville Rd. in that phase. 
r. Prior to approval of each applicable final plat of any subdivision within a phase containing 
Northern Ave., the developer will be obligated to construct or post a five-year performance 
bond (in the amount of the total estimated construction costs) for a half width roadway for 
the extent of Northern Ave. in that phase.  Prior to expiration of the bond, Maricopa County 
will determine the necessity for the roadway and developer’s share of the responsibility.

s. The applicant shall provide offsite improvements and related right-of-way as 
recommended in any approved White Tank Foothills Impact Study. 
t. Access points and median openings on all arterial streets shall be consistent with any 
approved White Tank Foothills Impact Study. 
u. Prior to initial Final Plat approval or initial precise plan of development approval, the 
applicant shall submit to the Maricopa County Planning and Development Department 
confirmation of service by City of Surprise and verification of approval of a 208 Amendment 
approved by the Maricopa Association of Governments Regional Council. 
v. Any alteration of existing natural washes shall be done in compliance with the rules and 
guidelines set forth by the United States Army Corps of Engineers. (C-44-22-099-X-00)
Chairman Gates asked the Clerk if there were any registered speakers or comments 
for items 9 - 10. 
The Clerk said speaker forms in opposition were received from Frank Scaglione, Nancy 
Rosenberg, Jim Ehinger, Dean Schwab. None of those individuals were present to 
speak. Additionally, 78 comments in opposition were received and two in favor.
Supervisor Hickman reviewed the items and said he appreciated that the applicant has 
modified his request and is seeking to alleviate community opposition. The project 
modifications have lowered the proposed density, restricted building heights, and 
redesigned traffic circulation. Supervisor Hickman said he believes this needs to be 
remanded back to the Planning and Zoning Commission to discuss the project 
modifications and to provide the Board with an updated recommendation. He said he 
hopes the applicant and the neighbors use this time at the Planning and Zoning 
Commission meeting to work out a compromise. Supervisor Hickman said he 
appreciates all the participation. 
Supervisor Hickman made a motion that item 9, case # DMP2021001 and item 10, case 
# Z2021050, White Tank Foothills Phase 3 be remanded to the Planning and Zoning

c. The following Planning Engineering condition shall apply: 
1. Engineering review of re-zone cases is conceptual in nature. All development and 
engineering design shall be in conformance with Section 1205 of the Maricopa County 
Zoning Ordinance; Drainage Policies and Standards; Floodplain Regulations for Maricopa 
County; MCDOT Roadway Design Manual; and current engineering polices, standards and 
best practices at the time of application for construction.    
d. All buildings subject to noise attenuation as per ARS § 28-8482(B). 
e. The master developer shall notify future homeowners that they are located within the state-
defined “territory in the vicinity of a military airport” with the following language:
"You are buying a home or property in the ‘vicinity of a military airport’ as described by State 
of Arizona statute ARS §28-8481. Your house should include sound attenuation measures 
as directed by State law. You will be subject to direct over flights and noise by Luke Air Force 
Base jet aircraft in the vicinity.
Luke Air Force Base executes over 200,000 flight operations per year, at an average of 
approximately 170 overflights per day. Although Luke's primary flight paths are located within 
20 miles from the base, jet noise will be apparent throughout the area as aircraft transient to 
and from the Barry M. Goldwater Gunnery Range and other flight training areas.

Luke Air Force Base may launch and recover aircraft in either direction off its runways 
oriented to the southwest and northeast. Noise will be more noticeable during overcast sky 
conditions due to noise reflections off the clouds.
Luke Air Force Base's normal flying hours extend from 7:00 a.m. until approximately 
midnight, Monday through Friday, but some limited flying will occur outside these hours and 
during most weekends.”
Such notification shall be recorded on all Final Plats, be permanently posted on not less than 
a three foot by five foot sign in front of all home sales offices, be permanently posted on the 
front door of all home sales offices on not less than an 8½ inch by 11 inch sign, and be 
included in all covenants, conditions, and restrictions (CC&Rs) as well as the Public Report 
and conveyance documents.
Such notification shall be recorded on all Final Plats, be permanently posted on not less than 
a 3 foot by 5 foot sign in front of all home sales offices, be permanently posted on the front 
door of all home sales offices on not less than an 8½ inch by 11 inch sign, and be included 
in all covenants, conditions, and restrictions (CC&Rs) as well as the Public Report and 
conveyance documents.
f. The following R1-6 RUPD development standards shall apply:

fourth page of the zoning exhibit entitled “Single Story Restricted Lots” shall be restricted to 
a single-story with a maximum height of 24-feet and the developer shall ensure these 
restrictions match this exhibit and are identified on each plat.
l. There shall be a ten-foot-wide multi-use trail along Northern Ave. outside of the ultimate 
right-of-way and public utility easement. 
m. Noncompliance with any Maricopa County Regulation shall be grounds for initiating a

IRRIGATION WATER DELIVERY DISTRICT
Pursuant to A.R.S. § 48-261, § 48-3423 and § 48-3424, convene the scheduled public 
hearing regarding the petitions filed for the formation of the proposed Tonka Vista Irrigation 
Water Delivery District, as they have been determined to be signed by a majority of the 
owners of the acreage within the proposed district.
Pursuant to A.R.S. § 48-3424, any landowner within the boundaries of the proposed district 
may appear and object to the organization thereof, or to the inclusion of the landowners’ 
property therein. The Board will hear and consider all comments in favor or against the 
organization of the district and decide whether to approve or reject the organization of the 
district within the boundaries proposed in the petition or with modified boundaries.
If the Board decides to proceed with the organization of the district, the Clerk is directed to 
publish a notice and post copies of the notice describing the boundaries of the proposed 
district and fix a date of June 28, 2022, a date not less than 20 days after the publications 
and postings are completed. Written protests against the organization may be filed by owners 
of a majority of the acreage with the proposed district boundaries. If no protest is filed, or if 
one is filed and found insufficient, an order establishing the district shall be entered and will

