Comments: 
The applicant seeks a Special Use Permit (SUP) to utilize an 
existing Wireless Communication Facility for an additional 
twenty-five years. The Wireless Communication Facility is an 
approx. 66’ high monopole with multiple carriers. LAFB sent 
staff comments stating that the request will not negatively 
impact flying operations at the base.  While the land use 
proposed is not necessarily consistent with a large lot 
residential land use, the Board previously approved a SUP for 
a cell tower on this site and relatively minor changes are 
being proposed. The site is located within the City of 
Goodyear municipal planning area. Staff received no 
comments from the City of Goodyear.  Staff also routed the 
proposal to the City of Buckeye, and the City did not have 
comments with the proposal. There is no known opposition or 
support from members of the public. 
 
Commission  
 
Recommendation: 
On 6/16/22, the Commission voted 7-0 to recommend 
approval of Z2022047 subject to conditions ‘a’ – ‘i’: 
 
a. 
Development of the site shall be in substantial conformance with the Site Plan 
entitled, “R and J Minshall (826869)” consisting of ten full-size sheets dated May 9, 
2022, and stamped received May 16, 2022, except as modified by the following 
conditions. Staff may determine slight refinements to remain in substantial 
conformance with the approved site plan.  Minor and major amendments to the

site plan will be determined in accordance with Chapter 3 of the Maricopa 
County Zoning Ordinance. 
 
b. 
Development of the site shall be in substantial conformance with the Narrative 
Report entitled, “CROWN CASTLE # 826869 MINSHALL”, consisting of nine pages, 
dated May 9, 2022, and stamped received May 16, 2022, except as modified by 
the following conditions. 
 
c. 
The following Planning Engineering condition shall apply:  
 
1. 
All development and engineering design shall be in conformance with 
Section 1205 of the Maricopa County Zoning Ordinance; Drainage Policies 
and Standards; Floodplain Regulations for Maricopa County; MCDOT 
Roadway Design Manual; and current engineering policies, standards and 
best practices at the time of application for construction. 
 
d. 
The following SUP standards shall apply:  
 
1. 
Max. WCF Tower Height – 66’ 
2. 
Min. WCF Setback from Rural/Residential Zoning – 64’ except for federal 
eligible colocation facilities 
3. 
Max. Diameter of Antenna Arrays – 12’ except for federal eligible colocation 
facilities 
4. 
Parking – 1 space required 
5. 
Pavement – ABC pavement or other acceptable pavement required for 
access easement and parking space with a dust-control plan approved by 
Maricopa County Air Quality Control 
6. 
Screening – 8’ chain-link fencing with privacy slats is permitted 
 
All other development standards per Rural 43 zoning shall apply 
 
e. 
The wireless communication tower shall retain the monopole properties as 
originally designed. Any damaged or missing fronds or branches shall be replaced 
within 60 days of such damage occurring. 
 
f. 
The special use permit is valid for a period of 25 years and shall expire 25 years 
from the date of BOS approval or upon termination of the use for a period of 90 or 
more days, whichever occurs first. All site improvements associated with the 
special use permit shall be removed within 90 days of such expiration or 
termination of use.   
 
g. 
Noncompliance with any Maricopa County Regulation shall be grounds for 
initiating a revocation of this Special Use Permit as set forth in the Maricopa County 
Zoning Ordinance.  
 
h. 
The property owner/s and their successors waive claim for diminution in value if 
the County takes action to rescind approval due to noncompliance with 
conditions.  
 
i. 
The granting of this change in use of the property has been at the request of the 
applicant, with the consent of the landowner.  The granting of this approval allows

the property to enjoy uses in excess of those permitted by the zoning existing on 
the date of application, subject to conditions.  In the event of the failure to comply 
with any condition, and at the time of expiration of the Special Use Permit, the 
property shall revert to the zoning that existed on the date of application.  It is, 
therefore, stipulated and agreed that either revocation due to the failure to 
comply with any conditions, or the expiration of the Special Use Permit, does not 
reduce any rights that existed on the date of application to use, divide, sell or 
possess the property and that there would be no diminution in value of the 
property from the value it held on the date of application due to such revocation 
or expiration of the Special Use Permit.  The Special Use Permit enhances the value 
of the property above its value as of the date the Special Use Permit is granted 
and reverting to the prior zoning results in the same value of the property as if the 
Special Use Permit had never been granted.

Project Summary: 
 
1. 
Crown Castle by Campbell A&Z, LLC is requesting a SUP to continue use of an existing 
wireless communications facility.  The subject property is located in the Goodyear area 
in unincorporated Maricopa County, and is designated as Large Lot Residential (1-2 
d.u./acre) in the White Tank/Grand Avenue Area Plan.  The City of Goodyear General 
Plan designates the subject property’s land use as Neighborhood. 
 
2. 
The legal description provided by the applicant identifies a site that is approximately 
1,350 square feet.  The subject site is leased to Crown Castle for telecommunications 
infrastructure and is part of a larger 4.01 acre property.  The Board of Supervisors 
approved the original SUP for the site in 1998 under case Z1998022 and granted a time 
period of twenty (20) years.  As the SUP has since expired, the applicant is requesting a 
new SUP to continue cell tower operations for an additional twenty-five years. 
 
3. 
The subject cell tower and associated appurtenances is approximately 65.5’ in height 
with a 12’ antenna array diameter. The tower will remain unmanned with an occasional 
visit by one employee to oversee site maintenance as needed.  The applicant’s site plan 
demonstrates that some small infrastructure associated with tower operations will be 
either replaced or eliminated.  Access to the tower is via a 10’ easement from 181st 
Avenue.  One parking spot is available for the maintenance employee.

The applicant is requesting to establish standards for height, wireless communication 
facility setback from rural/residential zoning, antenna array diameter, parking, pavement 
and screening that differ from Rural-43 zoning.  The standards for height, WCF setback 
and array diameter are being varied because the existing site already is constructed in 
this manner.  Parking for the site is being varied as it is an unmanned utility shelter that is 
visited infrequently and for maintenance only.  The applicant is requesting to vary the 
pavement requirement to allow for ABC pavement or another acceptable alternative 
as the easement and parking space existing on the site is for a tech parking spot that is 
used on an infrequent basis.  The applicant is requesting to vary screening requirements 
to allow for additional security and smooth operation of security equipment.

urban services such as sewer, water, schools, parks and fire and police protection may 
be only partially available or be required as an improvement district.

City of Goodyear General Plan (Adopted: 2014): This plan identifies the subject parcel as 
a Neighborhood land use which provides areas for the growth and development of 
neighborhoods. Neighborhoods include a wide range of densities and housing products, 
public and community facilities such as schools and places of worship, and commercial 
uses at appropriate intensities and locations. 
 
Public Participation Summary:

The applicant complied with the Maricopa County Citizen Review Process with the 
required posting of the site and notification by first class mail to adjacent property owners 
and HOA’s within 300’ of the subject parcel and notification to interested parties.  Two 
signs were posted on site in accordance with applicable regulations.  A Public 
Participation Results Report was submitted to Staff in accordance with County 
requirements.

As this site is inside the territory in vicinity of a military airport, LAFB sent staff comments 
stating that the request will not negatively impact flying operations at the base.  The site 
is located within the City of Goodyear municipal planning area. Staff received no 
comments from the City of Goodyear.  Staff also routed the proposal to the City of 
Buckeye, and the City did not have comments with the proposal.

Staff is supportive of the SUP request for the continued operation of an existing Crown 
Castle cell tower.  While the land use proposed is not necessarily consistent with a large 
lot residential or neighborhood land use, the Board previously approved a SUP for a cell 
tower on this site and relatively minor changes are being proposed.  Additionally, the 
request provides a community benefit – additional telecommunications infrastructure in 
a rural area.

Staff finds the requests for development standards reasonable in that there are no 
substantial alterations occurring to the site from what previously existed.  The screening 
request protects sensitive equipment and the use of the property is such that parking 
needs will be minimal.  Staff believes that the applicant has acted in good faith to notify 
nearby owners of the proposed change and to provide ample opportunity to make 
comments.   
 
Recommendation:

For the reasons outlined in this report, staff recommends the Commission motion for 
Approval of case Z2022047, subject to conditions ‘a’ – ‘i’.

PURPOSE OF REQUEST 
Campbell A&Z, LLC on behalf Crown Castle respectfully requests a 25 year term 
SPECIAL USE PERMIT for the existing 282’ tall co-located Wireless 
Communications Facility Lattice Tower located at 211 S. 181st Ave. 
 
DESCRIPTION OF PROPOSAL 
PROJECT: The existing Crown 60’ tall wireless communications facility 
monopole, with a 5’ lightning rod: 
• T-Mobile at the 57’ rad center, with 9 antennas, 3 antennas per sector, 3 
sectors and 2 one-foot microwave dish at the 50’ rad center. 
• The SUP lease area and equipment compound remains the same 
dimensions.  
• All associated cables are internal to the monopole and then on a cable 
tray to the equipment shelter.  
• The electrical and telco service are from the local service providers. The 
electric and telco service run overhead from the source to the equipment 
compound. 
• A designated gravel surfaced parking space, for the service technician is 
adjacent to the fenced equipment compound. The typical site maintenance 
visit is one time per month by the service technician. 
• Access to the site is via 181st Ave at the property driveway. 
 
• LANDSCAPE, SIGNAGE AND SCREEN WALLS 
• The existing WCF lattice tower has no planned landscaping. 
• The signage at the proposed WCF is limited to the FCC required postings, 
and a cell site identification/emergency contact notification sign. There will 
not be any commercial signage at the proposed WCF.  
• The site will have one exterior light mounted at the doorway(s) to the 
equipment compound walls for the safety of the service technician. The 
light(s) is typically on a motion sensor and is not dusk to dawn device. All 
lighting shall comply with Section1112 of the MZCO. 
• The site has existing 8’ chain link fence around the equipment compound. 
Crown Castle will update the 8’ fence to a slatted chain link fence for 
equipment screening and security.

TMobile network. The WCF has been serving the community for 20 plus years. 
The changes in the area served by the WCF have been minimal as the 
community remains largely a rural community.

The existing 60’ monopole was initially approved in 1998 when the County 
Wireless Ordinance allowed for setback of 80’ to all property lines within 
residentially zoned properties. The Wireless Ordinance was updated in 2015 to 
the current standards requiring a 2:1 setback to residential zoned districts.

LOCATION AND ACCESIBILITY 
The existing WCF is located on a parcel that is a small piece in the southeast 
corner of a larger parcel. The site is accessed from 181st Ave then over an 
existing gravel drive to the site. 
 
CIRCULATION SYSTEM 
The WCF has the use of a dedicated 10’ wide access route from 181st Ave to the 
site. The traffic generated by the WCF is minimal, with a monthly service 
technician visit as standard. 
 
DEVELOPMENT SCHEDULE 
The WCF is existing. The planned modifications to the WCF are as follows:

Justification of Standards 
Max. Height - The original conditions of Z1998022 permitted a maximum height of 83’ for 
the monopole and attachments. The existing tower developed at 66’ and the standard is 
being requested to be adjusted accordingly. 
 
Min. WCF Setback from Rural/Residential Zoning – The original approved SUP allowed for 
a minimum setback of 64’ from rural or residential zoning within the SUP area. 
 
Parking - The building is an unmanned utility shelter that is visited infrequently and for 
maintenance only.  One ADA space has been provided for an employee.   
 
Screening – The utility shelter requires unobstructed airflow for equipment cleanliness and 
operational stability.  Also this site is small and remote with no impact on the surrounding 
properties.  Chain-link fencing would be more appropriate.  1’ of barbed-wire is also 
proposed in order to provide a layer of security to the site to prevent unintentional 
damage of valuable equipment and to prevent access of sensitive information. 8’ chain-
link fencing with privacy slats is proposed by the Applicant. 
 
Pavement – The original conditions of Z1998022 required the access easement and 
parking space to be paved with either ABC or another acceptable pavement suitable 
for dust-proofing surfaces.

Wireless CF time frame extension at APN # 502-40-053. Water and sewer 
services will not be needed, MCESD has no concerns. 
 
Based on the above, MCESD raised no objections to the Planning & 
Development Department in Accela Automation on March 9, 2022. 
 
 
It should be noted that this document does not approve the referenced project.  
Comments are provided only as advisory to Maricopa County Planning and 
Development Department to assist staff to prepare a staff report.  Other 
Maricopa County agencies may have additional requirements. Final review and 
approval will be made through Planning and Development Department 
procedures. Applicant may need to submit separate applications to the 
Maricopa County Environmental Services Department for approval of proposed 
facilities regulated by the Department.  Review of any such application will be 
based on regulations in force at the time of application.

Thank you for allowing Luke AFB to make comments on the Special Use Permit for Wireless
Communication Facility Application. The applicant requests a 25 year SUP for an existing WCF.  The
site is located 1 mile outside the Luke AFB 1988 JLUS 65 Ldn, “high noise or accident potential zone”
as defined by A.R.S. § 28-8461 and is inside the “territory in the vicinity of a military airport” also
defined by A.R.S. § 28-8461. 
 
As described in the application, this request will not have a negative impact on Luke AFB Flight
Operations.  Since the site will be located inside the “territory in the vicinity of a military airport,” it
will be subjected to approximately 165 over flights per day, as low as 1,500 feet above the ground. 
We recommend you review the sound attenuation requirements found in A.R.S. § 28-8482.  In
addition, a strong notification program on the part of the applicant is essential to inform residents
about Luke AFB operations.
