Hello Rachel,
I do have some comments/questions regarding the 3rd submittal (I don't think we ever saw the
first two). 
1. Under Development Schedule, they state  they will begin operating with SUP as soon as we
have approval. We have been communicating our concerns and objections regarding the violation
and SUP for several months, and they have never ceased to operate. Just this morning there was a
large commercial truck delivery. (see attached photo)
2. Public Utilities and Services,
a. They state power is supplied by APS, but fail to mention the massive generator that is in use.
There have been several references to the noise from the generator in email communications to
both Donna Gerrone regarding V202101217 and Sean Watkins for the SUP Z2021127
Background Info
b. On 6/20/21-permit- B202107409 for a 500 gal A/g propane tank and hook to an existing
generator  (I do not believe this was an existing generator)
c. 6/3/2021 - permit - B202107929 - Cancelled- 400 Amp Electrical Service & Panel

3. Development Standards- In question is the 25% coverage, I believe it is more.
Not permitted was the block fence they mention which exceeds 6' as stated and not mentioned is
the asphalt they laid that probably covers 20% of back yard.

My name is Susan Bassett and I am writing to voice my opposition to the application for SUP Z201127
by Exquisite Stone. I live at 38903 N 15th Avenue in the Desert Hills area, and my property is located
directly across the street to the north of Exquisite Stone’s property at 38807 N 15th Avenue. I moved to
Arizona from Texas after the death of my husband to be near my daughter in August 2021. After
patiently waiting for the right property, and after careful consideration of the area, I purchased my
current home. I loved the country neighborhood and the location was perfect for me. I was completely
unaware that a commercial granite business occupied the property across the street.
I had an experience with a neighbor in Texas, which contributes to my strong opposition to this special
use permit. Our family lived on a 20 acre tract, just west of Amarillo, for 25 years. It was a quiet
country neighborhood with appropriate zoning and restrictions, to which our neighbors all adhered.
The 45 acre tract south of us at 8050 S. Blessen Road, sold to a gentleman who was quite wealthy. He
built a multimillion dollar home on the property and immediately started building massive barns.
Concerned, I notified the surrounding neighbors that our restrictions, which had been in force for 20
years, were set to expire within the year. All neighbors within the development had to sign to renew the
restrictions, but most did not think there would be a problem and refused to sign for fear of making the
wealthy new neighbor mad. The restrictions lapsed and expired. Within 3 years, this neighbor’s
property contained over 40 show pigs, more than 50 longhorn cows which calved every year, and
numerous horses, goats, chickens, ducks, geese, and 7 dogs. He installed stadium lights which lit up
not only his own property, but all surrounding properties as well. Large commercial fans roared
continuously, the smell of manure was forever in the air, and flies were a major nuisance. We could
never have foreseen the extent to which our neighborhood would be damaged. At that point, there was
nothing we could do. Our once quiet country neighborhood was forever changed.
Having experienced that, I am alarmed at the prospect of a commercial granite business being in
operation across the street from me. There are already a number of disturbing issues. Exquisite Stone
currently runs a very large generator that is extremely loud, especially for the neighbors to the south
and west of the property, but which can be heard from my property as well. Trucks are continually
being loaded and unloaded within the fenced yard and the loaders and other heavy equipment they use
are also quite loud. Semi trucks and smaller trucks come and go throughout the day. There are often
semi trucks waiting on 15th Avenue, a narrow street which is obviously not designed to handle this
type of traffic. Perhaps worst of all, the one and only truck entrance to Exquisite Stone is on the west
side of the property. My neighbor’s young children must pass by this truck entrance as they walk to
and from the school bus each day. There is no sidewalk, and there is no other route the children can
take to get home. They must pass by the truck entrance! Horses are also prevalent in our
neighborhood and riders often ride down 15th Avenue to get to the Maricopa Trail. Horses with truck
traffic can quickly become a dangerous situation. In addition, as I understand from research, silica
dust is produced in the cutting and manufacturing of granite. Is this dust being properly filtered,
captured, and contained, or is air quality another worrisome issue? Who monitors the operations for
safety and quality control? Will surrounding property values be affected? All these concerns are
relevant for our neighborhood today, and will become constant and persistent issues if a permit is
approved. Yet my biggest fear is that in 2 years, or 5 years, or 10 years as this business continues, and
potentially continues to grow, there will be even more noise, more traffic, and further safety issues -
and we will be powerless at that point to change it.

