The Board of Supervisors of Maricopa County, Phoenix, Arizona, convened in Formal Session at
9:30 AM on Wednesday, April 6, 2022, in the Supervisors' Auditorium 205 W. Jefferson Phoenix,
AZ 85003, with the following members present: Bill Gates, Chairman, District 3 (remote); Clint
Hickman, Vice Chairman, District 4; Jack Sellers, Supervisor, District 1; Thomas Galvin,
Supervisor, District 2; Steve Gallardo, Supervisor, District 5 (remote). Also present: Juanita
Garza, Clerk; Kelly Gardiner, Minutes Coordinator; Joy Rich, County Manager; Andrea

Vice Chairman Hickman opened the meeting and asked the Clerk to call the roll. Vice
Chairman Hickman then asked Supervisor Gallardo to introduce his guest who would
offer the invocation and lead the pledge today. Supervisor Gallardo introduced Petra
Falcon, Executive Director, with Promise Arizona.

Ms. Falcon led the Pledge of Allegiance to the flag.
Supervisor Gallardo thanked Ms. Falcon for her hard work and dedication to the County,
community, and families. Ms. Falcon is part of the Healthcare Initiative, helping families
that struggle with basic healthcare needs. She has been a pillar in the Latino community
and devoted her time and energy to various causes.

Vice Chairman Hickman introduced Hannah with Maricopa County Animal Care and
Control. Hannah introduced Clara, a six-year-old brindle Boxer, who has been at the
shelter since February. Hannah said Clara has some basic training, does well on a
leash, and is a very mellow and easy-going dog.
Vice Chairman Hickman asked the Clerk if there were any announcements or
corrections to the agenda. The Clerk responded there was one announcement on page
13, item #16. The Luxury Storage and RV Park will be continued to the April 20, 2022,
meeting.

Commission Recommendation: On 3/10/22, the Commission voted 7-0, to recommend
approval Z2021123 subject to the following conditions ‘a’ – ‘f’:
a. The IUPD Overlay is applied to restrict the use of the site. Until such time as the site is
served by sewer, uses on the site shall only be those acceptable to the Maricopa County
Environmental Services Department (MCESD) that can be accommodated by septic
systems. A public water system and public sewer system shall be required prior to
establishment of any non-residential use that requires potable water.
b. Administrative approval of a Plan of Development will be required prior to approval and
issuance of construction permits to develop and establish use of the site. Prior to issuance
of a building permit, written confirmation will be required from the emergency fire protection
jurisdiction having authority that the facility has been designed in accordance with their
regulations and requirements, and that emergency fire protection service will be provided to
the facility. Prior to issuance of the certificate of occupancy, local fire protection jurisdiction
review and approval will be required.
c. Subject to the following Planning Engineering conditions:
1. Without the submittal of a precise plan of development, no approval is implied by this
review, including, but not limited to drainage design, access and roadway alignments. These
items will be addressed as development plans progress and are submitted to the County for
further review and/or entitlement.
2. Any development must ensure that historic drainage patterns are maintained at the up
and downstream limits of development.
3. A traffic impact study must be submitted with any future entitlement application (i.e. plan
of development).
4. All development and engineering design shall be in conformance with Section 1205 of the
Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain
Regulations for Maricopa County; MCDOT Roadway Design Manual; and current
engineering policies, standards and best practices at the time of application for construction.
d. Noncompliance with any Maricopa County Regulation shall be grounds for initiating a
revocation of this Zone Change as set forth in the Maricopa County Zoning Ordinance.
e. The property owner/s and their successors waive claim for diminution in value if the County
takes action to rescind approval due to noncompliance with conditions.
f. The granting of this change in use of the property has been at the request of the applicant,
with the consent of the landowner. The granting of this approval allows the property to enjoy
uses in excess of those permitted by the zoning existing on the date of application, subject
to conditions. In the event of the failure to comply with any condition, the property shall revert
to the zoning that existed on the date of application. It is, therefore, stipulated and agreed
that either revocation due to the failure to comply with any conditions, does not reduce any
rights that existed on the date of application to use, divide, sell or possess the property and
that there would be no diminution in value of the property from the value it held on the date
of application due to such revocation of the Zone Change. The Zone Change enhances the
value of the property above its value as of the date the Zone Change is granted and reverting
to the prior zoning results in the same value of the property as if the Zone Change had never

