A RESOLUTION OF THE BOARD OF SUPERVISORS OF MARICOPA COUNTY, PHOENIX, 
ARIZONA (THE “COUNTY”) AUTHORIZING EXECUTION ON BEHALF OF THE COUNTY THE 
TERMINATION OF ASSURANCE AGREEMENT BETWEEN THE COUNTY, AND SLV ARROYO 
NORTE, LLC FOR THE DEVELOPMENT KNOWN AS ARROYO NORTE UNITS 8, 9 & 10 
SUBDIVISION 
 
 
WHEREAS, Maricopa County entered into an Assurance Agreement with SLV Arroyo, 
LLC dated October 23, 2019, which was recorded on October 29, 2019 as entry number 
20190864507 in the Official Records of Maricopa County; and 
 
 
WHEREAS, pursuant to paragraph 8 of the Assurance Agreement, SLV Arroyo Norte, 
LLC may terminate the Assurance Agreement by providing a substitute assurance as required by 
the ordinances and regulations of the County; and 
 
WHEREAS, SLV Arroyo Norte, LLC has provided a performance bond to the County to 
satisfy the requirements of ARS §11-821(C) and 11-822(A) in place of the Assurance Agreement; 
and 
 
 
WHEREAS, pursuant to paragraph 3 of the Assurance Agreement, the County shall 
execute a document presented to it by SLV Arroyo Norte, LLC for recordation to provide notice 
that the Assurance Agreement has been terminated. 
 
NOW, THEREFORE, BE IT RESOLVED, the Board of Supervisors of Maricopa County 
authorizes execution of the Termination of Assurance Agreement on behalf of the County.