Pursuant to A.R.S. § 48-261, § 48-3423 and § 48-3424, convene the scheduled public 
hearing regarding the petitions filed for the formation of the proposed Terrace View Trail 
Irrigation Water Delivery District, as they have been determined to be signed by a majority 
of the owners of the acreage within the proposed district.
Pursuant to A.R.S. § 48-3424, any landowner within the boundaries of the proposed district 
may appear and object to the organization thereof, or to the inclusion of the landowners’ 
property therein. The Board will hear and consider all comments in favor or against the

Chairman Gates asked the Clerk if there were any registered speakers or comments 
for item 15. The Clerk said no speaker forms were received for this item however a 
statement in opposition was received from Dave Sinovic that has been shared with the

Board offices. There was also a comment in opposition from Patricia Coughlin, however 
she is not a resident in the proposed Conversion District.
Dave Sinovic, resident, was present and asked to speak in opposition. He reviewed the 
proposed conversion project and said he is opposed because his property is not 
included in the group of homes that would receive power from this conversion. He 
stated he is not opposed to a conversion district itself; he simply does not want to be 
included due to the disruption to his property and the associated cost of $37,000.
  
Virginia O’Malley, the in-house attorney for Salt River Project (SRP) on the conversion 
project, came forward to speak. She talked briefly about the Arizona Revised Statutes 
(ARS) regarding the Underground Conversion and said SRP is not proposing this 
project, they are just the public utility involved.
 
Supervisor Galvin asked Ms. O’Malley when SRP was first approached. She indicated 
the initial petition, created by the neighbors, was filed October 26, 2021. Supervisor 
Galvin asked further questions regarding the background of this conversion project and 
learned that the process is initiated by the neighbors, as allowed by ARS, not SRP. He 
asked if conversions are done frequently? Ms. O’Malley said no. Supervisor Galvin said 
he has concerns about unintended consequences of actions like this. There are 15 
parcels affected, 70% signed the second petition and that leaves several homeowners 
who have not signed and would be subject to the $30,000 - $50,000 impact. Supervisor 
Galvin continued to get information on the impacts.
 
Brady Dressendorfer, Supervisor for Municipal Improvements for SPR, came forward 
to talk about some of the details of the conversion process including the statement that 
Mr. Sinovic could be excluded without jeopardizing the integrity of the Conversion 
District project.
Supervisor Gallardo asked what would happen if the homeowner that did not want to 
be included, was included, and did not pay his share, what would happen. Ms. O’Malley 
said ARS says each homeowner is obligated to pay and a lien is placed on the home 
as part of the process. Supervisor Gallardo asked if there was a provision for a 
homeowner to opt out? Ms. O’Malley said ARS says if the 60% threshold is met, there 
is no opt-out mechanism. The petitioners would need to restart the process without that 
parcel included.
Ms. O’Malley said Mr. Sinovic portion of cost would be $33,786.06 and if he chose to 
opt out, the entire process would need to start over to reapportion costs.
Ms. O’Malley clarified that for a Conversion project like this, if APS is the public utility 
in the area, the process goes through the city that has jurisdiction. If SRP is the public 
utility, the process goes through the Board of Supervisors because SRP is not regulated 
by the Arizona Corporation Commission (ACC).
Supervisor Hickman said he has never seen this type of conversion. He talked about 
unintended consequences and asked about irrigation in the neighborhood and who is 
responsible for ruptured irrigation lines. Ms. O’Malley answered saying subcontractors 
indemnify. 
Mr. Dressendorfer talked about easement issues. SRP (through ARS) requires 
homeowners to grant easement rights in the path that the underground line takes. 
Supervisor Galvin asked about the total cost of this project ($500,000) and is this 
conversion necessary for health and well-being. Mr. Dressendorfer said no, it is not.

Mr. Sinovic came back to the podium and stated no petition was offered to him and he 
objected to having to participate in this cost. He said if he would have been approached 
initially and objected, the remaining residents could have proceeded without his 
property being included.
The Clerk said there were three people on the webinar who wanted to speak in favor: 
Jason Morris, Alex Hays, and Joshua Simon.
 
Alex Hays spoke on behalf of Jason Morris, representing a neighbor who is the 
petitioner. He said the statute has been followed and is in place for a reason. Mr. Hays 
deferred to the next speaker, Joshua Simon.  
Mr. Simon, the petitioner, spoke and wanted to clarify some of the information that had 
been stated so far. Previously, the SRP representative said there can be an “opt out” 
for Mr. Sinovic and that is not accurate. SRP determined the properties that would be 
included which are the ones that “front the street” of the conversion project. This 
includes Mr. Sinovic’s property. He said that conversion district lines will run 
underground on the north side of Exeter; Mr. Sinovic is on the south side and so will 
have minimal disruption.  Mr. Simon spoke about the benefits of the Conversion District 
in terms of monsoon storms, property values and aesthetics.
Supervisor Galvin noted a discrepancy in what SRP had stated and Mr. Simon had 
stated, and he asked to have SRP clarify this.
Mr. Dressendorfer came forward and introduced the Project Lead for Municipal 
Improvements, Vince Sylvester. Mr. Sylvester said that according to ARS, when a 
Conversion District is complete, there cannot be any overhead facilities. To exclude Mr. 
Sinovic would result in overhead facilities remaining on the street. This is the reason he 
has been included to follow statute for the Conversion District. Mr. Simon was the 
leader/petitioner, and he submitted the map that included Mr. Sinovic. Mr. Simon stated 
that he did not submit the names to be added to the petition, SRP provided the names 
based on the properties that front the street of the conversion project. Ms. O’Malley said 
there is a provision in the statute that allows exclusion based on “benefit”. Based on 
ARS 40-346(b), the Board has the latitude to exclude a property. 
Supervisor Galvin said there seems to be some “bones of contention” between Mr. 
Simon and SRP in addition to Mr. Sinovic’s concerns about being included in something 
over his objections. Supervisor Galvin said he is a proponent of personal property rights 
and opposed government imposition. He strongly encouraged all parties to work 
together on a resolution because he would like to see a consensus.

answer. She said a patent easement is abandoned when an applicant asked for it to be 
abandoned and by statute, the process begins. 
Mr. Dixon said his main concern with this action is the potential flooding that may occur 
when the land is disturbed. The surrounding land was purchased by a person who then 
applied for a patent easement abandonment to create a larger parcel to build on. He 
said he was concerned that the new owner will “cut and fill” and change the flood control 
issues and the result could be flooding for Mr. Dixon who lives down the hill from the 
property.

