The proposed C-3 CUPD zoning is to accommodate the digitalization of a billboard along the Loop 202 freeway. The CUPD will permit a radial separation fewer than the 1,000’ minimum separation required by the base zoning district, and a billboard height up to 70’ where the base zoning district would permit a max. height of 70’ above adjacent grade but not to exceed 48’ above the elevation of the freeway (which is depressed below adjacent grade). There are no outstanding concerns from County review agencies. There is no known opposition. Commission Recommendation: On 9/22/22, the Commission voted 8-0 to recommend approval of Z2022075 subject to conditions ‘a’ – ‘g’: a. Development of the site shall be in substantial conformance with the Site Plan entitled “SITE-PLAN-2“, consisting of 2 full-size sheets, dated June 20, 2022, except as modified by the following conditions. b. Development of the site shall be in substantial conformance with the Narrative Report entitled “NARR-RPTS-2”, consisting of 4 full sized sheets, dated July 7, 2022, except as modified by the following conditions. Distance from Another Billboard to the west: 200’ e. Noncompliance with any Maricopa County Regulation shall be grounds for initiating a revocation of this Zone Change as set forth in the Maricopa County Zoning Ordinance. f. The property owner/s and their successors waive claim for diminution in value if the County takes action to rescind approval due to noncompliance with conditions. g. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, the property shall revert to the zoning that existed on the date of application. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation of the Zone Change. The Zone Change enhances the value of the property above its value as of the date the Zone Change is granted and reverting to the prior zoning results in the same value of the property as if the Zone Change had never been granted. The applicant is requesting a Zone Change with Overlay from R-5 and C-3 to C-3 CUPD on an approx. 28,435 sq. ft. site to convert an existing static billboard to a digital display. The applicant is applying for this zone change due to the existing billboard not meeting the 1000’ spacing requirements from other billboards within 3 miles of a municipality per MCZO 1403.3.1.A.1.B, with multiple billboards within 1000’ along Apache Trail and near the intersection of Apache Trail and the Loop 202 Freeway. The subject property is located at the intersection of Apache Trail and the Loop 202 freeway, and the billboard is located approx. 215’ from the southbound travel lane. The current billboard is 48’ in height and the applicant is also proposing to increase the size of the billboard facing to 14x48 (672 sq. ft) and raise the billboard from 48’ to 70’ in compliance with the maximum allowed sign face and height on a C-3 zoned parcel. The parcel is designated as Urban Residential in the East Mesa Area Plan and as Neighborhood residential in the Mesa 2040 General Plan. 2. The most recent aerial photography shows the subject site currently being used as vehicle storage for the Dunesport business that is being run on the adjacent parcel to the west. The site is directly bordered on the east by an exit lane to the Loop 202 freeway and to the north is the Desert Rose Motel and RV Storage facility. There is an existing billboard located approx. 236’ west on the adjacent parcel to the west, 218-40-001M, which is oriented east/west to face Apache Trail traffic coming onto and off the freeway. 3. The billboard on the site was approved in 2014 under planning cases variance BA2014033, plan of development Z2014059, and subsequently permitted under B201405650. The approved variance allows for a 40’ advertising sign height and a setback of 0’ from the east parcel line. The conditions for Z2014059 include a stipulation that the maximum height of the sign cannot exceed 40’ and that the billboard cannot be illuminated. It should be noted that the approved location on the Plan of Development does not match what was ultimately approved in permitting. The billboard was built approx. 135’ north of what was entitled. Staff found no explanation for this discrepancy. This request would grant a permanent entitlement for the billboard at its current location. 4. The parcel was subject to a violation case, V202102091, in late October of 2021 due to the billboard having been illuminated past midnight despite being permitted as being non-illuminated per the conditions of Z2014059. The lights were summarily removed, and the violation was closed in December of 2021. 5. The applicant is requesting a zone change to C-3 CUPD. The applicant has complied with the Maricopa County Citizen Review Process with the required posting of the site and notification by first class mail to adjacent property owners and HOA’s within 300’ of the subject parcel and notification to interested parties. A Public Participation Results Report was submitted to Staff in accordance with County requirements. 12. The applicant held a virtual public meeting on Tuesday, June 7, 2022. The Results Report indicated that there were no attendees at the meeting. 13. Staff received no letters of opposition or support for the request. Outstanding Concerns from Reviewing Agencies: 14. N/A. Staff Analysis: 15. Staff considers this site to be an appropriate site for a billboard. Billboards, including digital billboards, are a permitted use in the current C-3 zoning district. Additionally, this site is surrounded by commercial uses and bordered by a freeway. Areas closest to a freeway typically comprise the highest areas of intense multi-family residential, commercial and industrial activity due to the accessibility of the transportation node and are therefore appropriate for the use proposed. 16. Staff would note the existence of R-5 zoned parcels directly to the west and north of the site. Per the conditions of Z2014059 and under normal circumstances, per MCZO 1403.3.1.B.2, this billboard would not be allowed to be permitted. However, both adjacent parcels noted are owned by the Desert Rose Motel and are currently be used for a commercial purpose as a motel and RV storage respectively. The nearest residential use from the billboard is ~284’ to the north at 8946 E. Albany St in the Sunny Skies Mobile Estates Unit 2 subdivision, well beyond the required 150’ minimum separation from a digital billboard to a residential zoned parcel. 