TOM MANOS OUTSTANDING SERVICE AWARD 
 
In April of 2016, the Maricopa County Board of Supervisors created the Tom Manos 
Outstanding Service Award to recognize the legacy of public service left by retired County 
Manager Tom Manos. This includes his ability to achieve consensus on the most tenuous of 
issues; his service on a local and state level in budget and finance; his tireless work on behalf 
of the homeless; his support of regulatory reform; and his unwavering commitment to 
improving the justice system through Smart Justice. (C-20-22-004-X-00) 
 
           
  
 
Acting Chairman Hickman noted he had spoken with Tom Manos who could not be 
present, and Mr. Manos sent his regards to everyone. The Acting Chairman provided a 
brief review of the attributes to receive the award. He asked Joy Rich to explain the 
process for selecting the person for this award. Ms. Rich explained it is a competitive 
process and it is an honor to receive this award. 
 
Acting Chairman Hickman shared with the audience the accomplishments of Patti 
Cordova, Director of Diversion Strategies Group, Maricopa County Attorney’s Office. 
He explained that the Diversion Group offer alternatives to case processing such as 
allowing individuals to participate in community-based education or treatment programs 
that addresses behavioral change that gives the individual the opportunity to become a 
productive member of the community. Acting Chairman Hickman reviewed Ms. 
Cordova’s accomplishments and expressed his congratulations and that of the Board 
of Supervisors to Ms. Cordova.  
 
Acting Chairman Hickman introduced Rachel Mitchell, County Attorney, and asked her 
to come forward. She noted Ms. Cordova has served the public for many years in 
Arizona. She said Ms. Cordova has served with the Arizona Supreme Court, the 
Governor’s Office, and the Arizona Department of Juvenile Corrections. She started her 
career as a probation officer. Ms. Mitchell explained Ms. Cordova’s responsibilities with 
the County Attorney’s Office. 
 
Ms. Cordova was presented with a plaque and had a picture taken with Ms. Mitchell 
and the Board of Supervisors. Acting Chairman Hickman invited Ms. Cordova to share 
a few words.

Ms. Cordova extended her thanks to both the Acting Chairman and Joy Rich. She 
stated she had hoped to meet Tom Manos, a great public servant and shared how much 
she admired him. She mentioned Ms. Mitchell was the visionary behind one of the 
diversion programs and said members of her team, Debbie Mackenzie and Jason 
Kalish are great champions of diversion also. She thanked her supervisor Ken Vick and 
noted his support. She introduced her family and noted their support. 
 
Supervisor Sellers noted the work done by Ms. Cordova has been a critical part of the 
criminal justice system and he is proud of Ms. Cordova’s accomplishments in this area. 
 
Supervisor Galvin thanked Ms. Cordova for her contributions to the criminal justice 
community. He said it was great her team was in attendance for support and thanked 
Ms. Mitchell for her leadership. 
 
Chairman Gates commented on the service and dedication of Tom Manos and 
expressed his disappointment he missed serving with him. He noted how important the 
work being done by Ms. Cordova and her team is to the criminal justice system. The 
programs help address the problems of those making their way into the justice system 
due to mental health issues. He stated the entire Board was behind her and the County 
Attorney’s office in the efforts being made in this area. 
 
Acting Chairman Hickman shared a conversation he had with Tom Manos and the 
discussion turned quickly to being about Ms. Cordova, Ms. Mitchell, the County 
Attorney’s Office, and Ms. Rich. Acting Chairman Hickman noted that Mr. Manos will 
be rejoining the Peace Corp for its 60th anniversary and returning to Liberia.

e. This Special Use Permit allows for colocation of additional antenna, arrays and 
attachments but must maintain the integrity of the stealth design concealment elements and 
must maintain the setbacks (based on tower height) approved by this Special Use Permit.  
 
f. The wireless communication tower shall retain the stealth properties as originally designed. 
Any damaged or missing fronds or branches shall be replaced within 60 days of such 
damage occurring.  
 
g. This special use permit is valid for a period of 20 years and shall expire on May 18, 2042,
or upon termination of the use for a period of 90 or more days, whichever occurs first. All site 
improvements associated with the special use permit shall be removed within 90 days of 
such expiration or termination of use.   
 
