On 10/20/22, the Commission voted 6-0 to recommend 
approval of Z2022087 subject to conditions ‘a’ – ‘e’:

Development of the site shall be in substantial conformance with the Narrative 
Report entitled “El Mirage Road, LLC”, consisting of 9 pages, dated April 28, 2022, 
and stamped received April 29, 2022, except as modified by the following 
conditions. 
 
b. 
Continued compliance with conditions of approval “a” through “p” in Z2009094, 
with the elimination of conditions “b” and “k”. 
 
c. 
The right-of-way dedication along El Mirage Rd. to 65’ must be completed within 
180 days of Board of Supervisors approval.  
 
d. 
This special use permit shall expire on October 19, 2032, or upon termination of the 
use for a period of 90 or more days, whichever occurs first. All site improvements 
associated with the special use permit shall be removed within 90 days of such 
expiration or termination of use.

The granting of this change in use of the property has been at the request of the 
applicant, with the consent of the landowner.  The granting of this approval allows 
the property to enjoy uses in excess of those permitted by the zoning existing on 
the date of application, subject to conditions.  In the event of the failure to comply 
with any condition, and at the time of expiration of the Special Use Permit, the 
property shall revert to the zoning that existed on the date of application.  It is, 
therefore, stipulated and agreed that either revocation due to the failure to 
comply with any conditions, or the expiration of the Special Use Permit, does not 
reduce any rights that existed on the date of application to use, divide, sell or 
possess the property and that there would be no diminution in value of the 
property from the value it held on the date of application due to such revocation 
or expiration of the Special Use Permit.  The Special Use Permit enhances the value 
of the property above its value as of the date the Special Use Permit is granted 
and reverting to the prior zoning results in the same value of the property as if the 
Special Use Permit had never been granted.

Project Summary: 
 
1. 
The applicant proposes to modify stipulation “k” of previously approved SUP #Z2009094, 
which limits the approval to a 10 year period.  The applicant proposes extending the time 
frame an additional ten years.  In addition, the applicant has requested a deletion of 
stipulation “b”, which ties the SUP to the narrative.  Instead, the applicant is requesting 
the SUP to be stipulated to the narrative submitted for the subject case. No other changes 
to the SUP are proposed.  The SUP is for interim industrial and the site is used for outdoor 
storage of work trucks as well as storage of materials on the eastern portion of the site.  
The current tenant on the property is the second user on the site.  The site was initially 
used for airplane part storage and sales upon initial approval, with some historic aerials 
showing what appear to be helicopters stored on site.  While the user has changed since 
initial approval the general use remains the same.  The current user has been on site since 
2017 and the property has operated without issue and has not received any violations 
during the entire history of the SUP.

There has been no recent history on the site prior to the current proposal.  Due to the 
relatively small scope of the request no pre-application meeting was conducted.  The 
Technical Advisory Committee meeting was held on June 7, 2022.

Modification of Z2009094 condition “k”: This Special Use Permit shall expire 10 years from 
the date of approval by the Board of Supervisors, October 19 2032, or upon termination 
of the use, whichever occurs first. All of the site improvements that are not otherwise 
deemed as a by-right use shall be removed within 60 days of such termination or 
expiration.

Mixed-Use Employment.  The area plan defines this as major employment centers that 
include office, warehousing, storage, light industrial parks, research parks, government 
facilities, and other similar employment nodes.  Then plan calls for these centers to be 
compatible with adjacent land uses. 
 
City of Glendale “Envision Glendale 2040” (Adopted August 30, 2016): The subject parcel 
is identified as Heavy Industrial.  The plan identifies this designation as capital-intensive 
enterprises that manufacture or fabricate products.  The land use shall also 
accommodate warehousing and storage. Uses in this land use designation may involve 
significant noise, heat, and large-scale machinery and structures.

The applicant conducted an adequate Public Participation process that included site 
posting and notification mailers to area property owners.  The applicant reported no 
public response as of the time of the Citizen Participation Summary, which was provided 
to staff on August 22, 2022. The applicant noted that the lack of interest in the proposal 
may be a result of the non-intrusive nature of the use and the fact that it has been in the 
area for ten years without issue or complaint.

The proposal to modify condition “k” of Z2009094 in order to extend the outdoor storage 
use on property fits with the general area as well as the guiding land use designations.  
The current interim industrial use fulfills both the “mixed use employment” designation for 
the White Tank / Grand Ave Area Plan as well as the “heavy industrial” designation in the 
City of Glendale General Plan 2040.  Since the original SUP approval there has been some 
change in the area west of the subject site with the development of the Marbella Ranch 
neighborhood.  While there are now nearby homes, there are no homes are directly 
across El Mirage Rd. from the subject site as there is a retention tract west of the site.  
Additionally, the existing buildings on site act to buffer Marbella Ranch from the mining

operations to the east.  Lastly, the existing use has been in place well before any of the 
homes were erected and staff is not aware of any complaints or issues area homeowners 
have with the existing industrial and mining uses east of El Mirage Rd.

