ORDINANCE NO. 356 va AN ORDINANCE EXTENDING AND INCREASING THE CORPORATE LIMITS OF THE CITY OF MESA, MARICOPA COUNTY, ARIZONA, PURSUANT TO THE PROVISIONS OF TITLE 9, CHAPTER 4, ARTICLE 7, SUBSECTION (N), ARIZONA REVISED STATUTES AND AMENDMENTS THERETO, BY ANNEXING THERETO CERTAIN COUNTY RIGHT-OF-WAY CONTIGUOUS TO THE EXISTING CITY LIMITS OF THE CITY OF MESA. ANNEXATION CASE Z97-2 WHEREAS, the City of Mesa, a municipal corporation and Maricopa County, a public body, together were desirous for new improvements to Guadalupe Road (a Maricopa County roadway), lying between Power Road and Hawes Road and being contiguous to the Mesa City Limits; and WHEREAS, the Mesa City Council adopted Resolution No. 6937, on August 5, 1996, authorizing the City Manager to execute an Intergovernmental Agreement with Maricopa County pertaining to said improvements to Guadalupe Road; and WHEREAS, the Maricopa County Board of Supervisors on September 18, 1996, approved the Intergovernmental Agreement with the City of Mesa pertaining to the responsibilities of the City and the County for the cost sharing of the improvements to Guadalupe Road (between Power Road and Hawes Road), and the responsibilities for pre-engineering activities, design, construction, management and inspection of the roadway, in addition to a requirement for subsequent annexation of the completed roadway improvements by the City of Mesa; and : WHEREAS, said executed Intergovernmental Agreement between the City of Mesa and Maricopa County was recorded in the Office of the County Recorder of Maricopa County, Arizona on September 27, 1996, under Docket No. 96-068813; and WHEREAS, the Mayor and City Council of the City of Mesa are desirous of complying with the annexation requirement of said executed Intergovernmental Agreement by extending and increasing the corporate limits of the City of Mesa to include the County right-of-way for Guadalupe Road between Power and Hawes roads; and WHEREAS, the provisions of Section 9-471, Subsection (N), Arizona Revised Statutes provides for annexation of county rights-of-way when contiguous to the corporate limits of a city or town. NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF MESA, COUNTY OF MARICOPA, STATE OF ARIZONA, AS FOLLOWS: SECTION 1: That the following described territory be and the same is hereby annexed to the City of Mesa and that the present corporate limits be and the same hereby are extended and increased to include the following described territory contiguous to the present Mesa City Limits: COMMENCING at the Northwest Corner of Section 7, Township One South, Range Seven East of the Gila and Sait River Base and Meridian, Maricopa County, Arizona; THENCE East along the North Line of said Section 7, to a point of intersection with a line 65' East of and parallel to the West Line of said Section 7, said point of intersection being the TRUE POINT OF BEGINNING, THENGE South along said parallel line which is 65' East of the West Line of Section 7,to0 a point of intersection with a line which is 55' South of and parallel to the North Line of said Section 7; THENCE East along said paratiel line which is 55° South of the North Line of Section 7, to a point of intersection with the West Line of Section 8, Township One South, Range Seven East of the Gila and Salt River Base and Meridian, Maricopa County, Arizona; THENCE continuing East along a line 55' South of and parallel to the North Line of said Section 8, to a point of intersection with the West Line of Section 9, Township One South, Range Seven East of the Gila and Salt River Base and Meridian, Maricopa County, Arizona; THENCE continuing East along a line 55' South of and parallel to the North Line of said Section 9, to a point of intersection with a line 55' East of and parallel to the West Line of said Section 9; THENCE North along said parallel line which is 55' East of the West Line of Section 9, to a point of intersection with the South Line of Section 4, Township One South, Range Seven East of the Gila and Salt River Base and Meridian, Maricopa County, Arizona; THENCE continuing North along a line 55' East of and parallel to the West Line of said Section 4, to a point of intersection with a line 33' North of and parallel to the South Line of said Section 4; THENCE West along said parallel line which is 33' North of the South Line of Section 4, to a point of intersection with the East Line of Section 5, Township One South, Range Seven East of the Gila and Salt River Base and Meridian, Maricopa County, Arizona; THENCE continuing West along a line 33' North of and parallel to the South Line of said Section 5, to a point of intersection with the East Line of Section 6, Township One South, Range Seven East of the Gila and Salt River Base and Meridian, Maricopa County, Arizona; THENCE continuing West along a line 33’ North of and parallel to the South Line of said Section 6, to a point of intersection with a line 65' East of and parallel to the West Line of said Section 6; THENCE South along said parallel line which is 65' East of the West Line of Section 6, fo a point of intersection with the North Line of Section 7, Township One South, Range Seven East of the Gila and Salt River Base and Meridian, Maricopa County, Arizona, to the TRUE POINT OF BEGINNING. SECTION 2: That a copy of this ordinance together with an accurate map of the territory hereby annexed to the City of Mesa, certified by the Mayor of Mesa, be filed and recorded in the Office of the County Recorder of Maricopa County, Arizona.