h. Noncompliance with any Maricopa County Regulation shall be grounds for initiating a 
revocation of this Special Use Permit as set forth in the Maricopa County Zoning Ordinance. 
 
i. The granting of this change in use of the property has been at the request of the applicant, 
with the consent of the landowner.  The granting of this approval allows the property to enjoy 
uses in excess of those permitted by the zoning existing on the date of application, subject 
to conditions.  In the event of the failure to comply with any condition, and at the time of 
expiration of the Special Use Permit, the property shall revert to the zoning that existed on 
the date of application.  It is, therefore, stipulated and agreed that either revocation due to 
the failure to comply with any conditions, or the expiration of the Special Use Permit, does 
not reduce any rights that existed on the date of application to use, divide, sell or possess 
the property and that there would be no diminution in value of the property from the value it 
held on the date of application due to such revocation or expiration of the Special Use Permit. 
The Special Use Permit enhances the value of the property above its value as of the date 
the Special Use Permit is granted and reverting to the prior zoning results in the same value

fire protection jurisdiction review and approval will be required.

Site Location:  Generally located ¼ mile northwest of the NWC of Olive Ave. and Reems Rd. 
in the Glendale area 
 
Commission Recommendation:   On 5/12/22, the Commission will vote on this case to either 
recommend approval or denial of this zone change major amendment.  If the 
recommendation is to approve Z2021155, staff recommend the following conditions ‘a’ – ‘l’: 
 
a. A Plan of Development is approved subject to site plan entitled “Indicap – Olive and
Reems” consisting of ten full-sized sheets, dated March 28, 2022, and stamped received 
March 29, 2022. The Plan of Development may be amended administratively under separate
application as long as the amendment complies with the established IND-2 IUPD
development standards approved by the Board of Supervisors. Staff may determine slight 
refinements to remain in substantial conformance with the approved site plan. Minor and 
major amendments to the approved site plan will be determined in accordance with Chapter 
3 of the Maricopa County Zoning Ordinance.  
 
b. Development of the site shall be in substantial conformance with the Narrative Report 
entitled “Indicap, Inc. – Olive Ave. & Reems Rd.”, consisting of ten pages, dated March 28, 
2022, and stamped received March 29, 2022, except as modified by the following conditions.
c. Development of the site shall be generally consistent with the Landscape Plan entitled 
“Indicap – Olive and Reems”, consisting of nine pages, dated March 28, 2022, and stamped 
received March 29, 2022, except as modified by the following conditions.

d. The following Planning Engineering comments shall apply: 
 
1. Earthen berms used to retain or convey runoff must contain an eight-foot-wide top width. 
Use of concrete lined channels negate this requirement.  
 
2. Surface retention basins deeper than one foot must contain one foot of freeboard. 
 
3. Retention basins, including underground retention systems, must drain within 36 hours. 
 
4. The areas identified to provide access from Reems Road contain Special Flood Hazard 
Areas (FEMA Zone A); and contain lands owned or encumbered by the Flood Control District 
(FCD). In addition to floodplain use permitting, ROW permitting will be required by the FCD, 
see https://www.maricopa.gov/5657/Permits#row for more information. The FCD ROW 
permit must be procured prior to issuance of any building permit(s). 
 
5. Access to the site will be though a private easement through Maricopa County Flood 
Control District property. The applicant must demonstrate it has legal access to the site prior 
to the issuance of building permit(s). 
 
6. Access to 159th Avenue shall be gated and be used only for emergency access. 
 
7. Prior to issuance of building permit(s), the owner/ developer must contribute $118,820.00 
towards the cost of new traffic signal at the Olive Avenue / Reems Road intersection which 
is planned to be part of MCDOT TIP Project TT0562. 
 
8. A dedicated southbound right-turn lane and northbound left-turn lane at Access A (Reems 
Road & Hatcher Road alignments) must be constructed as part of the site’s development.
MCDOT permit(s) for said work shall be issued prior to or concurrent with any building 
permit(s). 
 
9. The owner/developer must coordinate with MCDOT and City of Glendale DOT for the new 
traffic signal design and installation along with the final geometry of Access A and Hatcher 
Road alignment for review and approval. Traffic signal design and installation will be based 
on the approval from the City of Glendale. Such approvals (emails, letters etc.) must be 
demonstrated prior to building permit issuance. 
 