Pursuant to A.R.S. § 11-424.01 (A) fix the salaries of the Constables in 17 justice precincts. 
Pursuant to A.R.S. § 11-424.01 (B), fix the salary of the Constable in Ironwood at sixteen 
thousand five hundred dollars commencing a four-year term on January 1, 2023. The 
average number of documents served over the previous four years is less than 100.  
Pursuant to A.R.S. § 11-424.01 (C)(5), fix the salaries of Constables in Agua Fria, 
Arrowhead, Downtown, East Mesa, Encanto, Hassayampa, Kyrene, Manistee, McDowell 
Mountain, North Valley, San Marcos, South Mountain, University Lakes, West McDowell, 
West Mesa, and White Tank at forty-eight thousand two hundred ninety-four and sixty-seven 
thousand dollars commencing a four-year term on January 1, 2023.  These Constables, upon

VICTIM COMPENSATION FUNDING FROM THE ARIZONA CRIMINAL JUSTICE 
COMMISSION
Approve acceptance of a second additional $50,000 in State grant funds from the Arizona 
Criminal Justice Commission for award VC-22-008. These funds come from the FY2021-
2022 Arizona Crime Victim Compensation program administered by the Arizona Criminal 
Justice Commission. The additional $50,000 raises the State funds received to $657,625 for 
FY2021-2022 and the total grant amount to $1,849,500. The funds will terminate on June 
30, 2022. 
These monies are to be used for the benefit of victims of crime through the Maricopa County 
Victim Compensation Program and cannot be used for indirect costs (Agreement, Page 7, 
Paragraph 35). 
The Maricopa County Attorney's Office's composite indirect cost rate for FY22 is 20.3%, or 
$10,150 of the additional award. The recoverable indirect cost of administering this grant is 
$0; the non-recoverable indirect cost is $10,150. Non-recoverable indirect costs will be

equipment was engineered using a Wright lawn mower platform with a Kawasaki 4-stroke 
Air cooled V-Twin Gasoline Engine and was purchased in preparation for maintenance on 
the twin engine helicopter.   It enables a single person to easily transport a helicopter safely 
and efficiently on the ground for monthly and six-month helicopter maintenance inspections.

The Maricopa County Sheriff’s Office is the Fiduciary of these funds for the County. The 
Maricopa County Sheriff’s Office will receive up to $564,625. The Maricopa County 
Attorney’s Office will receive up to $115,027. 
The Sheriff’s Office funding award is designated for two separate initiatives:  Intelligence 
Initiative (HIDTAISC):  $65,552 and Interdiction Initiative (MCDST): $499,073.  The total 
indirect cost amount for these two initiatives is $83,225.72 ($9,662.36 and $73,563.36). The 
Sheriff Office indirect rate is 14.74% and MCSO will not recover $83,225.72. The County 
Attorney’s funding award is designated for the Investigation Initiative (MISTIC) and its indirect 
rate is 20.3%. The total indirect cost amount for this initiative is $23,350.48 and MCAO will 
not recover $23,350.48.
This funding supports of the Sheriff’s public safety mandate through efforts to reduce illegal 
drug use with the interruption of drug trafficking. The funding is recurring and has been 
awarded to the Sheriff’s Office for over twelve years. There is no matching requirement and 
there are no future or ongoing contributions required after the grant period ends. This is a 
competitive award.
   
Grant revenues are not local revenues for the purpose of the constitutional expenditure 
limitation, and therefore, expenditures of these revenues are not prohibited by the budget

Agreement ADEQ18-182669 between the Maricopa County Air Quality Department 
(MCAQD) and the Arizona Department of Environmental Quality (ADEQ) for ADEQ to 
provide matching funds to MCAQD for the EPA FY22 Arizona State Clean Diesel Grant 
Program. The initial term of this Amendment shall commence on the Effective Date and end 
on December 31, 2023 with an annual Amendment and Work Plan update.
This IGA Amendment will provide matching funds to support MCAQD’s FY22 DERA Work 
Plan to retrofit or replace diesel powered vehicles through annual sub-award agreements 
until December 30, 2023.  An annual Amendment will be required to update the Work Plan 
and any future match funding dollar amounts.  The Work Plan for Amendment 6 will expire 
on December 30, 2023 and will provide for $366,593 in “matching” funds to allow additional 
DERA funding in the amount of $183,297 from the EPA.
Title VII, Subtitle G, Section 793 of the Diesel Emissions Reduction Program (DERA) in the 
Energy Policy Act of 2005 authorizes the U.S. Environmental Protection Agency (EPA) to 
support grant, rebate, and loan programs, administered by eligible states or territories, which 
are designed to achieve significant reductions in diesel emissions.  This program is referred 
to as the State Clean Diesel Grant Program.  The grant program is reoccurring and has been 
awarded to the department in previous years.  Cash, indirect costs or in-kind match are not 
applicable as this amendment is for the “matching” funds required for the state program.  The 
matching funds will be passed thru to sub-recipient(s) and is not subject to indirect cost 
recovery.  The annual grant program is non-competitively bid and is based on population.

