The requested zone change on this site to R-5 RUPD would 
match the R-5 RUPD zoning of the adjacent property that was 
rezoned last year. The rezone on this property will be part of 
the second phase of a multi-family development, known as 
Villages at Pleasant River.  
 
The site is within the municipal planning area of Peoria and 
their general plan designates the site as Park/Open Space. 
The City has not commented. There are no outstanding 
concerns from reviewing agencies. There is no known 
opposition.

Recommendation: 
On 10/20/22, the Commission voted 6-0 to recommend 
approval of Z2022119 subject to conditions ‘a’ – ‘j’:  
 
a. 
Development of the site shall be in substantial conformance with the Zoning Exhibit 
entitled “Villages at Pleasant River“, consisting of one full-size sheet, dated August 
30, 2022, and stamped received August 31, 2022, except as modified by the 
following conditions. 
 
b. 
Development of the site shall be in substantial conformance with the Narrative 
Report entitled “Villages at Pleasant River II”, consisting of nine pages, dated 
August 31,2022, and stamped received August 31, 2022, except as modified by 
the following conditions.

The two properties (APN 201-21-057 and APN 201-21-049B) shall be combined prior 
to the submission of building permits. 
 
d. 
A Plan of Development of the single project must be approved prior to submission 
of any building permits .

The following Planning Engineering comments shall apply:  
 
1. 
The Drainage waiver DRB2021006 must be approved prior to issuance of 
any building permits. 
 
2. 
There are Special Flood Hazard Areas on the site. Any encroachment into 
these Special Flood Hazard Areas requires a Floodplain Use Permit issued 
concurrently with the building permit. 
 
3. 
The project site is within the jurisdiction of Maricopa County. However, 
Happy Valley Parkway adjacent to the site is under the City of Peoria 
jurisdiction. Developer must coordinate with the City of Peoria for approval 
of proposed access onto Happy Valley Parkway. 
 
4. 
The County has no objections to the proposed site access on 115th Avenue 
utilizing future QT commercial driveway. However, if the proposed 
development is constructed prior to the planned QT facility, developer must 
provide half-street improvements on 115th Avenue as outlined in the 
approved QT master plan by Maricopa County.  
 
5. 
The proposed development is located in a Federal Patent Easement Area. 
Applicant will be required to go through Federal Patent Easement 
Abandonment 
Process

to

encroachments allowed within the patent easements unless abandoned 
or otherwise approved by MCDOT Planning. 
 
6. 
A 60-foot replacement easement will be required for a local roadway 
along the eastern boundary of the proposed development to provide 
access for neighboring properties.

The proposed development is located along a section line alignment on 
the south requiring setbacks be based upon a future half width right-of-way 
of 55-feet, per Maricopa County Zoning Ordinance Section 1105. However, 
this section line requirement along the south property line is no longer 
required. 
 
8.  
The subject site is not located within the County’s Urbanized Area; and thus, 
will not require a Storm Water Pollution Prevention Plan (SWPPP) from the 
County. This does NOT preclude the requirement to obtain a Construction 
General Permit (CGP) Notice of Intent to Discharge (NOI) from the State 
(ADEQ), as may be required. 
 
9. 
Without the submittal of a precise plan of development, no development 
approval is implied by this review, including, but not limited to drainage 
design, access and roadway alignments. These items will be addressed as

development plans progress and are submitted to the County for further 
review and/or entitlement. 
 
10. 
Any development must ensure that historic drainage patterns are 
maintained at the up and downstream limits of development. 
 
