The Board of Supervisors of Maricopa County, Phoenix, Arizona, convened in Formal Session at
9:30 AM on Wednesday, July 27, 2022, in the Supervisors' Auditorium, 205 W. Jefferson Phoenix,
AZ 85003, with the following members present: Bill Gates, Chairman, District 3; Clint Hickman,
Vice Chairman, District 4; Jack Sellers, Supervisor, District 1; Thomas Galvin, Supervisor, District
2; Steve Gallardo, Supervisor, District 5 (entered late). Also present: Amy Loper, Deputy Clerk;

INVOCATION - INVOCACIÓN
Chairman Gates introduced Rabbi John Linder, Senior Rabbi of Temple Solel in
Paradise Valley, and leader in the Valley Interfaith Project. Chairman Gates gave a brief
background of Rabbi Linder, summarizing his accomplishments in the Jewish
community and his love of family. Rabbi Linder offered the invocation.

John Reynolds, Animal Care and Control, introduced Dudley, a three-year-old male
Sheppard mix. Dudley loves to play and go out for walks and is a little shy and a slow
introduction with other pets would be best. Dudley has all his vaccinations and is
microchipped and is ready to go home today. For the month of July, all adoptions are
being sponsored by Bissel Pet Foundation as part of the Empty the Shelter event.
Gallardo entered meeting
Chairman Gates mentioned there have been some technical difficulties in the
auditorium this morning and apologized in advance for any inconvenience.
Chairman Gates asked the Clerk if there were any announcements or corrections to the
agenda. The Clerk said there was one announcement: On page 30, Animal Care and
Control, item 58 has been pulled as requested by the department.

f. The special use permit is valid for a period of 25 years and shall expire 25 years from the
date of BOS approval or upon termination of the use for a period of 90 or more days,
whichever occurs first. All site improvements associated with the special use permit shall be
removed within 90 days of such expiration or termination of use.
g. Noncompliance with any Maricopa County Regulation shall be grounds for initiating a
revocation of this Special Use Permit as set forth in the Maricopa County Zoning Ordinance.
h. The property owner/s and their successors waive claim for diminution in value if the County
takes action to rescind approval due to noncompliance with conditions.
i. The granting of this change in use of the property has been at the request of the applicant,
with the consent of the landowner. The granting of this approval allows the property to enjoy
uses in excess of those permitted by the zoning existing on the date of application, subject
to conditions. In the event of the failure to comply with any condition, and at the time of
expiration of the Special Use Permit, the property shall revert to the zoning that existed on

“The Enclave at Anthem Senior Living Casitas” consisting of nine pages dated May 10, 2022,
and stamped received May 13, 2022, except as modified by the following conditions.

entitled, “Enclave at Anthem”, consisting of 7 pages, dated, revised May 2, 2022, and

c. The Owner or Developer shall address and respond to all recommendations of the Daisy
Mountain Fire District (DMFD) included in the correspondence dated March 7, 2022 at the
time of construction permitting. A ‘will serve’ letter shall be required prior to approval of
construction permits.
d. Prior to final approval of construction permits, the Owner or Developer shall process a lot
combination or record a cross-access easement between APN 203-04-481 and APN 203-
04-549. Recordation of a cross-access easement may alter required setbacks on the site
and require a SUP Modification of Conditions.
e. The following Planning Engineering conditions shall apply:
1.
Off-site Hydrology – The grading plans submitted for building permit acquisition shall
identify the peak run-off flow rate for the wash adjacent to the site.
2.
Onsite Hydrology – The onsite hydrology calculations shall utilize County values as
indicated in Table 6.3 of the Maricopa County Drainage Policies and Standards Manual. A
value of 0.95 shall be used for commercial/industrial areas. For first flush, a coefficient of 1.0
shall be used for the entire site.

3.
Onsite Retention – The required retention volume for the site shall be the first flush
volume or the pre vs post runoff volume, whichever is greater.
4.
Retention Disposal – All retention must drain within 36 hours. Bleed-off to the
existing drainage channel along the southeast side of the site may be used in lieu of drywells
to drain the underground retention. Drywells are required to drain the first flush volume of
runoff unless a storm water quality device if provided on the bleed-off.
5.
Engineering review of planning and/or zoning cases is for conceptual design only.
All development and engineering design shall be in conformance with Section 1205 of the
Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain
Regulations for Maricopa County; MCDOT Roadway Design Manual; and current
engineering policies, standards and best practices at the time of application for construction.
6.
Based on the conceptual design nature of the information submitted, changes to the
site layout may be necessitated by the final engineering design of the site’s drainage
infrastructure.
7.
Detailed Grading and Drainage (Improvement) Plans must be submitted with the
application for Building Permits.
8.
Work within N Venture Drive (sidewalk, utility connections, and landscaping) will
require a MCDOT ROW permit issued concurrent with the building permit. Any landscaping
with the MCDOT right-of-way must meet the applicable standards listed in the MCDOT
Roadway Design Manual.
9.
The subject premises is located within the County’s Urbanized Area and will disturb
more than one (1) acre. A Storm Water Pollution Prevention Permit (SWPPP), issued by the
County (PND), will be required prior to issuance of any building permits required for site
development.
10. If the entitlement is approved, existing building permits B202105759 & B201905761
will need to be terminated and new building permits will need to be applied for the
construction of the improvements contemplated with this submittal. Review fees must be
paid prior to termination.
f. Noncompliance with any Maricopa County Regulation shall be grounds for initiating a
revocation of this Special Use Permit as set forth in the Maricopa County Zoning Ordinance.
g. The granting of this change in use of the property has been at the request of the applicant,