Site Location: Generally located at the SWC of the intersection of 483rd Ave. & Courthouse

Commission Recommendation: On 3/10/22, the Commission voted 7-0, to recommend
approval of Z2021111 subject to conditions ‘a’ – ‘k’:
a. The initial Plan of Development shall be developed in substantial conformance with the
Site Plan entitled “Harquahala Sun Site Plan” consisting of 17 full-size sheets, dated March
1, 2022, and stamped received March 1, 2022, except as modified by the following
conditions. Staff may determine slight refinements to remain in substantial conformance with
the approved site plan. Minor and major amendments to the site plan will be determined in
accordance with Chapter 3 of the Maricopa County Zoning Ordinance.
b. Development of the site shall be in substantial conformance with the Narrative Report
entitled “Harquahala Sun Narrative Report”, consisting of 14 pages, dated February 25,
2021, and stamped received March 1, 2022 except as modified by the following conditions.
c. The following Planning Engineering conditions shall apply:
1. At the time of application for building permits, the plans or a drainage exhibit must identify
(quantity) offsite flows entering the site,
2. At the time of application for building permits, retention basin design for basins located in
a floodplain must be revised to provide excavated basins.
3. Retention basin volumes must be sized for the 100 year, 2 hour storm event. Retention
basins must drain within 36 hours.
4. At the time of application for building permits, the weighted runoff coefficient to size
retention basins must be verified and be based on C=0.95 for the panels, C=0.88 for gravel
access roads; and C=0.5 for unimproved areas.
5. At the time of application for building permits, detailed grading and drainage plans must
show diversions necessary to direct flows from solar development site to a retention basin.
No flow from the solar development site shall be permitted to flow directly offsite (unretained).
6. Electrical equipment, including inverters must be elevated to be at or above the regulatory
flood elevation for each respective flood zone; or otherwise floodproofed.

7. Work with the floodplains will require a floodplain use permit issued concurrent with the
building permits.
8. Extension of the gen-tie across FCDMC owned properties will require procurement of a
Flood Control District R/W permit.
9. Extension of the gen-tie within County (MCDOT) right-of-way may require procurement of
a lease or license to occupy the right-of-way.
10. Driveways C and D along 491st Avenue, south of Courthouse Road must align.
11. The following R/W dedication and preservation will be required. R/W dedication must
occur prior to issuance of building permits.
Dedication:
491st Avenue – 40’ half width (80’ full) right-of-way for a collector roadway
Courthouse Road – 65’ half width right-of-way
Preservation:
483rd Avenue – 40’ half width right-of-way
499th Avenue – 65’ half width right-of-way
12. Based on the conceptual design nature of the information submitted, changes to the site
layout may be necessitated by the final engineering design of the site’s drainage
infrastructure.
13. Detailed Grading and Drainage (Site Infrastructure) Plans must be submitted with the
application for Final Plat Approval and Building Permits.
14. Engineering review of planning and/or zoning cases is for conceptual design only. All
development and engineering design shall be in conformance with Section 1205 of the
Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain
Regulations for Maricopa County; MCDOT Roadway Design Manual; and current
engineering policies, standards and best practices at the time of application for construction.
d. The following IND-2 IUPD Zoning District standards shall apply:
1. Maximum Electric Transmission Line Height – 140’
2. Maximum Lot Coverage – 60%
3. Parking Spaces Required – None required
4. Loading & Unloading Spaces Required - None required
5. Landscaping – No landscaping strip required
6. Sight Visibility Triangles – No sight visibility triangles are required at project site
entry/access points and road intersection, section line, mid-section line or alignment corners
7. Article 902.91 – All utility uses shall be permitted to be conducted outdoors
8. Site Enclosure and Screening – Chain-link fencing and gates are permitted around the
perimeter of the site boundaries except that opaque chain-link fencing with vinyl slats shall
be required along any property line abutting a residential zoning boundary
9. Pavement Required – Pavement not required for parking spaces with approval of a dust
control plan by Maricopa County Air Quality Department.
e. The applicant shall route their plans through the Department of Defense (DOD) siting
clearinghouse process in accordance with the letter from Luke Air Force Base dated