11. 
All development and engineering design shall be in conformance with 
Section 1205 of the Maricopa County Zoning Ordinance; Drainage Policies 
and Standards; Floodplain Regulations for Maricopa County; MCDOT 
Roadway Design Manual; and current engineering policies, standards and 
best practices at the time of application for construction. 
 
f. 
The required infrastructure of the site must be permitted in conjunction or prior the 
submission of permits for individual housing units. Any phasing shall be identified 
on site plans of the Plan of Development. If infrastructure is to be phased, the 
phased improvement must be able to stand alone, and the phased infrastructure 
must be completed prior to the housing units being served by that infrastructure.  
 
g. 
The following R-5 RUPD development standards shall apply:  
 
1. 
Minimum front yard of three feet. 
2. 
Minimum rear yard of three feet .  
3. 
Minimum interior side yard of three feet .  
4. 
Minimum street side yard of three feet .  
5. 
Required guest parking of zero percent. 
6. 
Maximum height for residential perimeter wall signs of eight feet.  
 
h. 
Noncompliance with any Maricopa County Regulation shall be grounds for 
initiating a revocation of this zone change as set forth in the Maricopa County 
Zoning Ordinance.  
 
i. 
The property owner/s and their successors waive claim for diminution in value if 
the County takes action to rescind approval due to noncompliance with 
conditions.  
 
j. 
The granting of this change in use of the property has been at the request of the 
applicant, with the consent of the landowner.  The granting of this approval allows 
the property to enjoy uses in excess of those permitted by the zoning existing on 
the date of application, subject to conditions.  In the event of the failure to comply 
with any condition, the property shall revert to the zoning that existed on the date 
of application.  It is, therefore, stipulated and agreed that either revocation due 
to the failure to comply with any conditions, does not reduce any rights that 
existed on the date of application to use, divide, sell or possess the property and 
that there would be no diminution in value of the property from the value it held 
on the date of application due to such revocation of the Zone Change.  The Zone 
Change enhances the value of the property above its value as of the date the 
Zone Change is granted and reverting to the prior zoning results in the same value 
of the property as if the Zone Change had never been granted.

Project Summary: 
 
1. 
The applicant is requesting a zone change from Rural-43 to R-5 RUPD on an 
approximately five-acre site of undisturbed desert.  The site is located approximately ¼ 
mile southeast of the southeast corner of Happy Valley Pkwy. and 115th Ave. in the Peoria 
area.  The site is located west of the Agua Fria River that crosses the site’s southeast 
corner. The adjacent property was rezoned from Rural-43 to R-5 RUPD late last year for 
future multi-family development, known as the Villages at Pleasant River, and the intent 
of this request is to change the zoning on the subject property to match the adjacent R-
5 RUPD zoning on the adjacent property and incorporate this five-acre site into the 
neighboring parcel to act as a second phase of the Villages at Pleasant River.  
 
2. 
Whereas the Villages at Pleasant River is a single-story multifamily residential development 
with 246-units on a 24.7-acre site, this second phase will contain 55-single-storied units on 
a five-acre site.  Once the second phase is incorporated into the residential development 
there will be an overall total of 297 dwelling units for the combined properties, which will 
have an overall density of 10.0 du/ac on the site. The developer will submit a Plan of 
Development (POD) Major Amendment for administrative approval of the multi-family 
residential development on the overall site. The development’s amenities will include a 
community swimming pool, community clubhouse, dog park, car wash area, barbeque 
grills, covered ramadas, and active open space areas. Pedestrian connectivity 
throughout the community will be provided by sidewalks and pathways from the units to 
the amenity areas. There will be six-foot-high theme walls around the site’s perimeter and 
decorative access gates. The cornerstone of this development is to provide much 
needed multifamily housing options for young families, working professionals and retires 
in an area predominated by single-family housing. 
 
3. 
Primary access to the site will be provided by a new access road to 115th Ave. and from 
the northeast boundary of the neighboring property to Happy Valley Pkwy. From there 
internal driveways will link the property to the rest of the site.  Throughout the parcel there 
are 33-foot wide Federal Patent Easements that will need to abandon prior to the POD 
Amendment and the submission of building permits.  
 