10. Detailed Grading and Drainage (Site Infrastructure) Plans must be submitted with the 
application for Building Permits to demonstrate how flow from each respective drainage area 
will be directed to its designated retention basin. This shall include the requirement to provide 
calculations to substantiate the storm drain design; and retention basin slope protection at 
areas that will receive direct inflow from paved areas and at concentrated inflow locations. 
 
11. Based on the conceptual design nature of the information submitted, changes to the site 
layout may be necessitated by the final engineering design of the site’s drainage 
infrastructure. 
 
12. Engineering review of planning and/or zoning cases is for conceptual design only. All 
development and engineering design shall be in conformance with Section 1205 of the 
Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain 
Regulations for Maricopa County; MCDOT Roadway Design Manual; and current 
engineering policies, standards, and best practices at the time of application for construction.

e. All buildings subject to noise attenuation as per ARS § 28-8482(B).  
 
f. The master developer shall notify future tenants or owners that they are located within the 
state-defined “territory in the vicinity of a military airport” with the following language: 
 
“You are in the ‘vicinity of a military airport’ as described by State of Arizona statute ARS 
§28-8481. Structures should include sound attenuation measures as directed by State law. 
You will be subject to direct over flights and noise by Luke Air Force Base jet aircraft in the 
vicinity. 
 
Luke Air Force Base executes over 200,000 flight operations per year, at an average of 
approximately 170 overflights per day. Although Luke's primary flight paths are located within 
20 miles from the base, jet noise will be apparent throughout the area as aircraft transient to 
and from the Barry M. Goldwater Gunnery Range and other flight training areas. 
 
Luke Air Force Base may launch and recover aircraft in either direction off its runways 
oriented to the southwest and northeast. Noise will be more noticeable during overcast sky 
conditions due to noise reflections off the clouds. 
 
Luke Air Force Base's normal flying hours extend from 7:00 a.m. until approximately 
midnight, Monday through Friday, but some limited flying will occur outside these hours and 
during most weekends. 
 
g. The following IND-2 IUPD development standards shall apply:  
 
1. There shall be a maximum height of 49’ for any structure.  
 
2. There shall be no screening along the site’s eastern and southern boundaries. 
 
3. Outdoor industrial uses or enclosures shall encroach into any required street side yard.  
 
4. There shall be a minimum side yard of 25-feet adjacent to any rural or residential zoning 
district. 
 
5. All structures shall be prohibited within 100-feet from both the R1-35 and R1-6 RUPD
zoning boundary to the north portion of the site.  
 
6. Any outdoor light sources within the 100-foot buffer area shall have a maximum height of 
12-feet and fully shielded.  
 
7. There shall be a minimum 25-foot-deep landscape buffer along the length of the northern 
site boundary. 
 
8. Adult oriented businesses, retail cannabis businesses, and residential uses shall be 
prohibited.    
 
h. The developer shall create a lot of re-delineations of the southern portion of parcel 501-
41-006N with a lot combination of parcel 501-41-006U prior to issuance of permits.   
 
i. Continued compliance with the approval of CPA2020005 and Z202012 as applicable.   
 
j. Amendments to the site plan and narrative report shall be processed as a revised 
application in accordance with Maricopa County Zoning Ordinance Article 304.9.

concerns.

Acting Chairman Hickman asked if there were any speakers or comments for this item. 
The Clerk said William Lally, representing the applicant, was available in person to  was 
one for Billy Lally to speak and there were two speakers in opposition. Sheryl Hamlin 
and Kelly Wright.  
 
Mr. Lally stated he wanted to give some background even though there was a denial by 
both the Commission and Staff. The property is about 1,000 acres between Morristown 
and Wittmann. He listed some of the concerns when the case was first brought forward. 
He said it was important to look at some of the development to the south of this property 
noting there are several master communities that have been zoned in either Surprise or 
the County as shown in the slide below.