November 1, 2021. Based on those findings, a revised site plan shall be submitted in
accordance with condition ‘a’ if required.
f. The Owner or Developer shall address and respond to all recommendations of the Arizona
Game and Fish Department (AZGFD) included in the letter dated February 24, 2022 at the
time of construction permitting. The response shall be sent to AZGFD for review and
consideration. The Zoning Inspector and/or their designee shall review the applicant’s
response, and any subsequent comments received from AZGFD, to determine whether the
response issued by the Owner or Developer addresses AZGFD comments in good faith.
Should the Zoning Inspector and/or their designee decide that the Owner or Developer has
not substantially addressed AZGFD comments in good faith, the Owner or Developer shall
be required to propose and implement alternatives to the recommendations made by
AZGFD.
g. The Owner or Developer shall receive approval of a Cultural Resource Survey accordance
with the comments received by AZSHPO in the letter dated July 8, 2021 prior to the issuance
of building permits.
h. The IND-2 IUPD shall limit the use of the site exclusively to a solar electric generating
facility including ancillary offices and ancillary uses. Any other site uses shall require a Zone
Change Major Amendment.
i. Noncompliance with any Maricopa County Regulation shall be grounds for initiating a
revocation of this Zone Change as set forth in the Maricopa County Zoning Ordinance.

Request: Special Use Permit (SUP) for commercial storage of RVs, boats and vehicles in
the Rural-43 zoning district
Site Location: 600’ east of the SEC of Carefree Hwy. and 12th St. in the Desert Hills area
Commission Recommendation: On 3/10/22, the Commission voted 7-0, to recommend
approval Z2021034 subject to the following conditions ‘a’ – ‘q’:
a. Development of the site shall be in substantial conformance with the Site Plan entitled
“Luxury Storage RV & Boat, LLC“, consisting of three full-size sheets, dated December 14,
2021, and stamped received December 28, 2021, except as modified by the following
conditions. Staff may determine slight refinements to remain in substantial conformance with
the approved site plan. Minor and major amendments to the site plan will be determined in
accordance with Chapter 3 of the Maricopa County Zoning Ordinance.
b. Development of the site shall be in substantial conformance with the Narrative Report
entitled “Luxury Storage RV & Boat, LLC”, consisting of eleven pages, dated December 14,
2021, and stamped received December 28, 2021, except as modified by the following
conditions.
c. The following Planning Engineering conditions shall apply:
1. Drainage review of planning and/or zoning cases is for conceptual design only and does
not represent final design approval nor shall it entitle applicants to future designs that are not
in conformance with Section 1205 of the Maricopa County Zoning Ordinance and the
Maricopa County Drainage Policies and Standards.
2. All development and engineering design shall be in conformance with Section 1205 of the
Maricopa County Zoning Ordinance and current engineering policies, standards and best
practices at the time of application for construction.
3. The entire site and adjacent half-streets’ runoff shall be retained onsite. If portions of
adjacent right-of-way are controlled by other jurisdictions, the adjacent half-streets’ runoff
shall be retained unless separately addressed by the other jurisdictions.
4. Retention basins with stormwater depths exceeding one foot shall provide one foot of
freeboard and all retention basins shall drain within 36 hours per County requirements.
d. The Following MCDOT conditions shall apply:
1. There shall be a Right-In/Right-Out access only to the site and there shall be no left turn
from the site or left turn from westbound Carefree Hwy. thru traffic to the site.
2. There shall be a right-turn deceleration lane at the main entry driveway to limit site traffic
impact to eastbound thru traffic on Carefree Hwy.
e. This special use permit is valid for a period of ten years and shall expire on April 6, 2032,
or upon termination of the use for a period of 90 or more days, whichever occurs first. All site
improvements associated with the special use permit shall be removed within 90 days of
such expiration or termination of use.
f. There shall be no repair of RVs or boats on the site.