4. 
On December 8, 2021, the Board approved a zone change from Rural-43 to R-5 RUPD on 
the adjacent property (Z2021067). After this approval the developer was approached by 
the property owner of the subject parcel with an interest to sell their lot, which was 
completed a few months later. On March 22, 2022, the applicant met in a pre-
application meeting, where staff directed the applicant to complete a zone change of 
R-5 RUPD on the lot to match the neighboring property, followed by a major amendment 
of the Z2021067 POD for the combined properties (PA2022035).  On July 19, 2022, the 
applicant met with Technical Advisory Committee staff to discuss the first technical 
review of this case.    
 
5. 
The applicant is requesting to vary several R-5 development standards that will match 
the varied standards of Z2021067 to keep consistency between the two properties since 
this will be a single site after this zone change is approved (see table on the next page).  
The first is to reduce the required perimeter yards to three feet to accommodate future 
covered attached patios of each unit which will be setback three feet to property lines. 
A second varied standard is to eliminate the required guest parking from 20% of the 
required parking to zero to main constancy with the neighboring RUPD.  A final request is

to vary the maximum height of wall signs from the required six feet to eight feet to 
maintain constancy with the neighboring RUPD.

White Tank/Grand Ave. Area Plan (adopted December 6, 2000): The area plan is a way 
to encourage planned community developments while preserving a variety of lifestyles 
and a high quality of life.  The subject site is designated as Small Lot Residential (2 – 5 
du/ac), which identifies areas where increased residential density development is 
appropriate and urban services are available.  Since the proposed density of the site will 
be greater than what is desired for this site, the applicant has adequately addressed in 
the Narrative Report of why this proposal is consistent with the goals / policies of the Area 
Plan and County’s Comprehensive Plan.   
 
10. 
Plan Peoria 2040 General Plan: The Peoria General Plan designates the site as Park / Open 
Space, which denotes areas best suited for open space and recreation. It would be up 
to the City of Peoria to determine if this proposed density would necessitate the need for 
a General Plan Amendment or not, as of the writing of this report there has been no 
comments from Peoria concerning this request.  
 
Public Participation Summary:

The applicant completed the requirements for notification to all the property owners 
within 300-feet of the subject site and to area stakeholders.  During the applicant’s public 
participation process staff received no concern, support, or opposition for this request.   
 
Outstanding Concerns from Reviewing Agencies:

There are no outstanding concerns from reviewing agencies. The City of Peoria was 
notified, and staff have not received any comments regarding this future development.

Staff Analysis:

Staff supports this rezoning and proposed multifamily residential development. The 
general area is predominated with single-family residences and providing an expanded 
multifamily residential alternative brings beneficial, housing diversity. This is a fast-growing 
region of the County with future and existing commercial, residential, and industrial 
developments. Proximate access to both Happy Valley Pkwy. and the Loop 303 Freeway 
improves viability of multi-family residential.  A major retail center is 1¾ miles to the east 
in Peoria and there are nearby recreational areas. The requested varied development 
standards are reasonable and would be compatible with the adjacent commercially 
zoned property to the west.  Moreover, the Agua Fria River to the east will act as a natural 
setback from the more rural residential uses further to the east.  
 
Recommendation:

Staff recommends the Commission adopt a motion recommending that the Board of 
Supervisors approve Z2022119 subject to the following conditions ‘a’ – ‘j’:

INTRODUCTION 
Village at Pleasant River II (“VPR II”) is a proposed single story multifamily 
residential development on approximately 5 acres located east and south of the southeast 
corner of 115th Avenue and Happy Valley Parkway, in Maricopa County, Arizona (“Site”).  
EMC Management, LLC (“EMC”) has already received rezoning reapproval for 246 
dwelling units on 24.69 acres located north of the Site (known as Village at Pleasant River 
– “VPR”).  EMC is acquiring the Site to include additional development area for VPR.  
The approved Plan of Development for Village at Pleasant River will be amended in the 
future to incorporate Village at Pleasant River II into one overall residential community.  
The proposed development on the Site (VPR II) will include approximately 55 dwelling 
units, consisting of 1-bedroom, 2-bedroom and 3-bedroom units.  There will be a total of 
approximately 297 dwelling units within VPR and VPR II. 
PURPOSE OF REQUEST 
 