entitled, “RV & Boat Storage - Dysart”, consisting of ten pages, dated May 31, 2022, and
stamped received June 1, 2022, except as modified by the following conditions.
c. The Military Compatibility Permit shall be limited to the following uses:
1.
Recreational vehicle and boat storage facility with canopies
2.
Existing caretaker residence and office
d. The following Planning Engineering conditions shall apply:
1.
Engineering review of planning and/or zoning cases is for conceptual design only.
All development and engineering design shall be in conformance with Section 1205 of the
Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain
Regulations for Maricopa County; MCDOT Roadway Design Manual; and current
engineering policies, standards and best practices at the time of application for construction.
2.
Based on the conceptual design nature of the information submitted, changes to the
site layout may be necessitated by the final engineering design of the site’s drainage
infrastructure.
3.
Detailed Grading and Drainage (Site Infrastructure) Plans must be submitted with
the application for Building Permits.
4.
The south half of Olive Avenue along the project frontage shall be developed to the
ultimate street cross-section to meet the City of El Mirage requirements, including any
required right-of-way dedication at the time of initial phase construction permitting.

5.
All development and engineering design shall be in conformance with Section 1205
of the Maricopa County Zoning Ordinance and current engineering policies, standards and
best practices at the time of application for construction.
6.
The entire site and adjacent half-streets’ runoff shall be retained onsite. If portions
of adjacent right-of-way are controlled by other jurisdictions, the adjacent half-streets’ runoff
shall be retained unless separately addressed by the other jurisdictions.
7.
Sufficient retention volume shall be provided onsite to retain the required 100-year,
2-hour runoff from all contributing areas. Retention basins with stormwater depths exceeding
one foot shall provide one foot of freeboard.
8.
All retention basins shall drain within 36 hours per County requirements.
e. Prior to initial phase construction permitting, the owner/developer shall submit a traffic
study to the City of Glendale for approval and incorporate any City of Glendale requirements,
including any required right-of-way dedication.
f. All new buildings are subject to noise attenuation as per ARS § 28-8482(B).

e. The facility will operate 7 days a week with hours of operation limited to 6 a.m. to 10 p.m.
f. There shall be no repair of RVs, boats, or other equipment on the site.
g. All materials and colors used in screening walls and office building, must be muted and
compatible with the desert environment.
h. All outdoor lighting shall be dark sky compliant, low intensity, fully shielded, and directed
downward at least 20% below the horizontal plane at bottom of light fixture so that no
illumination occurs off site. All light poles or standards shall have a maximum height of 16-
feet from surface grade of the parking lot, treated to minimize glare, placed at intervals, and
setback a minimum of 20-feet from adjacent properties.
i. Prior to issuance of the initial building permit, written confirmation will be required from the
emergency fire protection jurisdiction having authority that the facility has been designed in
accordance with their regulations and requirements, and that emergency fire protection
service will be provided to the facility. Prior to issuance of the certificate of occupancy, local
fire protection jurisdiction review and approval will be required.

GRANT FUNDS FOR VERTICAL PROSECUTION OF AUTO THEFT OFFENDERS
FROM ARIZONA AUTO THEFT AUTHORITY
Approve receipt of grant funds from the Arizona Automobile Theft Authority in the amount of
$235,751.00 and authorize the Chairman to sign all applicable documents. These grant
funds are intended to be used exclusively for reimbursement of expenditures related to the
prosecution of Arizona Vehicle Theft Task Force auto theft cases. This grant agreement
commences retroactively on July 1, 2022 and will terminate on June 30, 2023.
In accordance with paragraph 1, page 2, of the agreement, the grant allows a 0% rate for
indirect costs, or $0 that may be incurred by the County Attorney’s Office of Maricopa County
for the administration of this grant. The Maricopa County Attorney's Office's composite
indirect cost rate for FY23 is 22.35%, or $52,690.35. The recoverable indirect cost of
administering this grant is $0; the non-recoverable indirect cost is $52,690.35 which will be
covered by the department general fund. This grant is non-competitive and does not require
a match. The grant award does not require on-going cash contributions after the grant period
end date. This funding directly supports the mandated function of prosecution of criminal
cases.
Grant revenues are not “local revenues” for the purpose of the constitutional expenditure
limitation, and therefore expenditure of the funds is not prohibited by budget law.
This award agreement is in the amount of $235,751.00. These grant funds are intended to
be used exclusively for salary expenditures of two prosecutors and 2 paralegal who will give
priority to the prosecution of Arizona Vehicle Theft Task Force auto theft cases. The Arizona
Automobile Theft Authority enters into this agreement pursuant to its authority granted under
A.R.S. §41-3451.
This grant will expire at the end of the agreement, unless prior written approval for an
extension has been obtained from the Arizona Automobile Theft Authority. The funds will be
used to track and report total number of vehicle theft cases filed, of vehicle theft cases
adjudicated, type of sentencing imposed, responses to Arizona State Task Force
investigative activities, repeat offenders, and report convictions. The Maricopa County
Attorney’s Office has received Maricopa County Board of Supervisors approval for the

