The applicant is requesting a Special Use Permit (SUP) to allow
for the conversion of an existing legal non-conforming (LNC)
illuminated billboard with two static faces to a billboard with
two digital faces. The existing billboard is in the west side of
the lot adjacent to Mary St. with a height of 30’ with a sign
area of 300 SF per sign face, meeting the development
standards for non-freeway orientated billboards. The subject
billboard is considered LNC since it was permitted on the site
prior to the County’s 2021 text amendment regarding
billboard regulations. This sign is also LNC because there are
two other billboards within 1,000’ from the subject billboard.
These other billboards are oriented to the freeway. This
request to convert the existing billboard to digital will require
a SUP, per Article 1403.3.1.K of the Zoning Ordinance. The
proposal is increasing the height of the existing billboard to
62’, due to the adjacent height of the freeway, and increase
the sign area to 672 SF per sign face, both of which will meet
the current billboard standards.
There are no outstanding concerns from reviewing agencies.
Staff originally recommended denial for this SUP request
based largely upon the fact that the original billboard was
permitted oriented to the surface streets with a 300 SF face
and 30’ height. The ordinance at the time of permitting,
allowed for a 1,000’ linear separation along the same street,

thus the street to which the billboard was oriented was a key
factor. There are two existing billboards oriented to the Red
Mountain Frwy. that are 1,000’ apart along Gilbert Dr. The
subject billboard sits in between those two other billboards,
thus there will are three billboards along a 1,000’ length
adjacent to the freeway. This separation distance from the
other two billboards is the only reason the SUP is required. The
proposed digital billboard otherwise will meet all current
ordinance requirements.
The billboard modifications will increase the height from 30’ to
62’ and increase the face area from 300 sf to 672 sf, as well as
modifying the illumination from top-mounted downward
lighting to a digital face. It’s important to note there has been
no comment from the City of Tempe, who is the ultimate
annexing municipality. There is no known public opposition
despite an active community group. It is staff’s opinion that
redevelopment within the north Tempe County Island works
to mitigate the potential for neighborhood blight. It is also
staff’s and the Commission’s opinion that a digital face is
generally more aesthetic than traditional illumination.
The current traditionally illuminated billboard is a LNC use that
is permanently entitled. Staff’s negative recommendation in
the P&Z staff report was based on concern that LNC uses
should amortize over time. However, the only means to
improve the existing billboard aesthetic is via a SUP as
proposed. Therefore in further considering the facts of this
case, staff changed their recommendation from denial to
approval of SUP Z2022051 subject to conditions ‘a’ – ‘h’ but
with deletion of condition ‘c’ (which if included in the motion
would place a five-year limit on the SUP) and presented this
to the Commission. Thus, during the P&Z Commission Hearing,
the Commission voted to approve Z2022051, subject to
conditions ‘a’ – ‘g’ and removed condition ‘c’ from the list of
conditions. During the Commission Hearing no one from the
public spoke in opposition or support of the SUP request.
Commission
Recommendation:
On 7/7/22, the Commission voted 6-0 to recommend
approval of Z2022051 subject to conditions ‘a’ – ‘h’, with the
deletion of condition ‘c’. Shown below is the relabeled
conditions ‘a’ – ‘g’ in final format:
a.
Development of the site shall be in substantial conformance with the Site Plan
entitled “Gilbert Dr & Mary St. Digital Billboard“, consisting of two full-size sheets,
dated April 13, 2022, and stamped received May 6, 2022 , except as modified by
the following conditions.
b.
Development of the site shall be in substantial conformance with the Narrative
Report entitled “Mary St. Digital Billboard”, consisting of four pages, dated May 5,

