ROLL CALL - LISTA
The Board of Supervisors of Maricopa County, Phoenix, Arizona, convened in Formal Session at
9:30 AM on Wednesday, March 9, 2022, in the Supervisors' Auditorium 205 W. Jefferson Phoenix,
AZ 85003, with the following members present: Bill Gates, Chairman, District 3; Clint Hickman,
Vice Chairman, District 4(remote);Jack Sellers, Supervisor, District 1; Thomas Galvin, Supervisor,
District 2; Steve Gallardo, Supervisor, District 5. Also present: Juanita Garza, Clerk; Kelly

INVOCATION - INVOCACIÓN
Chairman Gates asked Supervisor Galvin to introduce his guest. Supervisor Galvin
introduced Linda Milhaven, Councilwoman with the City of Scottsdale who offered the
invocation.
3.
PLEDGE OF ALLEGIANCE - JURO FIDELIDAD A LA BANDERA
Councilwoman Milhaven led the Pledge of Allegiance to the flag.
Supervisor Galvin spoke about Councilwoman Milhaven’s contributions and
accomplishments in the community.
Chairman Gates talked about the ability for the public of Maricopa County to attend
Board meetings. During the pandemic, the Board adopted a virtual method of attending
to ensure that the community could participate via webinar. He said with the current
CDC recommendations, the Board meetings would now be available virtually and in
person. Chairman Gates noted the plexiglass dividers on the dais had come down and
welcomed the public back to the auditorium for future meetings.

PET SHOWCASE BY MARICOPA COUNTY ANIMAL CARE AND CONTROL -

Chairman Gates introduced Bermuda, a six-year-old mixed breed dog. She has basic
obedience skills, she is vaccinated, spayed and ready to go home today. Bermuda and
all dogs six years and older and those having been at the shelter for more than 30 days
can be adopted free of charge until March 5, 2022. For more information, please visit.

Chairman Gates asked the Clerk if there were any announcements or corrections to
the agenda. The Clerk stated items #7 and #8, White Tank Foothills Phase 3 will be
continued to the June 8th, 2022, meeting.

Request: Zone Change from Rural-43 to IND-2 IUPD with a Plan of Development for a
corporate office with outdoor storage of construction equipment and vehicles
Site Location: Generally located ½ mile southwest of the southwest corner of 7th Ave. and
Happy Valley Rd. in the Phoenix area
Commission Recommendation: On 2/10/22, the Commission voted 7-0, to recommend
approval Z2021037 subject to the following conditions ‘a’ – ‘h’:
a. A Plan of Development is approved subject to site plan entitled “Marrs Corporate Offices”
consisting of three full-sized sheets, dated December 20, 2021, and stamped received
December 21, 2021. The Plan of Development may be amended administratively under
separate application as long as the amendment complies with the established IND-2 IUPD
development standards approved by the Board of Supervisors. Staff may determine slight
refinements to remain in substantial conformance with the approved site plan. Minor and
major amendments to the approved site plan will be determined in accordance with Chapter
3 of the Maricopa County Zoning Ordinance.
b. Development of the site shall be in substantial conformance with the Narrative Report
entitled “Marrs Construction – Corporate Offices”, consisting of six pages, dated October 11,
2021, and stamped received October 12, 2021, except as modified by the following
conditions.
c. The IUPD zoning on this site shall restrict uses to office and construction storage.
d. The following Planning Engineering conditions shall apply:
1. The off-site flows across 11th Avenue into the site must be maintained.
2. At the time of application for building permits, retention basin side slopes can be designed
with 3:1 side slopes, except that a minimum 12-foot wide section must be designed with 4:1
side slopes to provide a “safety ramp”. This “ramp” must connect to the GSA with binder or
other accessible area of the site.
3. No improvements shall be permitted within the unabandoned portions of the Federal
Patent Easements surrounding the site.
4. Drainage review of planning/ zoning cases is for conceptual design only and does not
represent final design approval nor shall it entitle applicants to future designs that are not in
conformance with Section 1205 of the Maricopa County Zoning Ordinance and Drainage
Polices and Standards.
5. All development and engineering design shall be in conformance with Section 1205 0f
the Maricopa County Zoning Ordinance and current engineering policies, standards and best
practices at the time of application for construction.

6. The entire site and adjacent half-street’s runoff shall be retained onsite. If portions of
adjacent right-of-way are controlled by other jurisdictions, the adjacent half-street’s runoff
shall be retained, unless separately addressed by the other jurisdictions.
7. Sufficient retention volume shall be provided on-site to retain the required 100-year, two-
hour runoff from all contributing areas. Retention basins with stormwater depths exceeding
one-foot shall provide one-foot of freeboard.
8. All retention basins shall drain within 36 hours per County requirements.
e. The following IND-2 IUPD standards shall apply:
1. The use of six-foot-high fences with screening materials shall be used for screening.
2. The use of compacted asphalt millings with a petroleum binder shall be used to minimize
dust pollution emanating from driveways, parking areas, and storage areas.
3. Outdoor storage shall be allowed in both the required front and street side yards of the
property.
4. There shall be no landscaping in both the required front and street side yards of the
property.
f. Prior to issuance of a building permit, written confirmation will be required from the
emergency fire protection jurisdiction having authority that the facility has been designed in
accordance with their regulations and requirements, and that emergency fire protection
services will be provided to the facility. Prior to issuance of the certificate of occupation, local
fire protection review and approval will be required.
g. The property owner/s and their successors waive claim for diminution in value if the County
takes action to rescind approval due to noncompliance with conditions.
h. The granting of this change in use of the property has been at the request of the applicant,
with the consent of the landowner. The granting of this approval allows the property to enjoy
uses in excess of those permitted by the zoning existing on the date of application, subject
to conditions. In the event of the failure to comply with any condition, the property shall revert
to the zoning that existed on the date of application. It is, therefore, stipulated and agreed
that either revocation due to the failure to comply with any conditions, does not reduce any
rights that existed on the date of application to use, divide, sell or possess the property and
that there would be no diminution in value of the property from the value it held on the date
of application due to such revocation of the Zone Change. The Zone Change enhances the
value of the property above its value as of the date the Zone Change is granted and reverting
to the prior zoning results in the same value of the property as if the Zone Change had never