Mr. Lally reviewed the staff concerns from December 2021 as seen on the slide below 
and stated the applicant had worked to address some of these concerns. This is the first

Mr. Lally explained the biggest change since last year as seen on the slide below is a 
3,500-acre state land parcel that was auctioned off in March 2022 to BNSF Railroad for 
a logistics terminal and BNSF has moved forward with the purchase of the 3,500 acres 
and this could result in 6,000 jobs. He explained the area in green (Grand Vista) has 
been purchased by Apple as a testing ground for autonomous vehicles, which will mean 
more jobs. Mr. Lally said the establishment of affordable housing next to major 
employers is a favorable aspect.

committing to serving all the utilities such as water, sewer, and public safety as a pre-

Mr. Lally said the application before the Board today has new stipulations that mandate 
things that were mentioned in December of last year.  
 
Mr. Lally reviewed the slide below depicting traffic flows in and around the property and

Mr. Lally noted the real change from last year has been the demand for more attainable 
housing. The Santa Barbara Ranch project has the potential to answer some of that 
demand.

Mr. Lally stated the BNSF project next door to this property is a game changer. He said 
it will change how the City of Surprise will look at the area and how the entire area will 
develop. 
 
 
 
Sheryl Hamlin, resident, stated she had three topics she would like to speak about that 
have not been mentioned previously. The first one is the water issue. There is a need 
for a hydrology report due to current drought conditions. She said it is quite a large span 
from the end of Surprise’s water lines to this property and she asked who would pay for 
it.  Ms. Hamlin stated her next topic was about heat and how people are unable to pay 
for electricity for air conditioning. She provided a list of reasons for the excessive heat. 
She continued and discussed the ruin of the scenic corridor. Ms, Hamlin asked the Board 
to deny this request. 
 
Kelly Wright, resident, asked the Board to limit Santa Barbara Ranch, Walden Ranch, 
and Rancho Maria subdivisions or master communities to one home per acre. She 
expressed her concerns about the delicate ecosystem of the Hassayampa River. She 
talked about the aquafer being drained causing wells to go dry and she expressed her 
many other concerns related to development. She asked the Board to deny five houses 
to one acre. 
 
Mr. Lally returned to the podium and addressed the water concerns. This process is the 
first step to identifying density and have water model studies performed. He discussed 
how the process will address the concerns mentioned by Ms. Wright. 
 
Acting Chairman Hickman expressed his concerns as the representative for this area. 
He wants to make sure there are sufficient urban services available prior to approving 
any urban densities. He stated that due to the continued opposition and the

modifications that have been made, he would like to remand the item back to the 
Commission and asked Mr. Ellsworth to explain what that would entail.

"VINE" MOU FOR ARIZONA CRIMINAL JUSTICE COMMISSION 
 
Approve the "VINE" (Victim Information Notification Everyday application) Memorandum of 
understanding (MOU) between Arizona Criminal Justice Commission (ACJC) and Maricopa 
County Sheriff (MCSO). This MOU allows the County to participate in VINE and in ACJC's 
Master Contract with Appriss. The term of this MOU shall become effective upon signature 
of both parties and shall remain in effect for the term of contract with Appriss agreement or 
superseded by a subsequent MOU. MCSO may withdraw from the VINE MOU at any time 
upon 6 weeks written notification to ACJC. 
 
This agreement is for cooperation between the parties during implementation of VINE and 
will result in shared data transfer of criminal activity between both parties to aid in automated

PROGRAM 
 
Approve an Agreement between the United States Department of Homeland Security (DHS) 
and Maricopa County through the Air Quality Department, in the not-to-exceed amount of 
$677,877. This Agreement is funded by a grant from the DHS (Award Number 
06OHBIO00003-17-00) with the purpose of continuing funding for the seventeenth year of 
the BioWatch program.  
 
The BioWatch program includes an ambient air monitoring network to sample air pollution in 
a variety of settings, assess health and welfare effects, assist in determining sources of air 
pollution; and to carry out the provisions of the US EPA, the Federal Clean Air Act and 
Amendments, Arizona Revised Statutes, and County Air Pollution Control Regulations that 
are intended to correct, remove, minimize, or prevent air pollution within Maricopa County. 
 
The Agreement is effective from September 1, 2006, until April 30, 2025, while the budget 
program period is effective from May 1, 2022, until April 30, 2023. 
 
