RECITALS WHEREAS, the District acquired an Easement Agreement for Channel Construction and Maintenance (“Easement”) over a portion of land in Section 29, Township 1 North, Range 7 East of the Gila and Salt River Meridian, which was recorded on December 28, 1967, as Instrument Number 1967-0242147, in the Office of the Maricopa County Recorder, Maricopa County, Arizona (“MCR”), WHEREAS, the District determined that said easement, which is described and depicted on Exhibit “A” attached hereto and made part hereof is no longer needed and desires to release and extinguish the Easement; and FCD Project: Sossaman Road Drain FCD Parcel No.: SR-09PCE Page 2 of 6 APN: 218-54-022D, 009G, 009F, 995, 018A, 009L, 009M, 009N, 009P, 009Q, 009R, 009S, 009T, 009U, 009V, 009W, 009X, 009Y, 009Z, 992, 986 ptn. FCD Permit No.: FRU2500187 NOW, THEREFORE, District hereby releases and forever surrenders any and all interest it has or may have in Easement Agreement for Channel Construction and Maintenance for recorded as Instrument No. 1967-0242147 in the MCR. The Terms of this Release shall be construed in accordance with the laws of the State of Arizona and any action thereon shall be brought in the appropriate court located in Maricopa County, Arizona.