VICTIM COMPENSATION FUNDING FROM THE ARIZONA CRIMINAL JUSTICE
COMMISSION
Approve acceptance of $2,256,593 in grant funds from the Arizona Criminal Justice
Commission. These funds come from the Arizona Crime Victim Compensation program
administered by the Arizona Criminal Justice Commission for FY23. Of these monies,
$508,593.00 are State funds (ACJC), and $1,182,000.00 are Federal funds (VOCA) under
CFDA 16.576. The remaining $566,000.00 are Federal Funds from American Rescue Plan
Act (ARPA) funding under CFDA 20.017. The Arizona Criminal Justice Commission Grant
Number VC-23-008 Commences July 1, 2022 and will terminate on June 30, 2023.
Authorize the Chairman to sign all applicable documents. These monies are to be used for
the benefit of victims of crime through the Maricopa County Victim Compensation Program
and cannot be used for indirect costs (Agreement, Page 8, Paragraph 35).

Detention Training Academy. This Agreement allows City of Phoenix detention recruits to
participate in scheduled MCSO Detention Academies at a cost of $250 per registrant as
space permits. City of Phoenix is responsible for providing worker’s compensation insurance,
salary, benefits, uniforms and other items for its participants. The 2-year term begins
retroactive to July 1, 2022 through June 30, 2024. It is effective when signed by the parties.

Approve a financial IGA with the City of Phoenix for independent investigator service that
is effective upon signature of the parties. This IGA allows up to $250,000 in reimbursement
funding to MCSO for the cost of contracted independent investigator service concerning a
City of Phoenix case. Any charges recommended will be prosecuted by another County.
The funding period for this IGA is July 1, 2022, through June 30, 2023.
A separate MCSO agenda request has been submitted for a corresponding contract with

AGREEMENT WITH INDEPENDENT INVESTIGATIVE SERVICE
Approve an Agreement for Independent Investigative Services between Maricopa County on
Behalf of the Maricopa County Sheriff’s Office and Baseline Investigations, an Arizona
Private Investigation Agency, License Number 171229. This agreement is coincidental to
IGA with City of Phoenix concerning independent investigator service. The term is nine
months beginning August 1, 2022, through April 30, 2023. This agreement may be renewed
for up to six months or on a month-to-month basis not to exceed the term or funding of the
IGA with the City of Phoenix. Rates to be paid are $150 per hour per investigator and $75
per hour for travel time and mileage reimbursement at the current GSA rate of $0.625 per
mile.
The investigator will perform duties that enable professional reports and findings to the
designated prosecuting agency. Duties also include working with MCSO’s designated
resource contact for professional assistance, report review, and use of MCSO’s investigative

CONTROL POLICY FOR THE HIGH INTENSITY DRUG TRAFFICKING AREA (HIDTA) –
INITIATIVE XXXI
Approve Supplement #1 to the Agreement with the Office of National Drug Control Policy
(ONDCP) Award Number G21SA0005A, for the High Intensity Drug Trafficking Area (HIDTA)
Program. The amount of the supplement is $50,095.58, increasing the amount from
$671,414 to $721,509.58. The term of this funding is unchanged--January 1, 2021 to
December 31, 2022.
The Sheriff’s Office indirect cost rate for FY23 is 12.30% applicable to the supplement
amount less capital expenses of $16,377.15 for an indirect cost base of $33,718.43.
Unrecoverable indirect costs have been calculated as $4,147.37. The unrecoverable indirect
cost of $4,147.37 will be covered by the department General Fund.
This funding supports the Sheriff’s public safety mandate through efforts to reduce illegal
drug use with the interruption of drug trafficking. The funding is recurring and has been
awarded to the Sheriff’s Office for over twelve years. There is no matching requirement and
there are no future or ongoing contributions required after the grant period ends. This is a
competitive award.

DELEGATION OF AUTHORITY FOR FY 2021 SCAAP APPLICATION PROCESS
Approve, retroactively, delegation of authority to the Sheriff to apply for FY 2021 SCAAP
(State Criminal Alien Assistance Program) reimbursement funds, per Part I: SCAAP
Guidelines issued by the Bureau of Justice Assistance, Office of Justice Programs, U.S.
Department of Justice. SCAAP provides federal payments to states and localities that
incurred correctional officer salary costs for incarcerating undocumented criminal aliens who
have at least one felony and two misdemeanor convictions for violations of state or local law
and who are incarcerated for at least 4 consecutive days. The reporting period is July 1,
2019 through June 30, 2020. MCSO has applied for this funding on behalf of Maricopa
County for approximately 20 years.
Approval of this action allows the application process to continue. MCSO will return to the
Board for authorization to accept any funding that is awarded pursuant to this application.

