INVOCATION - INVOCACIÓN Chairman Gates recognized the loss of Judge Rosa Mroz who was an incredible member of the community. Judge Mroz served in Maricopa County Superior Court. In her honor, the flags have flown at half-mast. He asked for a moment of silence to remember Judge Mroz. Supervisor Sellers introduced City of Chandler Councilwoman, Christine Ellis, and shared all the work she has been involved in for our community. Councilwoman Ellis offered the invocation. 3. PLEDGE OF ALLEGIANCE - JURO FIDELIDAD A LA BANDERA Councilwoman Ellis led the assemblage in the Pledge of Allegiance to the flag. NOTE: Agenda item #12 was taken out of order and heard before agenda item #4. 12. APPOINT A JUSTICE OF THE PEACE FOR THE EAST MESA JUSTICE COURT Pursuant to A.R.S. §11-251(16) and the vacancy created by the resignation of Keith Russell, Justice of the Peace, East Mesa Justice Court, consider nominations and make an appointment to the fill the vacancy for a Justice of the Peace for the East Mesa Justice Precinct. Such appointment shall be effective February 9, 2022. (C-06-22-505-X-00) Supervisor Galvin shared that he met with the Presiding Judge of the Maricopa County Justice Court, Anna Huberman. She informed him a Justice position was very fast paced, with a heavy workload, and a degree of competence was required in order to keep the Courts running well. Supervisor Galvin provided a brief synopsis of Fred Arnett’s accomplishments. He said Mr. Arnett understands what it takes to serve on the bench and has the necessary experience for the role. Supervisor Thomas Galvin made a motion to appoint Fred Arnett to fill the vacancy for the Justice of the Peace, East Mesa Justice Court. PET SHOWCASE BY MARICOPA COUNTY ANIMAL CARE AND CONTROL - PRESENTACIÓN DE ANIMALES DOMESTICOS POR EL DEPARTAMENTO DE CONTROL Y CUIDADO DE ANIMALES Hannah with Maricopa County Animal Care and Control introduced Darryl. He is one of the longest residents at the shelter. He came to the shelter in November as a stray and is about four years old. He knows how to sit, lay down, and shake his paw. The staff can only speculate on what type of breed he is and believe he may have Shar Pei in him due to the wrinkles on his forehead. Chairman Gates asked the Clerk if there were any announcements or corrections to the agenda. The Clerk said there was one correction on item 61. The Supervisory District listed should read District 1, not District 2. CAREFREE CROSSINGS RV & BOAT PARKING EXTENSION Case #: Z2021098 Supervisor District: 3 Applicant & Owners: Casey Mahoney / Carefree Crossings SS/RV LLC, Mahoney Properties LLP/ETAL & Carefree Drainage Association Request: Special Use Permit Major Amendment for Carefree Crossings RV & Boat Storage Extension Site Location: Generally located at the NWC of 10th St. & Carefree Hwy. Commission Recommendation: On 1/13/22, the Commission voted 6-0, to recommend approval of Z2021098 subject to conditions ‘a’ – ‘k’: a. Development of the site shall be in substantial conformance with the Site Plan entitled, “Carefree RV Center Expansion” consisting of one full-size sheet dated December 21, 2021, and stamped received December 21, 2021, except as modified by the following conditions. b. Development and engineering design shall be in conformance with the Maricopa County Stormwater Quality Management and Discharge Control Regulation. The owner/developer shall prepare a Stormwater Site Plan (SWPP) and obtain approval by MCESD prior to construction (a separate submittal to MCESD is required). 3. Upon completion of construction, the owner shall fulfill MCESD post-construction requirements. This will include appropriate operation and maintenance requirements. f. The following Planning Engineering conditions shall apply: 1. The site contains a small area of regulated floodplain and jurisdictional washes in its southeast corner. Floodplains must be clearly mapped on construction plans. Any disturbance to the floodplain will require a floodplain use permit concurrent with building permit(s). Owner/Applicant is responsible for identifying and procuring any permit(s) for disturbance of, or work within delineated jurisdictional (404) washes. 2. Detailed Grading and Drainage (Site Infrastructure) Plans must be submitted with the application for Building Permits indicating that the site will drain to an existing retention basin. 3. No new driveways to Carefree Highway or 7th Street are included with this entitlement. Access to the development site shall be via the existing driveway located on 7th Street. 4. The subject site is located within the County’s Urbanized Area. A Storm Water Pollution Prevention Permit (SWPPP) from the County will be required prior to issuance of any construction permits. 