The FY2022 Air Quality composite indirect rate of 19.75% will be applied to the direct charges 
of $539,355.  The recoverable indirect cost of administering this grant is $106,522; the non-
recoverable indirect cost is $0. The award includes equipment expenses of $32,000 which 
are excluded from the indirect cost recovery.  
 
The grant award is reoccurring and has been awarded to the department in previous years. 
The cash or in-kind match is not applicable, indirect cost is fully recoverable, ongoing cash 
contributions not applicable. The grant award is not mandated, and the activities are 100% 
financially supported by the grant from Department of Homeland Security (DHS). The Air 
Quality Department works with DHS to protect the citizens of Maricopa County by operating 
a network of biological samplers. The grant award is non-competitively bid. There are no 
costs that will need to be absorbed by the departments operating budget. 
 
Grant revenues are not local revenues for the purpose of the constitutional expenditure 
limitation, and therefore, expenditure of the funds is not prohibited by the budget law. A 
budget adjustment is not required. (C-85-22-044-X-00)

Approve an agreement between A Home 4 Spot Animal Rescue and Maricopa County, 
administered by Maricopa County Animal Care and Control, to allow said rescue to transfer 
animals that have been deemed eligible for the New Hope program. Maricopa County will 
provide a rabies vaccination, dog license tag, and new owner transfer fee within the first year 
of transfer for each dog three months of age or older at no cost to the Contractor. The cost 
for these services is $52 for each animal transferred in FY 2022 and thereafter. Animal Care 
and Control estimates 10 (ten) New Hope transfers annually, for a total of $520 per year, 
over the term of the agreement. The term of this agreement shall commence upon approval

and control services. The initial term of the agreement provides services from July 1, 2022,
through June 30, 2027, with the option of renewals as set forth in paragraph 5 of the 
Sheltering Agreement and paragraph 4 of the IGA. The Town of Paradise Valley agrees to 
pay the annual sum of $0 for sheltering services provided during the initial term of the 
Agreement, as set forth in Appendix A of the Agreement; and agrees to pay the annual sum 
of $6,320 for animal control services provided during the initial term of the IGA Agreement,

Approve the attached Maricopa County Premium Pay Rates effective 5/16/2022. Human 
Resources recommends updating the shift differentials' language for consistency with how 
ADP processes them. 
 
These premium pay rates apply to the County’s elected offices, appointed departments, 
Judicial Branch of Maricopa County who receives funding from Maricopa County,  and the 
Flood Control District of Maricopa County and the Maricopa County Library District (Special 
Districts). The Board of Supervisors is authorized to jointly adopt policies applying to the

AMENDMENT TO LEASE AGREEMENT WITH CITY OF CHANDLER FOR 
CLASSROOM SPACE 
 
Approve and execute Amendment No. 10 to Lease Agreement L-7178 with City of Chandler, 
for the use of 2,200 square feet of classroom space and non-exclusive use of common area 
and playground facilities located at 660 South Palm Lane, Chandler, Arizona. The space is 
utilized by the Maricopa County Human Services Department for the Early Education 
Division to provide Head Start program services. 
 
The purpose of this Amendment is to address the following: (A) renew and extend the term 
of the Lease; (B) provide for a renewal option; (C) replace counterpart language. 
 
The term of the Lease shall be extended for two (2) years to commence on July 1, 2022, and 
expire June 30, 2024, its current Lease rate of $333.33 monthly plus rental tax. Funding for 
this Amendment is provided by Grant No. 09CH012079 (C-22-22-174-X) funding from the 
U.S. Department of Health and Human (DHHS)/Administration for Children and Families 
(ACF), Office of Head Start (OHS). The Lease is subject to termination pursuant to the 
provisions of A.R.S. 38-511. Either Lessor or Lessee may terminate the Lease by giving 
ninety (90) days prior written notice of termination to the other Party. All other terms and 
conditions of the Agreement and previously approved Amendment remain the same and full 
force and effect.

The purpose of this project is to reduce transmission of COVID-19 disease and related 
deaths in students, and faculty through four targeted functional activities, including

testing and mitigation outreach; temporary staffing assistance to support testing, 
investigation, and disease mitigation; and establishing a grant coordination and management 
unit.  
 