ACCEPTANCE OF FFY 2020 STATE CRIMINAL ALIEN ASSISTANCE (SCAAP)
FUNDING
Approve acceptance of $582,301 Federal FY2020 reimbursement funding from the Bureau
of Justice Assistance, State Criminal Alien Assistance Program (SCAAP). The
corresponding application was approved by the Board of Supervisors (Agenda C-50-21-123-
X-00), on February 24, 2021.
This has been a reoccurring grant to the County for over 20 years and there is no cash or in-
kind matching requirement. This funding is not competitive. The award amount is determined
using a formula that applies inmate data from jail information system downloads and payroll
system data for a specific period of time. Indirect costs are not applicable or recoverable
since the reimbursement formula calculation only allows for staff whose primary
responsibility is the care, custody, or supervision of persons detained (pre-trial detention)
and incarcerated (convicted and sentenced) inmates. There are no future or ongoing
contributions required. This grant reimburses a portion of the costs for a mandated
requirement--incarcerating undocumented criminal aliens who are convicted of felony
offenses.
The Bureau of Justice Assistance allows these funds to be used for corrections purposes
only. The specific planned use, as designated by the County Budget Office, will be

by MSCO SWAT K9 Unit for use in last-minute callouts, responding patrol assistance needs,
and use when assigned vehicle is down for repair. The estimated annual cost to operate

Approve and execute the First Amendment to Right of Entry and Access Agreement for an

and operation of an Air Quality Monitoring System within City of Phoenix Well Site #94,
located at 8351 N. 6th Street, Phoenix, AZ. This amendment extends the term of the
Agreement from March 12, 2023 through March 11, 2028. There is no cost to the County.

Blue Crowley, resident, was present to speak on items 53 – 57, regarding air quality
and transit in the valley. He commented on an article from the newspaper where the
governor flushed the plan that did not include transit. He talked about the light rail and
the need for it to be more multimodal and make connections to the bus routes. Mr.
Crowley said The Regional Public Transit Authority is not doing enough to reduce air
pollution and he wants the job done right.

the term of the Agreement from January 1, 2023 through December 31, 2027. The license

AGREEMENT WITH US ENVIRONMENTAL PROTECTION AGENCY TO MONITOR

Approve an Agreement between the US Environmental Protection Agency (EPA) and
Maricopa County through the Air Quality Department in the not-to-exceed amount of
$129,245. This assistance is funded by a grant from the US Environmental Protection
Agency, Award ID# PM-98T03501-3 which provides full federal funding in the amount of
$129,245.
The Agreement is effective from April 1, 2022, until March 31, 2023, while the budget is
retroactively effective from April 01, 2022, to March 31, 2023. Project budgets are applied
annually. This agreement is subject to applicable EPA regulatory and statutory provisions,
all terms and conditions of this agreement and any attachments. The FY2021 Air Quality
composite indirect rate of 19.75% will be applied to the direct charges of $41,123. Indirect
costs of $8,122 are fully recoverable. A capital equipment expense of $80,000 is included.
Grant revenues are not local revenues for the purpose of the constitutional expenditure
limitation; therefore, expenditures of these revenues are not prohibited by the budget law. A

BANFIELD FOUNDATION GRANT AGREEMENT
Approve the application and acceptance of grant funds from Banfield Foundation Agreement
(the “Agreement”) in the amount not-to-exceed $13,200. The grant provides funding for
medical equipment needed to monitor the vital signs of every animal under surgery while
performing a mandated service, which is to spay/neuter every animal that leaves the shelter
for adoption. The grant award begins upon execution and ends on August 31, 2023.
Authorize the Chairman to sign the Agreement and authorize the Animal Care and Control
appointed authority and/or designee to sign other grant-related documents, such as reporting
requirements, etc., as applicable to administer the grant.
In accordance with A.R.S. §42-17106(B), authorize the increase of revenue and expenditure
authority in the Animal Care and Control (D790) Animal Control Grants Fund (573) Non-
Recurring Non-Project (NRNP) by $13,200 in Fiscal Year 2023.
The grant allows a 0% rate or $0 for indirect costs. The Maricopa County Department of
Finance has calculated the Fiscal Year 2023 indirect cost rate at 16.70% or $2,205. The
recoverable cost rates for administering this grant is $0 and the Animal Care and Control will
absorb the non-recoverable indirect cost of $2,205 into the department’s operating budget
in the current fiscal year.
This grant is non-recurring, and a cash or in-kind contribution is not applicable. There are no
future or ongoing contributions required following the grant period.
Grant revenues are not local revenues for the purpose of the constitutional expenditure
limitation and, therefore, expenditure of the funds is not prohibited by the budget law. The
approval of this action does not alter the budget constraining the expenditures of local