5. Engineering review of planning and/or zoning cases is for conceptual design only. All development and engineering design shall be in conformance with Section 1205 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual; and current engineering policies, standards and best practices at the time of application for construction. 6. Based on the conceptual design nature of the information submitted, changes to the site layout may be necessitated by the final engineering design of the site’s drainage infrastructure. g. Noncompliance with any Maricopa County Regulation shall be grounds for initiating a revocation of this Special Use Permit as set forth in the Maricopa County Zoning Ordinance. h. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, and at the time of expiration of the Special Use Permit, the property shall revert to the zoning that existed on the date of application. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions, or the expiration of the Special Use Permit, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation or expiration of the Special Use Permit. The Special Use Permit enhances the value of the property above its value as of the date the Special Use Permit is granted and reverting to the prior zoning results in the same value of the property as if the Special Use Permit had never been granted. The drainage channel included within the SUP area shall be maintained in perpetuity by the property owners of all parcels within the C-2 CUPD zoning district. j. (C-44-22-116-X-00) Chairman Gates asked Thomas Ellsworth, Planning and Zoning Director, and Darren Gerard, Planning Division Manager, to come forward. Mr. Ellsworth stated the purpose of the text amendment was to bring the Maricopa County Zoning Ordinance up-to-date with the Federal Housing Act. Mr. Ellsworth stated this amendment was a more comprehensive look at the Group Home regulations. He then reviewed some of the changes made in the text and reviewed the bullet points from the slide. Supervisor Gallardo asked where group homes for youth fell in the ordinance. Mr. Ellsworth answered they would be considered Community Residences. Supervisor Galvin thanked staff for the hard work that went into this endeavor. He explained the purpose of the amendment and asked several questions on how this text amendment would improve opening or running one of these group homes. Formal Meeting Minutes 02/09/2022 Page 6 of 43 Mr. Ellsworth said this provides clarity, removes ambiguity, and provides more guidance for enforcement officers. Supervisor Galvin noted the public concerns about how changes are made, and a short discussion was held concerning recovery homes and SUP requirements for these type homes. Supervisor Clint Hickman made a motion to approve Text Amendment TA2020001, in accordance with the refined language post-Commission recommendation as shown in the memorandum dated February 9, 2022, handed out at today's hearing and posted online. BUNGALOWS AT 19TH AVE. & PARSONS ROAD Case #: Z2021051 Supervisor District: 3 Applicant & Owner: Kurt Waldier, Beus Gilbert McGroder PLLC / Bungalows at Norterra LLC Request: Zone change from Rural-43 to R-2 Site Location: Generally located on the SEC of 19th Ave. and Parsons Rd. in the Phoenix area Commission Recommendation: On 1/13/22, the Commission voted 6-0, to recommend approval of Z2021051 subject to conditions ‘a’ – ‘h’: a. Development of the site shall be in conformance with the Zoning Exhibit entitled “Bungalows at Norterra”, consisting of 1 full-size sheet, stamped received October 12, 2021, except as modified by the following conditions. Development of the site shall be in substantial conformance with the Narrative Report entitled “Bungalows at Norterra”, consisting of 5 pages, dated October 8, 2021, and stamped received October 12, 2021, except as modified by the following conditions. c. The following Planning Engineering conditions shall apply: 1. Without the submittal of a precise plan of development, no development approval is inferred by this review, including, but not limited to drainage design, access and roadway alignments. These items will be addressed as development plans progress and are submitted to the County for further review and/or entitlement. 2. The applicant will be responsible for coordinating with the City of Phoenix to review any traffic impact, right-of-way dedication, permitting or roadway improvement requirements for 19th Avenue in conjunction with this and future entitlement(s). 3. Design for site development must ensure that historic drainage patterns are maintained at the up and downstream limits of development. 4. A traffic impact study must be submitted with any future entitlement application (i.e. plan of development). 