This is the beginning of year two of the grant and it is uncertain whether it will occur beyond 
the initial term. It was non-competitive and there is no cash or in-kind match required. The 
grant award is not a mandated function but provides a benefit to our citizens by continuing 
COVID-19 related services. Should funding be discontinued, on-going contributions should

SURVEILLANCE SERVICES 
 
Approve a new IGA (CTR059146) between Arizona Department of Health Services (ADHS) 
and Maricopa County by and through its Department of Public Health (MCDPH) to provide 
funding for the HIV Surveillance Services formerly HIV Surveillance Capacity Expansion 
Program. The funding for this program is in the not-to-exceed amount of $237,807 for the 
budget period of January 1, 2022, through December 31, 2022. The term of this agreement 
is from January 1, 2022, through December 31, 2026. 
 
This is a new IGA with no requirement for in-kind match or on-going contributions. This award 
was not competitive. HIV Surveillance Services is not a mandated function but provides a 
benefit to citizens by conducting HIV Case Surveillance activities in accordance with the 
most recent guidelines from CDC. 
 
This grant deviates from County Policy A2505 and does not allow for full indirect cost 
reimbursement, but a maximum of 10% indirect cost reimbursement as delegated in the 
Grant Agreement, while MCDPH indirect rate for FY22 is 17.97%. The full indirect costs are 
estimated at $38,849.02 of which $26,618.82 is recoverable and $17,230.20 is

unrecoverable. Program costs not covered by the grant will be subsidized by the MCDPH 
indirect cost pool. 
 
Grant revenues are not local revenues for the purpose of the constitutional expenditure 
limitation, and therefore expenditure of the revenues is not prohibited by the budget law. This 
Agreement does not alter the budget constraining expenditures of local revenues duly 
adopted by the Board pursuant to A.R.S. §42-17105.  The overall grant budget will be 
adjusted as necessary to accommodate this grant through a future reconciliation. Funding 
for this Agreement is provided by a grant from ADHS and will not affect the County’s general

Amendment to Agenda Item C-64-22-166-X-00 originally approved on February 9, 2022. 
  
Request approval of the low bid for construction which exceeds the Engineer’s estimate by 
greater than 10 percent.  The low bid exceeds the Engineer’s estimate by 167 percent. 
 
Per the original BOS approval to construction (February 9, 2022): “Award the contract to the 
lowest, responsive, responsible bidder, provided that the lowest, responsive, responsible 
bidder did not exceed the Engineer’s estimate by more than 10 percent.”   
 
Two bids were received after advertised for construction and both bids were within 2 (two) 
percent of each other. County staff and consultants have conducted a bid analysis and have 
determined that the increase is due to materials cost escalations, fuel cost increases, 
competition from other projects, and labor shortages.   
 
The purpose of the project is to provide clear zone protection at 31 locations which consist 
of box culvert extensions, pipe culvert extensions, channel lining removal and replacement, 
curb & gutter, and sidewalk improvements. 
 
This is a joint project with the Flood Control District (Agreement No. C-64-21-175-X-00). 
Flood Control staff have reviewed the bid results and concur with accepting the low bid.

March 2, 2030; they have requested an extension through March 2, 2040. 
 
On February 17, 2010, the BOS Approved License No. C-91-10-106-M-00 (the “Original 
License”) for Plains to operate and maintain three (3) pipelines measuring six inches (6”) in 
diameter to transport liquid propane and butane gases over three and one-half (3.5) mile 
length.  The Original License established that Maricopa County would allow Plains to operate

AND THOMPSON THRIFT FOR IMPROVEMENTS TO NORTHERN PARKWAY 
 
Approve the Intergovernmental Agreement between Maricopa County (County), Arizona 
Department of Transportation (ADOT), the City of Glendale (City) and Thompson Thrift 
(Developer). The County will design and construct capacity improvements along Northern 
Parkway, to include reconstructing the Loop 101 interchange; and the Loop 101 ramps to 
the mainline connection, widening the north and south legs of each intersection. 
 
As part of the County's Project for capacity improvements along the Northern Parkway, the 
Developer has requested the design and construction of a frontage road extending from the 
Southbound Loop 101 on-ramp within ADOT right of way to the Developer's property, as 
shown on Exhibits A and B of the Agreement. 
 