Please accept this as my written objection to the Special Use Permit applied for by Exquisite
Stone (Isfan) for a granite shop at 38807 N. 15th Ave., Desert Hills, AZ  85086.
 
My house is located three lots east of said property.  The following are my objections:
1. This area is zoned residential. I feel granite or quartz fabrication should be limited to
commercial or industrial zonings.
2. We are on a shared well. The excessive use of water for the fabrication process means
using far more of this precious resource than the typical residential use.
3. As quartz and granite fabrication require wet conditions, the excessive use of the well
pump may cause it to fail earlier than its normal life-cycle when used by residential
properties increasing maintenance costs to each of the properties who share the well. 
4. Does the business intend to haul water to its property instead of using our shared well? 
5. How will they handle the runoff wastewater? Are they recycling it? Hauling it off the
property?
6. Silica is toxic. What precautions are in place to handle this hazardous byproduct?
Please let me know when the meeting is being held.  The sign regarding the SUP states the
date, time and location are to be determined.

Good Afternoon ,
 
I wanted to send a brief email outlining my concerns for issuing a Special Use Permit (SUP) on #8807
N 15th ave.  I am a resident of 38722 N 15th ave  just South west of said property. 
 
I have some major concerns with SUP being granted to operate a Stone fabrication company out of a
residential neighborhood. Mu concerns are  not only as  home owner but as a licensed real estate
professional. It is important to first point out that this company has been operating without any such
permit for as long as I have occupied my home in May of 2021.   Many complaints have been made
to the county and the business does not meet any of the Home occupation standard to be
considered a home business as stated in Chapter 5 section 10 a-q of the Maricopa county zoning
ordinance which has lead to the business putting in for the SUP. 
 
As a real estate professional for over 6 years,  I am quite concerned with how granting Exquisite
Stone LLC to operate a industrial business in a residential area will effect our home values.   The
homeowners like myself purchased properties in a ru-43 area not a industrial area where a business
like this belongs.  It is in my professional opinion that resale values of the surrounding homes will be
greatly effected in addition to the homeowners will  legally will have to disclose the noise issue
coming from the location , which will infact impact the amount of people that will be willing to
purchase a home with such disturbances.
 
Some of the negative impacts we have seen occur  to the neighborhood while  Exquisite stone
 continues  to operate without a SUP is a s follows:
 
Tractor trailers making deliveries to the business as early a 7am and continue to honk horns for gate
to be opened for deliveries.
Loud generator operating from 7am to 6pm causing a noise disturbances to the neighborhood
Parking of employees vehicles on 15th ave.  out side the main gate
Increased commercial traffic on 15th ave  all times of day for deliveries .
 
In closing I would strongly urge you to consider the negative impact that allowing Exquisite Stone
LLC  to be granted a SUP to operate a industrial stone fabrication company in a Residential
community.

As a direct neighbor of this proposed permit I would like to be put on record that I am against the
issuance of a SUP for this business.
 
They have been operating without any such permit for at least the last 11 months that I have lived
here. 
 
There is a high level of constant noise coming from the facility from 7 am until 6 pm daily from the
generators and stone cutting.  I would also like to point out that delivers are made via tractor trailer
more then just 2 times a week  often resulting in truck drivers repeatedly honking their horns to gain
access to the property. 
 
This area is al RU-43 zoned and has no place for a industrial business being operated.
 
The business continues to operate at this time with out the special Use Permit even after being sited
by the county for operating without permits.