Commission Recommendation: On 2/10/22, the Commission voted 7-0, to recommend
approval of Z2021149 subject to conditions ‘a’ – ‘j’:
a. Development of the site shall be in substantial conformance with the Zoning Exhibit
entitled “Marbella Ranch East”, consisting of 1 full-size sheet, dated December 24, 2021 and
stamped received December 28, 2021, except as modified by the following conditions.
b. Development of the site shall be in substantial conformance with the Narrative Report
entitled “Project Narrative for Rezone of Marbella Ranch East”, consisting of 6 pages, dated
December 24, 2021 and stamped received December 28, 2021, except as modified by the
following conditions.
c. The R-5 RUPD zoning district shall have a maximum of 400 residential units and shall be
subject to the following R-5 RUP¬¬¬D zoning district standards:
1. Minimum front yard: 15 ft.
2. Minimum rear yard: 15 ft.
3. Minimum lot area: 3,000 sq. ft.
4. Minimum lot width: 40 ft.

d. The following Planning Engineering conditions shall apply:
1. Without the submittal of a precise plan of development, no development approval is
implied by this review, including, but not limited to number of proposed building lots/units,
drainage design, access and roadway alignments. These items will be addressed as
development plans progress and are submitted to the County for further review and/or
entitlement.
2. A traffic impact study (TIS) must be submitted with future entitlement (preliminary plat or
POD) application(s).
3. The eastern border of the site is within the Agua Fria River Floodway and Floodplain. No
fill will be allowed within the Floodway. Future entitlement (preliminary plat or POD)
application(s) must address floodplain/floodway and erosion protection.
4. Engineering review of re-zone cases is conceptual in nature. All development and
engineering design shall be in conformance with Section 1205 of the Maricopa County
Zoning Ordinance; Drainage Policies and Standards; Floodplain Regulations for Maricopa
County; MCDOT Roadway Design Manual; and current engineering policies, standards and
best practices at the time of application for construction.

e. All buildings subject to noise attenuation as per ARS § 28-8482(B).
f. The master developer shall notify future homeowners that they are located within the state-
defined “territory in the vicinity of a military airport” with the following language:
“You are buying a home or property in the ‘vicinity of a military airport’ as described by State
of Arizona statute ARS §28-8481. Your house should include sound attenuation measures
as directed by State law. You will be subject to direct over flights and noise by Luke Air Force
Base jet aircraft in the vicinity.
Luke Air Force Base executes over 200,000 flight operations per year, at an average of
approximately 170 overflights per day. Although Luke's primary flight paths are located within
20 miles from the base, jet noise will be apparent throughout the area as aircraft transient to
and from the Barry M. Goldwater Gunnery Range and other flight training areas.
Luke Air Force Base may launch and recover aircraft in either direction off its runways
oriented to the southwest and northeast. Noise will be more noticeable during overcast sky
conditions due to noise reflections off the clouds.
Luke Air Force Base's normal flying hours extend from 7:00 a.m. until approximately
midnight, Monday through Friday, but some limited flying will occur outside these hours and
during most weekends.
Such notification shall be recorded on all Final Plats, be permanently posted on not less than
a 3 foot by 5 foot sign in front of all home sales offices, be permanently posted on the front
door of all home sales offices on not less than an 8½ inch by 11 inch sign, and be included
in all covenants, conditions, and restrictions (CC&Rs) as well as the Public Report and
conveyance documents.
g. Noncompliance with any Maricopa County Regulation shall be grounds for initiating a
revocation of this Zone Change as set forth in the Maricopa County Zoning Ordinance.
h. The property owner/s and their successors waive claim for diminution in value if the County
takes action to rescind approval due to noncompliance with conditions.
i. The granting of this change in use of the property has been at the request of the applicant,

recommendation by the Planning and Zoning Commission (Commission), for consideration

Request: Major Amendment of White Tank Foothills Development Master Plan (DMP) to
change the land use designations from Small Lot Residential (2 – 5 du/ac) and Rural (0-1
du/ac) to Small Lot Residential (5 – 8 du/ac) and Transitional Lot (3 -5 du/ac)
Site Location: Generally located at the NWC of Citrus Rd. and Northern Ave. in the Glendale
area
Commission Recommendation: On 11/4/21, the Commission voted 5-1, to recommend
approval of DMP2021001 subject to conditions ‘a’ – ‘v’.
Additional Comments: The applicant is requesting to amend the DMP and rezone for an
increased lot yield in Phase 3. The previously approved DMP allowed for a maximum of 387
units in Phase 3, or 1.58 du/ac. The amendment, as now modified, will increase the lot yield
to 654 units at 2.63 du/ac. The subject site is the third and final phase of the White Tank
Foothills Development Master Plan (DMP) residential community. The applicant had the
cases continued from the December 8, 2021, January 26, 2022 and February 23, 2022 BOS
hearings. The Board instructed the applicant to work with the neighbors on a modified project
with a lower density. In review of the modified Phase 3 amendment, staff offers the following
modifications to the Commission recommended DMP2021001 conditions ‘a’ – ‘v’ with
revisions to conditions ‘a’, ‘f’ and ‘i’:
a. Development shall comply with the Development Master Plan Narrative Report entitled
“White Tank Foothills”, dated February 25, 2022, and stamped received February 28, 2022,
including all exhibits, maps, and appendices, except as modified by the following conditions.
b. Changes with regard to use and intensity, or changes to any of the approved conditions
shall be processed as a revised application with approval by the Board of Supervisors upon
recommendation by the Maricopa County Planning and Zoning Commission. Revised
applications shall be in accordance with the applicable Development Master Plan Guidelines,
subdivision regulations, and zoning ordinance in effect at the time of application(s)
submission. The Maricopa County Planning and Development Department may approve
minor changes as outlined in the Maricopa County Development Master Plan Guidelines in
effect at the time of amendment. Non-compliance with the narrative report, maps, and
exhibits, or the conditions of approval will be treated as a violation in accordance with
Maricopa County Procedures.
c. The master developer shall be responsible for the construction of all public and private on-
site roads within the Development Master Plan. Further, the applicable homeowner’s
association shall be responsible for the maintenance and upkeep of all private roads, public
open spaces and facilities, washes, parks, roadway median landscaping, landscaping within
public rights-of-way, and all pedestrian, bicycle, and multi-use paths.