THE JODY A. KOSOW IRREVOCABLE TRUST APPROVAL OF ACCOUNTING AND 
RELEASE
Approve and execute documents relating to the upcoming fourth and final distribution of the 
Jody A. Kosow Irrevocable Trust ("Trust"), of which Animal Care & Control is a beneficiary. 
Trustees, Condit and Associates, LLC, have provided documents setting forth the accounting 
and distribution of the Trust, including the Approval of Accounting Release, which require 
the approval and signatures of the beneficiaries prior to final distribution.  Condit and 
Associates, LLC anticipates distributing the fourth and final distribution to Maricopa County 
Animal Care and Control after September 22, 2022, and the distribution of funds is contingent 
upon the approval and execution of these documents by all of the beneficiaries. The fourth 
and final distribution from the Trust to Maricopa County Animal Care & Control will be brought 
separately before the Board for acceptance. 
Donation funds are not local revenues for the purpose of the constitutional expenditure 
limitations and therefore expenditures of these revenues are not prohibited by the budget 
law. The approval of this action requested does not alter the budget constraining the 
expenditure of local revenues duly adopted by the Board pursuant to A.R.S. §42-17105. (C-

NEW HOPE AGREEMENT WITH FOLLOW YOUR HEART FOUNDATION INC.
Approve an agreement between Follow Your Heart Foundation Inc. and Maricopa County, 
administered by Maricopa County Animal Care and Control, to allow said rescue to transfer 
animals that have been deemed eligible for the New Hope program. Maricopa County will 
provide a rabies vaccination, dog license tag, and new owner transfer fee within the first year 
of transfer for each dog three months of age or older at no cost to the Contractor. The cost

for these services is $52 for each animal transferred in FY 2022 and thereafter. Animal Care 
and Control estimates sixty-seven (67) New Hope transfers annually, for a total of $3,484

“Adoption Partner”) for the purpose to help facilitate and provide a location to facilitate 
adoptions of cats and dogs in-store and through special events.  The Adoption Partner 
Agreement will begin upon approval and execution by the Board of Supervisors and may 
terminate, with or without cause, with a thirty (30) days’ written notice to the other party. (C-

In accordance with A.R.S. 42‐17106(B), authorize the following appropriation adjustments to 
the FY2022 Equipment Services budget:
1. Increase the FY 2022 expenditure and revenue budgets for the Equipment Services 
(D740) Equipment Services Fund (654) Operating (OPER) by $2,574,384.
2. Offsetting expenditure and revenue adjustments in the Eliminations (D980) Eliminations 
Fund (900) Operating (OPER) in the amount of $2,419,921.
3. Offsetting expenditure and revenue adjustments in the Eliminations County/Districts 
(D990) Eliminations Fund (900) Operating (OPER) in the amount of $154,463.
This appropriation adjustment is needed to increase the Equipment Services budget to 
account for increased costs related to vehicle fuel and parts.  Budgeted amounts for FY22 
did not account for the substantial increase in prices related to fuel and parts due to the 
current global economic situation.  A detailed financial impact that shows the increases is 
attached to this submission. This action will have a net zero impact on the overall County

Pursuant to Arizona Revised Statutes §41-1279.07(E), each political subdivision shall

ELECTRONIC FUNDS TRANSFER AUTHORIZATION
Pursuant to the Electronic Fund Transfer Policy A2512, the Office of Budget and Finance is 
requesting authorization to have the Treasurer’s Office process Electronic Funds Transfers 
(wire transfers) due to the Trustee(s) for annual debt service payments for certificates of 
participation in the amount of $96,759,207 and pledged revenue obligations in the amount 
of $254,331,294, and other County business as necessary in Fiscal Year 2023. The 
payments have been budgeted. The Office of Budget and Finance requests for authorization 
to the Treasurer’s Office will come from the Chief Financial Officer, Cynthia Goelz, and 
Deputy Finance Director, Bridget Harper.  Debt Service payments require guaranteed funds. 
The Office of Budget and Finance will prepare corresponding journal vouchers to record the 
EFT transactions on the County’s Financial (Accounting) System in the same accounting

        County’s annual HSA contribution amount.

benefit.

FY 22-23 TECHNICAL RATE ADJUSTMENT
1. Approve the revised Medical Benefit rates for active employees for July 1, 2022, through 
December 31, 2023, as outlined in the attached Exhibit A.
2. Approve the revised Dental Benefit rates for active employees for July 1, 2022, through 
December 31, 2023, as outlined in the attached Exhibit B.
3. Approve the revised Vision Benefit rates for active employees for July 1, 2022, through 
December 31, 2023, as outlined in the attached Exhibit C.
The recommended medical, dental, and vision rates were developed by Employee Benefits 
and Wellness, based on actuarial analyses and input from the County’s external benefits 
consultants, for use in the Workday Benefits and Payroll System. Subsequently, it was 
determined that benefit rates and deductions would be managed by the Businessolver 
system as of July 1, 2022, until the implementation of Workday is completed. Businessolver 
calculates bi-weekly premiums using a different rounding methodology which created one-
cent differences for some of the rates.  The one-cent differences have been incorporated

DEVELOPMENT AND TRAINING SERVICES
Approve financial Amendment No. 2 to the Intergovernmental Agreement (“Agreement”) 
between City of Scottsdale (“City”) and Maricopa County (“County”), administered by its 
Human Services Department (MCHSD). The purpose of the Agreement is to integrate the 
County’s workforce development system into the City’s social and community services 
resource network. Service activities shall be delivered within City’s Human Services Vista 
del Camino Center (“Center”) located at 7700 East Roosevelt Street, Scottsdale, Arizona 
85257. A Workforce Development staff will be utilized to provide services under this 
Agreement, as a Workforce Development Coordinator (“WDC”). The Agreement contains 
extension options for two (2) additional 1-year terms. Upon approval of Amendment No. 2, 
no renewal term remains.
The City of Scottsdale will share 50% of the cost of personnel salary and related expenses 
for the administration and operation of the program. 
The purpose of the Amendment No. 2 is to address the following:
A. Extend the Agreement Termination Date from June 30, 2022, to June 30, 2023 
(“Extension Period No. 2”).
B. The City shall compensate the County a not to exceed amount of $51,478 for service 
delivery for the extension period.
C. Add language to paragraph 9.0 (Responsibilities of Organizations).
D. Include Attachment “A” Itemized Service Budget (ISB) to the Agreement as modified for 
the new agreement term.