The Developer will be responsible for all costs associated with the design and construction 
of the Developer's Project, including but not limited to, construction engineering and 
administration (CE) and construction contingencies. Upon approval of this  Agreement, the 
County will invoice the Developer for the costs associated with the Developer's Project, 
shown in Exhibits C-1 and C-2, estimated at $87,863. 
 
ADOT will maintain access control on the frontage road as shown in Exhibits A and B. The 
City and the Developer will maintain the area adjacent to the ramp as depicted in Exhibit A. 
The funds are budgeted in FY2025 Transportation Department (640) Transportation Capital 
Project Fund (234) Five Year Program in the Transportation System Management Project, 
sub-project TT0372. 
 
The terms of the agreement are in effect as of the Board of Supervisors’ approval and shall 
remain in full force and effect until all stipulations have been satisfied, except that it may be

administer the construction of roadway improvements to the US60X (also referred to as 
Apache Trail), from Sossaman Road to Meridian Road. 
 
ADOT will lead the design and construction of the improvements to the County’s standards. 
The improvements will include, but are not limited to, widening, signing, and striping of the

ADOT will obtain federal funds for the design and construction costs associated with the

maintenance responsibilities of US 60X from Sossaman Road to Meridian Road to the 
County, with the approval of the State Transportation Board. The abandonment will be 
accommodated by the State’s Right of Way process of either 120-day advance notice or a 
separate four-year waiver consistent with Arizona Revised Statutes § 28-7209.

MCDOT has developed an alternative to alleviate ponding and sedimentation build up on 
Patton Road at the Wash 1 West. FCDMC will provide a financial contribution of $500,000 
as part of their SPAP. The remaining amount of improving the roadway will be the 
responsibility of MCDOT. The funds are budgeted in FY2023 Transportation Department 
(640) Transportation Capital Project Fund (234) Five Year Program in the Transportation

Approve the Intergovernmental Agreement between Maricopa County and City of Peoria to 
waive traffic control permit fees in certain situations. Under the Intergovernmental 
Agreement, the agencies will agree to reciprocally waive traffic control permit fees for 
projects meeting specific requirements. Either party may terminate this Agreement at any 
time prior to the expiration date by furnishing the other party with a thirty (30) day written 
notice. 
 
This Agreement will allow for traffic control permit fees to be waived when the City has a 
project adjacent to or near County right-of-way, the County is not a partner to the project, 
and the City needs to place traffic control in County right-of-way for appropriate notice and 
safety. The traffic control permit fees would be waived for County projects meeting the same 
conditions. Both parties are required to submit traffic control plans and follow standard 
permitting requirements. The review of the traffic control permit application plans would be

The Clerk reported two comments were received via email, one concerning the County 
Attorney and one concerning County jails and these comments have been shared with 
the Board offices. 
 
Blue Crowley, resident, reiterated his concerns and opinions about bus transportation 
and funding. 
 
Vice Chairman Hickman welcomed the Arizona State University (ASU) from the Watts 
College of Public Service. He encouraged one of them to fill out a public speaker form 
and share why they are in attendance today.  
 
John Borga stated he was from the Philippines. He and others with him are young 
leaders from all over southeast Asia. He personally is an elected official in the 
Philippines and most of the others are leaders of their organizations hoping for social 
changes. He said they are very interested on how the Board decide on matters before 
them. He said they will take some of the best practices they have learned back to their 
own countries. 
 
Hector Zeyala, ASU Watts College, stated he wanted to make a statement on behalf of 
Watts College. He said the young people today are part of the Young Southeast Asian 
Leaders Initiative, a program of the U.S. State Department, and have been here for a 
little over two weeks learning about civic engagement.

Supervisors'/County Manager's summary of current events - Resumen de temas de

Supervisor Galvin reported he attended an event in Mesa hosted by Building Homes 
for Heroes. It is an organization that provides homes mortgage free to veterans who 
have suffered injury or served abroad during conflict. They surprised Kevin Raposo and 
his family with a new home. Mr. Raposo suffered a traumatic brain injury and PTSD 
and is on his way to recovery. Supervisor Galvin reported he and those in his office 
visited Falcon Field in Mesa which is one of the busiest aviation airports in the entire 
country. They were there on the catwalk when a B-17 World War II era plane took off. 
He stated Falcon Field is an economic drive for the east valley. Supervisor Galvin 
reported he was at Robert Louis Stevenson Elementary School in Mesa and gave a 
presentation to 100 third graders. He said they asked great questions and he was glad 
to see them interested in history. 
 