g. There shall be a maximum lot coverage of 50% on the site.
h. There shall be minimum interior side and rear yards of 15-feet on the site.
i. There shall be a minimum front yard adjacent to the Highway right-of-way of 50-feet with
no average front setback.
j. All landscaping shall consist of indigenous trees, plants, shrubs, and groundcover typical
of the Upper Sonoran Desert, preserving existing vegetation where possible and any
landscaping used shall be drought tolerant with low water consumptive landscaping
materials.
k. Any rooftop mechanicals, ground mechanicals, parking areas, trash enclosures, and
transformers shall be screened.
l. All materials and colors used in screening walls, buildings, covered RV wash bay, and
parking shade canopies must be muted and compatible with the desert environment and the
architecture of the main office.
m. There shall be no reflective glass used in any building.
n. All outdoor lighting shall be dark sky compliant, low intensity, fully shielded, and directed
downward at least 20% below the horizontal plane at bottom of light fixture so that no
illumination occurs off site. All light poles or standards shall have a maximum height of 16-
feet from surface grade of the parking lot, treated to minimize glare, placed at intervals, and
setback a minimum of 20-feet from adjacent properties.
o. The developer must complete habitat and special status species evaluation and submit to
the Arizona Game and Fish Department for review prior to the submission of building permits.
p. Noncompliance with any Maricopa County Regulation shall be grounds for initiating a
revocation of this Special Use Permit as set forth in the Maricopa County Zoning Ordinance.
q. The granting of this change in use of the property has been at the request of the applicant,
with the consent of the landowner. The granting of this approval allows the property to enjoy
uses in excess of those permitted by the zoning existing on the date of application, subject
to conditions. In the event of the failure to comply with any condition, and at the time of
expiration of the Special Use Permit, the property shall revert to the zoning that existed on
the date of application. It is, therefore, stipulated and agreed that either revocation due to
the failure to comply with any conditions, or the expiration of the Special Use Permit, does
not reduce any rights that existed on the date of application to use, divide, sell or possess
the property and that there would be no diminution in value of the property from the value it
held on the date of application due to such revocation or expiration of the Special Use Permit.
The Special Use Permit enhances the value of the property above its value as of the date
the Special Use Permit is granted and reverting to the prior zoning results in the same value
of the property as if the Special Use Permit had never been granted. (C-44-22-162-X-00)

APPLY AND ACCEPT THE 2022 TITLE III CONSORTIUM GRANT FROM THE
ARIZONA DEPARTMENT OF EDUCATION
Approve the application for and acceptance of $166,299.56 for the Title III Consortium grant
from the Arizona Department of Education (ADE). This grant is a federal entitlement grant
that provides funds for the support of students who are learning the English language. These
funds also support instructors who teach classes for students who are learning the English
language. The term of this grant is for one year, July 1, 2021 to June 30, 2022. Authorize
the Chairman to sign all documents related to these grant funds, as applicable.
The grant award is reoccurring and has been awarded to the department in previous years.
The cash or in-kind match is not applicable. MCSS’s indirect rate for FY 2022 is 18.3 percent.
The indirect cost rate allowed by this grant source is 2.06 percent. Total indirect costs on this
award are $0 as all the monies are a pass through to the consortium members. The
estimated unallowable indirect costs are $26,397.29. Ongoing cash contributions not
applicable. MCSS serves as the fiscal agent for this consortium as the districts, by federal
law, must have a consortium when their allocation is less than $10,000. The grant award is
non-competitive and an entitlement grant from the federal government. There are no costs
that will need to be absorbed by the department’s operating budget.
Grant revenues are not local revenues for the purpose of the constitutional expenditure
limitation, and therefore, expenditures of these revenues are not prohibited by the budget
law. This action does not alter the budget constraining the expenditures of local revenues

Approve the application for and acceptance of the Title I - Delinquent – LEA from the Arizona
Department of Education in the amount of $86,000.71. The purpose of this grant is to provide
prevention and intervention programs for children and youth who are neglected, delinquent,
or at-risk. The Grant period is from July 1, 2021 to June 30, 2022.
MCESA’s indirect rate for 2022 is 18.3%. MCESA's approved indirect cost rate for this grant
is 2.06%. The estimated unallowable indirect costs are $13,684.61. Grant revenues are not
local revenues for the purpose of the constitutional expenditure limitation, and therefore,
expenditures of these revenues are not prohibited by the budget law. This action does not
alter the budget constraining the expenditures of local revenues duly adopted by the Board
pursuant to A.R.S. §42-17105.
The grant award is reoccurring. The department has no in-kind match requirement during

grant award is for a mandated function as it goes to the jail school education for 16 to 18
year old's already in county jail. This award is non-competitive and the grant award is a