Approve a data transfer agreement between Arizona Board of Regents for and on behalf of
Arizona State University and Maricopa County by and through the department of Correctional
Health Services (CHS).
The purpose of this project to understand the reach of services for justice-involved individuals
in Maricopa County experiencing opioid withdrawal and the barriers to providing treatment.
Data will be compiled and analyzed for potential publications, conference presentations, and
reports. We will not link the data with any other data sets. This data was obtained from human
subjects incarcerated in the Maricopa County jail system. There are typically 100,000 people
incarcerated in the Maricopa County system in any given year. Data will be obtained from

The State approved the budget after the County had completed budget adoption, and there
were several items not included in the final budget. First, the ALCTS contribution is
increasing due to the federal government removing its enhanced pandemic support and a
provider rate increase of approximately $19 million. Second, the County is required to
contribute for the next five years to the new ADOR Tax System Modernization Project Fund.
Finally, the approved Sheriff Deputy and Detention Officer stipend will require additional
funding from the County to pay for the taxes for all employees and retirement for PSPRSS
enrolled employees. These adjustments will be offset by contingency in the Non

effective 7/27/22. This revision clarifies who this policy applies to and when a dismissal
without a performance improvement plan may be appropriate.
This policy applies to classified employees of Maricopa County appointed departments, the
Flood Control District of Maricopa County, and the Maricopa County Library District (Special
Districts). The Board of Supervisors is authorized to jointly adopt policies applying to the
Special Districts under the Intergovernmental Agreement, C-06-18-393-6-00, approved on
April 11, 2018.
This policy may be used as guidance for performance management of unclassified, contract,
and temporary employees. This Policy also applies to employees of County Elected Officials,
unless the County Elected Official has implemented a performance management policy

AZ Corporate Events, Inc. is a member of Benefairs, the County’s employee discount
program provider. The County’s relationship with Benefairs was originally approved by the

Arizona’s Governor signed into law S.B. 1268 which allows employees in PSPRS to extend
their participation in DROP from 60 months to 84 months if approved by their employer. This
was an emergency measure to help address recruitment and retention issues.
Arizona State’s PSPRS DROP is a voluntary and irrevocable benefit program that offers
eligible employees the opportunity to receive a one-time lump sum payment, at the time of

occupied by low-income households in Maricopa County, excluding dwellings located within
the incorporated city limits of the City of Phoenix. The priority population for the
Weatherization Assistance Program is persons who are particularly vulnerable such as the
elderly, persons with disabilities, families with children, high residential energy users, and
households with high-energy burdens.
The funds will be utilized to provide weatherization measures in 75 dwellings occupied by
low-income households in Maricopa County outside of the City of Phoenix.
Maricopa County will complete the following number of units for each funding source:
1. DOE: thirty-three (33) completed units; and
2.
LIHEAP: forty-two (42) completed units
Acceptance of this Agreement will not impact the County General Fund.

Request approval of the following actions:

Submit a new Permanent Agreement to Arizona Department Of Education Child
Nutrition Program Child And Adult Care Food Program Permanent Agreement (“Agreement”)
(A.G. Contract No. KR02-1170-ALS) for the Child and Adult Care Food Program (CACFP),
administered by Maricopa County Human Services Department, Early Education Division,
Head Start Program. The Agreement identifies the individuals authorized to sign any
documents that relate to CACFP activities. The Agreement allows for the Human Services
Department to submit for CACFP funds on an annual basis. Before any amendment or
extension may become effective, appropriate action must be taken by ordinance, resolution

Human Services Department appropriated County General funds. The County shall also
allocate $745,109 in American Rescue Plan Act (ARPA) funds for the Contract term. The

Area Agency contracts with the County on an annual reoccurring, non-competitive basis to

Approve and execute the Joint Program and Marketing Agreement between SanTan
Shredders LLC (STS) and Maricopa County (County) through the Maricopa County Parks
and Recreation Department. This agreement also provides for the County’s Director of Parks
and Recreation or designee to administer the agreement.
This revenue generating agreement will establish a relationship between the County and
STS and delineate authorities and responsibilities for the parties to work in harmony to
supplement the other’s strengths as they work together to accomplish common goals and
objectives for the education, cooperative marketing, operation and management of
sustainable outdoor recreational opportunities and reflect the mutual interest in supporting
and promoting healthy outdoor lifestyles within all the Maricopa County Regional Parks
including the Maricopa Trail. Both County and STS engage in activities that provide highly
interactive and hands-on experiences. STS will teach participants how to recreate within the
Parks responsibly while challenging them to learn new outdoor skills and experience the
healthy and transformational lifestyle the outdoors provides, thereby benefiting the public
and the community in support of the Parks’ mission and vision and appropriate standards.
The term of the agreement commences on the date fully executed and ends on January 31,
2024, with a provision for extension by a written amendment agreed to by the parties.