AMENDMENT TO THE IGA WITH REGIONAL PUBLIC TRANSPORTATION 
AUTHORITY
Approve Amendment No. 4 to the Intergovernmental Agreement “Agreement” with Regional 
Public Transportation Authority (RPTA/Valley Metro) and Maricopa County (County) 
administered by its Human Services Department. RPTA and the County shall be referred to 
as the “Parties.” The purpose of the Amendment is to address the following:
1. The County shall provide RPTA with $282,677 for Paratransit Services and $384,413 for 
RideChoice Services, for a total of $667,090 for the first six months of the period July 1, 2022 
through June 30, 2023. The amounts above are derived by using six months of last FY 2022 
calculations. 
2. The County shall pay the RPTA in (2) quarterly installments of $141,338.50 and 
$192,206.50 for Paratransit Services and RideChoice Services during the first six month 
period. Payment of invoices shall become due within thirty (30) calendar days after receipt 
of an invoice from RPTA. If at any time the costs of this program are projected to exceed the 
six month amount of $667,090, the Parties agree to develop a viable solution to keep the 
service to vulnerable populations operating. The parties agree to adjust the first six month 
FY 2023 projections once the FY 2022 reconciliation is completed. 
3. If it is determined upon the annual reconciliation at year end that Member has underpaid 
its share of the actual cost of services all parties shall refer to Section 6 of the Master 
Agreement regarding annual reconciliation and availability of funds.
4. RPTA shall submit the final invoice no later than August 5, 2023.
5. Amends Schedule A and Schedule B. 
Funding for this Agreement shall be provided by the Human Services Department 
appropriated General Funds and Arizona Lottery funds.

Approve Amendment No. 1 to the Agreement (C-95-22-024-X-00) between Robin Schaeffer 
Consulting, LLC (Contractor) and Maricopa County (County). The Contractor and County are 
sometimes referred to collectively as “Parties” and individually as a “Party.” The purpose of 
the Agreement is to create and implement a nursing workforce practice readiness program 
for senior nursing students. 
The purpose of Amendment No. 1 is to address the following:
1. Revise Contractor Responsibilities to increase the number of nurses to be engaged in pilot 
phase from 50 to 55.
2. Replace Exhibit B (Contractor Information and Program Budget) and incorporate in this 
Agreement. The Exhibit identifies the activities and funding amount to be paid to Contractor.
Acknowledge the Agreement funding amount shall-not-exceed $328,000 for the Agreement 
term.

AMENDMENT TO LICENSE AGREEMENT WITH PORTABLE PRACTICAL 
EDUCATIONAL PREPARATION, INC.
Approve and execute the Amendment No. 1 to financial License Agreement (P-50361) with 
Portable Practical Educational Preparation, Inc. (Licensee), for the access and use of 126 
square feet of allocated space at Maricopa County’s West Valley One Stop Shop Career 
Center located at 4425 West Olive Avenue Glendale, Arizona 85302 (“Facility 3”). 
This Amendment will extend the term of the License Agreement commencing July 1, 2022 
and expiring June 30, 2023. Licensee’s payment for the July 1, 2022 to June 30, 2023 term 
shall not exceed the amount of $2,586. The License Agreement is subject to termination 
pursuant to the provisions of A.R.S. 38-511. Either Lessor or Lessee may terminate the 
License Agreement by giving thirty (30) days prior written notice of termination to the other 
Party.

MESA
Approve and execute Amendment No. 15 to Lease Agreement L-7271, between First 
Presbyterian Church of Mesa (Lessor) and Maricopa County (Lessee), for the use of 1,583 
square feet (SF) of Head Start classroom space located at 161 North Mesa Drive, Mesa, 
Arizona.
This Amendment extends the term of the Agreement from October 1, 2022 through 
September 30, 2027, with an option to renew this Agreement for one additional period of five 
(5) years. The rent for the entire lease term is $1,584.32 per month plus rental tax. Lessor 
authorizes Lessee to make tenant improvements to the Premises, which will ensure licensing 
and Head Start facility requirements are met. The tenant improvements shall not exceed 
$65,000. Funding for this Amendment is provided by Grant No. 09CH012079 (C-22-22-174-
X) funding from the U.S. Department of Health and Human Services  (DHHS)/Administration 
for Children and Families (ACF), Office of Head Start (OHS).
The Lease is subject to termination pursuant to the provisions of A.R.S. 38-511. Either 
Lessor or County may terminate the Agreement by giving no less than ninety (90) days prior 
written notice of termination to the other party.  All other material terms and conditions of the

CLASSROOM SPACE
Approve and execute Amendment No. 9 to Lease Agreement C-6552 with the City of 
Chandler, for the use of 1,341 square feet of the City of Chandler owned recreation building 
and the use of the covered patio and playground area located at 130 N. Hamilton Street, 
Chandler, Arizona. The space is utilized by the Maricopa County Human Services 
Department for the Early Education Division to provide Head Start program services.
The purpose of this Amendment is to address the following: (a) define Premises; (b) renew 
and extend the term of the Lease; (c) provide for a renewal option; (d) and replace 
counterpart language.
The term of the Lease shall be extended for two (2) years to commence on July 1, 2022 and 
expire June 30, 2024, at the rate of $333.33 monthly plus rental tax. Funding for this 
Amendment is provided by Grant No. 09CH012079 (C-22-22-174-X) funding from the U.S. 
Department of Health and Human (DHHS)/Administration for Children and Families (ACF),

Approve a non-financial Intergovernmental Agreement (“Agreement”) with the City of 
Phoenix and Maricopa County administered by its Human Services Department. The City 
and County are sometimes referred to collectively as “Parties” and individually as a “Party.” 
The purpose of the Agreement is for the Parties to providing heat relief services for people 
who are experiencing homelessness during the summer months and during the term of this 
Agreement. 
Services will be provided at a City of Phoenix-owned building located at 2739 East 
Washington Street (“Property”). The County will be responsible for funding and managing 
heat relief and shelter operations at the Property. The City will be responsible for property 
renovations, case management, outreach, navigation, transportation, and intake 
coordination services. Each Party will be solely responsible for all costs associated with the 
performance of its obligations under this Agreement. 
The term of the Agreement is retroactive to May 13, 2022 through October 31, 2022, The 
Agreement may be extended for up to two one-year options upon mutual written consent of 
the Parties. The Agreement is subject to termination pursuant to the provisions of A.R.S. 38-
511.