IGA WITH CITY OF PHOENIX FOR ICAC
Approve an Intergovernmental Agreement (IGA) between Phoenix Police Department
(Primary Grantee)/Arizona ICAC Task Force Lead Agency and Maricopa County Sheriff’s
Office (Affiliate Agency) regarding Arizona Internet Crimes Against Children Task Force
(ICAC). This IGA becomes effective upon the date of the last signature of the executing
parties and remains in effect for five (5) years after the effective date. This agreement can

be terminated in writing by either party upon a thirty (30) day notice. This is a reimbursement
agreement with a funding award of up to $30,000. Categories of reimbursement are direct
costs such for training, investigations, computer forensics and public awareness in
connection with Internet Crimes Against Children (ICAC).
The Sheriff’s Office indirect cost rate is 14.74%. Indirect costs for this award are $4,422 and
are not recoverable. This amount will be absorbed within the Sheriff's Office budget. This
award is competitive, and the Sheriff's Office has received this funding before. Funding is
recurring, there is no match requirement and there are no future or ongoing contributions
required following the agreement period. This funding is not for a specific mandate but
supports the Sheriff's Office overall public safety mandate. The total estimated cost
associated with this award including indirect costs is $34,422.

COUNSELING FY23
Approve the application and acceptance of grant funds from the Administrative Office of the
Courts (AOC) in the amount not-to-exceed $271,986 for the purpose of Family Counseling.
The grant award will begin on July 1, 2022 and ends on June 30, 2023. The JPD department
was awarded $271,794 in FY22. Authorize the Chairman to sign all documents related to
these grant funds, as applicable. The Juvenile Probation Department indirect rate for FY22
is 24.1%. Total grant indirect costs are estimated to be $65,549 and are not recoverable.
The grant does require a cash equivalent match of $67,996.
The grant award is reoccurring and has been awarded to the department for over ten years.
The department has an in-kind match requirement of $67,996 during the grant award period.
The grant award is a mandated function and provides a benefit to the citizens by providing
family counseling services to support juveniles and intended to support their success upon
release with the goal of providing behavioral change. The grant award is competitively bid
and other eligible agencies may or may not bid on this grant award. If awarded, the

Vice Chairman Hickman thanked Lee Ann Bohn, Assistant County Manager, for the

place. Vice Chairman Hickman wanted to point out the hard work over the past two
years, and stated that it is really comforting to know that backup is in place.

administered by Maricopa County Animal Care and Control, to allow said rescue to transfer
animals that have been deemed eligible for the New Hope program. Maricopa County will
provide a rabies vaccination, dog license tag, and new owner transfer fee within the first year
of transfer for each dog three months of age or older at no cost to the Contractor. The cost
for these services is $52 for each animal transferred in FY 2022 and thereafter. Animal Care
and Control estimates five (5) New Hope transfers annually, for a total of $260 per year, over
the term of the agreement. The term of this agreement shall commence upon approval and

vaccination, dog license tag, and new owner transfer fee within the first year of transfer for

Approve the Letter of Promulgation and the Approval and Implementation Letter by the
Chairman of the Board of Supervisors for the 2022 MCEOP. The Letter of Promulgation is
signed by the jurisdiction’s senior elected or appointed official(s). The Approval and
Implementation Letter is a signed statement formally recognizing and adopting the plan as
the jurisdiction’s all-hazards Emergency Operations Plan (EOP). The implementation letter
introduces the plan, outlines its applicability, and indicates that it supersedes all previous
plans. It includes a delegation of authority for specific modifications that can be made to the
plan and by whom they can be made without the senior official’s signature. These documents
are required to be updated when a new senior elected official is selected (Board Chairman).

