The applicant is requesting a Special Use Permit (SUP) to allow 
for the conversion of an existing legal non-conforming (LNC) 
bottom-up illuminated static billboard to digital format.  The 
existing billboard is on Willis Rd. with a height of 33’ and face 
size of 672 sq feet.  The existing height and size were approved 
with BA2015032, as well as the existing setback from the rural-
43 parcel to the west of the subject billboard.  The subject 
billboard is considered LNC since it was entitled prior to text 
amendment TA2018001which established a requirement that 
billboards must adhere to a radial separation of 1000’ face to 
face, rather than the previous linear separation requirement, 
and as such the subject billboard is just 492’ to the west of 
another existing billboard.  The digital conversion and 
requested increase in height to 63’ would be allowed per the 
ordinance without a SUP if the billboard was not LNC. 
 
 
Staff originally recommended denial for this SUP request 
based on the fact that the original billboard was entitled on 
Willis Rd and was not orientated towards the freeway.  
Additionally, in the event of approval staff originally 
recommended that the use be limited to a ten-year period 
due to the general feeling that LNC uses should be 
encouraged to amortize over time. Staff notes that no 
comment was received by the City of Chandler, nor has staff 
received any comment from the public. Staff was also 
provided with photometric diagrams from the applicant after

publication of the initial staff reports.   With this new 
information staff reconsidered the original recommendation 
under the basis that the digital billboards produce less light 
trespass than the current bottom up illuminated static 
billboard, and that it can be viewed as an aesthetic 
improvement over the existing billboard.  Therefore, in further 
considering the facts of this case, staff  changed their 
recommendation from denial to approval of SUP Z2022054 
subject to conditions ‘a’ – ‘h’ but with deletion of proposed 
condition ‘c’ regarding a ten-year limit on the SUP. The 
Commission voted to approve Z2022054, subject to 
conditions ‘a’ – ‘h’ with removal of the time limits. During the 
Commission Hearing no one from the public spoke in 
opposition or support of the SUP request.

Recommendation: 
On 7/7/22, the Commission voted 6-0 to recommend 
approval of Z2022054 subject to conditions ‘a’ – ‘h’, with the 
deletion of condition ‘c’. Shown below is the relabeled 
conditions ‘a’ – ‘g’ in final format:

entitled “For Willis Road Digital Billboard“, consisting of two full-size sheets, dated 
June 6, 2022, and stamped received June 6, 2022 , except as modified by the 
following conditions.

Development of the site shall be in substantial conformance with the Narrative 
Report entitled “Narrative Report / Special Use Permit for Digital Billboard”, 
consisting of four pages, dated May 5, 2022, and stamped received June 6, 2022, 
except as modified by the following conditions. 
 
c. 
The following Planning Engineering condition shall apply:

Applicant shall be responsible for coordinating any requirements that may 
be imposed by ADOT (redletter@azdot.gov)  
 
2. 
Engineering review of zone change/Special Use Permits are conceptual in 
nature. All development and engineering design shall be in conformance 
with Section 1205 of the Maricopa County Zoning Ordinance; Drainage 
Policies and Standards; Floodplain Regulations for Maricopa County; 
MCDOT Roadway Design Manual; and current engineering policies, 
standards and best practices at the time of application for construction. 
 
d. 
The digital billboard shall be in conformance with Article 1403.3.1.J. of the 
Maricopa County Zoning Ordinance. 
 
e. 
All outdoor lighting shall comply with Section 1112 of the Maricopa County Zoning 
Ordinance.

f. 
Noncompliance with any Maricopa County Regulation shall be grounds for 
initiating a revocation of this Special Use Permit as set forth in the Maricopa 
County Zoning Ordinance.  
 
g. 
The granting of this change in use of the property has been at the request of the 
applicant, with the consent of the landowner.  The granting of this approval 
allows the property to enjoy uses in excess of those permitted by the zoning 
existing on the date of application, subject to conditions.  In the event of the 
failure to comply with any condition, and at the time of expiration of the Special 
Use Permit, the property shall revert to the zoning that existed on the date of 
application.  It is, therefore, stipulated and agreed that either revocation due to 
the failure to comply with any conditions, or the expiration of the Special Use 
Permit, does not reduce any rights that existed on the date of application to use, 
divide, sell or possess the property and that there would be no diminution in value 
of the property from the value it held on the date of application due to such 
revocation or expiration of the Special Use Permit.  The Special Use Permit 
enhances the value of the property above its value as of the date the Special 
Use Permit is granted and reverting to the prior zoning results in the same value of 
the property as if the Special Use Permit had never been granted.