Approve a financial Intergovernmental Agreement (Agreement) between the City of 
Avondale (City) and Maricopa County (County), administered by its Human Services 
Department, Workforce Development Division for workforce development services. The City 
and the County are collectively referred to herein as the “Parties” and individually as “Party.”
The purpose of this Agreement is to integrate the County’s workforce development system 
into the City’s social and community services resource network. The Parties agree to support 
workforce development and training efforts that will enable the City’s employers to attract 
and retain top talent and to provide adult and youth services. Service activities shall be 
delivered within Arizona Complete Health Resource Center located at 995 E. Riley Dr., 
Avondale, AZ 85323. A Workforce Development staff will be utilized to provide services 
under this Agreement, as a Workforce Development Coordinator (WDC). Additionally, an 
Itinerant Youth Career Advisor will be located at the center 1 day per week.
The Agreement term is July 1, 2022 to June 30, 2024. The City shall compensate the County 
a not to exceed amount of $99,365 ($48,870 FY23; $50,495 FY24) for service delivery.
The Agreement may be extended upon acceptance and approval by the Parties.

EMERGENCY RENTAL ASSISTANCE (ERA1) FUNDS TO THE HUMAN SERVICES 
DEPARTMENT
Request approval and receipt of reallocation of Emergency Rental Assistance (ERA1) funds 
from the U.S. Department of the Treasury. The Department of Treasury awarded funds to 
the State of Arizona through its Department of Economic Security (DES). DES has voluntarily 
agreed to have the Treasury Department reallocate funds in the amount of $30,000,000 to 
Maricopa County administered by its Human Services Department. 
Also request authorization for the Human Services Department Director to submit financial 
and data reports on behalf of the County to the U.S. Department of the Treasury.

The Human Services Department worked with DES to identify the funding need and 
submitted a request on March 29, 2022 to the Department of Treasury to reallocated the 
funds to the County.
The funding will be utilized to assist eligible renter households impacted by the COVID-19 
Pandemic, with direct financial assistance including rent, rental arrears, utilities and home 
energy costs, utilities and home energy costs arears, and other expenses related to housing.

oral health service First Teeth First (FTF) program. The Dignity Community Care FTF

information regarding Contracted Service Unit requirements and mandatory meetings. All

Also, the Scope of Work in Exhibit G is modified in the following manner: Additional column 
to increase funding for the Special Projects scope of work. Exhibit G functions to support 
Community Support and Outreach efforts, including a questionnaire for a data collection. The 
increase in funding is in the amount of $500,000 for the period of performance July 1, 2022 
through December 30, 2022. This amendment is effective upon Board approval. This brings 
the not-to-exceed amount to for both Exhibits D and G to $663,280.

November 1, 2017 through October 31, 2022. The updated price sheet brings the not-to-
exceed amount to $184,883.50 for the budget period of August 1, 2021 through October 31, 
2022. The scope of work has been modified to include the Arizona Heat-Related Illness 
Dashboard, LEAD Project, and Content Workgroup.
The MCDPH indirect rate for FY22 17.97%. The full indirect costs are estimated at 
$9,883.50, all of which is recoverable. Departmental indirect rates are reestablished at the 
beginning of each fiscal year and the future indirect rates will be collected at the 
corresponding rates. The EPHT grant is reoccurring and has been awarded to the 
department in previous years. This competitive grant does not require an in-kind match or 
on-going contributions. The grant award is not for a mandated function but provides a benefit 
to the citizens as it provides funding for data collection, management, and analysis that 
meets the standards set by the EPHT Nationally Consistent Data and Measures (NCDM) for 
dissemination to local stakeholders.

NOTICE OF FUNDING OPPORTUNITY FOR GRANT FUNDS FROM CENTERS FOR 
DISEASE CONTROL FOR OVERDOSE DATA TO ACTION PROGRAM
Approve Notice of Funding Opportunity (NOFO) CDC-RFA-CE19-1904, from the U.S. 
Department of Health and Human Services, Centers for Disease Control (CDC) to Maricopa 
County by and through its Department of Public Health (MCDPH) to provide continued 
funding for work focused on increasing access to comprehensive and timely surveillance 
data on opioid overdose morbidity and mortality rates. Authorize the Board Chairman to sign 
all documents related to the NOFO as applicable. Subject to the availability of funds, the 
NOFO anticipates providing funding in the not-to-exceed amount of $2,688,960 for the 
budget period beginning September 1, 2022 through August 31, 2023. In addition, the NOFO 
extends the agreement term for an additional 12 months, which brings the term of the 
agreement to September 1, 2019 through August 31, 2023.  
The grant award is anticipated to be divided as follows:
Prevention - $2,288,960
Surveillance - $400,000
This is a new grant and its reoccurrence is not known. It was a non-competitive grant 
opportunity and there is no cash or in-kind match required.  Should the grant cease, on-going 
contributions should not be required. This is not a mandated service but provides a benefit 
to our citizens by obtaining evidenced-based data to support solutions for opioid use disorder 
prevention and treatment services for targeted underserved populations. 
MCDPH’s indirect rate for FY 2021-22 is 17.97%.  $92,939.00 is pass-thru and not subject 
to indirect.  The full indirect costs are estimated at $395,526.91 all of which are recoverable.

Departmental indirect rates are reestablished at the beginning of each fiscal year and the 
future indirect rates will be collected at the corresponding rates.

WITH DELTA DENTAL PLAN OF ARIZONA FOR DENTAL INSURANCE SERVICES
Approve a funding authority increase in the amount of $3,000,000 for Request for Proposal 
(RFP) Contract 190140 between the Delta Dental Plan of Arizona (DDPA) and Maricopa 
County through its Department of Public Health (MCDPH).  
This increase shall be used for services rendered in the current budget period beginning 
3/1/2022 thru 2/28/2023 and it shall bring the total not-to-exceed amount from $6,000,000 to 
$9,000,000 over the life of the contract that began 3/1/2019. 
The purpose of this increased funding is to continue providing Oral Health Services 
(Provision of Dental Insurance Premiums) according to the most current CDC guidance and 
recommendations to person infected with HIV/AIDS. These services are funded with grant

purchase from Bentley Systems, Inc. only. All upgrades, improvements, enhancements and 
Bentley LEARN educational materials are provided directly with Bentley Systems and cannot 
be provided by a third party or alternate vendor.  Advantages include local seminars, user’s 
groups and more robust training programs provided under the Enterprise Public Subscription 
agreement.