This request is for a Zone Change from RU-43 to R-5 RUPD (Residential Unit 
Planned Development) to allow the development of a high-quality single story multifamily 
development on the Site, consistent with the already rezoned R-5 RUPD property to the 
north (Village at Pleasant River).  The additional units will be integrated into the Village 
at Pleasant River residential development.    
DESCRIPTION OF PROPOSAL 
 
The proposed community will add more diverse housing options to this 
underutilized vacant Site with needed, unique living options for those who work in the area 
or want easy access to major thoroughfares, like Happy Valley Pkwy and Loop 303, for 
convenient commuting.  The buildings will incorporate enhanced architecture and high-
quality building materials with an appealing color scheme consistent with the previously 
approved units to the north.  The intention is to seamlessly incorporate the additional 55 
units into the Village at Pleasant River.  Utilizing identical building materials and design 
elements will facilitate the integration of the additional units creating a cohesive 
multifamily community.   
The development will include approximately 18 1-bedroom units, 28 2-bedroom 
units and 9 3-bedroom units.  Pedestrian connections throughout the proposed community 
will provide easy access to the open spaces, clubhouse, and pool.  The generous amenities 
and pedestrian connectivity will facilitate a comfortable, community feel for residents.  
This development will provide much needed multifamily living options for residents in the 
area, including families, working professionals, and retirees and more.

CONSISTENCY WITH COUNTY’S COMPREHENSIVE PLAN AND WHITE 
TANK/GRAND AVE PLAN 
The proposed development is consistent with the County’s Comprehensive Plan and 
White Tank/Grand Ave Plan.  The proposed community promotes the following goals and 
policies enumerated in the County’s Vision 2030 Comprehensive Plan: 
• Land Use Goal #1: Achieve balanced and efficient development patterns. 
The proposed multifamily development will help achieve balanced and efficient 
development in the area by fulfilling a need for quality multifamily housing.  The 
surrounding area consists of undeveloped land, commercial properties, and large 
single-family residential lots.  A quality multifamily option with easy access to all 
areas of the Valley via the existing transportation infrastructure in the area which is 
readily accessed by Happy Valley Parkway will help the County achieve a balanced 
and efficient development pattern. 
• Land Use Goal #4: Exercise sound financial management through land use 
decisions that build the County’s fiscal strength. 
The proposed community will build the County’s fiscal strength by providing 
quality housing options for those who wish to work in the area.  The additional 
residents will promote the local economy by shopping, dining, entertaining, etc. in 
the area.  Furthermore, additional housing options will allow industry and the area’s 
job market to grow while providing a good quality of life for members of the work 
force. 
• Land Use Policy #7: Maricopa County supports coordinating land use and 
infrastructure planning with state agencies, counties, and municipalities. 
The Site’s developers have worked with MCDOT and the City of Peoria to improve 
the land use patterns in the area.  The developers will continue to work with the City 
to improve the frontage and landscaping along Happy Valley Parkway.   
• Land Use Policy #17: Maricopa County supports balanced land use patterns 
that include various residential, retail, non-retail employment, and public and 
civic land uses. 
The proposed development will support the County’s balanced land use pattern by 
providing a needed multifamily residential option for this area of the County.  
Nearby properties include vacant, undeveloped land, commercial development, and 
single-family residential lots.  The proposed development will provide variety, thus 
achieving a balanced land use pattern. 
• Land Use Policy #30: To promote safe and active lifestyles Maricopa County 
supports interconnected trails, parks, preserves, open space, recreation centers 
and similar features in new urban development.