Project Summary: 
 
1. 
The applicant is seeking to convert an existing billboard from static to digital.  Since the 
billboard is only 492’ west of another existing billboard it does not meet the current radial 
distance requirement of 1000’.  MCZO 1403.3.1.A.1.b allows for billboards that were 
rendered Legal Non-Conforming (LNC) by TA2018001 to convert to digital via an 
approved Special Use Permit.  The applicants also propose to raise the height of the 
billboard to 63’.

The IND-2 zoning district was established over the subject parcel via Z2010020 which was 
approved by the Board of Supervisors (BOS) on July 7, 2010.  Subsequently, in 2015 a Plan 
of Development (POD), Z2015055, was submitted for a billboard on the northwestern 
portion of the parcel.  The POD, along with an associated variance (BA2015032) for 
increased height and decreased setbacks.  The staff reports for both BA2015055 and 
Z2015055 clearly note that the subject billboard is oriented towards Willis Rd and that it 
would not have met spacing requirements if it were oriented towards the freeway.

The subject billboard was originally entitled via a 2015 POD.  At the time of initial 
entitlement the billboard located 492 feet to east of the subject billboard had already 
been entitled.  The billboard to the east had been entitled to be orientated towards the 
Loop 202.  Based off a 2013 Zoning Interpretation it was determined that the subject 
billboard could be entitled if it was orientated towards Willis Rd. rather than the Loop 202. 
It is clearly noted in the staff reports to both variance case BA2015032 and the POD 
Z2015055 that the subject billboard was orientated towards Willis Rd. and not the Loop 
202. The subject billboard would never have been able to be approved if it were 
orientated towards the Loop 202 during initial entitlement because it would not have met 
the 1000’ spacing requirement to the billboard to the east. With the passage of 
TA2018001 billboards must adhere to 1000’ radial separation rendering the subject 
billboard LNC.  While MCZO allows for static LNC billboards to convert to digital with an 
approved SUP staff does not feel that this is an appropriate site as the subject billboard 
was originally entitled to a surface road not the freeway.  Furthermore, the subject 
billboard would not have been able to be erected in its current location if it were 
considered to be orientated towards the Loop 202 as the billboard to the east was 
already entitled.

Staff does note, however, that the existing static billboard is currently illuminated from the 
bottom up.  A digital conversion, with the use of louver technology, may create an

aesthetic improvement and illuminate unnecessary upward light trespass.  The applicant 
is also proposing to increase the height of the billboard to 63’.  MCZO 1403.3.1.F.2.a allows 
billboards within 300’ of a freeway main travel lane to be 48’ above natural grade or the 
elevation of the freeway, whichever is greater.  The applicant provided a topographic 
land survey illustrating that there is at least a 15’ elevation difference between the grade 
of the freeway and the natural grade around the billboard allowing for the requested 
63’ height.

Since LNC uses are expected to amortize over time staff recommends that if this SUP is 
approved a condition is set limiting the use to a maximum of ten years.  At which time 
the may be evaluated for a modification of stipulations for a potential extension of time 
frame.  If after the ten year period the use has not been extended the billboard will need 
to be removed at the owner’s expense. 
 
Recommendation:

For the reasons outlined in this report, staff recommends the Commission adopt a motion 
that the Board of Supervisors deny Z2022054. 
 
13. 
However, if the Commission choses to adopt a motion to recommend approval, staff 
offers the following conditions ‘a’ – ‘h’ for Commission consideration:

June 6, 2022, and stamped received June 6, 2022 , except as modified by the

This Special Use Permit is valid for a period of ten years and shall expire on August 
17, 2034, at which time it must be removed at the owner’s expense unless the 
Special Use Permit is extended by the Board of Supervisors.  
 
 
d.