Pursuant to the Board’s Resolution, regarding Processing of Tribal Gaming Fund
Applications, dated May 31, 2016 (“Gaming Resolution”), Maricopa County is the
administrative pass-through for tribal gaming applications (“Applications”) received pursuant
to the State of Arizona Department of Gaming Compact (“Compact”). The Applications seek
funds for government services that benefit the general public, including public safety,
mitigation of the impacts of gaming, or promotion of commerce and economic development.
Pursuant to the Board’s Gaming Resolution, Maricopa County defers substantive review of

Resources recommends adding a sign-on incentive for Probation Officers ($1,500 after 6
months and $1,500 after 18 months), Law Enforcement Officers ($1,750 after passing the
academy and $1,750 after 1 year), and Law Enforcement Officers - Lateral ($2,500 after
passing field training and $2,500 after 1 year), and modifying the RN sign-on incentive that
was approved by the Board on 2/9/22 (from three $2,000 payments to two $3,000 payments;
after 3 months and 1 year).
These premium pay rates apply to the County’s elected offices, appointed departments,
Judicial Branch of Maricopa County who receives funding from Maricopa County, and the
Flood Control District of Maricopa County and the Maricopa County Library District (Special

NURSE RETENTION INCENTIVE
Approve retention incentives for nurses that mirror the County’s nurse sign-on incentives.
The County continues to struggle to recruit and retain nurses. To address recruitment issues
and be consistent with market practice, the County implemented a nurse sign-on incentive
program in June of 2021. The nurse retention incentives below will help address retention
issues for nurses who are not eligible for the sign-on incentive.
Incentive: $3,000 in March of 2022 and $3,000 on the first paycheck in March 2023
Eligibility: Nurses hired before 6/28/21 (effective date of the nurse sign-on incentive program)
Repayment Clause: Employees who receive a nurse retention incentive and voluntarily leave
County employment before two (2) years of consecutive County service must repay all
retention incentives received during the last 12 months prior to their separation. The amount
owed or a portion thereof may be deducted from the final paycheck. Employees whose final

Request approval and receipt of Emergency Rental Assistance (ERA 2) funds from the U.S.
Department of the Treasury. The Department of Treasury assigned the funds to the Human
Services Department DUNS Number 050391270, Assistance Listing Number and Title
21.023 Emergency Rental Assistance Program. The funding amount is $2,485,134.52. The
total ERA 2.0 funding is now $23,504,592.80.
Also request approval and authorization for the Human Services Department Director to
submit reports and sign required documents required by the Department of Treasury for
these designated funds.
Section 3201(a) of the American Rescue Plan Act of 2021, Pub. L. No. 117-2 (March 11,
2021), authorizes the Department of the Treasury to make payment to certain eligible
grantees to be used to provide emergency rental assistance. On March 18, 2022, the
Department of Treasury provided notification via email of the funding allocation to the

purpose of this agreement is to provide the County’s Ryan White Part A Program funding for
expansion of the anti-stigma HIV campaign “Positively You” in the Phoenix metropolitan
area. This IGA is in the not-to-exceed amount of $50,000 for the four (4) month term
beginning March 1, 2022 and ending June 30, 2022.
This is a new grant award and it is not anticipated to reoccur. It is non-competitive and there
is no cash or in-kind match required. In addition, there is no mandated services required.
MCDPH indirect rate for FY22 is 17.97%. Full indirect costs are estimated at $7,616 all of

funding to support the Find Help Phoenix (FHP) program. The grant fund not-to-exceed
amount is $120,000 for the grant term, July 1, 2022 through June 30, 2023.
This is the last year of the grant and the reoccurrence is not sure. This is a non-competitive
grant and there is no cash or in-kind match required. In addition, there is no mandated service
required. Find Help Phoenix is not a mandated function but provides a benefit to citizens.
The First Things First Regional Councils within Maricopa County will continue to work to
provide an online information and referral resource to families with young children and to
agencies that provide supports and services to those families. Services available through

