THISISA COMPETITION IMPRACTICABLE PROCUREMENT BECAUSE (attach additional pageif needed):

Quality Testing is currently administering the project and has the familiarity regarding all project history, coordinating
stakeholders, and all complications associated with the additional unforeseen work encountered on the project. They have
facilitated all construction management of the project since construction hand off in 2021. They are required to provide pre and
post bid, pre-construction, construction, and post-construction construction management services. The TT0495 (Lower
Buckeye Rd: 71st Ave to 67th Ave) project will not be completed by its original estimated completion date due to numerous
unforeseen subsurface utility conflicts resulting in unintended but necessary additional construction work and construction
administration services required to complete the project. This additional construction work has increased the estimated project
construction duration susbstantially whereby requiring additional construction management and administration services from
Quality Testing. It is in the best interest of MCDOT to utilize Quality Testing to complete the TT0495 Lower Buckeye Rd: 71st
Ave to 67th Ave project remaining construction, and post-construction construction management services. Utilizing a different
construction management consultant at this state of the construction would be contrary to the public interest.

The alternative would be to use a different construction management consultant, which would
be unacceptable because of unfamiliarity with with the project, including current construction
coordination and utility issues. Quality Testing has the history and detailed background to
complete the remaining construction and post-construction management services.

MC1-352-B states: The Using Agency requesting a Competition Impracticable Procurement shall provide written evidence
to support a Competition Impracticable determination containing an explanation of why the proposed procurement
process is advantageous to the County; and the scope, duration, and estimated total dollar value of the procurement.

Dear Mr. Coleman:

Behind this letter you will find QT’s cost proposal, formatted in accordance with MCDOT Tables A, B & C,
for completing our work on the TT0495, Lower Buckeye Rd project. Beginning 9/8/2022, our services for
this project will be covered under new MCDOT Contract 2022-052, Assignment No. 2. In reference to
this proposal, please consider the following:

e The initial MCDOT 2018-021, Assignment 8 cost proposal for this TT0495 project was developed
on 10/8/2022 and based on consultant service time beginning in 12/2021 and ending in 8/2022.
At this time, the construction project was just recently advertised, but not yet awarded. The
consultant service duration was based upon the designated construction contract time of 235
calendar days, and the expectation of a fairly routine project.

e MCDOT issued the consultant NTP on 10/11/2022. Routine project set-up and preparations
began immediately. During early plan and specification reviews it became apparent that there
were multiple design inconsistencies to address, hence with the intention of mitigating future
costly issues, preliminary pre-construction hours by the CA team were heavier than expected.

e The construction contract was awarded to Nesbitt Contracting and the initial construction NTP
date was set at 1/24/2022 with an end date of 9/16/2022.

e Due to multiple design conflicts, utility and local government intervention, and significant
changed conditions being encountered, all well documented outside the context of this cost
proposal, several large change orders have been necessary, many involving time extensions.
Thus far, 85 calendar days have been added to the contract. As a result, the current approved
contract end date for construction is now 12/10/2022.

e With construction ending on 12/10/2022, our expectation is that our service will end after project
close-out, sometime in 2/2023.

e = The initial 10/8/2022 cost proposal for MCDOT 2018-021, Assignment 8 is now entirely exhausted
and Contract 2018-021 expired on 9/7/2022.

e This new cost proposal covers remaining services for TT0495 beginning on 9/8/2022 and
continuing through project administrative closeout.

Your not-to-exceed estimate of $241,289.36 for Assignment No.2 has been received and accepted for this project with
a completion date of 6/28/2023. You are hereby authorized to proceed with the work for the referenced project as
originally described in the Scope of Work. Please specify the contract title, contract number, assignment number, and
the dates of the completed service on all related correspondence, including the invoice. Send the invoices, Certificate
of Performance, and SBE Participation Reporting Form to the attention of Financial Services Branch, Maricopa County
Department of Transportation. The Certificate of Performance must be dated on or after the final invoice date and
must accompany the final invoice. The SBE Participation Reporting Form must be submitted with each pay application
or invoice. Any pay application or invoice without this form attached is subject to rejection as not being a completed
pay application or invoice pursuant to the terms of the contract.

Consultant shall perform the remainder of the construction administration duties for MCDOT Project No. TT0495
Lower Buckeye Rd: 71st Ave to 67th Ave in accordance with the Scope of Work issued under previously issued Work
Assignment 2018-021-8. Work assignment 2018-021-8 was issued under contract 2018-021 which has now expired.
This work assignment will provide for the completion of the remaining construction administration work under
contract 2022-052. With this work assignment, its predecessor, 2018-021-8 will be closed upon receipt of final
invoice and the certificate of performance.

Consultant's fee proposal has been reviewed and approved by MCDOT Construction Management. See attached Fee
Schedule.

Consultants NTP date is 9/8/2022.

Consultants work shall be completed by 2/28/2023.

An additional 120 calendar days shall be added for internal administration and close out work resulting in a work
assignment completion date of 6/28/2023.

If at any time during the project assignment a material change in the scope of services to be provided occurs, causing
an increase in the original cost estimate shown here, you must provide MCDOT with a written Explanation of the
additional work along with an estimate of additional costs. No additional work shall commence prior to written
authorization by MCDOT. No claims for additional work shall be accepted that have not received prior MCDOT
approval.