d. Landscaping of all common areas and open spaces, except for identified recreational
areas shall consist of indigenous and or low water use species.
e. The Development Master Plan shall be developed sequentially as depicted on the phasing
diagram contained in the narrative report.
f. The total number of residential dwelling units of White Tank Foothills Phase 3 shall not
exceed 654 dwelling units. Overall, the total number of residential dwelling units for the
entire White Tank Foothills master community shall not exceed 1,621 dwelling units. To help
ensure compliance, the cumulative number of dwelling units completed to date, in relation to
the identified limit, shall be identified on all plats.
g. The master developer shall notify all future residents that they are not located within an
incorporated city or town, and therefore will not be represented by, or be able to petition a
citizen-elected municipal government. Notification shall also state that residents will not have
access to municipally managed services such as police, fire, parks, water, wastewater,
libraries, and refuse collection. Such notice shall be included on all final plats, be
permanently posted on the front door of all home sales offices on not less than an 8-½ by
11-inch sign, and be included in all homeowner association covenants, conditions, and
restrictions (CC&Rs).
h. All park facilities shown on plats shall be completed concurrently with residential
development. Park facilities and amenities shall be identified on all applicable plats.
i. Not less than 50.36 acres shall be reserved for active and passive open space. Further,
the project shall have not less than five pocket parks and one off-site park as depicted on
the parks plan exhibit in the narrative. Further, not less than six pocket parks and off-site
park shall be provided. At the time of each preliminary plat submission, the master developer
shall include a description of the status of the cumulative open space acreage and park
numbers with respect to the requirements of this condition. A description of the types of
recreational amenities that will be included in the pocket parks and off-site park shall be
submitted with all preliminary plats.
j. Unless otherwise agreed to in writing by the applicable school districts, not less than 15-
acre school site and a minimum of 15 acres shall be reserved. Said school shall not front on
to arterial streets.
k. Development phasing shall assure two access points are provided.
l. Bike lanes shall be required on all arterial and collector streets as specified in the Maricopa
County Bicycle Transportation System Plan.
m. Prior to approval of the final plat, a total half-width 65-foot right-of-way shall be dedicated
for Citrus Rd. and Northern Ave.
n. Prior to approval of the final plat, a total half-width 55-foot right-of-way shall be dedicated
for Perryville Rd. with a ten-foot roadway and utility easement shall be provided adjacent to
the right-of-way.
o. Prior to approval of each applicable final plat of any subdivision within a phase containing
Olive Ave., the developer will be obligated to construct (or post the necessary financial
assurances) the ultimate half-width roadway for the extent of Olive Ave. in that phase.

p. Prior to approval of each applicable final plat of any subdivision within a phase containing
Citrus Rd., the developer will be obligated to construct (or post the necessary financial
assurances) the ultimate half-way width roadway for the extent of Citrus Rd., in that phase.
q. Prior to approval of each applicable final plat of any subdivision within a phase containing
Perryville Rd., the developer will be obligated to post a five-year performance bond (in the
amount of the total estimated construction costs) for a half-width roadway for the extent of
Perryville Rd. in that phase.
r. Prior to approval of each applicable final plat of any subdivision within a phase containing
Northern Ave., the developer will be obligated to construct or post a five-year performance
bond (in the amount of the total estimated construction costs) for a half width roadway for
the extent of Northern Ave. in that phase. Prior to expiration of the bond, Maricopa County
will determine the necessity for the roadway and developer’s share of the responsibility.
s. The applicant shall provide offsite improvements and related right-of-way as
recommended in any approved White Tank Foothills Impact Study.
t. Access points and median openings on all arterial streets shall be consistent with any
approved White Tank Foothills Impact Study.
u. Prior to initial Final Plat approval or initial precise plan of development approval, the
applicant shall submit to the Maricopa County Planning and Development Department
confirmation of service by City of Surprise and verification of approval of a 208 Amendment
approved by the Maricopa Association of Governments Regional Council.
v. Any alteration of existing natural washes shall be done in compliance with the rules and
guidelines set forth by the United States Army Corps of Engineers.) (C-44-22-099-X-00)
Chairman Gates asked Tom Ellsworth, Planning and Development Director and Matt
Holm, Planning and Development Supervisor to come forward.
Supervisor Hickman said many people have been working hard on White Tank Foothills
Phase 3. He stated items #7 and #8 would be continued to give all parties an opportunity
to work out the issues. Supervisor Hickman also stated if the items were to be voted on
today, he would have been present and the people of District 4 could be heard by the
Board in person.

measures as directed by State law. You will be subject to direct over flights and noise by
Luke Air Force Base jet aircraft in the vicinity.
Luke Air Force Base executes over 200,000 flight operations per year, at an average
of approximately 170 overflights per day. Although Luke's primary flight paths are located
within 20 miles from the base, jet noise will be apparent throughout the area as aircraft
transient to and from the Barry M. Goldwater Gunnery Range and other flight training areas.
Luke Air Force Base may launch and recover aircraft in either direction off its runways
oriented to the southwest and northeast. Noise will be more noticeable during overcast sky
conditions due to noise reflections off the clouds.

Luke Air Force Base's normal flying hours extend from 7:00 a.m. until approximately
midnight, Monday through Friday, but some limited flying will occur outside these hours and
during most weekends.”

m. Noncompliance with any Maricopa County Regulation shall be grounds for initiating a

above its value as of the date the Zone Change is granted and reverting to the prior zoning
results in the same value of the property as if the Zone Change had never been granted.

ARIZONA DEPARTMENT OF EDUCATION FOR THE FY2023 INDIVIDUALS WITH
DISABILITIES EDUCATION ACT (IDEA) BASIC ENTITLEMENT REVISED
Approve acceptance of up to $40,000.00 in continued and recurring grant funding from the
Arizona Department of Education, for the FY2023 Individuals with Disabilities Education Act
(IDEA) Basic Entitlement. The term of this funding is from July 1, 2022 through June 30,
2023.
The Sheriff’s indirect cost rate is 14.74%. Total indirect costs associated with this award are
estimated to be $5,896. Indirect cost recovery was not approved for this award this year.
These costs will be absorbed by the Inmate Services fund. A cash or non-cash match is non-
applicable.
The award is non-competitive and is based on number of eligible students from enrollment
counts taken in October of each year. This award supports a mandated function. The priority
use for these funds is to ensure Maricopa County Jail Education Programs follow state and
federal special education requirements. These funds will be used to contract with special
education consultants to work with staff in implementing the IDEA Laws and Regulations, to

improvement efforts. The Sheriff’s Office has been awarded this funding for the last nineteen

Approve financial Amendment No. 1 to the Intergovernmental Agreement between the City
of Mesa (“Subrecipient”) and Maricopa County, administered by its Human Services
Department. The purpose of the Agreement is for the Subrecipient to provide Emergency
Rental Assistance to residents in the City of Mesa and its unincorporated areas, impacted
by the COVID-19 pandemic.
The purpose of the Amendment is to address the following:
A. Revise the term of the Agreement to August 1, 2021 through February 28, 2022.
B. Increase the Agreement funding amount by $23,000, from $5,500,000 to $5,523,000.

PARTNERSHIPS PROGRAM ACTIVITIES
Approve Amendment No. 1 to the Intergovernmental Agreement (Agreement) between the
City of Surprise (City), a member of the Maricopa HOME Consortium, and Maricopa County
administered by its Human Services Department. The purpose of the Agreement is for the
City to provide Tenant Based Rental Assistance (TBRA) to eligible individuals that reside in
the City of Surprise. TBRA funds may also be utilized to assist residents with security deposit
for housing. The County and the City collectively are referred to as the “Parties.”
The purpose of the Amendment is to address the following:
A. Extend the termination of the Agreement from September 30, 2024 through September
30, 2025.

WEATHERIZATION ASSISTANCE PROGRAM
Approve Amendment No. 1 to the revenue Agreement between Arizona Department of
Housing (ADOH) and Maricopa County administered by its Human Services Department.
The purpose of the Agreement is for ADOH to provide funding to the County to administer
the Weatherization Assistance Program.
The purpose of Amendment No. 1 is to address the following:
A. ADOH Scope of Work has changed to reflect an increase to the LIHEAP average per unit
investment limits and revised the unit completion goals. The LIHEAP Weatherization average
per unit investment over Program Year 2021 (July 1, 2021 through September 30, 2021) is
$10,000 and increases to $20,000 (October 1, 2021 to June 30, 2022). The funding sources
are identified in the Original Agreement. LIHEAP - CARES Act funds in the amount of
$1,175,012 and ADOH funds in the amount of $624,152. The funding amounts are
unchanged. The funds will be utilized to provide Weatherization Assistance Program
measures in dwellings occupied by low-income households in Maricopa County outside of
the City of Phoenix and the City of Mesa. The revised number of units the County will be
required to complete is revised to seventy-four (74) units. Contract expiration remains the
same.

REPLACEMENT AND DEPOSIT PROGRAM
Approve Amendment No. 1 to the revenue Agreement between Wildfire and Maricopa
County, administered by its Human Services Department. The purpose of this Agreement is
for Wildfire to provide the County with funding for the administration of Utility Repair
Replacement and Deposit (URRD) program to low-income residents of Maricopa County.
The Amendment funding amount is increased by $50,000 ($45,455-Direct Service + $4,545
Program Delivery.) The URRD funding amount shall now be increased to $342,690
($311,537 Direct Service + $31,153 Program Delivery.) The term of the Agreement began

APPROVAL TO SUBMIT APPLICATION FOR GRANT FUNDING TO ARIZONA
LOTTERY FUNDS FOR TRANSPORTATION SERVICES
Request approval to submit a grant application on behalf of Maricopa County to the Arizona
Lottery Funds (ALF) for FY2022 transportation services for individuals with Americans with
Disabilities Act (ADA) certifications. Transportation services shall be provided by Valley
Metro and administered by Public Transportation Authority (RPTA). Grant application
requested amount is $804,040, all funds shall be utilized for the provision of transportation
services and do not contain Administrative or Indirect funds.
Also request authorization for the Chairman to sign all documents related to the grant funding
and authorize the Chief Financial Officer to sign financial documents related to this grant.
The Human Services Department shall submit the grant application on behalf of the County.
If the grant application is approved and Maricopa County is awarded the ALF grant, funds
shall be held in trust by RPTA who shall administer the grant funds on behalf of the County

Dental Plan of Arizona (DDPA) and Maricopa County through its Department of Public Health

This amendment shall extend the Expiration Date to February 28, 2023. In addition, the
Annual Maximum Benefits has been updated. From October 1, 2020, thru February 28, 2022,
the maximum rate increased from $1,500 to $5,000 per person per benefit year. From March

The purpose of this Amendment is to continue providing Oral Health Services (Provision of
Dental Insurance Premiums) according to the most current CDC guidance and

funds received through the Ryan White HIV/AIDS Treatment Extension Act of 2009. The

Services and Maricopa County by and through its Department of Public Health (MCDPH) to
provide continued funding for WIC Services, Breast Feeding Peer Counseling Services
Program (BFPC), WIC Special Projects, and LA Project.
The Amendment adds LA Project to the WIC Services with funding of $62,524. In addition,
the Amendment decreases the WIC Special Project funds by $91,976 for a total reduction of
$29,452 for the combined total revised Price Sheet in the not-to-exceed amount of

Maricopa County Department of Public Health’s Indirect Rate for FY22 is 17.97%. Indirect

The WIC Services award is reoccurring and has been awarded to the department for many
years. This grant does not require match, indirect costs are fully recoverable and ongoing
cash contributions are not required. The grant award is not a mandated function but provides
a benefit to the citizens by providing vouchers for approved foods (milk, cheese, cereals,
peanut butter, eggs, infant formula, and juice etc.) for low-income pregnant, post-partum,
breast-feeding women, infants, and children up to five (5) years of age. Clients also receive
nutrition and breast-feeding education and referrals to applicable social services. The grant
award is competitive, and there are no costs that will need to be absorbed by the

Approve Amendment 1 of the fixed-price Intergovernmental Agreement (IGA) No. ADHS18-
175153 between Arizona Department of Health Services (ADHS) and Maricopa County
through its Department of Public Health (MCDPH), Office of Oral Health (OOH) to provide
services for the Dental Sealant (DS) Program. The expanded scope now includes the use of
Silver Diamine Fluoride (SDF) The price sheet has been revised to include SDF ($50 per
child) and Program Outreach ($18 per hour) with a total not-to-exceed amount of $20,000.
The budget period begins January 1, 2022 and goes through September 30, 2022. The
addition of Exhibit A - 2 CFR 200.332 ensures the subaward is clearly identified to the
subrecipient. The duration for this IGA remains unchanged from the original January 1, 2018
through December 31, 2022 term.
The Oral Health Dental Sealant Services grant award is reoccurring and has been awarded
to MCDPH in previous years. This grant does not require an in-kind match, indirect cost is
fully recoverable, and ongoing contributions are not required. The grant award is competitive.
The grant award is not a mandated function but provides a benefit to the citizens by providing
the dental sealant services necessary to promote oral health and provide authorized
preventive dental services to at-risk children in Maricopa County.
MCDPH’s indirect rate for FY22 is 17.97%. Indirect costs are estimated at $3,047 all of which
is recoverable. Departmental indirect rates are reestablished at the beginning of each fiscal
year and future indirect costs will be collected at the corresponding rate. All program costs
are allocated to the grant so there will be no additional burden on the department’s operating
budget.
Grant revenues are not local revenues for the purpose of the constitutional expenditure
limitation, and therefore expenditure of the revenues is not prohibited by the budget law.
This IGA does not alter the budget constraining expenditures of local revenues duly adopted

This was a new grant award and is not expected to reoccur. The grant does not require an
in-kind match and ongoing cash contributions are not required. This grant award was not

amount to $2,000,000 annually for a cumulative not-to-exceed (NTE) amount of $6,000,000
over the next three (3) years, bringing the total cumulative NTE to $15,000,000 over the life
of the IGA.
Section I, General Provision, 5.0 Payment of Method has also been amended to include
language regarding monitoring all subrecipients’ income and to meet grantor requirements.
In addition, Section III, Scope of Work, 1.0 Service Category(s) has been amended to provide
clear instructions to program services.
The purpose of this IGA is to provide medically necessary health care and support services

RESERVE CORP VOLUNTEER OPERATIONAL READINESS
Approve the Letter of Award of grant funds and Contract from the National Association of
County & City Health Officials (NACCHO) in the not-to-exceed amount of $10,000 for the
2022 Medical Reserve Corps (MRC) Volunteer Operation Readiness program. Authorize
the Board Chairman to sign all documents related to the award as applicable. The project
and budget period for this award is January 1, 2022 through September 29, 2022.
This is the third award period for this project and if a new round occurs, the Program will
most likely apply. It was a competitive grant opportunity. There are no cash or in-kind match
requirements and on-going contributions will not be required. This is not a mandated service
but provides a benefit to our citizens by improving upon the operational readiness of our
MRC volunteers in order to better meet emergency management and response needs;
currently COVID-19 and the increase in needed volunteers.
The grant allows for the full indirect rate of 17.97%. Indirect cost is estimated to be $1,524,
all of which is recoverable. All program costs are allocated to the grant so there should be
no additional burden on the department’s operating budget.

VISITATION PROGRAM
Approve and accept an award for Grant Application (RFGA2022-003-007) by the Arizona
Department of Health Services (ADHS) to Maricopa County by and through its Department
of Public Health (MCDPH) for the Nurse Family Partnership (NFP) grant to provide additional
funding for the Maternal, Infant, and Early Childhood Home Visiting (MIECHV) Home Visiting
Services program. This new Notice of Award (NOA) is a continuation of a previously
approved IGA Contract under ADHS17-155910. The NOA is for a period of performance
beginning January 14, 2022, through January 13, 2027. The anticipated funding is expected
to be $1,298,969.10 per year through January 13, 2027.
Due to variances in the federal fiscal year and the NOA’s period of performance dates, the
initial purchase order issued of $649,484.55 will be added to the previous IGA budgeted
amount bringing it to $1,465,245.55 during the budget period of October 1, 2021, through
September 30, 2022. This brings the total not-to exceed from $2,447,284.50 to
$3,096,769.05 for the previous IGA Contract ADHS17-155910.
The Department of Public Health FY22 indirect rate is 17.97%; therefore, indirect costs are
estimated at $60,908 all of which is recoverable. The Pass Thru amount to sub-recipient

this award is January 1, 2020 through July 31, 2022.
This is a new fellowship grant and its reoccurrence is not known. It was a competitive grant
opportunity and there is no cash or in-kind match required. Should the grant cease, on-going
contributions will not be required. This is not a mandated service but provides a benefit to
our citizens by continuing work to foster knowledge-based community resilience within
Maricopa County.
This Grant deviates from County Policy A2505 and does not allow for any indirect cost
reimbursement. MCDPH indirect rate for FY22 is 17.97%. The full indirect costs are
estimated at $5,391 none of which is recoverable. Program costs not covered by the grant

TUBERCULOSIS CONTROL INCENTIVE PROGRAM
Approve the acceptance and use of Bashas’ grocery vouchers provided by Arizona
Department of Health Services (ADHS) to Maricopa County by and through its Department
of Public Health (MCDPH), Tuberculosis Clinic (TB), Tuberculosis Control-Incentive
Program. The MCDPH TB Clinic has received a donation of 250 grocery vouchers at $10
each for a total value of $2,500.
Gift card and voucher donations have been received by the TB program for several years.
We expect them to continue. Cash and/or in-kind match is not applicable, nor will ongoing
cash contributions be required should they cease to be provided. TB Services are a
mandated function and donations such as these incentivize the treatment program.
Awareness and treatment of TB patients is a benefit to our citizens. To our knowledge, the
donations to the TB program are not given in a competitive manner. Program costs
associated with the donations are absorbed by the TB programs grant budget. Administration
costs are absorbed the department’s operating budget.

REQUEST TO INCREASE THE MAXIMUM THRESHOLD FOR RAPID COVID-19 AT
HOME/OVER THE COUNTER (OTC) TEST KITS AGREEMENT
Authorize an increase to the total not to exceed amount on Maricopa County’s master
agreement (MA) #220206 for Rapid COVID-19 At Home/Over the Counter (OTC) Test Kits.
The current MA was approved by the Board on 1/26/22 for an initial shipment of 100,000 test
kits at an approximate value of $1,000,000. MCDPH requests an increase of $10,000,000 to
the current NTE amount for a new NTE of $11,000,000 to be able to purchase additional test
kits over the life of the contract. This additional funding is from MCDPH’s ADHS ELC2

IGA WITH STATE OF ARIZONA DEPARTMENT OF PUBLIC SAFETY
Approve and execute an Intergovernmental Agreement (IGA) G-30234, with State of
Arizona, Department of Public Safety (AZDPS), for the co-location of the radio
communications equipment.
This agreement allows County and AZDPS to make their respective radio sites available for
the co-location of the radio communications equipment. The term of this agreement is
approximately five (5) years, expiring on June 30, 2027. A Site-Specific Supplemental
Agreement (SSSA) will be established between the parties for each specific site utilized
under this IGA. Unless otherwise specified in SSSAs, the costs associated with the co-
location will be borne by the benefiting party. This agreement may be terminated by either
party with at least sixty (60) days’ prior written notice.

FEDERAL FUNDING FOR VIDEO SHARING RESPONDER TRUCK MOUNTED CCTV
CAMERAS
Authorize the Maricopa County Department of Transportation (MCDOT) to accept federal
funding reimbursements and expend the grant funds for the Department of Transportation:
Transportation System Management Project, sub-project TE077 Video Sharing Responder
Truck Mounted CCTV Cameras Program.
Estimated cost of the project is $49,653.00. Federal Highway Administration (FHWA) has
authorized $39,722 in federal reimbursement funds which are available in FY 2022-23.
MCDOT’s local match portion is $9,931 and will be absorbed by the department operating
budget from Operation funds.
The grant awarded is a one-time award. There are no future or ongoing contributions
required after the grant period ends. The grant fulfills a mandated service that the department
is required to perform. The grant award is a competitively bid and other eligible agencies
may or may not bid on this grant award.
The County’s FY 2020 indirect cost rate is 14.84%. All costs under this agreement are for
capital expenditures which are not subject to indirect cost recovery.
Grant revenues are not local revenues for the purpose of the constitutional expenditure
limitation, and therefore, expenditure of the funds is not prohibited by the budget law. This
budget adjustment does not alter the budget constraining the expenditure of local revenues
duly adopted by the Board pursuant to A.R.S. §42-17105

IGA WITH UNIVERSITY OF ARIZONA TO PERFORM RESEARCH ORIENTED TRAFFIC
AND ITS DEVELOPMENT STUDIES
Approve the Intergovernmental Agreement (IGA) between Maricopa County Department of
Transportation (County or MCDOT) and the University of Arizona (U of A) to perform
research oriented traffic & Intelligent Transportation Systems (ITS) development studies.
The term of this Agreement shall be effective for five (5) years beginning January 1, 2022
through December 31, 2026.
MCDOT will act as lead agency for various research assignments requested of UofA each
fiscal year. MCDOT shall determine the appropriateness of UofA staff selected for such
research and studies. The estimated cost will remain at $75,000 per fiscal year, plus be
extended another five years for various non-federal, project/research studies requested by

UTILITY AGREEMENT WITH SALT RIVER PROJECT (SRP) FOR CONSTRUCTION
AND CONSTRUCTION MANAGEMENT OF A WATERLINE ON THE GILBERT RD.
BRIDGE
Approve the contract between Maricopa County and Salt River Project (SRP) for
Construction and Construction Management of a Waterline on the Gilbert Rd. Bridge Project.
SRP is responsible for the cost associated with the construction of the waterline, as well as
any future operation and maintenance of it, which is currently estimated to be $5,118,617.92.
The County is in the process of planning and constructing a bridge for Gilbert Road going
over the Salt River. SRP owns, operates and maintains multiple wells within the vicinity of
the Bridge Project. SRP has requested County construct, at SRP’s expense, a waterline as
part of the Bridge Project so SRP can connect the wells. SRP will pay half up front at the
time of Notice to Proceed and the balance upon construction completion. (C-64-22-180-X-

Approve the solicitation of bids for the Maricopa County Department of Transportation’s
construction of a new a four-lane bridge along Gilbert Road between Thomas Road and SR
87 (Beeline Highway) in Maricopa County to provide a new four lane structure and
associated roadway improvements over the Salt River, replacing the existing two-lane bridge
and two-lane low flow crossing.
Award the contract to the lowest responsive bidder, provided that the lowest bidder does not
exceed the Engineer’s estimate by more than ten percent.

Supervisor Sellers thanked Supervisor Gallardo and his staff for their assistance in
making the selection. He said this kind of appointment is important and a lot of thought
went into this decision. Supervisor Sellers gave a brief background on the nominee who
has experience with both property owners and renters.
Supervisor Jack Sellers made a motion to appoint Bridget Bellavigna as the Constable
for the Kyrene Justice Precinct. The motion was seconded by Supervisor Steve
Gallardo.
Supervisor Gallardo thanked Supervisor Sellers for taking the time to vet the candidates
and making the selection for this Constable position.

ADJUSTMENT OF JUSTICE PRECINCT BOUNDARIES
Pursuant to A.R.S. § 22-101, approve changes to the justice precincts as shown on the maps
on file with the Clerk of the Board of Supervisors and accompanying legal descriptions,
incorporated herein by reference. This action of the Board of Supervisors shall become
effective on March 17, 2022 for the 2022 elections, and then become effective for purposes
of the justice courts’ jurisdiction on January 1, 2023.
State law requires the County Board of Supervisors to create or redraw the justice court
precinct boundaries in order to reduce the judicial productivity credits for any precinct which
exceeds twelve hundred credits. A.R.S. § 22-125(H). On September 27, 2021 the County
Board of Supervisors voted to approve new justice court precinct boundaries to comply with

this statutory requirement and to achieve better balance of workloads. On January 24, 2022,
the Arizona Independent Redistricting Commission certified new boundaries for Arizona’s
Congressional and Legislative districts. The certified changes to the Legislative and
Congressional district lines require the County to adjust justice court precinct boundaries.
The attached maps and exhibits provide further details. (C-21-22-041-X-00)
Chairman Gates commented on the three redistricting items, #83, #84, and #85. He
said the Board is responsible for making some changes to the precinct lines based on
the decisions of the Independent Redistricting Commission. Chairman Gates noted that
the changes that were made were reviewed by the Political Parties and are necessary
in the redistricting process. Supervisor Galvin reiterated that Political Parties have been
notified of these changes.

ADJUSTMENETS
Pursuant to A.R.S. 16-411, approve establishment of new voting precincts and new precinct
boundaries as shown on the maps on file with the Clerk of the Board of Supervisors and
accompanying legal descriptions, incorporated herein by reference. This action of the Board
of Supervisors shall become effective on March 17, 2022 for the 2022 elections.
State law requires the County Board of Supervisors to establish and set the boundaries of
voting precincts within election districts prescribed by law for elected officers of the state and
its political subdivisions. On January 24, 2022, the Arizona Independent Redistricting
Commission certified new boundaries for Arizona’s Congressional and Legislative districts.
The certified changes to the Legislative and Congressional district lines require the County
to adjust voting precinct boundaries. The attached maps and exhibits provide further details.

ADOPTION OF A RESOLUTION FOR REDISTRICTING BOARD OF SUPERVISOR
BOUNDARIES
PURSUANT TO A.R.S. A.R.S. § 11-212, A.R.S. § 15-1441 ADOPT A RESOLUTION
authorizing and directing the Elections Department and the Recorder’s Geographic
Information Systems division to prepare draft maps and narrative descriptions dividing the
County into five Supervisorial Districts and defining the boundaries and limits of each district.
The resolution requires the draft maps to begin with existing district boundaries and then to
adjust such boundaries as necessary to fulfill the following criteria drawn from Arizona
Constitution Article 4, pt. 2, § 14, revised to fit the circumstances of a county:
A. Districts shall comply with the United States Constitution and the United States Voting
Rights Act;
B. Districts shall be drawn with a goal of not more than a five percent difference in population
and in no event with more than a ten percent difference in population, as required by A.R.S.
§ 11-212;
C. Districts shall be geographically compact and contiguous to the extent practicable;

AMENDMENT TO THE CONTRACT WITH SOLARI, INC
Approve financial Amendment No. 2 to a Competition Impracticable Contract (220102) with
Solari, Inc. (Contractor) and Maricopa County, administered by its Human Services
Department. The purpose of the Agreement is for the Contractor to provide navigation
services to individuals seeking assistance that have been impacted by the COVID-19
pandemic.
The purpose of the Amendment is to address the following Sections:
A. Revise 2.0 Purpose of the Agreement to expand 211 services to include transportation
services, housing crisis hotline, and assistance to those facing eviction.
B. Revise 3.0 Contractor Responsibilities to address the following activities:
3.1.1 Emergency Rental Assistance Program Support
3.1.2 Transportation Navigation and Direct Assistance
3.1.3 Housing Crisis Hotline
C. Revise 4.0 County Responsibilities to address the development and implementation of
activities.

The County shall provide funding under Catalogue of Federal Domestic Assistance
(CDFA) 21.027 American Rescue Plan Act State and Local Fiscal Recovery Funds provided
to the County through the U.S. Department of Treasury.
10.2 The Agreement total funding amount is $2,987,030, which is separated by activity as
follows:
10.2.1 $1,285,970 for Emergency Rental Assistance Navigation Support;
10.2.2 $1,267,566 for the Housing Crisis Hotline; and
10.2.3 $383,494 for the Transportation Navigation and Assistance Services.
F. Amendment No. 2 increases the funding by $2,937,030 to a total amount of $2,987,030.
The Amendment shall be effective upon approval and signature by the Parties.

Supervisor Hickman thanked Chairman Gates and the Clerk’s office for navigating the Board
through the pandemic with technology. The webinar process allowed all to participate and
stay connected. He talked about the meeting on Monday with Public Health and not wearing
masks for the first time. Supervisor Hickman recently had an opportunity to stop and thank
a Maricopa County Department of Transportation construction crew and acknowledged them
for the work they do. Supervisor Hickman reminded all of us to be cautious in the work zones.
Supervisor Sellers talked about the three separate meetings he attended with East Valley
Legislators. The interaction with them contributed to a mutual understanding of priorities for
all parties. He said it was a very productive week. Supervisor Sellers also attended the Intel
Community Advisory Panel meeting where a lot of exciting things are taking place. The First
Lady paid a visit to Intel this week as well.
Supervisor Gallardo said it is great to attend the meeting with no partitions and masks. He
reminded us to be careful and stay home when not feeling well. Supervisor Gallardo
commented on the nice weather and outdoor events including the Melrose Street Fair last
weekend and youth sports right around the corner.
Supervisor Galvin said he has been enjoying crisscrossing District 2 and was able to meet
with Ginny Dickey, Mayor of Fountain Hills. Mayor Dickey talked about some issues Fountain
Hills was having with the washes in the area. He said the Flood Control District Manager has
been very responsive and has reached out to the Fountain Hills town engineer to help resolve
those issues. Supervisor Galvin also attended groundbreaking for the water treatment plant
in Gilbert and met with the town leadership.
Chairman Gates said he would use his summary time to read a Chairman Resolution
regarding Ukraine. He added that his colleagues could comment on this if they chose to.

Supervisor Sellers thanked Chairman Gates for this very important and very well stated
proclamation for Maricopa County.
Supervisor Gallardo also thanked Chairman Gates for the Resolution. He said this is a
time when all of the United States need to remain united. Supervisor Gallardo said it is
important to welcome Ukrainians to Maricopa County and help them assimilate during
this difficult time.
Supervisor Hickman shared a personal story on how businesses need to be involved as
well. Hickman Farms purchased six egg-barn systems from a Ukrainian Company and
there were six technicians here to install the barns. He said two of the technicians wanted
to return home to defend their country. The sales representative for Hickman Farms was
featured on the world news fighting for their country. He said when doing business in the
egg business, those people become family and he encouraged other businesses to
support the Ukrainian families in whatever way possible. He thanked Chairman Gates for
this timely Resolution.
Supervisor Galvin thanked the Chairman for the well-crafted Resolution and endorsed it
wholeheartedly. There are a lot of Ukrainian Americans that live here in Maricopa County
and Supervisor Galvin extended his sympathy to the many families here and abroad who
are affected by this invasion. He mentioned a mother and her two children who were
fleeing the area and who did not make it out safely. He read their names to honor their
memory. There are also stories of bravery and inspiration as demonstrated by President
Zelenskyy who reminds us to stand united and fight for democracy. He said he wants this
to remind us, as leaders, to elevate the discourse and stop the hate.

The project is a site renovation of the Flood Control District’s property at 2801 W Durango
Street to include complete renovation of the parking lot and landscaping, both of which have
reached the end of their design life. Landscape renovations will take advantage of water
harvesting and conservation techniques such that project costs will be recovered through
water savings. In addition, the wellness trail will be resurfaced, outdoor spaces for employees
will be improved, and modifications made to achieve full ADA compliance.
This property is owned and maintained by the Flood Control District of Maricopa County
(FCDMC), and the project is 100% funded by FCDMC.

RETARDING STRUCTURE NO. 1 PHASE 2B REHABILITATION PROJECT
Amend the authorization under agenda Item number (C-69-12-052-5-00), which authorized
the award of a Construction Manager at Risk contract with Coffman Specialties, Inc. (CSI).
This amendment will increase the current Final Draft Guaranteed Maximum price (GMP) to
$21,731,139.95. The previous amount was $21,409,739.
Authorize the Chairman to execute all contracts to CSI necessary to perform and complete
all pre-construction and construction activities, inclusive of the Phase 2B Construction
Contract GMP without further action by the Board of Directors provided that the aggregate
of all such contracts does not exceed the sum of $50,733,675. The previously approved
total aggregate amount for all pre-construction and construction activities was $44,995,068.
On October 19, 2019, the District BOD authorized an increase to the Project Pre-
Construction Services Contract FCD2012C006 (C-69-12-052-5-02) for Phase 2A and Phase
2B for a combined total not to exceed $44,995,068. To date, CSI has provided pre-
construction services in the amount of $594,427 through final design of Phase 2B. The
construction cost of Phase 2A was $23,408,109 and the estimated Phase 2B construction
cost has increased to $21,731,139.95 bringing the combined total to$45,733,675. The
increase in Phase 2B construction costs from $21,409,739 can be attributed to project-
specific issues during design, regulatory agency requirements, constructability input from the