the online resource address the social, health and early care and education needs of families
with children 0-5. Should the grant cease, on-going contributions would not be required.
This Grant deviates from County Policy A2505 and does not allow for full indirect cost
reimbursement, but a maximum of 10% indirect cost reimbursement as delegated in the
Grant Agreement. $80,000 is a pass-thru amount to the subrecipient (Crisis Response
Network) and not subject to indirect cost. MCDPH indirect rate for FY22 is 17.97%. The full
indirect costs are estimated at $6,534.55 of which $3,636.36 is recoverable. Unrecoverable
indirect costs are estimated at $2,898.18 and will be subsidized by the Department’s indirect
cost pool. Departmental indirect rates are reestablished at the beginning of each fiscal year
and the future indirect rates will be collected at the corresponding rates.
Grant revenues are not local revenues for the purpose of the constitutional expenditure
limitation, and therefore expenditure of the revenues is not prohibited by the budget law.
This Agreement does not alter the budget constraining expenditures of local revenues duly
adopted by the Board pursuant to A.R.S. §42-17105. The overall grant budget will be
adjusted as necessary to accommodate this grant through a future reconciliation. Funding
for this grant will be provided by First Things First and will not affect the County general fund.

Approve Purchase Order (PO) FY22-636 for Grant Award (RFGA2022-003-007) by the
Arizona Department of Health Services (ADHS) to Maricopa County by and through its
Department of Public Health (MCDPH) for the Nurse Family Partnership (NFP) to provide
additional funding for the Maternal, Infant, and Early Childhood Home Visiting (MIECHV)
Home Visiting Services Program. The purchase order is for the total not-to-exceed amount
of $649,484.55 for the budget period of April 1, 2022 through September 30, 2022. The
period of performance is January 14, 2022 through January 13, 2027.
The Department of Public Health FY22 indirect rate is 17.97%; therefore, indirect costs are
estimated at $98,934 all of which is recoverable. Departmental indirect rates are
reestablished at the beginning of each fiscal year and the future indirect rates will be collected
at the corresponding rates.
This competitive grant award is reoccurring and has been awarded to the department in
previous years. The cash or in-kind match is not applicable. Future ongoing cash
contributions are not required after the grant period. The grant award is not a mandated

FOR EMERGENCY PREPAREDNESS PROGRAM
No-cost extension to Intergovernmental Agreement (IGA) Contract No. ADHS17-133194,
action No. 11, between Arizona Department of Health Services (ADHS) and Maricopa
County by and through its Department of Public Health (MCDPH), Office of Preparedness
and Response (OPR). This program continues to provide funding to combat the COVID-19
pandemic with City Readiness initiatives. The purpose of this action is to approve a second
12-month No Cost Extension. The term and project period end dates have been extended
from March 15, 2022 to March 15, 2023. The cumulative not-to-exceed amount is $2,510,698
as of this amendment.
The COVID 19 award is emergency funding and it is unknown at this time whether it will be
a one time or reoccurring funding. Match is not required nor are ongoing cash contributions.
This is not a mandated function though it does provide a benefit to the citizens by
strengthening the readiness of the community to prepare for, respond to, and recover from

right-of-way and related easements within unincorporated Maricopa County required for the
Project. The City will pay for all costs associated with the right-of-way acquisition. The
proposed improvement will complete the minor arterial standard in places it was not finished
during development. The improvements will include four vehicular travel lanes (two lanes in
each direction), raised medians, bike lanes, curb, gutters, sidewalks, ADA ramp upgrades,
traffic signal upgrades, street lighting, undergrounding SRP 12kV, drainage improvements,
landscaping, dual left turn lanes at Riggs Road, water, sewer and private utility
improvements. The Intergovernmental Agreement requires the City to annex the Project
upon completion.

Vice Chairman Hickman asked the Clerk if she had any public comment email
responses to report. The Clerk replied one was received by email regarding the legal
class verification process. The email was shared with the district offices. The Clerk said
there was one public comment slip received from Mr. Blue Crowley who would like to
speak.
Mr. Blue Crowley III, resident, commented on the Valley Metro Regional Public
Transportation Authority (RPTA) and the Maricopa Association of Governments (MAG).
He said in the past, RPTA was trying to eliminate public comment at the meetings. He
stated if action is being taken, then the public should be allowed in.
Mr. Crowley spoke about how the light rail and transit are now together as one unit and
five bus routes that cross the light rail routes have no stops. If they are multimodal, all
five need to be dealt with. Mr. Crowley requested that Supervisor Gallardo help him
speak with RPTA about doing the meeting over again with the public involved.