c.
The following Planning Engineering condition shall apply:
1.
Engineering review of zone change/Special Use Permits are conceptual in
nature. All development and engineering design shall be in conformance
with Section 1205 of the Maricopa County Zoning Ordinance; Drainage
Policies and Standards; Floodplain Regulations for Maricopa County;
MCDOT Roadway Design Manual; and current engineering policies,
standards and best practices at the time of application for construction.
d.
The digital billboard shall be in conformance with Article 1403.3.1.J. of the
Maricopa County Zoning Ordinance.
e.
All outdoor lighting shall comply with Section 1112 of the Maricopa County Zoning
Ordinance.
f.
Noncompliance with any Maricopa County Regulation shall be grounds for
initiating a revocation of this Special Use Permit as set forth in the Maricopa
County Zoning Ordinance.
g.
The granting of this change in use of the property has been at the request of the
applicant, with the consent of the landowner. The granting of this approval
allows the property to enjoy uses in excess of those permitted by the zoning
existing on the date of application, subject to conditions. In the event of the
failure to comply with any condition, and at the time of expiration of the Special
Use Permit, the property shall revert to the zoning that existed on the date of
application. It is, therefore, stipulated and agreed that either revocation due to
the failure to comply with any conditions, or the expiration of the Special Use
Permit, does not reduce any rights that existed on the date of application to use,
divide, sell or possess the property and that there would be no diminution in value
of the property from the value it held on the date of application due to such
revocation or expiration of the Special Use Permit. The Special Use Permit
enhances the value of the property above its value as of the date the Special
Use Permit is granted and reverting to the prior zoning results in the same value of
the property as if the Special Use Permit had never been granted.

Project Summary:
1.
The applicant is requesting a Special Use Permit (SUP) to allow for the conversion of an
existing legal non-conforming (LNC) illuminated billboard with two static faces to a
billboard with two digital faces. The billboard is adjacent to the Red Mountain Frwy. on
a 7,706 ft² property in the IND-2 zoning district. Other than the billboard the site is being
used for outdoor storage, which is an allowed use in the IND-2 zoning district. The existing
billboard is in the west side of the lot adjacent to Mary St. with a height of 30’ with a sign
area of 300 ft² per sign face, meeting the development standards for non-freeway
orientated billboards. The subject billboard is considered LNC since it was permitted on
the site prior to the County’s 2021 text amendment regarding billboard regulations. This
sign is LNC because there are two other billboards within 1,000’ from the subject billboard.
These other billboards are oriented to the freeway. This request to convert the existing
billboard to digital will require a SUP, per Article 1403.3.1.K of the Zoning Ordinance. The
proposal is increasing the height of the existing billboard to 62’, due to the adjacent
height of the freeway, and increase the sign area to 672 ft² per sign face, both of which
will meet the current billboard standards.

The existing billboard has been on this site for eight years and was originally approved
administratively as a billboard oriented to Mary St. and specifically not considered
oriented to the freeway, on January 24, 2014 (Z2013100). Despite the fact there were two
other billboards less than 1,000’ from the subject billboard, the determination was made
(in a letter from the Director dated December 24, 2013, attached) that the proposed
billboard is not located on the same street as the two proximate billboards oriented
toward the freeway but is instead oriented toward a different street from the other
billboards. The ordinance requirement at the time was a 1,000’ linear separation between
billboards on the same street rather than the current 1,000’ separation radius. On
September 29, 2016, the applicant requested a minor amendment of the Plan of
Development (Z2016031) to change the orientation of the billboard from a north/south
orientation towards Mary St. to an east/west orientation towards Gilbert Dr. (the surface
street parallel and adjacent to the freeway) and since this request still conformed with
the billboard interpretation of 2013 the amendment was approved. However, changing
the orientation to Gilbert Dr. does make the billboard visible to the westbound and the
off-ramp traffic of the freeway. The existing billboard was permit per B201400444 and
B2014012088 as a 30’, 300 sf illuminated billboard.
3.
On January 21, 2022, the applicant applied for Plan of Development to convert the
existing static billboard to digital but was denied, since this conversion will require a SUP,
since the billboard is LNC. On April 19, 2022, staff held a Technical Advisory Committee
Meeting to discuss the first review of this SUP request.

Tempe’s General Plan 2040 (adopted December 12, 2014): The General Plan for Tempe
designates the site as Mixed-Use. This land use is intended for a mixture of residential and
commercial uses on a site. This category encouraged creatively designed developments
that create a living environment, reflective of a village or activity hub, in which there is
the opportunity to live, work and recreated in the same development or with in the area.
Public Participation Summary:

The applicant notified property owners within 300’ of the site and to area interested
parties. During the applicant’s Citizen Participation process neither staff nor the applicant
received any support or opposition. The City of Tempe was notified and as the writing of
this report staff have provided comments.
Outstanding Concerns from Reviewing Agencies:

There are no outstanding concerns from reviewing agencies.
Staff Analysis:

The existing billboard was approved prior to the 2021 Billboard Text Amendment. And,
when approved was on the basis of a 2013 Zoning Interpretation that a billboard can be

placed less than the required 1,000’ from another billboard if the two billboards are
oriented toward different street. Thus, this billboard is considered LNC. However, the
existing billboard would never have been originally permitted but for the fact that it was
not oriented toward the freeway. The proposed SUP will increase the height and sign area
of this billboard for the sole purpose of orienting it toward the freeway and not toward
Mary St./Gilbert Dr. as it was permitted. Staff is concerned approval of this SUP may result
in three digital billboards within a 1,000’ length of the Red Mountain Freeway, which
arguably will create visual distraction to motorists and goes against the reasoning behind
billboard spacing in the first place. Since LNC uses are expected to amortize over time
and staff are recommending if this SUP is approved to set a condition with a maximum
of five years, then if not extended, to remove the billboard at the owner’s expense. Staff
would suggest the digital billboard be revisited on a regular basis, every five years, to
determine if the SUP should be extended or revoked.

There is some argument for billboard approval. The existing billboard is illuminated. A
digital face will result is less luminescence into the nighttime sky and potential light
trespass into adjacent neighborhoods that does conventional sign illumination. Arguably
the digital face is more aesthetic than a conventionally illuminated billboard.
Recommendation:
12.
For the reasons outlined in this report, staff recommends the Commission adopt a motion
that the Board of Supervisors deny Z2022051.
13.
However, if the Commission choses to adopt a motion to recommend approval, staff
offers the following conditions ‘a’ – ‘h’ for Commission consideration:
a.
Development of the site shall be in substantial conformance with the Site Plan
entitled “Gilbert Dr & Mary St. Digital Billboard“, consisting of two full-size sheets,
dated April 13, 2022, and stamped received May 6, 2022 , except as modified by
the following conditions.
b.
Development of the site shall be in substantial conformance with the Narrative
Report entitled “Mary St. Digital Billboard”, consisting of four pages, dated May 5,
2022, and stamped received May 6, 2022, except as modified by the following
conditions.
c.
This Special Use Permit is valid for a period of five years and shall expire on August
17, 2029, at which time it must be removed at the owner’s expense unless the
Special Use Permit is renewed for another five-year period.
d.
The following Planning Engineering condition shall apply:

Purpose of Request
The applicant requests a Special Use Permit (“SUP”) to allow for the conversion to digital faces of the
existing billboard structure (the “Billboard”) along Red Mountain Freeway (the “202”), parcel # 132-19-
008B (the “Property”). This 7,706 square foot parcel is located in unincorporated Maricopa County and
is currently zoned IND-2 (Light Industrial). The current structure will also be raised to 62’ in height due
to the elevation difference and distance between the 202 and the Property. All other standards and
structures stay the same. The SUP is required due to the spacing requirements of 1,000 feet in Section
1403.3.1.A.1.b.
Description of Proposal
The property is located approximately 730 feet east of the northeast corner of Scottsdale Road and the
202, specifically the northeast corner of Mary St and Gilbert Dr. The billboard is along the southern
perimeter closest to the freeway as possible. The Property is currently being used for outdoor storage.
The property can be accessed off Gilbert Dr in order to maintain the billboards.
The billboard was originally permitted by a Plan of Development, Z2016031, as a billboard only oriented
to the local street and not the adjacent freeway. The billboard was built shortly after the approval on
September 29, 2016. Since 2016, there has been a text amendment to Section 1403.3.1 to allow digital
billboards in IND-2 zoning districts if the billboard is within 300 feet of an existing freeway. The current
billboard is 180’ from the travel lanes of the 202.
The SUP is required because the existing billboard is considered to be Legal Non-Conforming (“LNC”), since
it predates the 2021 text amendment for billboards and because there are two existing billboards within
1000’ of this existing billboard, both of which are oriented towards the freeway. The billboard to the west
is 490’ and the billboard to the east is 539’ to the existing billboard.
The applicant is proposing to convert both faces of the existing billboard with 14’ x 48’ (672 sqft) digital
sign faces at a 30 degree center mount, and raise the structure to 62’ in height. All other development
standards of the Maricopa County Zoning Ordinance apply. The billboard will meet the standards in
Chapter 11, Section 1112 of the Zoning Ordinance.
Wherein this SUP is approved, the Applicant will apply for building permits and will meet all
requirements of Article 1403.3 including 1403.3.F.2 regarding height. The 62’ height is allowed by right
through a POD. Section 1403.3.f.2.a states billboards located within 300 feet of an existing freeway
“shall be limited to 48 feet above adjacent grade or elevation of the main travel lanes of a freeway
immediately adjacent to the billboard or subject property (whichever is greater but not to exceed 70
feet)”. The freeway adjacent to the billboard is from 13-20 feet higher than the billboard location and
24’ above the Property at the Scottsdale Rd interchange which affects the cross read greatly. 62’ will
allow oncoming traffic to safely read the sign face
Justification for Request
The current billboard was approved through a Plan of Development, Z2016031, by staff as a billboard
oriented to the Gilbert Dr and not the adjacent freeway. In 2015, the billboard was considered an “arterial
board” because of Gilbert Dr fronting the Property to the south. Since then, the Ordinance change in 2021
now allows billboards within 300’ of freeways by right at a height of 48’ (if adjacent to level freeway grade)
and 672 sqft. The Ordinance also allows billboards to be digital within the radial spacing of 1,000’. The
1000’ radial spacing requirement has created a legal nonconformity for this billboard since it is between
two other billboards to the east and west. The Ordinance change now allows this board to become digital
since it is within 300’ of the 202. Gilbert Dr now becomes irrelevant since the board is only 180’ from the
202 freeway. The allowance of a digital sign at this location is necessary for the property owner to enjoy
their reasonable property rights similar to other properties along freeways. This allowance will not affect
or be detrimental to any adjacent properties or surrounding area. The area is very industrial in nature
consisting mostly of outdoor storage and outdoor auto repair and dead vehicle storage. A new functioning
digital billboard will only create more value to the Property and surrounding area.
Relation to Surrounding Properties
The surrounding parcels of the Property consist of IND-2 and industrial uses. The entire area is a
County Island from Scottsdale Rd to Miller Rd, and Curry Rd to Gilbert Dr. The parcels to the north, east
and west are all IND-2 zoned parcels and are also used for outdoor storage and dead vehicle storage.
The 202 is to the south of the Property across Gilbert Dr. A new functioning digital billboard will only
create more value to the Property and surrounding area and will allow businesses in the
Scottsdale/Tempe area to advertise to traffic along this portion of the 202.
North – IND-2 zoned with dead vehicle storage. No adverse effects are expected.
South – 202 - No adverse effects are expected.
West – IND-2 zoned with outdoor storage. No adverse effects are expected.
East – IND-2 zoned with dead vehicle storage. No adverse effects are expected.
Location and Accessibility
The Property is accessible from Gilbert Dr. The billboard will be reachable for maintenance form this
access point. As stated, the 202 freeway is directly to the south of the Property. The Property has
regional access via the 202.
Circulation System
The billboard is accessed from Gilbert Dr. through a gate to the billboard maintenance vehicle parking
space located in the northeast corner of the site. There will be no vehicular movement to any
surrounding properties. The driveway and parking space will be surfaced with asphalt millings to
minimize dust pollution. The driveway and parking will only be used to replace the static faces with
digital, and then only occasionally for maintenance. A benefit of digital panels is that maintenance is
much lower and typically occur only a few times a year. Asphalt millings is more suitable for this limited
amount of use.
Development Schedule
Once the permit is issued by Maricopa County the sign face will be ordered and delivered within 4 weeks
of being ordered. The construction process can be done in only a few days.

documents received from the Maricopa County Planning and Development Department
for the above referenced project. This project is a request for SUP for spacing between

documents, water and sewer services will not be needed, MCESD has no concerns.
Based on the above, MCESD raised no objection to this project to the Planning &
Development Department in Accela Automation on March 15, 2022 and the project
may proceed at this time subject to the following stipulations:

Comments are provided only as advisory to Maricopa County Planning and
Development Department to assist staff to prepare a staff report. Other Maricopa

PND Engineering Plan Review (DPR, FCD and PND Transportation) has reviewed the
1st submittal of the Special Use Permit application routed for review on March 15,
2022, and has no objections subject to the following conditions:
1. Engineering review of re-zone cases is conceptual in nature. All development and
engineering design shall be in conformance with Section 1205 of the Maricopa
County Zoning Ordinance; Drainage Policies and Standards; Floodplain
Regulations for Maricopa County; MCDOT Roadway Design Manual;
and current engineering policies, standards and best practices at the time of
application for construction.