Purpose of Request 
The applicant requests a Special Use Permit (“SUP”) to allow for a digital conversion of both 
faces of the billboard structure (the “Billboard”) along the Loop 202 (the “202”), parcel # 303-
28-033M (the “Property”).  This 20.49 acre parcel is located in unincorporated Maricopa County 
and is currently zoned IND-2 (Light Industrial).  The Property is used as a dairy farm. Please see 
Exhibits 1 and 2 for aerials of the Property.  The billboard structure is requested to be at a 
height of 63’ and both faces converted to digital.  The billboard location will not be changed.   
 
The SUP is required due to the digital sign spacing requirements of 1,000 feet in Section 
1403.3.1.A.1.b.  The request is to modify the spacing to 492’ to the existing billboard to the east 
which is owned by the same property owner and billboard company.  Louver technology will be 
used on both faces to mitigate light trespass and has been submitted with the permit 
application. 
 
Description of Proposal 
 
The property is located directly adjacent to the 202 freeway with the address of 11645 E Willis 
Rd.  The billboard is along the northern perimeter closest to the freeway as possible. The 
Property is currently being used for a dairy farm and associated uses.  The Property owner’s 
home is adjacent to the billboard to the west.  The property can be accessed off Willis Road to 
the west.  
 
The applicant is proposing to convert the current dual faced billboard from the current 36’ to 
63’ in height and will stay as a full flag structure.  The billboard has a setback 0’ from the north 
property line as allowed by right.  There was relief previously approved for the 10.38’ setback 
to residential to the west via BA2015032.  BA2015032 also granted relief for an illuminated off-
site sign to 10.38’.  The residential property to the west is owned by the same property owner 
of the subject site.  These standards were approved by the Board of Adjustment and will be 
unchanged.  The only change will be the static faces conversion to digital faces and the height.  
All other development standards of the Maricopa County Zoning Ordinance apply.  The 
billboard will meet the standards in Chapter 11, Section 1112 of the Zoning Ordinance.   
 
Both faces will incorporate vertical louvers that help mitigate any light trespass to the south of 
the billboards.  The vertical louvers will meet the standards codified in Section 1403.3.J.2. 
 
Wherein this SUP is approved, the Applicant will apply for a Plan of Development (”POD”) and 
will meet all requirements of Article 1403.3 including 1403.3.F.2 regarding height.  The 63’ 
height is allowed by right through the POD.  Section 1403.3.f.2.a states billboards located within 
300 feet of an existing freeway “Shall be limited to 48 feet above adjacent grade or elevation of 
the main travel lanes of a freeway immediately adjacent to the billboard or subject property 
(whichever is greater but not to exceed 70 feet)”.  The freeway adjacent to the billboard is from 
15-20 feet higher than the billboard location.

Justification for Request 
 
The current billboard was granted multiple variances in 2015 for an off-site sign at 36’ in height, 
and 10.38’ to the west property line for an illuminated board.  In 2015, the billboard was 
considered an “arterial board” because of its orientation to Willis.  This relief was needed 
during the time since the County did not allow full size (672sqft) billboards to be along 
freeways.  Since then, the Ordinance now allows billboards within 300’ of freeways by right at a 
height of 48’ (if adjacent to level freeway grade) and 672 sqft.  The Ordinance also allows 
billboards to be digital within the radial spacing of 1,000’.  The 1000’ radial spacing requirement 
has created a legal nonconformity for this billboard since it is 492’ to the billboard to the east.   
 