The proposed multifamily community will promote a safe and active lifestyle by 
providing various amenities.  The planned amenities include multiple open spaces, 
pool, pedestrian connections, clubhouse and other opportunities for recreation and 
interactions as members of a close-knit community. 
• Economic Growth Goal #1: Contribute to an effective regional economy. 
The proposed development will bring additional consumers to the area with 
convenient access to regional transportation systems.  Residents will work, shop, 
dine, and engage in various recreational and civic activities that will bolster the 
regional economy. 
• Economic Growth Goal #3: Attract knowledge industries in a range of Basic 
Sector clusters, and attract the knowledge workers they need by achieving 
quality of place and quality of life. 
The Site will help attract workers needed for industries by providing quality of place 
and quality of life.  Industry workers will have comfortable, quality living spaces 
with access to numerous amenities.  Residents will have access to a pool, dog park, 
clubhouse, open spaces, and more.  Furthermore, the amenities will help create a 
tight-knit community adding to the residents’ overall quality of life. 
• Open Space Goal #4: Have quality neighborhood parks and open space with 
adequate and appropriate recreation amenities in urban residential 
development. 
The proposed multifamily community will provide various amenities including 
open spaces and opportunities for recreation.  Residents will have access to a pool, 
dog park, clubhouse, and pedestrian connections within the community.  Residents 
will also have easy access to outdoor activities nearby, such as hiking on a number 
of trails cultivated by the County and nearby municipalities.  
• Water Resources Policy #7: Maricopa County supports low water use and 
drought tolerant landscaping. 
The proposed development will utilize drought tolerant landscaping throughout the 
Site.   
• Energy Goal #4: Increase energy efficiency in new development. 
The proposed development will increase energy efficiency consistent with new 
construction throughout the County.  The Site will incorporate thoughtful design 
techniques incorporating modern and efficient building materials.   
 
The proposed multifamily community promotes the following goals and objectives 
enumerated in the Maricopa County Eye to the Future White Tank/Grand Avenue Area 
Plan:

• Land Use Goal L1: Promote efficient land development that is compatible with 
adjacent land uses, is well integrated with the transportation system, and is 
sensitive to the natural environment. 
The proposed development is an efficient use of the now underutilized and 
undeveloped land adjacent to Happy Valley Parkway.  The proposed multifamily 
community is compatible with the nearby commercial and single-family residential 
uses.  The Site will provide a quality housing option for area residents and 
commuters while providing easy access to all areas of the Valley via arterial 
streets/parkways and interstate freeways. 
• Policy L1.2.4: Encourage the use of flexible planning and design techniques. 
The proposed community is a creative, unique design incorporating aspects of 
single-family style living within a multifamily community.  This creative design 
facilitates the flexible planning that will benefit the area and those who wish to live 
or work in the White Tank/Grand Ave area.    
• Policy T1.1.3: Preserve scenic corridors where appropriate and implement 
access management measures on primary roads. 
The proposed development will not have a negative impact on any scenic corridors.  
Primary access to the Site will be via 115th Avenue rather than Happy Valley 
Parkway.  The Site will be developed with attention to traffic and road concerns. 
• Policy E1.1.4: Adequate control of on and off-site drainage should be required 
prior to development. 
The Site will implement a carefully considered drainage plan.  
• Objective E1.4: Support adequate opportunities for outdoor recreation that 
are sensitive to the environment. 
The Site will offer several opportunities for outdoor recreation that are sensitive to 
the environment.  Residents will be able to walk outdoors and engage in various 
outdoor play activities within the community.  Residents will also have easy access 
to nearby hiking and other outdoor activities.  
• Economic Development Objective ED1.5: Improve housing conditions in 
unincorporated communities. 
The Site will provide quality housing options for area residents looking for a 
multifamily option.  The proposed development will fulfill the area’s need for 
additional housing options as the area now offers predominantly single-family 
housing.  Residents of the unincorporated area will benefit from a quality, 
multifamily community with access to the highways and other areas of the Valley. 
• Policy ED 1.5.3: Encourage housing design and improvement techniques that 
increase energy efficiency.

