There are no outstanding concerns from reviewing agencies, 
and there is no known opposition. This is a SUP Major 
Amendment to expand a water treatment plant that includes 
a well site and an arsenic removal component. The originally 
approved SUP area encompasses approx. 96 sq. ft. (0.002 
ac.) of the 1.02 ac. parent parcel; which is currently being 
utilized for water tank storage within Phase 1 of the Buckeye 
Ranch subdivision under SUP case Z2007004. This major 
amendment will have the effect of expanding the SUP area 
north to include Lot 14 of the Buckeye Ranch subdivision for a 
total SUP area of 2.13 acres. The site is currently owned and 
operated by the Water Utility of Greater Tonopah. The facility 
will be used for water distribution and arsenic treatment. The 
water treatment (for potability for safe human consumption) 
aspect of the subject request requires a SUP. The expansion 
includes a new well location, SES and control panels, a future 
150,000-gallon storage tank, and a future arsenic treatment 
facility. Arsenic levels vary based on depth, location, pumped 
flow etc. The EPA Maximum Contaminant Level (MCL) is 0.010 
mg/L, and the Water Utility is encountering levels from non-
detect to 0.030 mg/L in this area.

Recommendation: 
On 8/4/22, the Commission voted 9-0 to recommend 
approval of Z2021139 subject to conditions ‘a’ – ‘n’:

a. 
Development and use of the site shall be in substantial conformance with the site 
plan entitled “Site Plan of Lot 14 & Tract A of Buckeye Ranch” consisting of one (1) 
full-size sheet dated June 20, 2022, and stamped received June 28, 2022, except 
as modified by the following conditions. 
 
b. 
Development and use of the site shall be in substantial conformance with the 
narrative report entitled “Lot 14 & Tract A of Buckeye Ranch Special Use Permit 
Major Amendment” consisting of twenty-three (23) pages, dated revised June 20, 
2022, and stamped received June 28, 2022, except as modified by the following 
conditions. 
 
c. 
All transformers, back-flow prevention devices, utility boxes and all other utility 
related ground mounted equipment shall be painted to complement the 
development and shall be screened with landscape material where possible.  All 
HVAC units shall be ground-mounted. 
 
d. 
Prior to commencing construction of the arsenic treatment system, the applicant 
shall obtain an Approval to Construct from Maricopa County Environmental 
Services Department (MCESD).  
 
e. 
Prior to the issuance of construction permits, the applicant shall submit a Grading 
and Drainage plan and Drainage Report that have been signed and sealed by 
an Arizona Registered Civil Engineer.  Said plan and report shall include the 
following: 
 
1. 
Retention basin needs to provide for a maximum side slope of 4:1.  
 
2. 
Drainage review of planning and/or zoning cases is for conceptual design 
only and does not represent final design approval nor shall it entitle 
applicants to future designs that are not in conformance with Section 1205 
of the Maricopa County Zoning Ordinance and the Maricopa County 
Drainage Policies and Standards.  
 
3. 
All development and engineering design shall be in conformance with 
Section 1205 of the Maricopa County Zoning Ordinance and current 
engineering policies, standards and best practices at the time of 
application for construction.  
 
4. 
Any development in the floodplain will require a floodplain use permit issued 
concurrent with building permit(s) required for site development.  
 
5. 
Driveway access to Papago Street must be paved and will require a permit 
from MCDOT issued concurrent with building permit(s) required for site 
development. Drainage flow along the roadway must be maintained.  
 
6. 
All retention basins shall drain within 36 hours per County requirements.  
 
f. 
The applicant or his successor shall obtain approval of any development plans 
from the Office of the Arizona State Fire Marshal prior to any construction.

g. 
Development and use of the site shall comply with requirements for fire hydrant 
placement and other fire protection measures as deemed necessary by the 
applicable fire department. Prior to issuance of zoning clearance, the applicant 
shall seek review and comment from the applicable fire protection agency, and 
shall provide written confirmation that the site will be developed in accordance with 
their requirements. 
 
h. 
All outdoor lighting shall conform to the Maricopa County Zoning Ordinance. 
 