The applicant also proposes the deletion of condition “b” of Z2009094.  This condition tied 
the SUP to the narrative that was included with the original case.  The applicant would 
prefer a new stipulation holding the SUP to the narrative included with the subject 
modification of stipulations.

Staff notes that SUP condition “e.1”, which required a 65’ half-width right-of-way 
dedication for El Mirage rd. went unfulfilled.  The applicant has been accommodating 
on discovery of this issue and has initiated dedication with MCDOT.  Documentation of 
such has been provided to staff.

Our law firm represents JROK Holding Corporation, the property owners of the approximate 
5-acre property located approximately 1/4 mile north of the northeast corner of Glendale Avenue 
and El Mirage Road, in the Glendale area, which received Board of Supervisor’s approval for a 
Special Use Permit on July 25, 2012 (case number Z2009094) to allow for outdoor storage and 
interim industrial use in the site’s RU 43 zoning district.  The purpose of this letter is to request a 
Modification to Conditions, seeking an extension of an additional 10 years onto to the existing 
approval. No other changes are proposed.   
 
Request 
 
The purpose of this request is for a modification of a stipulation from an approved Special Use 
Permit—Case Z2009094 on parcel 501-54-004J. The specific request is to allow another ten years 
of usage once the existing approval ends.  The approval was for outdoor storage and interim 
industrial use in the RU-43 zoning district.  The approval was subject to a series of stipulations, 
which can be read in the attached approval (see Exhibit A attached to this narrative). The full 
language of stipulation k is contained below:  
 
k. This Special Use Permit shall expire 10 years from the date of approval by the Board of 
Supervisors or upon termination of the use, whichever occurs first.  All of the site 
improvements that are not otherwise deemed as a by-right use shall be removed within 60 
days of such termination or expiration.  [Emphasis added]    
 
Our request is to modify this stipulation to allow for another 10 years.  The proposed Modification 
of Conditions for the Special Use Permit does not change the approved uses or other aspects of the 
approval. 
 
Description of Area and Surrounding Properties 
 
The land is approximately five acres 
and is approximately 1/4 mile north 
of the northeast corner of Glendale 
Avenue and El Mirage Road.  The 
site is fully developed and there are 
no plans for additional development 
or construction at this time.   
 
The Glendale General Plan has the 
site 
designated 
as 
“Public 
Facilities,” but the property is still 
surrounded by other properties in 
unincorporated Maricopa County.

This property has been and continues to be surrounded by outdoor industrial uses. This was true 
at the time the SUP was approved in 2012 and it continues to be true today. Below is an aerial

Moreover, the Glendale Airport remains only 1.5 miles to the east.

To not allow this property to continue with its current use would be to force it to convert to a use 
consistent with the underlying RU-43 use. In our opinion, an acre-lot residential development 
would be very out of character with the outdoor industrial uses in the immediate area.  
 
East 
 
To the east of the property, on the other side of the Desert Drain Wash, is a Cemex Plant and a 
Vulcan Asphalt Plant (see aerial above and streetview image below). In 1970, they were approved 
with a Special Use Permit to allow the development or extraction of earth products.  This is still in 
use today.

South 
 
To the south of the property is an RV storage facility with barbed wire on top of the existing wall, 
with no landscaping along the roadway.  
 
 
 
 
North 
 
Immediately to the north are two parcels owned by American Sand and Rock Inc. Ewing 
Landscape Materials operates on these properties with open outdoor storage of equipment and 
building materials.  Both properties have split zoning and have County C-3 on the front one-third 
of their property.  The remaining portion of the properties is County RU-43 and a Conditional Use 
Permit was approved in 1998 to allow landscape material sales as a special use in RU-43 zoning 
district.   
 
 
 
West 
 
In 2019, the Marabella Ranch subdivision began building single-family residences zoned County 
R-5.  For the reasons stated in the following section, we do not see any concerns with compatibility 
introduced with this residential subdivision. The subject use was existing when the developers 
developed the site and when the homeowners purchased their homes. And we are unaware of any 
complaints from any neighbors.

Description of Use 
 
On July 25, 2012 the Maricopa County Board of Supervisors (BOS) approved the Special Use 
Permit to allow outdoor storage and light industrial uses on the RU-43 zoned property. The existing 
uses on the property are perfectly within the allowances granted and the proposal is to continue 
with the existing approval for ten more years.  
 
Upon BOS approval, the owner leased the property to Vision Air Inc., who bought and sold aircraft 
parts. In 2017, JROK Holdings purchased the property and the tenant changed to Rokstad Power 
who subcontracts with APS and SRP, and soon to be Navajo Tribal Utility Authority to service 
electric facilities. The site is used for office, parking of trucks and equipment, and outdoor storage.   
 
The property retains a quiet and non-intrusive use profile. The outdoor uses are limited to parking 
of vehicles and equipment when not in service in the field and storage of materials on the far east 
side of the site. Employees come to the site, pick up their work trucks and equipment, and then 
travel off-site to work. When maintenance to the vehicles and equipment is needed, it is typically 
done indoors and is very light in nature (not even oil bays are present).  The buildings on the site 
are used for office uses. The use is very quiet and the activity is low.  
 