The billboard is as far west as it can possibly go.  The parcel to the west is residential where the 
owner of the dairy has lived for over 50 years and the City of Chandler boundary with large 
scale industrial buildings is just further to the west.  The only option for this board to be 
converted to digital is through the SUP process.  The digital billboard will allow the surrounding 
area’s and the east valley’s small businesses more opportunity to advertise to the east valley 
traffic.  There are not many advertising opportunities along the 202 for small businesses.  The 
subject billboard and the billboard to the east are one of the few opportunities for small 
businesses to advertise in this area of the Valley.  The allowance of a digital sign at this location 
is necessary for the property owner to enjoy their reasonable property rights similar to other 
properties along freeways.  This allowance will not affect or be detrimental to any adjacent 
properties or surrounding area.  The louver technology will mitigate any light trespass to the 
surrounding residential properties.  Another benefit to the area is that the billboards will be 
turned off at 11:00 pm.  The current billboards are allowed to stay on 24 hours with up-lighting.  
The new digital panels with louver technology will provide much less light to the surrounding 
area and the dark sky and will be turned off instead all night.  This is a major improvement for 
the Property and surrounding area. 
 
 
Relation to Surrounding Properties 
 
The surrounding parcels to the south and west of the Property consist of IND-2 zoning uses 
associated with the dairy.  The City of Chandler owns land to the east of the Property and is 
currently zoned RU-43 in the County but is currently vacant.  Further to the west of the 
property is vacant land platted for storage condos.  PODS moving and storage center is also to 
the west.   
To the north of the Property is the 202 freeway.  Further to the north is a single-family 
residential development in the City of Chandler.  Because of the distance away across the 202 
and obstructions including an ADOT sound wall and mature vegetation, the board cannot and 
will not be seen from the development. Please see Exhibits 4 and 5 for obstructions.   
North – 202 Freeway.  No adverse effects are expected.

South – Dairy Farm zoned IND-2.  No adverse effects are expected. 
East – Dairy Farm zoned IND-2.  No adverse effects are expected. 
West – Residential property owned by Property owner. No adverse effects are expected. 
New digital faces on the Property will allow local businesses of the east valley to advertise to 
viewers.  A new, quality billboard at this site will add improvement to the property and allow 
for messaging to the east valley.  This billboard is consistent with freeway types of development 
and the Industrial zoning and uses on the south side of the freeway.  
Location and Accessibility 
The Property is accessible from Willis Rd as it dead ends to the west.  The billboard will be 
reachable for maintenance from this access point.  As stated, the 202 freeway is directly to the 
north of the Property.  The Property has regional access via the 202 freeway.   
Circulation System 
The billboard is accessed from Willis Rd.  there will be no vehicular movement to any 
surrounding properties.  
Development Schedule 
Once a permit is issued by Maricopa County the digital faces will be ordered and delivered 
within 4 weeks of being ordered.  The construction process can be done in only a few days.   
Community Facilities and Services 
The Property is in the Chandler Unified School District #80.  San Marcos Elementary school is 
the closest school to the site at 451 W Frye Rd, 2 miles to the north of the Property.  The City of 
Chandler Tumbleweed Park is 2,100’ to the south of the Property.

The Maricopa County Environmental Services Department (MCESD) has 
reviewed revised documents received from the Maricopa County Planning and 
Development Department for the above referenced project. This project is a 
request for conversion of static billboard to digital at APN # 303-28-033M. 
Water & Sewer: - Well Water & Septic. MCESD has no concerns. 
 
Based on the above, MCESD raised no objections to the Planning & 
Development Department in Accela Automation on March 24, 2022. 
 
 
It should be noted that this document does not approve the referenced project.  
Comments are provided only as advisory to Maricopa County Planning and 
Development Department to assist staff to prepare a staff report.  Other 
Maricopa County agencies may have additional requirements. Final review and 
approval will be made through Planning and Development Department 
procedures. Applicant may need to submit separate applications to the 
Maricopa County Environmental Services Department for approval of proposed 
facilities regulated by the Department.  Review of any such application will be 
based on regulations in force at the time of application.

PND engineering plan review (DPR, FCD and PND Transportation) has reviewed the 1st 
submittal of the POD application routed for review on March 24, 2022. PND Engineering 
has no comments or objections subject to the following conditions: 
 
1. Applicant shall be responsible for coordinating any requirements that may be 
imposed by ADOT (redletter@azdot.gov).  
 
2. All development and engineering design shall be in conformance with Section 1205 
of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; 
Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual; 
and current engineering policies, standards and best practices at the time of 
application for construction.