Supervisor Sellers reported he spent most of last week with the Greater Phoenix 
Economic Council in Washington D.C. He had the opportunity to speak privately with 
both of our Senators to ensure Maricopa County gets its share of the bipartisan 
infrastructure bill. 
 
Acting Chairman Hickman reported he attended the Del Webb birthday celebration in 
Sun City and explained the extent of the work done by Del Webb and his group. He 
also shared a story about Del Webb as owner of the New York Yankees Baseball Team.

DRAINAGE IMPROVEMENT PROJECT – PRE-CONSTRUCTION 
 
Authorize the Flood Control District of Maricopa County (District) to issue a Request for 
Qualifications for a qualified construction manager/general contractor to provide 
Construction Manager at Risk (CMAR) services under Contract (2022C029) for the Rawhide 
Wash Flood Hazard Mitigation Pre-Construction (Project) and award a Pre-Construction 
services contract to the successful respondent not to exceed $500,000.  Authorize the 
District to award the pre-construction services contract FCD 2022C029 to the selected 
respondent and pending negotiation of a mutually acceptable Guaranteed Maximum Price, 
authorize the District to award one or more construction services contracts to the selected 
respondent. The estimated total cost of the construction contract(s) is $30,000,000. 
 
This is a qualification-based selection in accordance with Maricopa County Procurement 
Code, Article 5, Paragraph 504(F), and Article IV of the Maricopa County Procedures 
Manual. 
 
The Flood Control District of Maricopa County has initiated design work for the Paradise 
Ridge Drainage Improvement Project under a consultant contract with Wood-Patel.  The City
of Phoenix is the project partner.  The Project includes a channel, sediment basin(s) and 
associated improvements within the Rawhide Wash corridor from Scottsdale Road to SR-
101.  This is a complex project and, as such, the District will select the CMAR Contractor 
based on qualifications in order to obtain valuable constructability input during the design 
effort through delivery of pre-construction services under the Construction Manager At Risk
contracting method.  The future construction cost is currently estimated to be 30.0 million

DRAINAGE IMPROVEMENTS PROJECTS 
 
Approve Amendment No.1 to the Intergovernmental Agreement (IGA) FCD 2020A019 for 
the Powder House Drainage Improvements Project between the Town of Wickenburg (Town) 
and the Flood Control District of Maricopa County (District).  This Amendment serves to 
extend the Project construction and funding from June 30, 2022, to June 30, 2023.  All other 
terms and conditions of the IGA remain the same. (C-69-21-012-X-01)

IGA WITH MARICOPA COUNTY FOR THE PATTON ROAD AT 195TH AVENUE 
DRAINAGE IMPROVEMENT PROJECT 
 
Approve Intergovernmental Agreement (IGA) FCD 2022A006 for the Patton Road at 195th 
Avenue Drainage Improvement Project (Project) between the Maricopa County Department 
of Transportation (County) and the Flood Control District of Maricopa County (District). The 
estimated total Project cost is $2,067,545. The District’s estimated share of the Project cost 
is $500,000 and is limited to $500,000; the County’s estimated share of the Project cost is 
$1,567,545. The County will operate and maintain the completed Project. This Agreement 
shall become effective as of the date it has been executed by all PROJECT PARTNERS and 
shall expire two years from that date, or upon Project completion, whichever occurs first.  
 
The County proposed the Project for the District’s evaluation under the District’s Small 
Project Assistance Program for Fiscal Year 2023. This IGA is proposed in accordance with 
the terms of the Small Project Assistance Program, adopted by the Board under Resolution 
FCD 2009R003A (C-69-09-062-6-01). 
 
The Patton Road drainage improvements will provide a low water crossing with 4-10’x4’ box 
culverts, a raised roadway profile, and upstream and downstream channel improvements.