 
 
Aside from striped parking on the north side of the site, the storage of larger equipment and other 
materials is done either between the buildings on the site or east of the easternmost building, which 
means views of those materials are away from El Mirage and significantly interrupted by the 
buildings. From any angle on El Mirage, views are limited into any rear areas.

The on-site office has approximately ten employees and the field crew consists of thirty-four. 
Regarding the hours of operation, the office is typically open between 8am and 4pm Monday 
through Friday. Employees may arrive earlier to pick up their vehicles.  There is an occasional 
Saturday where there are employees, but the hours are very minimal.  
 
We recognize that in the past ten years, residential has been developed on the west side of El 
Mirage Road. We do not believe this creates a problem for extending the SUP for several reasons. 
First, as described above, the use is quiet and non-intrusive. We are not proposing outdoor uses 
that would generate noise inconsistent with a residential area. The use amounts to a minor office 
use of ten employees, a parking area that generates some trips coming and going from the site, and 
storage that is away from the residential and visibly obscured or invisible from El Mirage.  
 
Second, this use acts as a buffer and transition use to the mining operation to the east. The use is 
not harmed by being next to the mining operation and yet it’s a quiet use for the residents to the 
west. Additionally, the buildings will block any sound coming from the mining operations.  
 
Third, the use is already in existence. We are not seeking to introduce something that was not 
already present when all of the residents purchased their homes. We suspect that all, or nearly all, 
of those residents were unaware of any ten-year timing stipulation on this site and instead 
purchased their homes with the expectation that the subject use, like the surrounding uses, were 
likely to continue.  
 
Fourth, the use is separated from the residential by El Mirage.  
 
Fifth, there is a retention basin due west of the site and no residential.

Sixth, we are unaware of any concerns that have been raised by those neighbors. Generally, land 
use requests are forward looking. We must estimate what the impacts will be of a use that has not 
yet been developed. But here, we have a positive track record to look back on that should give the 
County confidence to allow this use to continue.  
 
Seventh, all of the homes west of the use are single-story homes, meaning they will not have any 
substantial view onto the subject site from within their properties.  
 
 
 
Location, Accessibility and Utilities 
 
The site has one point of access along its El Mirage Road frontage.  The driveway is located near 
the northwest corner of the site.  The site provides excellent regional access to both the Loop 101 
and Loop 303 freeways.  These freeways provide connection to I-10 and I-17 Freeways, which 
allow access to the entire valley and interstate freeway system.  Due to the nature of the business, 
there is no public foot traffic and very few automobiles visit the site except for the employees. The 
lack of traffic to the site is great for the residential to the west as it keeps the commercial activity 
to a minor level.   
 
The property has services for sewer, water, police and fire and all are managed by the City of 
Glendale.  
 
Circulation System 
 
Part of the stipulations for the approval in 2012 was to bring the site into County regulations, which 
was completed.  In addition, MCDOT requested and received an additional right-of-way from 33 
feet to 65 feet wide adjacent to the property.  Regarding parking, all standards were met including 
the 24’-wide paved driveway.  This driveway flows into the paved parking spaces along the north 
side of the existing office building.  While 40 spaces were required and met, this is more than is 
needed. We are not requesting a reduction but merely noting that no additional parking is 
necessary.

Development Schedule 
 
The site is fully developed and there are no plans for additional development or construction at 
this time.

The Maricopa County Environmental Services Department (MCESD) has 
reviewed revised documents received from the Maricopa County Planning and 
Development Department for the above referenced project. a modification of 
a stipulation from an approved Special Use Permit—Case Z2009094 on parcel 
501-54-004J. The specific request is to allow another ten years of usage once 
the existing approval ends.  at APN # 501-54-004J. The property has existing 
services for sewer, water and are managed by the City of Glendale. 
 
Based on the above, MCESD raised no objections to the Planning &

Thank you for the opportunity to provide comments on the El Mirage Rd LLC.  The proposed request is for a 10 year 
extension of the existing SUP.   The 5 acre parcel is approx. .6 miles outside the Luke AFB 1988 JLUS 65 DNL “high noise 
or accident potential zone” as identified by A.R.S. § 28-8461 and is within the “territory in the vicinity of a military 
airport” also defined by A.R.S. §28-8461.      
 
As described in the narrative, the El Mirage Rd LLC SUP extension will not negatively impact the flying operations at Luke 
AFB.  As always, we recommend a strong notification program to inform future land occupants and developers about 
Luke AFB operations.

We received a proposed modification to stipulation “K” of previously approved Special Use Permit Z2009094 on parcel 
APN 501-54-004J which is located on El Mirage Rd about 1300 feet north of Glendale Ave.  The existing SUP is for interim 
industrial and the proposal is to extend the use for an additional ten years as the original entitlement is set to expire this 
summer. 
 
 
 
The Technical Advisory Committee meeting is to be held June 7th.