i. 
Prior to zoning clearance, developer(s) and/or builder(s) shall establish 
emergency fire protection services, covering all real property contained within the 
project area during course of construction and shall obtain a ‘will serve’ letter 
substantiating coverage from the appropriate Fire Department servicing the site. 
 
j. 
In the event the use of this site is terminated for a period exceeding 180 days, the 
SUP shall expire and all related equipment shall be removed within 180 days.  
 
k. 
Major changes to the Special Use Permit shall be processed as a revised 
application, with approval by the Board of Supervisors upon recommendation of 
the Planning and Zoning Commission.  Minor changes may be administratively 
approved by the Planning and Development Department.  Major changes to the 
Special Use Permit may require a new Citizen Participation Process as determined 
by the Planning and Development Department. 
 
l. 
Noncompliance with the conditions of approval will be treated as a violation in 
accordance 
with the 
Maricopa County 
Zoning 
Ordinance. 
 
Further, 
noncompliance of the conditions of approval may be grounds for the Planning 
and Zoning Commission to take action in accordance with the Maricopa County

Project Summary: 
 
1. 
This is a SUP Major Amendment to expand a water treatment plant for removal of arsenic 
in the Rural-43 zoning district. The originally approved SUP area encompasses approx. 96 
sq. ft. (0.002 ac.) of the 1.02 ac. parent parcel; which is currently being utilized for water 
tank storage within Phase 1 of the Buckeye Ranch subdivision under SUP case Z2007004. 
The existing well site consists of a 150,000 gallon above-ground water storage tank along 
with additional support equipment such as the well pump, generators, booster pumps, 
hydropneumatics tank, and a 220,000 gallon above-ground water storage tank. The 
existing arsenic treatment component includes two (2) 8’ (h) arsenic treatment tanks on 
a 12’ x 8’ (96 sq. ft.) pad.  
 
2. 
This major amendment will have the effect of expanding the SUP area north to Lot 14 of 
the Buckeye Ranch subdivision. The site is currently owned and operated by the Water 
Utility of Greater Tonopah. The facility will be used for water distribution and arsenic 
treatment. As a water distribution facility, the site does not require a SUP; however, the 
water treatment aspect of the subject request requires a SUP. The expansion includes a 
new well location, SES and control panels, a future 150,000-gallon storage tank, and a 
future arsenic treatment facility.

Primary access to the site will be off 355th Ave. and then to Buckeye Ranch Rd. and 355th 
Ln. The site can also be accessed from Buckeye Rd. and then to Papago St, which is also 
a paved street within Buckeye Ranch (Phase 1) subdivision, through a 20’ (w) entry gate. 
The existing well site was anticipated with the original design of the subdivision; therefore, 
traffic generated by the proposed well site has already been included in the original 
traffic report that was approved by MCDOT. The applicant indicates the projected traffic 
generated by the well site is minimal and primarily consists of daily inspections and 
maintenance by Water Utility of Greater Tonopah staff and its contractors. Additionally, 
the arsenic treatment facility operates with the daily functioning of the well and is not 
expected to increase the projected traffic. The proposed arsenic treatment facility 
designates one (1) 10’ x 30’ parking space reserved for maintenance vehicles. A replat 
of the subdivision is in process to combine the two parcels (Lot 14 and Tract A) and the 
lots have been combined through the Assessor’s office under APN 506-41-285A.

development, POD) and although the special use permit is a legislative approval, the 
POD is administratively approved. Therefore, POD approval is contingent upon prior SUP 
approval.

Tonopah/Arlington Area Plan (County Area Plan): The County Area Plan designates the 
site for Rural Residential development (0-1 d.u./ac.).  At an overall density of 0.91 d.u./ac., 
the Buckeye Ranch subdivision is in concert with this plan. The Buckeye Ranch water 
distribution and storage facility is a by-right use and the arsenic treatment component is 
a requirement, therefore the SUP request is in concert with Tonopah/ Arlington Area Plan.   
 
Public Participation Summary:

Applicant completed all necessary public participation requirements per Special Use 
Permit requirements and according to MCZO Section 304, including notification of 
property owners and homeowner’s associations within 300’ of the subject major

amendment site. The notice indicated a contact person for any questions on the request. 
A list of owners and associations within 300’ of the site was supplied along with the 
notification letter. 1st notice was sent January 3, 2022. The site was posted January 6, 2022. 
Hearing dates were changed on the site posting on July 18th. No public comment was 
received by the applicant nor by staff. 
 