5. Design for site development must provide for at least two (2) paved points of access to existing and improved public roads. 6. In lieu of pre-annexation service agreement, the developer must provide a ‘will serve’ letter from the certificated water and sewer providers. e. Administrative approval of a Plan of Development will be required prior to approval and issuance of construction permits to develop and establish use of the site. Prior to issuance of a building permit, written confirmation will be required from the emergency fire protection jurisdiction having authority that the facility has been designed in accordance with their regulations and requirements, and that emergency fire protection service will be provided to the facility. Prior to issuance of the certificate of occupancy, local fire protection jurisdiction review and approval will be required. f. Noncompliance with any Maricopa County Regulation shall be grounds for initiating a revocation of this Zone Change as set forth in the Maricopa County Zoning Ordinance. g. The property owner/s and their successors waive claim for diminution in value if the County takes action to rescind approval due to noncompliance with conditions. h. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. (C-44-22-128-X-00) Mr. Ellsworth introduced this item as Bungalows at 19th Avenue and Parsons. The applicant would like to have this area re-zoned from R43 to R2 which would allow the applicant to develop a multi-family development in the area. The City of Phoenix is in the process of annexing this area, but they had no concerns with approving this item. Mr. Ellsworth stated there was significant opposition to this development noting concerns such as traffic and noise, and the general character of the area. Formal Meeting Minutes 02/09/2022 Page 9 of 43 Chairman Gates asked if there were any speakers registered for this item. The Clerk responded there were speakers. Speakers included the applicant, who would be making a presentation. There were seven speakers in opposition, but only two registered to speak. Paul Gilbert applicant reviewed the slides in his presentation noting the location of the property, the density of surrounding homes being the same, and the consistency with the City of Phoenix Comprehensive Plan. He clarified the bungalows would be single- family homes to be rented. He reviewed benefits and neighborhood concerns surrounding the project. Melissa Crawford, resident, stated she owns one of the houses directly across from the project. She filed an appeal against allowing the project to proceed and was able to obtain 100 signatures opposing this development. She is asking the development be changed to single family dwellings for purchase and not be rentals. Rusty Hill, resident, stated the bungalows come within 40 feet of his house. He expressed his concerns about traffic, headlights, etc. Everyone lives on three to four acres of land so they can have livestock. He expressed other concerns and asked his concerns be considered. The Clerk read the following names who were in opposition but did not wish to speak: Laurel Brodie Linda Slay James Whatley Laura Bates Alison McKee Chairman Gates asked Mr. Ellsworth if he had any comments to make concerning this project. Mr. Ellsworth said he contacted the City of Phoenix because they would be providing city services to this project. He reiterated an annexation was underway and it would be approved through City of Phoenix. The comprehensive plans of both Maricopa County and the City of Phoenix were considered. Mr. Gilbert noted they were preserving the dirt road, Parsons Road, and residents would still be able to ride horses there. Only 500 feet of Parsons Road would be used for the development. Mr. Gilbert then noted that there would be another access to the development other than Parsons Road, and it would meet the City of Phoenix requirements. Mr. Gilbert addressed the comments about gridlock and noted that is a problem that is occurring now, and this development would be helping relieve this problem. Chairman Gates thanked Ms. Crawford and Mr. Hill for their comments. He noted that Councilwoman O’Brien is in favor of the development. He reminded everyone there is a significant need in Maricopa County for affordable housing. Supervisor Clint Hickman made a motion to approve item #7, Z2021051, in accordance with the Commission recommendation as printed on the agenda. The motion was seconded by Supervisor Thomas Galvin. ROAD FILE DECLARATIONS - DECLARACIONES DE CARRETERA Approve, by resolution, petitions to open and declare the following roads into the county highway system. This action will serve as notice of the Board of Supervisors’ acceptance of all U.S. Patent easements, reservations, rights-of-way or properties along the alignments into the Maricopa County highway system and will also authorize the maintenance and acquisition of the necessary rights-of-way through donation, purchase, or condemnation. a. ROAD FILE NO. 5983 Convene a hearing for Road File No. 5983 to Open and Declare the following described alignments into the County Transportation System. The Maricopa County Department of Transportation has inspected and approved/accepted the developer constructed roads within the Crossriver Point recorded in MCR 1321-19 and has recommended that the Board of Supervisors adopt the resolution accepting the roads in the subdivision into the County road system. Brian Grayek, resident, stated on any given day except for a few days following a rainstorm, the road is excessively dusty. When they moved to Arizona and found their property, they were unconcerned it was on a dirt road. However, this road has a hanging dust bowl over it every day. In the past they have maintained the road themselves, but with an increase in traffic, they are no longer being effective with road maintenance. Adrienne Bien-Willner, resident, stated in the past she and her husband have been supportive of improvements made by Maricopa County. She noted her husband has been trying to cooperate with the County and the City of Chandler regarding the expansion of Chandler Heights Road. They do not oppose the widening of the street, but they have been hurt by the process and they are concerned about the future value of their property among other issues. Leslie Thompson, resident, stated their opposition is strictly related to the cost of $650,000 over a period of 15 years. There has been nothing to indicate what the impact this cost will have on her. They asked for this estimation up front. This is a Continuity of Operations Planning (COOP) software package for all jurisdictions within Maricopa County. The grant period for this grant is October 1, 2022 through September 30, 2023. The Department will not be recovering indirect costs off of this grant. The amount of unrecoverable indirect cost is $8075. Emergency Management will absorb these indirect costs within their general budget. The department does not have an in-kind match requirement for this grant. The grant award is not a mandated function but it is a department strategic goal to have all county departments with a viable Continuity of Operations Plan (COOP). Maricopa County jurisdictions compete for projects based off the State grant initiatives. Maricopa County has spear headed the grant for the Emergency Operations Plans (EOP)/COOP software project for all county departments and jurisdictions within Maricopa County. Each year Maricopa County applies for the recurring cost of the software maintenance and training funds. Maricopa County does not have to fund any additional costs for the program. The grant is intended to renew the MaricopaRegionPrepares.com subscription. This software tool benefits Maricopa County in developing Emergency Operations Planning (EOP), Continuity of Operations Planning (COOP), Continuity of Government (COG) Planning for local government. The Department was awarded a grant for the software in 2015, we are applying for a grant to cover the cost associated with the maintenance of the system. He said he met with the residents in two lengthy meetings. He said he hopes to have a resolution in three or so months. He said he emphasized his goal is to have a good source of water at a reasonable cost and a long-term, viable, and sustainable solution. He thanked Jen Pokorski and Andy Linton for their help. Supervisor Sellers noted he and Supervisor Galvin attended the East Valley Partnership board meeting where Supervisor Galvin was able to make some introductory remarks. Supervisor Sellers stated he chaired an East Valley Partnership Critical Infrastructure and Transportation Committee meeting, and this committee has expanded to include water and broadband as part of the infrastructure. He also noted he attended an Asian festival in Mesa. The turnout for the event was phenomenal. Supervisor Gallardo noted how great the weather is for more outdoor events. There was a parade in Laveen, and the Laveen Barbeque is coming soon. He said he is looking forward to Superbowl weekend and he will be rooting for the underdog, the Cincinnati Bengals. Chairman Gates reported the Superbowl will be in Maricopa County next year. He spoke via Zoom for the graduation class of the Valley Leadership Catalyze Group last night and he was able to talk a lot about leadership. He said the future is bright in Maricopa County.
