minimum separation from a nearby billboard required by the 
base zoning district. There is no known opposition. However, 
the recommended conditions of approval from the 
Commission included typographical date errors shown below 
in legislative edit (deleted language struck through and

the date of application, subject to conditions.  In the event of the failure to comply 
with any condition, the property shall revert to the zoning that existed on the date 
of application.  It is, therefore, stipulated and agreed that either revocation due 
to the failure to comply with any conditions, does not reduce any rights that 
existed on the date of application to use, divide, sell or possess the property and 
that there would be no diminution in value of the property from the value it held 
on the date of application due to such revocation of the Zone Change. The Zone 
Change enhances the value of the property above its value as of the date the 
Zone Change is granted and reverting to the prior zoning results in the same value 
of the property as if the Zone Change had never been granted.

Project Summary: 
 
1. 
The applicant’s agent is requesting a special use permit to convert an existing static 
billboard face to digital. The applicant is applying for this Special Use Permit due to the 
existing billboard not meeting the 1,000’ spacing requirements from other billboards per 
MCZO 1403.3.1.A.1.B, with the nearest billboard 888’ to the south. The applicant is also 
requesting to raise the billboard to 70’ as the current height of the billboard is not tall 
enough to be seen effectively at freeway grade due to the existence of electrical poles 
and lines that obscure the billboard. No other aspects of the billboard are being 
changed with this application. 
 
2. 
The site is zoned IND-2 and the most recent aerial photography shows the subject site 
being used as a facility for Central California Truck and Trailer Sales, LLC with the billboard 
being located on the northwest of the parcel oriented towards the Loop 202 freeway. 
The site itself matches the industrial character of the surrounding area. The latest street-
view aerials of the billboard shows it being partially obstructed by electrical lines and 
other street fixtures. 
 
3. 
The site was subject to an as-built plan of development regarding the existing truck sales 
business in 2016 under LU20160073. Prior aerials show the existing structures on this site 
having existed since the early 1980’s with the site having maintained consistent industrial 
usage. The billboard was constructed in 2019 through B201910169 with a plan of 
development having been approved administratively through Z2019045.

Staff considers the applicant’s request for this special use permit for billboard digitization 
to be reasonable and consistent with the changing character along the Loop 202 
corridor. This site is surrounded by industrial uses and bordered by a freeway.  Areas 
closest to a freeway typically comprise the highest areas of intense multi-family 
residential, commercial, and industrial activity due to the accessibility of the 
transportation node and are therefore appropriate for the use proposed. Staff is also 
supportive of replacing the existing static billboard with a digital face billboard. It is staff’s 
opinion that a digital face billboard with light mitigation is preferable than a traditional 
illuminated billboard. The applicant submitted all documents required to meet public 
participation requirements.  Staff notified the City of Phoenix about the request and 
received no comments.  Staff received no public opposition and reviewing agencies 
(Engineering and Environmental Services) have no objections to the request.

Purpose of Request 
The applicant requests a Special Use Permit (“SUP”) of a digital conversion of both faces of the 
billboard structure (the “Billboard”) along the Ed Pastor 202 Freeway (the “202”), parcel # 104-
26-003Q (the “Property”).  This 2 acre parcel is located in unincorporated Maricopa County and 
is currently zoned IND-2 (Light Industrial).  The applicant is also requesting the billboard 
structure be raised from the current height of 30’ to the allowed height of 70’ to offset the 
difference in elevations from the base of the structure to the freeway.  The sign cannot be seen 
effectively from the freeway travel lanes today because of powerlines and obstructions.  All 
other standards and structures stay the same.  Only the faces will be converted to 14x48 digital.  
The SUP is required due to the spacing requirements of 1,000 feet in Section 1403.3.1.A.1.b.  
The closest billboard is 888’ to the south. 
 
Description of Proposal 
 
The property is located directly adjacent to the 202 freeway approximately 1,300’ south of the 
SEC of Buckeye Rd and the 202, and approximately 1,200’ north of the Roosevelt Canal.  The 
billboard is along the western perimeter closest to the freeway as possible. The Property is 
currently being used for outdoor storage.  The property can be accessed off of N 59th Ave, an 
ADOT frontage road to the 202. 
 
The applicant is proposing to convert the dual faced billboard with 14’ x 48’ digital sign faces at 
a 30 degree vee.  The billboard is currently at 30’ in height and flag mounted.  The billboard is 
proposed to be raised to 70’ in height because of the raised elevation of the freeway near the 
Buckeye Rd interchange and the Roosevelt Canal overpass.  All other development standards of 
the Maricopa County Zoning Ordinance apply.  The billboard will meet the standards in Chapter 
11, Section 1112 of the Zoning Ordinance.   
 
The distance requirement is 1,000 feet separation.  There is another billboard 888 feet to the 
south, so only a difference of 112 feet.  There are no other areas on this eastern portion of the 
freeway that are zoned to allow billboards without major deviations.  Two billboards 888 feet 
apart in this very heavily industrial area along a freeway will not create a precedent or 
proliferation of digital billboards.  Both billboards are also existing and legal non-conforming.  
The digital panels will also be turned off every night at 11:00 pm other than the existing static 
signs that stay on all night.   
 
Height Justification 
 
The billboard is currently 237’ from the main travel lanes.  With the large swath of ADOT right-
of-way the main views of oncoming traffic are approximately 501’ from northbound traffic and 
475’ from southbound traffic.  The freeway is 6’ to 13’ higher than the Property based son 
engineered at sea level calculations.  There are a number of utility lines and poles that block the 
views of the billboard for oncoming traffic to safely view the sign faces, as well as ADOT 
signage.  The request to 70’ in height will allow oncoming traffic to view the board safely.

Relation to Surrounding Properties 
 
The surrounding parcels of the Property consist of IND-2 zoning and industrial uses.  The parcels 
to the north, east and south are all zoned IND-2 and have similar storage uses.  To the west of 
the Property is the 202 freeway.   
North – IND-2 zoned for outdoor storage.  No adverse effects are expected. 
South – IND-2 zoned for outdoor storage - No adverse effects are expected. 
East – IND-2 zoned for outdoor storage.  No adverse effects are expected. 
West – 202. No adverse effects are expected. 
There are a few residential areas over half a mile to the southwest.  With the grade differences 
from that distance there should be no views of the billboard from the residents.   
Th new digital faces on the structure will allow local businesses of the west valley to advertise 
to viewers.  A new, quality billboard at this site will add improvement to the property and allow 
for messaging to the east valley.  The billboard is conducive to the development and General 
Plan land use designations in the City of Phoenix.  Digital billboards are also allowed in the City 
of Phoenix along the 202 freeway in Industrial Zoning. 
Location and Accessibility 
The Property is accessible from the frontage road, N 59th Ave.  The billboard will be reachable 
for maintenance from the access point along 59th Ave.  As stated, the 202 freeway is directly to 
the west of the Property.  The Property has regional access via the 202 freeway.   
Circulation System 
The billboard is accessed from N 59th Ave.  There will be no vehicular movement to any 
residential areas.   
Development Schedule 
Once a permit is issued by Maricopa County the digital faces will be ordered and delivered 
within 4 weeks of being ordered.  The construction process can be done in only a few days.

Community Facilities and Services 
The Property is in the Riverside Elementary School District.  Riverside Elementary School is the 
closest school to the site at 3.7 miles away at 1414. S 51st Ave.  Smith Park is the closest park at