Approve Amendments to Contract 13054-RFP with Chicanos Por La Causa and Area
Agency on Aging for Ryan White Part A Program for Medical and Non-Medical Case
Management Services. This Amendment adds an additional deliverable to the scopes of
work for the purchase of an Electronic Health Record system to be used by the Contractors.
In addition, MCDPH requests the total maximum threshold for all contracts under this RFP
to be increased by $3,000,000 for a new NTE amount of $8,910,175 to be used for the above
stated purchases as well as existing services already being provided under the terms of the
contracts.
The case management services will continue to inform service delivery design for more than
12,000 people living with HIV in Maricopa County. It will also help to identify opportunities for
efficiencies and improved health outcomes as we work to reduce new HIV infections in
Maricopa County by 75%.
The Base Contracts were approved under the Office of Procurement Services and were

Pursuant to MC1-329, approve an Amendment 1 to Public Health Contract #PH RFP 220159
between Maricopa County (County), a political subdivision of the State of Arizona, through
its Department of Public Health (MCDPH) and The Arizona Adverse Childhood Experiences
Consortium, ("Contractor'') for expanded training related to Community Support for Adverse
Childhood Experiences (ACE’s).
The amendment extends the term date from December 31, 2023 to December 31, 2024. It
also increases the total not-to-exceed budget by $1,333,588, increasing the total not-to-
exceed amount to $3,333,588. This amendment will be funded by ARPA funds and these
were approved on the 6/8/2022 BOS agenda as a COVID-19 related award.
The expanded training includes hosting over 180 trauma awareness school-based training
programs, 100 youth trauma education programs, 50 single-session administrative trauma
education programs, and 15 community organization trauma awareness education
programs, at more than 120 sites across Maricopa County. The amendment also includes
expansion of the Youth Mental Health First Aid training and solidifies partners for training

This amendment revises and replaces several areas in the Scope of Work. Major changes
include the movement of the Public Health Improvement Program and the Healthy Arizona
Worksite Program (HAWP) out of this IGA. However, specific Worksite Wellness activities
will be moved to the existing HAPI scope of work/action plan. Exhibits A through E are
revised and replaced to reflect these changes.
The Price Sheet has been revised and replaced and reflects a total not-to-exceed amount of
$3,062,829 for the budget period beginning July 1, 2022, through June 30, 2023. The term
of the original Agreement is July 1, 2020, through June 30, 2025.

TRANSFER OF OWNERSHIP OF ULTRA-COLD FREEZER TO GRAND CANYON
UNIVERSITY
Request the Board of Supervisors to approve the transfer of ownership of an Ultra-Cold
Freezer, #MDF-U76VA-PA, Serial # 19107N03235 from PHC Corporation from Maricopa
County by and through its Department of Public Health’s (MCDPH) to Grand Canyon
University, thereby relinquishing control of the asset from MCDPH. Grand Canyon University
will accept the transfer of this asset which was originally procured under the CARES Act.
The freezer was used in the maintenance of vaccines during the initial days of the pandemic
under the direction of the Unified Command Center and transferred to MCDPH in June 2021.
The freezer currently has a County Capital Asset number of F2100493 and has an estimated
value of $15,000. Transfer of ownership shall commence upon receipt of signatures on the

continued funding for the Healthy Start program.
This NOA is in the amount of $702,147.00 for the budget period April 1, 2022, through March
31, 2023, bringing the total not to exceed to date to $1,144,121. The project period is June
1, 2019, through March 31, 2024.
The Department of Public Health’s indirect rate for FY23 is 17.24%. Indirect costs are
estimated at $103,249.87, all of which is recoverable. Departmental Indirect Rates are
reestablished at the beginning of each fiscal year and the future Indirect Rate will be collected
at the corresponding rates.
The HSI grant award is reoccurring and has been awarded to the department in previous
years. This competitive grant does not require an in-kind match, indirect cost is fully
recoverable, and ongoing cash contributions are not required. Healthy Start services are not
a mandated function but provide a benefit to the citizens in perinatal case management
services, health education events and learning opportunities, and community referrals to
women and their families in the large urban Maricopa County communities of South Phoenix,
Maryvale, and Laveen. All program costs are allocated to the grant so there will be no
additional burden on the department’s operating budget.
Grant revenues are not local revenues for the purpose of the constitutional expenditure
limitation, and therefore expenditure of the revenues is not prohibited by the budget law. This
Amendment does not alter the budget constraining expenditures of local revenues duly
adopted by the Board pursuant to A.R.S. 42-17105. The overall grant budget will be adjusted
as necessary to accommodate this grant through a future reconciliation. Funding for this
Agreement is provided by HRSA and will not affect the County’s General Fund. (C-86-02-

change the funding source of this particular proposal to be funded by the American Rescue
Plan Act (ARPA) so the community-based organization may execute its plan to impact
change in policy and systems within Maricopa County. The total not to exceed amount is
$499,882.23.
The term of this agreement is 12 months, beginning on July 1, 2022 and ending May 31,

ACCEPT GRANT FUNDS FROM NATIONAL ASSOCIATION OF COUNTY AND CITY
HEALTH OFFICIALS FOR MEDICAL RESERVE CORPS COVID-19 RISE AWARD
Approve the Letter of Award of grant funds from the National Association of County & City
Health Officials (NACCHO) in the not-to-exceed amount of $75,000 for the 2022 Medical
Reserve Corps (MRC) Respond, Innovate, Sustain, and Equip (RISE) program. Authorize
the Board Chairman to sign all documents related to the award as applicable. The project
and budget period for this award is July 1, 2022 through December 31, 2022.
This is the first award period for this RISE project and if a new round occurs, the Program
will most likely apply. It was a competitive grant opportunity. There are no cash or in-kind
match requirements and on-going contributions will not be required. This is not a mandated
service but provides a benefit to our citizens by improving upon the capacity building of our
MRC volunteers in order to better meet emergency management and response needs;
currently COVID-19 and the increase in needed volunteers and trainings.