The Narrative Report states that water is supplied by PRIVATE well.  That is a lie.  It is a
SHARED well.  I'm the well manager and all of the homeowners on said well need to be in
agreement for an owner to use the water for anything other than their personal residence. 
They need to obtain their water from another source.  If this doesn't happen, we will sue.

  Their storage yard is very full and they are taking the crates that the marble slabs come in
apart  right next to the west fence of our riding arena.  Due to the noise (sawing and
hammering) and the wind blowing their trash around our horses are afraid to go to that end of
our arena.  The trash consists of styrofoam, packing slips, loose boards, etc..  This has become
a safety issue in that if our horses spook while I am riding I could be seriously injured.  Just
one MORE reason their business does NOT belong in a residentially zoned neighborhood.

Dear Rachel, 
I am writing to voice my opposition to the special use permit Z2021127, applied for by Mr. Isfan of 
Exquisite Stone, at the residence located at 38807 N 15th Ave, Phoenix AZ  85086.   
I am the owner and sole occupant of the property located at 38903 N 15th Ave, Phoenix, AZ  85086, 
Parcel #211-50-025A.  My property is a residential dwelling situated directly across the street to the 
north of the Isfan residence. While I have no personal issue with the family and wish them well, the 
noise from the daily operation of the business, the heavy equipment noise, and the semi truck traffic are 
all very concerning issues to me. Our peaceful rural community should be free from industrial noise and 
traffic, as it was originally zoned. It is quite frustrating to sit on my patio and listen to the whine of 
equipment, the idling of semi trucks, and the beeping back-up alarms of loaders. The issue is not that a 
business is being run from the property. The issue is that it’s a very loud business, which, in addition to 
the noise, brings in commercial trucks and trailers to an area not designed for such traffic. And while the 
noise generated from the business is certainly a huge nuisance, I feel that the truck traffic is a very real 
safety concern. 
I have previously written a letter to Sean Watkins, the prior Planner, addressing my concerns. This letter 
should be on file with the Maricopa Planning and Development Department. As a nurse, due to my work 
schedule, I am unable to attend the Planning and Zoning Commission hearing scheduled for Thursday 
June 16, 2022.  May this letter be record of my opposition to SUP Z2021127.

BASIS FOR FINDINGS:  Code Enforcement Officer Donna Gerron presented testimony regarding the 
charges in Case No. V202101217. Respondents Leonard Isfan and James Isfan are the owners of the 
subject property. Following complaints alleging violation(s) of Maricopa County ordinances, the Department 
conducted an inspection of the subject property on July 20, 2021. Based on the inspection, violation(s) 
involving commercial business operation in a rural/residential zoning district without proper zoning 
entitlement on the subject property was confirmed. The Department issued a Notice and Order to Comply 
to Respondents on July 21, 2021. In response, Respondents filed a special use permit application with the 
County (case no. Z2021127) on September 21, 2021. Subsequent Department investigations revealed that 
the noted violation(s) had continued, and that Respondents had not obtained the proper zoning entitlement. 
A Hearing Summons was mailed to Respondents and posted on the subject property on February 8, 2022. 
A pre-hearing investigation conducted on April 14, 2022, confirmed that that the violation(s) had not been 
corrected. 
Based on the testimony and evidence offered at the hearing, Respondents are found responsible as to 
the Charge(s). 
Non-compliance fines, including daily non-compliance fines, are appropriate in this case.  Daily non-
compliance fines shall accrue if compliance is not verified as set forth below. 
IT IS THEREFORE ORDERED THAT RESPONDENTS PAY THE FOLLOWING FINES/SANCTIONS:

Hello Rachel
I emailed you earlier about my position of the Special Use Permit for the Isfan Residence #
Z2021127.   As mentioned earlier, I am opposed it.
The reason for this 2nd email is add more information.   
Years ago I had built an accessory building in my back yard without a permit and built it outside the
setback area.    After construction of this building, a dispute with a neighbor resulted in a visit from
code enforcement.  I was cited for multiple violations.    The violation case # was V200600150.
Since I had invested considerable effort & money into this building, I was hesitant to tear it down. 
Thus, I chose to pursue a variance with the county.   I created construction drawings, paid a filing fee
and sat in a room all day for my case to be heard.   This happened to be the last one of the day.  
After speaking to the board and stating my case, they ended up disapproving my variance.
I Then chose to relocate the building which involved more construction drawings, another fee and
the additional costs to relocate.    I ended up completing the move with great success while
complying with the county building & zoning requirements.
The other violation infringement consisted of having several unregistered vehicles in the back yard. 
In order to resolve this, I built a fairly large garage and moved the cars into it.  Again, this involved
more construction drawings, a permit fees as well as more money to build the garage.
The point of all this is that I made an attempt to deviate from rules of the existing R43 zoning and
was turned down.  It is only fair the the Isfan Residence receive the same treatment, comply with
the existing R43 zoning residential requirements of this neighborhood and move their commercial
business elsewhere.

My name is Sandra Luedke, I am a registered voter and I live at 38816 
N 15th Ave in Desert Hills, AZ. Parcel 211-50-023-B. For over 14 years 
my husband and I have called this place home.
I wish to clearly state my objections to SUP Z2021127 that Leo Isfan 
has applied for and do protest this request. I plan to attend the hearing 
in person, which is scheduled for June 16th, and I also wish to speak.
For over a year now, myself and several neighbors have been 
submitting letters of complaint, first regarding the Violation that was filed 
(V202101217) for which they were found Responsible at a hearing on 
April 14th 2022, and again for SUP Z 2021127. Photographs and Video 
have previously been submitted to document concerns and ordinance 
violations. Since Leo Isfan and his son James purchased the home, 
there have been multiple non-permitted changes made to the property, 
and they have continued to operate a noisy industrial business under 
the guise of a home business despite not having an approved SUP.
As I review the letters I have previously sent, and those from neighbors 
that have shared the letters they have sent, it is apparent that Exquisite 
Stone is not the type of home run business that belongs in our 
neighborhood. The companies lack of communication, honesty, and 
omission of accurate details in the 3rd SUP submittal I believe are 
intentional and only add
 to the distrust. 
In the 3rd submission, they state that they operate off a Private 
Well, this is not accurate. It is a Shared Well with 3 other 
households sharing the well.

They fail to mention the massive generator that is also used to 
operate this business. This generator is located on the south side 
of the building and is not identified in the schematic drawing 
submitted in the 3rd submittal
 6/20/21 Permit B202107409 for a 500 gal A/g propane tank 
and hook to an existing generator. 
The generator on the south side of the building was not 
pre-existing, and somehow smells like diesel when they 
start it up.
They fail to mention or identify the RV that is parked on the west 
side of the building, and I believe occupied. 
What they state as an existing concrete driveway from the gate up 
to the building  (106 in drawing), was not pre existing, the blacktop 
was laid down after they purchased the property.
The block wall on the west side of the property is at least 7 feet tall 
and was not pre existing. They removed the existing fence and built 
the block wall fence after purchasing the property.
The outdoor storage listed is actually a 54 foot Sea-tainer
The large RAD roll off container is not in the diagram

The forklifts used are not mentioned

There are probably more inaccuracies in the 3rd submission, but I have

Today they put that United Rental fork lift to use. It is the one that showed up on June 2, 2022. I
guess they needed something bigger than the forklifts they currently have on the property. Just
more reasons why I oppose  SUP Z2021127. Please add this documentation to the file. (In one

I would like to state my opposition to the Isfans request for an SUP (Z2021127). I own the
residence (parcel 211-50-027K) that borders the south side of the Isfan residence. This stone
cutting shop is an industrial business that creates excess noise and traffic and does not belong
in a residential neighborhood. I previously attended the commissioners hearing and spoke my
opposition at that time, I now plan to attend the Nov 2nd, BOS hearing.