Supervisors'/County Manager's summary of current events - Resumen de temas de

Joy Rich, County Manager, stated she was hopeful that the last 8:30 a.m. COVID call
was held this morning. The calls started March 12, 2020. She said it was a unique
experience amongst governments and enabled leadership to give direction and execute
necessary actions quickly when the community needed it the most.
Supervisor Sellers stated a lot of difficult decisions have been made. He said with an
experienced team in place to report on health issues, he was very proud of what the
County was able to do.
Chairman Gates stated it was very encouraging that a point is being reached in the
pandemic and there is no need for these meetings on a regular basis. He thanked
County employees for the efforts made that saved lives. He stated he appreciated Ms.
Rich’s comment that this was a unique partnership between the elected Board and
County leadership on a day-by-day basis.
Vice Chairman Hickman commented it was an unbelievable experience and one he
would never forget. He noted when a decision would need to be made, a special
session would be called to execute the action as soon as possible.
Supervisor Sellers stated he attended a virtual meeting with Senator Mark Kelly's Office
about congressionally directed spending. He noted he and Chairman Gates attended
the International State of the State with Governor Ducey as the keynote speaker.
Supervisor Sellers made a presentation at the Chandler Chamber of Commerce Policy
Impact Statement series, and a presentation on the extension of Prop 400.
Supervisor Gallardo stated tough decisions were made from the mask mandate to
closing parks. These decisions were made under a lot of pressure due to life and death
situations. He said he was glad the public's health, safety, and lives were put first and
foremost. He thanked Ms. Rich and everyone for their involvement and participation.
He noted that Hello Fresh has opened a new facility in the West Valley suppling healthy
meals for families and bringing 1,200 new jobs to Maricopa County. Another facility will
open soon in Goodyear with another 800 new jobs.
Supervisor Galvin commented on Copa Health, a private non-profit corporation in
Mesa. He highlighted the contributions made to those in need. He thanked Ms. Rich for
her kind words. He noted it is not over and everyone should remain vigilant due to the
BA2 variant.
Vice Chairman Hickman stated he joined Supervisor Galvin for a power breakfast at
Brophy College Preparatory and the speaker was the General Manager of the
Diamondbacks. It was a great speech about adversity and hope. He said he spoke at
a few leadership programs at Brophy and with a student who had a full athletic
scholarship to Notre Dame. This student made a brief speech today. He noted more
accomplishments made by this young man.
Chairman Gates thanked Vice Chairman Hickman for running a good meeting. He
announced the Farm City Breakfast would be held on Wednesday, April 13 from 8 a.m.
to 10 a.m. at Arizona Wholesale Nursey and he invited everyone to attend.

UTILITY LICENSE AGREEMENT WITH APS FOR THE RELOCATION OF A 12KV
POWERLINE FOR THE MCMICKEN DAM REHABILITATION PROJECT
Approve the Utility License Agreement FCD2021A014 for the relocation of a 12KV APS
Powerline needed for the McMicken Dam Rehabilitation Project between Arizona Public
Service (APS) and the Flood Control District of Maricopa County (District). The cost for the
relocation is $1,556,952.81 and will be fully reimbursed by the District.
Without the relocation of the existing APS 12KV Powerline the McMicken Dam Rehabilitation
Project cannot proceed. This Utility License Agreement is in accordance with the Board
approved Resolution FCD 2010R009 (C-69-12-005-6-00) which gives the Director the power
to authorize and negotiate IGA’s, right of way’s, design and construction needed for the
McMicken Dam Rehabilitation Project. This Agenda Item impacts Supervisorial District 4.

RESOURCES CONSERVATION SERVICE
Approve IGA FCD 2022A008 between the Flood Control District of Maricopa County
(DISTRICT) and the United States Department of Agriculture, Natural Resources
Conservation Service (NRCS) and accept $479,884.99 in Federal Funds for technical and
financial assistance to the DISTRICT for repair of portions of the Scott Avenue Wash in the
Town of Gila Bend.
Portions of Scott Avenue Wash were damaged in the August 2021 storm event. The NRCS
Emergency Watershed Protection Program provides for technical and financial assistance
to a local sponsor for the restoration of flood control facilities damaged due to flooding.