Goodyear for the exchange of services or reimbursement of services (Entente). This
Agreement shall become effective as of the date it is approved by the Maricopa County
Board of Supervisors and remain in full force and effect until either Party terminates it. Either
Party may terminate this Agreement at any time before the expiration date of this Agreement
by furnishing the other Party with a thirty (30) day written notice.
The purpose of this Intergovernmental Agreement is to identify and define both Parties'
respective roles in the execution of the responsibilities of specific maintenance tasks in areas
that cross jurisdictional boundaries.
The Agreement provides the opportunity to focus on specific maintenance tasks or
emergency highway projects and the availability of the most economical resources by
extending beyond jurisdictional or geographical boundaries. The Agreement's application will

benefit areas in the County and the City where the other Party could complete specific types
of routine maintenance or emergency highway project activities based on scheduled work
within the area. Individual tasks performed by either Party will be executed upon completing

If the value of goods or services exchanged by the Parties is not of equal value, the total
aggregate reimbursement to the respective Party will not exceed $250,000 per fiscal year. If
no services are exchanged, there is no financial impact. An accounting mechanism will be
utilized to track each LOA, as applicable, to identify specific tasks and services and ensure

IGA WITH CITY OF MESA FOR THE IMPROVEMENTS TO UNIVERSITY DRIVE FROM
POWER ROAD TO HIGLEY ROAD
Approve the Intergovernmental Agreement between Maricopa County (County) and the City
of Mesa (Mesa) for the Improvements to University Drive from Power Road to Higley Road.
Under this Intergovernmental Agreement, the County will act as the lead agency for all
aspects of the design and construction of the Project, which will be completed to County and
City standards. The County operates and maintains University Drive. The County proposes
to upgrade ADA ramps, sidewalks, driveways, bus stops, and signal equipment on University
Drive from Power Road to Higley Road to meet 2010 ADA standards. The work also includes
the relocation of existing waterline and wastewater facilities, including hydrants, manholes,
and valves, which are owned and maintained by the City's Water Resources Department.
The County will be financially responsible for the construction cost of the Project, which is
currently estimated at $3,500,000. The funds are budgeted in FY2023 - 2024 Transportation
Department (640) Transportation Capital Project Fund (234) Five–Year Program in the
Transportation System Management Project, sub-project TT0612. Construction is planned
for fiscal years 2023 - 2024. The City will be responsible for the waterline relocation
improvements and will contribute $22,000 towards the construction cost.
The County will continue to maintain the road after the Project is complete. The City will
retain responsibility for the operation and maintenance of the relocated waterline
improvements.
The terms of the agreement are in effect as of the Board of Supervisors' approval. They shall
remain in full force and effect until all stipulations have been satisfied, except that it may be
amended upon written agreement by all parties.

Approve the Agreement for Construction of Buckeye Water Conservation& Drainage District
(BWCDD) Facilities between BWCDD and Maricopa County for the relocation of the irrigation
facilities in conflict with the MCDOT Roadway Improvement Project TT0572, MC85 and
Verrado. The estimated cost to relocate the irrigation delivery facilities is $1,097,855.60.
Funds are budgeted in Transportation System Management (TMAN) project, Sub-Project
TT0572 MC85 and Verrado.
All property owners, farmers and developers have been included in the coordination of this
work. All of the work to relocate the irrigation delivery facilities is necessary for the road work
to occur, therefore MCDOT is responsible for all costs related to the design, construction and
relocation of these facilities. Approval of this agreement will allow the irrigation facilities to be

DISTRICT
Pursuant to Arizona Revised Statutes Title 48, Chapter 6, Article 1, schedule public hearing
to solicit comments and consider the petition to establish the Rio Verde Foothills Domestic
Water Improvement District. Hearing to be set for the informal meeting of the Maricopa
County Board of Supervisors on August 29, 2022.

Chairman Gates asked the Clerk if there was anything to report regarding Public
Comment email responses.
The Clerk said there were three speakers in person. Additionally, there were 141 emails
regarding Maricopa County Animal Care and Control; one regarding a tax lien from the
Assessor’s office; one regarding the Head Start Program. She said all emails and
comments have been shared with the Board offices.
Wendy Kirsner, resident, and founder of Dawgz, Tailz & Wagz Rescue, stated as an
animal advocate, her organization has rehomed 408 animals in the last two years. Ms.
Kirsner said her organization is filling a need in the community and this past year, they
have started pulling e-listed dogs from the shelter. The lack of funds causes programs
to suffer, and she is offering her assistance to help create solutions.
Dylan Kingsley, resident, spoke about a recent petition being circulated that has
gathered over 15,000 signatures in favor of reform for Maricopa County Animal Care
and Control. She feels the concerns of the public have been ignored and downplayed.
She said as elected officials, it is important that the Board represent the constituents,
and work toward a solution that is acceptable to all. Ms. Kingsley read the following
which was copied to the Board:

Blue Crowley, resident, talked about an article in the Arizona Republic about
proposition 400. He read an excerpt and noted it said nothing about bus funding. Mr.
Crowley talked about the transit money allocations and disagrees with how it is being
spent.