The proposed development will incorporate modern design techniques and efficient 
materials.  The Site will promote energy efficiency consistent with other new 
construction in the County.   
RELATIONSHIP TO SURROUNDING PROPERTIES 
 
The overall Village at Pleasant River residential community (the previously rezoned 
24.69 acres and additional 5-acre Site) is bordered on the north by Happy Valley Parkway, 
the future site of the QT gas station to the west, and vacant land to the south and east.  There 
is an existing self-storage facility southwest of the Site which can provide additional 
storage for the proposed community’s residents.  The development will benefit the area 
since there is a need for a quality multifamily housing options in the area.     
LOCATION AND ACCESSIBILITY 
 
The existing roadways that will provide access to/from the Site are 115th Ave and 
Happy Valley Parkway.  Happy Valley Parkway is designated as a principal arterial 
road/parkway and 115th Ave is designated as an arterial road.     
The proposed multifamily community will have its primary entrance/exit on the 
western side of the Site with access to/from 115th Ave and a secondary entrance/exit to the 
east with access to/from Happy Valley Parkway.   
 
Existing regional transportation facilities that serve the area are Loop 303, Loop 101 
and Grande Ave/Route 60.  Loop 303 is less than a mile from the Site.  Grand Ave/Route 
60 can be accessed to the southwest of the Site via the interchange with Loop 303.  Loop 
101 can be accessed to the southeast of the Site via the interchange with Grand Ave/ Route 
60 or various streets, including 83rd Ave or Bell Road. 
CIRCULATION SYSTEM 
The onsite circulation and parking layout have been designed to provide a safe and 
convenient flow for residents and guests.  Residents will have adequate space to 
comfortably move throughout the Site with clear visibility of the route, other drivers as 
well as pedestrians.  Residents will navigate through the Site to conveniently located 
parking in the form of garages and surface parking spaces.  The Site will provide an 
additional approximately 126 parking spaces.  Additionally, the onsite circulation layout 
will allow easy access to Village at Pleasant River community trash compactor and car 
wash as well as the other amenities.    
DEVELOPMENT SCHEDULE 
 
The Site will likely be constructed as a second phase to Village at Pleasant River, 
pending timing and schedule of a Major Amendment to the Plan of Development and 
abandonment of patent easements.

COMMUNITY FACILITIES AND SERVICES 
 
There are no adjacent or nearby community parks or amenities.  The nearest parks 
are located approximately 4 miles northeast of the Site (Paloma Regional Park) and 
approximately 2 miles southeast of the Site (Alta Vista Park).  The Site will provide 
valuable amenities for area residents.  Residents will have access to a clubhouse, pool, 
carwash, and large open spaces.  Residents will have the opportunity to gather and enjoy 
the amenities while developing a sense of community.  The Site is located in the Peoria 
Unified School District.  The nearest school is Zuni Hills Elementary located more than 2 
miles southeast of the Site.  The Site is surrounded by mostly vacant desert land.  The 
proposed multifamily community will not have any negative impacts on any school district, 
parks or other amenities in the area.

Development Standards - Justifications for Variations to R-5 Base Zoning District  
The Board of Supervisors approved the same variations to Development Standards 
in Z2021067 – Villages at Pleasant River.  This zoning case (Villages at Pleasant River II) 
includes property that will be incorporated into one cohesive gated community with 
Villages at Pleasant River and, therefore, requires the same Development Standards.  The 
proposed development is a hybrid community which includes elements of single family 
detached homes and elements of a traditional multifamily development, whereby 
individual units have private backyards.  Many of the backyards abut the perimeter of the 
Site and the backyards will typically be a minimum of 10 feet in depth to the building; 
however, each backyard will contain an uncovered brick patio that requires a minimum 
building setback of 3 feet if covered.  Therefore, the Site’s layout, unique and special 
circumstance, and type of hybrid multifamily housing development support the deviations 
to Development Standards on this Site.   
Further, there are no adjacent single-family homes in the area.  Given the land use 
compatibility and land use patterns in the area, the proposed variations are appropriate.   
CONCLUSION 
 
This Zone Change Application establishes uses and other criteria that are 
appropriate for the Site and compatible with the surrounding area.  We request the County’s 
Approval.