AMENDMENT TO IGA WITH THE FLOOD CONTROL DISTRICT OF MARICOPA 
COUNTY FOR SUN CITY WEST AREA CHANNEL CROSSINGS PROJECT
Approve the First Amendment to the Intergovernmental Agreement (C-64-20-0167-M-01) 
between Maricopa County (County) and the Flood Control District of Maricopa County 
(FCDMC) to collaborate on mutually beneficial, channel-area improvements in Sun City West 
Area Community.
This First Amendment aims to amend the 2021 Intergovernmental Agreement (IGA) to revise 
the responsibilities of the FCDMC and County for the project, including the design, 
construction, permitting, and cost-sharing.
The funds are budgeted for FY2023 Transportation Department (640) Transportation Capital 
Project Fund (234) Transportation System Management Project, sub-project TT0615. The 
revised estimated construction cost is $6,038,000. The County’s estimated cost-share 
contribution is $3,622,800 and the FCDMC’s estimated cost-share contribution is 
$2,415,200. Under the original agreement FCDMC contributed $2,000,000 upon completion 
of design of the project. Upon start of construction FCDMC will contribute the balance.
This First Amendment changes the financial terms of the 2021 IGA, and this First 
Amendment shall supersede and replace the previous terms in the original agreement. 
Accordingly, the IGA shall become effective on the date approved by both the County Board 
of Supervisors and the District’s Board of Directors and remain in full force and effect until 
all stipulations are met.

Approve the Intergovernmental Agreement between Maricopa County and Arizona State 
University (ASU) for the implementation of new bridge repair and rehabilitation methods for 
bridge deck connections and thin concrete overlays using advanced concrete materials. 
Either Party may terminate this Agreement at any time prior to the expiration date by 
furnishing the other Party with a thirty (30) day written notice.  
The purpose of this Agreement is to authorize the County to coordinate with ASU to research 
and implement a four-stage work plan to for repairs and rehabilitation for Bridge Deck 
Connections utilizing Ultra-High-Performance Concrete. ASU has recently developed a 
multi-tiered approach that will be implemented on the Palo Verde Bridge and on future 
MCDOT bridge preventative maintenance projects. This will include locating sources of 
material, designing preliminary overlay mixtures, guidance and training to County 
Transportation staff, and recommendations that will assist the County in performing 
maintenance on several bridge structures that are managed by the County.

Approve the Intergovernmental Agreement between Maricopa County (County) and the 
City of Peoria (City) for the right-of-entry to operate and maintain the Traffic Signals at the 
intersections of Thunderbird Road and 94th Drive and Thunderbird Road and Boswell 
Boulevard/Plaza Del Rio.
Maricopa County currently maintains Thunderbird Road between 94th Drive and Boswell 
Boulevard/Plaza Del Rio Boulevard. The City currently operates and maintains two traffic 
signals, two cabinets and two power meters, at the intersections of 94th Drive and Boswell 
Boulevard/Plaza Del Rio Boulevard. The traffic signal equipment is located within Maricopa 
County’s jurisdiction. The City is upgrading the traffic signal cabinets at these two locations 
and will require access to their equipment in order to complete the upgrade and perform 
maintenance work.
Under this Intergovernmental Agreement, the County shall issue no-cost right-of-entry 
permits to the City to perform the required maintenance and operations of their traffic 
signals at the intersections.
The City shall bear all financial responsibility of upgrading the equipment and does not 
change the authorities of the County or the City.
The terms of the agreement are in effect as of the Board of Supervisors approval and shall 
remain in full force and effect until all stipulations have been satisfied, except that it may 
be amended upon written agreement by all parties.

Chairman Gates asked the Clerk if there was anything to report regarding Public 
Comment email responses.
The Clerk said there were a few email responses: One regarding the Assessor’s 
website; One comment regarding Public Comment; 29 comments regarding Animal 
Care and Control. She said all the comments have been shared with the Board offices. 
Chairman Gates asked if there were any speakers slips for in-person comments. He 
was given the speaker slips to call on the public. Chairman Gates noted the guidelines 
for public speakers with a two minute limit and the Board not able to respond directly to 
the comment during the meeting.
Randi Buslik was called on but was not present.
Kim Schulze, former Behavior and Training Manager, Maricopa County Animal Care 
and Control (MCACC), was surprised when the Behavior team was disbanded for 
reasons she does not know. She believed an animal shelter should have medical 
shelter and a behavior team on staff. After her resignation, she was banned from 
volunteering at the shelter despite a shortage of volunteers. Ms. Schulze said the 
current leadership for MCACC has very little animal shelter work experience and she 
believed animal shelters are an important part of the community and effective 
management is vital.
Nancy Doyle, resident, expressed concern for the number of animals who have died at 
the shelter. Ms. Doyle cited statistics ranging from 2017 to 2022 and the number of 
animals dying in the shelter is slowly increasing while the intake numbers are 
decreasing. She suggested that if animals are sick and suffering, humanly euthanizing 
is better than for the animal to suffer and die in the kennel.
Debra Tarasfaust, resident, an advocate for MCACC animals for 10 years, expressed 
concern about the mislabeling of dogs during intake. Ms. Tarasfaust talked about two 
dogs: one was misidentified by breed and the dog described was clearly not the dog in 
the kennel.  Ms. Tarasfaust talked about another dog that was injured at the shelter and 
needed medical care and was moved from one shelter to another. She said they need 
to work as a team to take care of the dogs.
Diane Barker, resident, supported public comment.  Ms. Barker said democracy is two 
sided and it is important for residents to be heard. She talked about the wording of the 
public comment guidelines and thanked the Board for clarifying the process in writing 
for the public on the agenda.

