GENERAL POLICIES CONCERNING THE FINANCIAL MANAGEMENT OF THE FLOOD
CONTROL DISTRICT OF MARICOPA COUNTY
(Rescinding and Replacing Resolutions FCD 2010R008, 2015R005, 2009R003, 2009R003A,
2009R003B and 2009R003C)
Agenda Item:
WHEREAS, the Flood Control District of Maricopa County (District) was established in
accordance with the provisions of Arizona Revised Statutes Title 48, Chapter 21, which
authorizes the District acting through the Board of Directors of the Flood Control District of
Maricopa County (Board) to construct, operate and maintain flood control works and to contract
and join with the state, the United States or any other flood control district or floodplain board,
municipality, political subdivision, governmental agency, irrigation or agricultural improvement
district, association, corporation or individual in acquiring, constructing, maintaining and
operating flood control works; and,
WHEREAS, Arizona Revised Statutes Title 48, Chapter 21 authorizes the District to
generally do all things which may be necessary to construct, acquire and maintain facilities,
operate the District and perform its regulatory functions; and,
WHEREAS, the District reduces the risk of flooding-related injury, loss of life, and
property damage in Maricopa County, and executes its functions as enumerated by Arizona
Revised Statutes Title 48, Chapter 21, through flood hazard identification, remediation (facility
construction and maintenance), regulation and education, requiring expenditure of flood control
operating and capital funds; and,

WHEREAS, these funds are generated primarily through a flood control secondary tax on
real property in Maricopa County, intergovernmental cost share revenue, permitting fees and
excess land sales and leases; and,
WHEREAS, the District adopted Resolution FCD 2010R008 (C-69-11-055-6-00) on
April 13, 2011, formulating general policies concerning financial management to accomplish the
District's functions and responsibilities as enumerated in Arizona Revised Statutes Title 48,
Chapter 21; and,
WHEREAS, the District adopted Resolution FCD 2015R005 (C-69-15-036-6-00) on
March 25, 2015, to modify a prioritization procedure for the evaluation of flood control capital
projects; and,
WHEREAS, the District adopted Resolution 93-03 on May 3, 1993, establishing the
District's Landscape and Aesthetic Policy; and,
WHEREAS, the District adopted Resolution FCD 2006R003 (C-69-07-016-6-00) on
October 4, 2006, establishing the District's Flood-prone Properties Assistance Program and
subsequently amended the program with resolution FCD 2006R003A (C-69-07-016-6-01) on
March 25, 2015; and,
WHEREAS, the District adopted Resolution FCD 2009R003 (C-69-09-062-6-00) on
May 6, 2009, establishing the District's Small Project Assistance Program, and subsequently
amended the program three times with resolutions FCD 2009R003A (C-69-09-062-6-01) on
April 27, 2011, 2009R003B (C-69-09-062-6-02) on March 25, 2015, and 2009R003C (C-69-09-
062-6-03) on July 31, 2019; and,
WHEREAS, the District seeks to leverage available external funding and cost share to the
maximum extent practicable, without compromising the District's mission; and,
WHEREAS, District annual Operating Budget targets are established by the Board; and
WHEREAS, District Capital Improvement Program funding levels are determined based
on a balance of needs, funding availability and sustainability; and,

WHEREAS, the District desires consolidated financial management guidance to reflect
current economic conditions and established operational requirements, policies and practices.
NOW THEREFORE BE IT RESOLVED that the District wishes to consolidate and
affirm its general policies concerning financial management as described in the following
paragraphs, and,
BE IT FURTHER RESOLVED, the Board hereby rescinds resolutions FCD 2010R008,
2015R005, 2009R003, 2009R003A, 2009R003B and 2009R003C; and,
BE IT FURTHER RESOLVED that the Director of the District shall review prospective
capital improvements to existing District structures, including acquisition of necessary ancillary
land rights; shall evaluate their merit; shall advance resolutions for such projects to the Board for
approval; and shall establish funding priority for such projects based on readiness and hazard
mitigation need; and,
BE IT FURTHER RESOLVED that the Director of the District shall review prospective
flood control capital projects involving federal cost share; shall evaluate their merit; shall advance
resolutions for recommended projects to the Board for approval; and shall establish funding
priority for such projects based on readiness and hazard mitigation need; and,
BE IT FURTHER RESOLVED, the Board hereby reauthorizes the Small Project
Assistance Program (SPAP), for purposes of mitigating frequent, localized flooding, to be
carried out in accordance with program guidelines as developed and maintained by the Director
of the District; and,
BE IT FURTHER RESOLVED, the Director of the District is authorized and directed to
negotiate and prepare agreements for flood control projects within the District boundaries in
accordance with the SPAP guidelines, for the coordination and cost sharing of design and
construction of projects submitted to the SPAP, limiting District contributions to seventy-five
percent (75%) of project design and construction costs, not to exceed $1,000,000 per project,
subject to the ratification and approval of this Board; and,
BE IT FURTHER RESOLVED that the Director of the District shall evaluate, under a
published procedure developed and maintained by the Director of the District, proposed flood

control capital projects not involving federal cost share; shall advance resolutions for
recommended projects to the Board for approval; shall advance intergovernmental agreements
for recommended projects to be implemented with a project partner to the Board for approval;
and shall establish funding priority for such projects; and,
BE IT FURTHER RESOLVED that, applying the guidance contained herein and in
resolutions FCD 93-03 (Landscape and Aesthetic Policy and any subsequent amendments),
FCD 2006R003 and 2006R0063A (Flood-prone Properties Assistance Program and any
subsequent amendments), the Director of the District shall formulate, annually, a Capital Budget
and five-year Capital Improvement Program; the Capital Budget and Capital Improvement
Program shall be presented to the District's citizens' advisory board for review and to the Board
for approval; shall include annual expenditures in four categories: Primary Capital Improvement
Program, Small Project Assistance Program, Major Maintenance and Flood-prone Properties
Acquisition (the Capital Budget Categories), and associated projected annual engineering, right-
of-way, construction and internal labor costs, in accordance with Arizona Revised Statutes Title
48, Chapter 21; and,
BE IT FURTHER RESOLVED that the Director of the District is authorized to allocate
and re-allocate, if necessary, funding among capital projects within each Capital Budget
Category, and shall request Board approval to reallocate, if necessary, funding between Capital
Budget Categories or to modify the aggregate Capital Budget; and,
BE IT FURTHER RESOLVED that the Director of the District shall formulate an annual
Operating Budget, in accordance with approved annual budget guidance and Arizona Revised
Statutes Title 48, Chapter 21, addressing requirements related to flood hazard identification,
maintenance, regulation and education, and necessary administrative support; the annual
Operating Budget shall be presented to the District's citizens' advisory board for review and to
the Board for approval; and,
BE IT FURTHER RESOLVED that the Director of the District shall ensure annual
proposed Operating Budgets and Capital Budgets are consistent with established Board
guidance that balances flood hazard mitigation needs, fiscal responsibility, sustainability and
efficient operation, and shall annually recommend to the Board the annual tax levy considered
necessary or appropriate for its operations in accordance with Arizona Revised Statutes Title 48,
Chapter21; and,

BE IT FURTHER RESOLVED that for capital projects authorized by Board adopted
resolutions, and for operational items pertinent to the District's mission, the Director of the
District shall seek to negotiate partnerships where such partnerships enhance the District's
ability to perform its mission, increase the District's efficiency, generate District revenue, or
reduce District expenditures, and shall present resultant agreements to the Board for approval;
and,
BE IT FURTHER RESOLVED that the Director of the District shall periodically review
the policies established by this resolution and shall present recommended amendments to the
Board for approval.