17. Z2014059 also requires a maximum height of 40’ and requires the billboard to be non- illuminated. However, the zone change would moot these requirements as the applicant would be able to meet the existing zoning standards. 18. The request for the CUPD standards is due to the spacing of the relocated billboard and an existing billboard on the southwest of the adjacent parcel. As noted above, this existing billboard is oriented towards traffic coming onto and off Apache Trail. The subject billboard would be oriented towards the Loop 202 Freeway. Staff is also supportive of replacing the static billboard with a digital face billboard. It is staff’s opinion that a digital face billboard with light mitigation is preferable than a traditional illuminated billboard. 19. The applicant submitted all documents required to meet public participation requirements. Staff notified the City of Mesa about the request and received no comments. Staff received no public opposition and reviewing agencies (Engineering and Environmental Services) have no objections to the request. Z2022075 Page 9 of 10 Recommendation: 20. Staff recommends the Commission adopt a motion recommending that the Board of Supervisors approve Z2022075 subject to the following conditions ‘a’ – ‘h’: a. Mesa, AZ. 85207 Purpose of Request The applicant requests a Commercial Unit Plan of Development (“CUPD”) to allow for a digital conversion of the single face structure (the “Billboard”) along the Loop 202 (the “202”), parcel # 218-40-001X (the “Property”). This small 28,435 square foot parcel is located in unincorporated Maricopa County and is currently zoned C-3 (General Commercial) with a small portion of R-5 (Multiple Family Residential) on the northeast portion of the parcel. The billboard structure will be built in the same location. A second face will be added to the south face, and both faces will be converted to digital. All other standards and structures stay the same. The SUP is required due to the spacing requirements of 1,000 feet in Section 1403.3.1.A.1.b. The spacing is due to being 200’ to an arterial sign along Apache Trl. and 750’ to signs at the SEC and NEC of Apache Trl and the 202. The height of the sign will be at 70’ due to the Apache Trl. overpass and elevation difference between the Property and the freeway lanes. The digital face will also incorporate horizontal and vertical louvers to mitigate any light trespass to surrounding properties since it is within 500’ of residential zoning to the north. Description of Proposal The property is located directly adjacent to the 202 freeway with the address of 8946 E Apache Trail. The billboard is along the eastern perimeter closest to the freeway as possible. The Property is currently industrial and used for outdoor storage. The property can be accessed off Apache Trail to the south. The applicant is proposing to convert the current single faced billboard to two faced and from static to digital. The current billboard is at 48’ in height and is oriented to the 202 off ramp. The billboard has a setback 0’ from the east property line as allowed by right. The setback will stay the same but the height will be raised to 70’. The static faces will be converted to digital faces. The digital faces will also incorporate horizontal and vertical louvers to mitigate any light trespass to surrounding properties. All other development standards of the Maricopa County Zoning Ordinance (“MCZO”) Chapter 14 apply. The billboard will meet the standards in Chapter 11, Section 1112 of the Zoning Ordinance and all digital general provisions provided in MCZO Art. 1403.3.1.J. New digital faces on the Property will allow local businesses of the east valley to advertise to viewers. A new, quality billboard at this site will add improvement to the property and allow for messaging to the east valley. The rezone is conducive to the development and General Plan land use designations in the City of Mesa. This billboard is consistent with freeway types of development and the Commercial zoning and uses on the east side of the freeway. Location and Accessibility The Property is accessible from Apache Trail. The billboard will be reachable for maintenance from this access point. As stated, the 202 freeway is directly to the east of the Property. The Property has regional access via the 202 freeway. Circulation System The billboard is accessed from Apache Trail. There will be no vehicular movement to any surrounding properties. Development Schedule Once a permit is issued by Maricopa County the digital faces will be ordered and delivered within 4 weeks of being ordered. The construction process can be done in only a few days. Community Facilities and Services The Property is in the Mesa Unified School District. Stevenson Elementary school is the closest school to the site at 628 S 96th St, 1.6 miles to the southeast of the Property. The City of Mesa Skyline Park is 2.4 miles to the south of the Property. Notification and Information Procedures We have met all County noticing requirements for a SUP. These include letters to surrounding property owners and other interested stakeholders. We have posted the site on our street frontages with signs to inform passersby of the proposed SUP case. We worked with County staff on the exact location and number of signs to be posted. The County will also send notifications to the surrounding property owners as the cases near the public hearing dates with the County Planning and Zoning Commission and Board of Supervisors. Letters went out on May 11,2022 for a notice of application and of a neighborhood meeting which was held on June 7, 2022 at: 5:00 PM via a zoom webinar. We had no one register, or was in attendance for meeting. Response Procedures We will respond to all input and comments we receive from parties affected by our application. We will also provide our responses to the County staff for their records. We will follow‐up as necessary to ensure proper responses are provided and information is shared regarding the status of the request to interested stakeholders. We will provide the County with copies of our correspondence, letters, and information shared with stakeholders. In addition, maps and lists of stakeholders and property owners will be included in our final Citizen Participation Results Report. Schedule of Completion We are submitting the SUP request for the Property with this Citizen Participation Plan Report on June 13, 2022. We will let staff know if we receive any further neighborhood input or comments. Status Procedure We will update the County staff via email and telephone calls.