Supervisors'/County Manager's summary of current events - Resumen de temas de 
actualidad de los Supervisores/Administrador del Condado
Supervisor Gallardo said District 5 is lucky to have an intern this summer, Angel Vega, 
who will be attending ASU this fall. Supervisor Gallardo said he was glad to have him 
present, asking questions and learning from the County.
Supervisor Galvin and staffer, Dan Gardner, were honored to be hosted by the Fort 
McDowell Yavapai Nation and given a tour of their farm, their school for early childhood 
education and the We-Ko-Pa Casino. Supervisor Galvin said they also went to the Salt 
River Pima Indian Community and received a tour where they saw wild horses and

toured the new health facility. Supervisor Galvin talked about the working meeting he 
had with the Town of Gilbert, including Mayor Brigette Peterson and the Town staff. 
They discussed a variety of subjects that affect both the Town of Gilbert and Maricopa 
County and how they can work together and keep the lines of communication open.
Supervisor Hickman wished Supervisor Galvin a happy birthday. He said he had a great 
breakfast meeting with all the Constables in District 4.  They thanked the Board for all 
the support with evictions and other duties they are tasked with. Supervisor Hickman 
recalled when he sought appointment, he was a “fish out of water”. He was fortunate to 
acquire an operating staff from previous Supervisor, Max Wilson. He said he has 
appreciated his Chief, Scott Isham, for the past 8 years of service and Michelle Montijo 
who came on board later. Supervisor Hickman presented Scott with a 20-year pin.
Chairman Gates recently represented the County at the American Legion Boys State 
at Northern Arizona University where he talked about property taxes. He also visited 
William Jewell College outside of Kansas City and the Truman Foundation presented 
him with the Stevens Award for Lawyer in Public Service. Chairman Gates viewed this 
as an award to all of Maricopa County, particularly the Elections Department. He was 
also a panelist at the President Bush Library where the discussion focused on 
democracy and defending the work being done by Elections. Many in attendance 
expressed accolades to Elections, for the work well done.

Approve Amendment No.1 to the Intergovernmental Agreement (IGA) FCD 2020A008 for 
the Vista Verde Drainage Improvements Project between the City of Litchfield Park (City) 
and the Flood Control District of Maricopa County (District).  This Amendment is necessary 
due to a delay in construction contract issuance and increased construction cost. This 
Amendment serves to extend the Project construction and funding from June 30, 2022 to 
June 30, 2023 and to increase the basis of funding for the project from $250,000 to $450,000. 
All other terms and conditions of the IGA remain the same.
The City proposed the Project for the District’s evaluation under the District’s Small Project 
Assistance Program for Fiscal Year 2021.  The Project was recommended, scoring 3rd 
among 11 submittals by various municipalities. This Amendment to the IGA is proposed in 
accordance with the terms of the Small Project Assistance Program, adopted by the Board 
under Resolution FCD 2009R003C (C-69-09-062-6-03).
The estimated total Project cost is $450,000. The District’s estimated share of the Project 
cost is $337,500 and is limited to $500,000; the City’s estimated share of the Project cost is 
$112,500. The City will operate and maintain the completed Project.
The Project will reduce the flood hazard to several structures in the vicinity that have 
experienced historic flooding.

PROJECT
Approve the First Amendment to the Intergovernmental Agreement (IGA) FCD 2021A005 
between the Flood Control District of Maricopa County (District) and Maricopa County 
(County) to collaborate on mutually beneficial channel-area improvements in Sun City 
West Area Community.
This First Amendment aims to amend the 2021 Intergovernmental Agreement (IGA) to 
revise the responsibilities of the District and County for the project, including the design, 
construction, permitting, and cost-sharing. The revised estimated construction cost is 
$6,038,000. The County’s estimated cost-share contribution is $3,622,800 and the 
District’s estimated cost-share contribution is $2,415,200. Under the original agreement 
the District contributed $2,000,000 upon completion of design of the project. Upon start of 
construction FCDMC will contribute the balance.
This First Amendment changes the financial terms of the 2021 IGA, and this First 
Amendment shall supersede and replace the previous terms in the original agreement. 
Accordingly, the IGA amendment shall become effective on the data approved by both the 
County Board of Supervisors and the Flood Control District’s Board of Directors and remain 
in full force and effect until all stipulations are met.

IGA WITH THE TOWN OF QUEEN CREEK FOR THE OPERATION OF THE QUEEN 
CREEK LIBRARY
Approve and execute an Intergovernmental Agreement (IGA) between the Maricopa County 
Library District and the Town of Queen Creek for the operation of the Queen Creek Library 
located at 21802 S. Ellsworth Road, Queen Creek, AZ 85142.
The Library District and the Town of Queen Creek are entering into a new IGA to establish 
the terms and conditions under which the parties will continue providing library services to 
Town and Maricopa County residents at the existing library currently operated under IGA as 
amended on April 11, 2018 by C-65-13-007-M-02.  The IGA will commence on July 1, 2022 
and once fully executed will supersede and terminate the previous IGA that was amended 
on April 11, 2018. (C-65-22-036-X-00)

AMENDMENT TO IGA WITH THE DEER VALLEY UNIFIED SCHOOL DISTRICT NO. 97 
FOR OPERATION OF A REGIONAL AND HIGH SCHOOL LIBRARY
Approve and execute the Seventh Amendment to the Intergovernmental Agreement (# C-
65-03-001-2) between the Maricopa County Library District and the Deer Valley Unified 
School District for the operation of a Regional and a High School Library located at 40410 N 
Gavilan Peak Pkwy, Anthem, AZ 85086.  The Seventh Amendment to the Intergovernmental 
Agreement (# C-65-03-001-2) will extend the term for a period of five (5) years commencing 
on July1, 2022 and continuing through June 30, 2027 and amends operational areas 
including costs, hours and parking. (C-65-03-001-2-08)
Motion to approve by Director Clint Hickman, seconded by Director Steve Gallardo 
Chairman Gates said thank you to the Deer Valley School District for the continued 
support of the Maricopa County Library District by operating the library out of the High 
School.