Outstanding Concerns from Reviewing Agencies:

Staff Analysis:

This approx. 2.1-acre SUP expansion request for a water treatment (arsenic) plant in the 
Rural-43 zoning district provides a direct benefit to the Tonopah area. The purpose of the 
facility is to meet the lower arsenic levels that have been mandated by the EPA. 
Reviewing County agencies, interested parties and adjacent property owners offer no 
opposition to this request. Staff is supportive of an indefinite SUP period since the EPA 
standards are to remain in effect indefinitely and therefore the site will require an arsenic 
treatment facility as long as the facility continues to supply drinking water.  The site will be 
utilized by Water Utility of Greater Tonopah which will provide Buckeye Ranch and 
surrounding communities with water and is therefore not making any request which 
would deem this project out of character or having a negative impact on the 
surrounding properties.  Staff is in support of this critical infrastructure expansion. 
 
Recommendation:

Staff recommends the Commission adopt a motion recommending that the Board of 
Supervisors approve Z2021139 subject to the following conditions ‘a’ – ‘n’.

Executive Summary and Purpose of Request
EPS Group, Inc., on behalf of the property owner, submits this request for a Special Use Permit Major 
Amendment in order to expand and develop an arsenic treatment facility, located on the southwest corner 
of Buckeye Road and 355rd Avenue in Tonopah, AZ. The site is identified as Lot 14 and Tract A of the Buckeye 
Ranch Phase 1 Replat, which is Book 504, Page 12 of the Maricopa County Recorder.   
2. Description of Proposal
The site is approximately 2 acres and is currently zoned RU‐43.  The existing well site and treatment facility 
is located on Tract A and current has a Special Use Permit (SUP) for the arsenic treatment approved as 
Maricopa County case number Z2007004.  This request is to expand the existing site north into Lot 14 of the 
Buckeye Ranch subdivision.  The expansion includes a new well location, SES and control panels, a future 
150,000‐gallon storage tank and a future arsenic treatment facility.  Please see the site plan included with 
this submittal for the overall site design.  In order for the arsenic treatment to be allowed on the residential 
Lot 14, the previously approved SUP a part of Z2007004 will need to be amended to encompass the Lot 14 
expansion.  
Day‐to‐day operations include one employee visit for one hour each weekday to monitor the well site and 
arsenic  treatment  facility  or  perform  maintenance.    These  operations  are  already  happening  with  the 
existing site on Tract A and the expansion will not necessitate the need for more employees on site. 
A new deed was recorded with the Maricopa County Recorder to remove the property line between Tract 
A and Lot 14.  The new assessor parcel number given to the combined property from the Maricopa County 
Assessor’s office is 506‐41‐285A.  This will ensure the expanded site on Lot 14 is permitted to connect to the 
existing well site on Tract A. 
To  facilitate  the  expansion  of  the  subject  facility,  this  application  requests  a  Special  Use  Permit  Major 
Amendment. The expansion of this site will enable future development opportunities in the surrounding 
Tonopah area.

4. Location and Accessibility
This site is generally located on the southwest corner Buckeye Road and 355th Avenue outside of Buckeye, 
Arizona.  Regional access shall be provided by Interstate 10 from an existing traffic interchange at 339th 
Avenue which is roughly 2 miles east along Buckeye Road and 1.8 miles north on 339th Avenue from the 
property.    Site  access  will  be  provided  via  355th  Lane  or  Papago  Street  through  the  Buckeye  Ranch 
subdivision which are already improved.   
5. Circulation System
Access to the site shall be provided by the already improved local streets of Papago Street and 355th Lane 
of the Buckeye Ranch subdivision.  Lot 14 shall have a swinging ingress and egress gate for employees to 
access the new well and the future arsenic treatment facility via ABC surface driveway with a parking spot 
for a maintenance vehicle. 
6. Community Facilities and Services
This  application  request  will  not  adversely  affect  existing  or  future  public  and  private  open  space, 
recreation, schools or library facilities.  
7. Public Utilities and Services
This  application  request  will  not  adversely  affect  municipal  and  private  facilities  and  services.  The 
following list identifies public and private services for the development:

The development team is committed to ensuring the expansion of the existing arsenic treatment facility

General Project Summary: 
The proposed development consists of additional well site and future arsenic 
treatment facility at the existing Global water facility located on Lot 14 & Tract 
A of Buckeye Ranch at the intersection of Buckeye Road and 355th Avenue in 
Maricopa County. No new access(s) are proposed for the facility. 
As per the TS, the new facility is anticipated to generate a total of 8 weekday 
trips, with 1 total AM peak hour trips and 2 PM peak hour trips. 
Review Comments: 
No additional R/W dedication is required for the proposed development (see 
attached confirmation from MCDOT planning). No half-street improvements 
are required. 
As per the TS provided, MCDOT estimates that there is no significant impact 
on the surrounding MCDOT roadway network due to the traffic generated by 
the proposed development.  Therefore, MCDOT has no further comments on

The subject lot is APN 506-41-234, Lot 14 of Buckeye Ranch Phase 1 replat for which the subdivision

half-width dedication is 55’.  The applicant will need to do a replat to combine this lot with the Tract
A, adjoining parcel 506-41-285.
As the subdivision has the 55’ half-width set do you want the 65’ dedication across the frontage of
these two lots for the intersection of the two streets as part of the entitlement of the replat for
these two lots or leave as is at 55’ to be consistent with the remainder of the subdivision.

PND Engineering has reviewed the 3rd submittal plans and 2nd submittal drainage report 
for the subject application and have the following comments.  We would support 
approval of this proposal subject to the below stipulations: 
Drainage Plan and Report Review Comments 
1. Maximum retention basin side slopes are 4:1 (not 3:1 as shown).   We would
accept conditioning the approval as there appears to be adequate additional
room on-site.
Flood Control District Comments 
1. Flood Control District concerns are addressed with this plan. Further review
and permitting to occur with the building plan review.
PND Transportation Comments 
1. Submitted Traffic Impact Statement has been approved by MCDOT. No
offsite improvements nor additional right-of-way is needed.
Any approval of this case shall include the following standard stipulations:

Retention basin needs to provide for a maximum side slope of 4:1.
•
Drainage review of planning and/or zoning cases is for conceptual design only
and does not represent final design approval nor shall it entitle applicants to
future designs that are not in conformance with Section 1205 of the Maricopa

County Zoning Ordinance and the Maricopa County Drainage Policies and 
Standards. 
•
All development and engineering design shall be in conformance with Section
1205 of the Maricopa County Zoning Ordinance and current engineering
policies, standards and best practices at the time of application for construction.
•
Any development in the floodplain will require a floodplain use permit issued
concurrent with building permit(s) required for site development.
•
Driveway access to Papago Street must be paved and will require a permit from
MCDOT issued concurrent with building permit(s) required for site
development. Drainage flow along the roadway must be maintained.
•
All retention basins shall drain within 36 hours per County requirements.

The Maricopa County Environmental Services Department (MCESD) has reviewed 
documents received from the Maricopa County Planning and Development 
Department for the above referenced project. This project is a request for a Special 
Use Permit Major Amendment to expand the existing well site and arsenic treatment 
use of Tract A to Lot 14 of Buckeye Ranch Phase 1. The proposed facility will be 
located at the southwest corner of 355th Avenue and Buckeye Road.  This system will 
treat groundwater to meet the current arsenic maximum contaminate level required 
by the Safe Drinking Water regulations.   
Based on the above, MCESD raised no objection to the Planning & Development 
Department in Permits Plus on November 12, 2021 and will allow the project to 
proceed at this time subject to the following stipulations: 
Stipulations:  
No construction of the arsenic treatment system can begin prior to the 
issuance by MCESD of an Approval to Construct. 
It should be noted that this document does not approve the referenced project.  
Comments are provided only as advisory to Maricopa County Planning and 
Development Department to assist staff to prepare a staff report.  Other Maricopa 
County agencies may have additional requirements. Final review and approval will be 
made through Planning and Development Department procedures. Applicant may 
need to submit separate applications to the Maricopa County Environmental Services 
Department for approval of proposed facilities regulated by the Department.  Review 
of any such application will be based on regulations in force at the time of 
application.