General Project Summary: 
 
The proposed residential development is on currently undeveloped land 
located east of a planned QT Gas Station located in the southeast corner of 
115th Avenue and Happy Valley Parkway, in Maricopa County, Arizona.  
 
The proposed development (Bayham Parcel) is an extension to Village at 
Pleasant River (Phase 1) and not affiliated with the Phase 1 development.  It 
is planned to consist of approximately 50 multi-family dwelling units. Project 
buildout year assumed to be in year 2023 and horizon year to be in year 
2028. 
 
The proposed development (Phase 2) by itself is forecasted to generate 366 
daily trips, with 23 trips occurring during the weekday AM peak hour and 28 
trips occurring in the weekday PM peak hour. This traffic volume is included in 
background traffic conditions for the 2028 horizon year. 
 
General Comments: 
 
The current Phase 2 development on Bayham Parcel has no new access 
proposed. The site is expected to utilize the south access roadway 
(intersection 3 in the study) exclusively for gaining access to the current site.  
 
As the traffic impact analyses for Phase 1 development is also presented for 
current Phase 2 development by adding the Phase 2 site generated traffic as 
background traffic, County estimates there will be no additional significant 
impacts to the surrounding roadway system other than what is presented in 
Phase 1 development study. Therefore, County has no further comments on 
the current submittal.  However, all the relevant comments from the Phase 1 
development (attached) also apply to the Phase 2 development. Developer 
must coordinate with Phase 1 development as necessary for access and

Engineering Review has reviewed the first plan and report routed for review on 
08/11/2022, for the subject application and has no objections provided the following 
stipulations are part of any approval:
DRAINAGE PLAN REVIEW 
1.
Drainage waiver DRB2021006 was administratively approved on 08/10/2022 
and sent for site posting. Once the information is posted on site for 15 days, if 
there are no complaints, the Drainage Waiver will be approved. Waiver must 
be approved prior to issuance of any building permits.

There are Special Flood Hazard Areas on the site. Any encroachment into 
these Special Flood Hazard Areas requires a Floodplain Use Permit issued 
concurrently with the building permit.
3.
The project site is within the jurisdiction of Maricopa County. However, Happy 
Valley Parkway adjacent to the site is under the City of Peoria jurisdiction.

The proposed development is located along a section line alignment on the 
south requiring setbacks be based upon a future half width right-of-way of

requirement is no longer needed.

The subject site is not located within the County’s Urbanized Area; and thus 
will not require a Storm Water Pollution Prevention Plan (SWPPP) from the 
County. This does NOT preclude the requirement to obtain a Construction 
General Permit (CGP) Notice of Intent to Discharge (NOI) from the State 
(ADEQ), as may be required.
The following stipulations will apply:
1.
Without the submittal of a precise plan of development, no development 
approval is implied by this review, including, but not limited to drainage design, 
access and roadway alignments. These items will be addressed as 
development plans progress and are submitted to the County for further review 
and/or entitlement.
2.
Any development must ensure that historic drainage patterns are maintained 
at the up and downstream limits of development.
3.
All development and engineering design shall be in conformance with Section 
1205 of the Maricopa County Zoning Ordinance; Drainage Policies and 
Standards; Floodplain Regulations for Maricopa County; MCDOT Roadway 
Design Manual; and current engineering policies, standards and best practices 
at the time of application for construction.

revised documents received from the Maricopa County Planning and Development

RUPD to develop a multi-family development (Z2022119 - Villages @ Pleasant River 
II) at APN # 201-21-057. Water service EPCOR and sewer service will be provided 
by EPCOR, MCESD has concerns, ATC for water and sewer must be obtained prior to 
construction permit approval. 
 
Based on the above, MCESD raised no objection to this project to the Planning & 
Development Department in Accela Automation on June 21, 2022 and can allow the 
project to proceed at this time subject to the following stipulations:
