Contract No. C-22-22-050-X-01 Amendment No. 1 Town of Gila Bend Page 1 of 3 AMENDMENT NO. 1 TO THE INTERGOVERNMENTAL AGREEMENT BETWEEN MARICOPA COUNTY ADMINISTERED BY ITS HUMAN SERVICES DEPARTMENT AND THE TOWN OF GILA BEND I. Maricopa County (“County”), administered by its Human Services Department, entered into a financial Intergovernmental Agreement (“Agreement”) with the Town of Gila Bend (“Subrecipient”) on or about December 1, 2021. The purpose of the Agreement in Scope of Work A is for the Subrecipient to renovate the Gila Bend Community Center located at 202 East Euclid Avenue, Gila Bend AZ, 85337, including the construction of an 800 square foot addition and reconfigure office space. The County has provided the Subrecipient with $450,000 in U.S. Department of Housing and Urban Development (HUD) Community Development Block Grant CARES Act (CDBG-CV) Program Year/Fiscal Year 2021/2022 (PY/FY 21/22) funds under Assistance Listing Number (ALN) 14.218. The purpose of the Agreement in Scope of Work B is for the Subrecipient to reconstruct approximately two hundred and fifty (250) feet of existing eight (8) inch sewer lines at two (2) locations along the south side of Papago Street between Washington Street and Cholla Avenue. The County has provided the Subrecipient with $500,000 in American Rescue Plan Act (ARPA) funds under ALN 21.027. The Agreement term began on December 1, 2021 through March 31, 2023. The County and the Subrecipient collectively are referred to as the “Parties.” II. The Parties agree to amend the Agreement by this Amendment No. 1 as follows: A. The County shall provide the Subrecipient with an additional $50,000 for Scope of Work A for the reconfiguration of the Community Center HVAC system to help reduce the potential spread of infectious viruses through the HVAC system. Funding is provided under ALN 14.218 U.S. Department of Housing and Urban Development (HUD) Community Development Block Grant CARES Act (CDBG- CV) funds. B. The Agreement amount shall now be increased to a total not-to-exceed amount of $1,000,000. C. Revise Section 2 (Special Provisions), Paragraph 4.0 (Audit Requirements), delete in its entirety and replace with the following: 4.0 AUDIT REQUIREMENTS In accordance with A.R.S. § 9-481, the Subrecipient shall, at its own expense, file with the County by March 31st of each Agreement year, either: 4.1 Audited financial statements prepared in accordance with federal single audit requirements; or 4.2 Financial statements of the CDBG program prepared in accordance with generally accepted accounting principles audited by an independent certified public accountant; or 4.3 A Comprehensive Annual Financial Report, prepared in accordance with generally accepted accounting principles audited by an independent certified public accountant. Revise Section 3 (Work Statement), Paragraph 2.0 (Scope of Work), Subparagraph 2.1 (Project Description) delete in its entirety and replace with the following: 2.1 Project Description: 2.1.1 The Subrecipient shall renovate the Gila Bend Community Center (“Center”), located at 202 East Euclid Avenue, Gila Bend, AZ 85337, to expand the client service and delivery area. The scope includes the construction of an 800 square foot addition and reconfiguration of office spaces. The changes to the Center will improve the entrance into the building and allow for social distancing, reducing the risk of spreading COVID-19. The changes to the Center will allow for the Center to remain open during critical times. 2.1.2 The Subrecipient shall reconfigure the Community Center HVAC system. The reconfiguration will help reduce the potential spread of infectious viruses through the HVAC system. E. Revise Section 4 (Budget and Compensation), Paragraph 1.0 (Budget) delete in its entirety and replace with the following: Activity Budget Scope of Work A: Construction, and Construction Management, CDBG-CV Funds $500,000.00 Scope of Work B: Construction, construction management and design/ Permits, ARPA Funds $500,000.00 Total $1,000,000.00 III. Section II above contains all the changes made by this Amendment No. 1. All other terms and conditions of the Agreement shall remain unchanged and in full force and effect as executed by the Parties. IV. The Parties have authorized the undersigned to execute this Amendment No. 1 on their behalf, and it shall be effective upon approval and signature by both Parties.