Joy Rich, County Manager, mentioned the COVID vaccine event today being offered to
Maricopa County employees and families.
Supervisor Gallardo reminded everyone that Tuesday is Election Day. He said the
Elections Department is working hard to ensure safe, secure, and accurate elections.
Supervisor Gallardo encouraged all eligible citizens to exercise their fundamental right
to vote. He also mentioned that the City of Phoenix and District 5 are offering Water
Days in the month of July which helps to engage the communities with the services that

are available to those in need. There have been three so far and this weekend is the
final day at Grant Park. There will be giveaways of backpacks for kids, haircuts, and
water fun to stay cool. He said thank you to the many Maricopa County departments
that assisted in making this event successful.
Supervisor Sellers talked about the several events with the Taiwanese community
including a Taiwanese Semiconductor Delegation Reception at the Greater Phoenix
Economic Council, for those interested in supporting production at the Taiwan
Semiconductor Manufacturing Company. Supervisor Sellers said he had a productive
meeting with Senator Kelly and his staff about I-11 Tier 2 environmental impact funding.
He said he was in Washington, D.C. with Scott Jarrett to accept an award, Protecting
American Democracy, on behalf of the Elections Department and the Board of
Supervisors. Supervisor Sellers attended the National Association of Counties Annual
Conference in Denver, Colorado where he led the Large Urban County Caucus panel
on solutions for protecting election officials.
Supervisor Galvin said there was good news to report that a hearing date has been set
for the proposed Rio Verde Foothills DWID. He commented that the Phoenix Mesa
Gateway Airport received $14.4 million in funding for new projects. Supervisor Galvin
said he also met with the Mesa Chamber of Commerce President & CEO, Sally
Harrison, and they discussed common interests including economic development,
water, transportation, housing, and fixing our roads. He said it was very productive. He
echoed Supervisor Gallardo and importance of voting and commented on the amazing
and informative website that Elections has put together. He encouraged everyone to
utilize the webpage as a resource.
Supervisor Hickman talked about the success of the elections in 2020 and the lessons
learned as a result. He said we will learn things again in the upcoming elections.
Supervisor Hickman asked Joy Rich a question: Do we have enough volunteers and
are employees being called on again to fill the gap. Joy said employee participation is
good and she anticipated having all the help needed. Supervisor Hickman remarked on
Rabbi Linder words of prayer on elections. Intimidation is a common tactic that is used,
and it will not be tolerated. He thanked Sheriff Penzone and staff for all the effort being
put forth to make this election safe.

Chairman Gates talked about the monsoon season and the Flood Control District and
all they do to protect our property and our roadways. He commented on the Elections
Department and all that they have done. Chairman Gates reminded voters to listen to
the experts and for those who are casting doubt on the process, stop it. Be responsible.

Supervisor Hickman said his comments would be related to all the agenda items for the
Library District. He started by talking about the opening of the El Mirage Library and
how Roy Delgado had once served on the Library District Board of Directors and has
now moved into Community Development Advisory Committee, representing the City
of El Mirage. He said the new library is part of an adaptive reuse project and they turned
an old fire station into library. Supervisor Hickman stated he is proud to be able to work
with the municipalities in providing services like a library to the citizens of El Mirage.
Supervisor Gallardo echoed the comments on the importance of libraries in Maricopa
County and stated libraries are a point of pride, where are books are checked out, wifi
is being accessed and is a meeting place for the community. He knows firsthand that
Gila Bend uses their library year-round.
Supervisor Hickman commented that the City of Goodyear will be opening their
municipal center that has a library too. Chairman Gates had similar comments on the
library up in Anthem.

GRANT-IN-AID FROM THE ARIZONA STATE LIBRARY, ARCHIVES AND PUBLIC
RECORDS
Approve the application and acceptance of grant funds from the Arizona State Library,
Archives and Public Records in the amount not to exceed $25,000 for the purpose of
professional development of staff and providing access to digital resources for customers.
The grant award begins July 1, 2022 and ends on June 30, 2022. Authorize the Chairman
to sign all documents related to these grant funds as applicable. The Library District indirect
rate for FY22 is 10.20%. Total grant indirect costs are estimated to be $2,550.00 and are
not recoverable. The grant award is reoccurring and has been awarded to the Library District
in previous years. The Library District does not have an in-kind match, or ongoing

contributions requirement. The grant award is not a mandated function, but provides a
benefit to the citizens by training staff and allowing access to resources to better meet the
needs of the Library District customers. The grant award is competitively bid, or non-
