The applicant is requesting to modify Condition ‘f’ of SUP Z 
97-39 that allowed the existing WCF with a 180’ lattice tower 
for a timeframe of 25 years from approval by the Board of 
Supervisors, which was on October 22, 1997.  Thus, the special 
use will expire on October 22, 2022.  This request is to modify 
Condition ‘f’ to allow for an additional 25 years of validity or 
until October 22, 2047. The WCF is located a quarter mile 
northwest of the northwest corner of Gates Rd. and 
Wickenburg Highway in the Morristown area. Currently, there 
are four cellular carriers collocated on the existing tower.   
 
There are no outstanding concerns from reviewing agencies. 
The site is within the City of Surprise’s Municipal Planning Area.  
Both the City’s general plan and the White Tank/Grand Ave. 
Area Plan designates the site as Rural Residential.  Since the 
existing WCF requires no urban services, such as water or 
sewer, and is a public utility, it is compatible with both the 
City’s General Plan and County’s area plan. As of the writing 
of this report staff have not received comments from the City 
of Surprise concerning this request. Additionally, staff nor the 
applicant has received any support or opposition for this 
request from the public.

Recommendation: 
On 6/16/22, the Commission voted 7-0 to recommend 
approval of Z2022049 subject to conditions ‘a’ – ‘f’:  
 
a. 
Development of the site shall be in substantial conformance of the narrative report 
entitled “Special Use Permit Modification of Condition Project Narrative”, 
consisting of seven pages dated revised May 10, 2022, and stamped received 
May 10, 2022.   
 
b. 
The Special Use Permit shall expire on July 27, 2047, or upon cessation of the use 
for 90 consecutive days, whichever occurs first.  The site improvements, including 
the monopole, shall be removed within 60 days of termination of expiration of the 
lease.   
 
c. 
Maximum height for a lattice tower of 188 feet in Class 2 of the Wickenburg 
Highway Scenic Corridor for the Wireless Communication Facility.   
 
d. 
Allow an existing Wireless Communication Facility with a 188-foot-tall lattice tower 
to be setback a minimum of 16 feet from the east property line.  
 
e. 
The following Planning Engineering condition shall apply: 
 
1. 
All development and engineering design shall be in conformance with 
Section 1205 of the Maricopa County Zoning Ordinance; Drainage Policies 
and Standards; Floodplain Regulations for Maricopa County; MCDOT 
Roadway Design Manual; and current engineering policies, standards and 
best practices at the time of application for construction. 
 
f.

Project Summary: 
 
1. 
The applicant is requesting to modify Condition ‘f’ of SUP Z 97-39 that allowed the existing 
WCF with a 180’ lattice tower for a timeframe of 25 years from approval by the Board of 
Supervisors, which was on October 22, 1997.  Thus, the special use will expire on October 
22, 2022.  This request is to modify Condition ‘f’ to allow for an additional 25 years of 
validity or until October 22, 2047. The WCF is located a quarter mile northwest of the 
northwest corner of Gates Rd. and Wickenburg Highway in the Morristown area. 
Currently, there are four cellular carriers collocated on the existing tower.   
 
2. 
The site is in the Rural-43 zoning district and Class 3 of the Wickenburg Highway Scenic 
Corridor overlay zoning district (WHSC).  The WHSC is broken up into four different classes 
of intensity with Class 3 designated for parcels that are 300’ to a quarter mile of the 
ultimate highway’s right-of-way north of the Rolling Hills Rd. alignment in Morristown. In 
Class 3 of the WHSC maximum structure height is 33’; however, Z 97-36 varied this to a 
maximum height of 180’ to accommodate lattice tower. This was followed by two minor 
amendments to allow for co-location by two different wireless carriers (Z20000028 & 
Z20001129).  On August 23, 2002, there was a SUP major amendment approved by the 
Board of Supervisors to expand the WCF’s ground mounted equipment area (Z2002103). 
This was followed by two minor SUP amendments to allow co-location of a wireless carrier, 
antenna modification, and to allow an eight-foot lightning rod which increased the 
overall height of the existing lattice tower to 188’ (Z2006045 & Z2009037).  The increase in 
height for the lightning rod seems to have been determined to be an Eligibility Facility 
Request per Section 6409 of the Spectrum Act. The eight-foot-tall lightning safety rod 
does not significantly change the tower’s appearance.  The subject request will also 
permit an increased tower height from 180’ to 188’.  Still another request is to allow the 
existing WCF to be setback 19’ instead of the required 376’, from the east side property 
line, which was approved per Z 97-36 thus predates the current Zoning Ordinance. This 
request will codify this varied standard.   
 
Therefore, the applicant is requesting to carry forward all previous stipulations of Z 97-36  
and the following modifications to the conditions of special use permit approval:

recorded private access easement that links the site to Gates Rd. to the south.

White Tank/Grand Ave. Area Plan (adopted December 6, 2000): This area plan 
designates the site as Rural Densities (0-1 du/ac). The Rural Density category identifies 
areas where single family residential development is desirable, but unique circumstances 
dictate lower densities in areas will limited or nonexistent urban services.  Since the existing 
WCF requires no urban services, such as water or sewer, it is compatible with the area 
plan.

Surprise’s General Plan 2035: This general plan designates the site as Rural Neighborhoods 
which represents areas defined by low density residential uses and limited low intensity 
neighborhood commercial and civic uses that are necessary to support the rural lifestyle.   
 
Public Participation Summary:

The applicant notified property owners within 300’ of the site and to area interested 
parties. During the applicant’s Citizen Participation process neither staff nor the applicant 
received any support or opposition.  The City of Surprise was notified and as the writing 
of this report staff have provided comments.

Staff supports this request to modify the conditions of special use approval.  The existing 
WCF has been on the site for almost 25 years and serves four separate wireless carriers.  
The WCF has been vital in offering wireless coverage for residents and for travelers along

a busy highway.  By varying both the current height and distance from the east property 
line this amendment will codify what was approved prior to the County’s current Zoning 
Ordinance.   Increasing the validity of this SUP will create a seamless transition that will not 
interrupt wireless service in this area for another quarter century.   
 
Recommendation:

Staff recommends the Commission adopt a motion recommending that the Board of 
Supervisors approve Z2022049 subject to the following conditions ‘a’ – ‘f’:

The SUP lease area and equipment compound remains the same.

All associated cables are attached to the lattice tower and then on a cable
tray to the equipment shelter(s).

electric and telco service run overhead from the source to the equipment
compound.

A designated gravel surfaced parking space, 9’x 18’, for the service
technician is at the entry to the parcel from Gates Rd. The typical site
maintenance visit is one time per month by the service technician.

PURPOSE OF REQUEST 
Campbell A&Z, LLC on behalf Crown Castle respectfully requests a 
MODIFICATION OF SPECIAL USE PERMIT by Z97-39, Condition “F” for the 
existing 188’ tall co-located Wireless Communications Facility Lattice Tower 
located at 41002 N US 60, Morristown, 85342. 
Crown respectfully requests a 25-year term for the Special Use Permit 
Subject to the Conditions of approval from SUP Z97-39: 
a. Development in accordance with the site plan entitled “Site Plan Cellular
One Morristown”, consisting of 1 sheet, dated June 19, 1997, and
stamped received July 17, 1997.

c. Prior to the issuance of building permits, the applicant shall construct a 6” 
berm around the perimeter of the lease area in compliance with the 
regulations of the Flood Control District.
d. Prior to the issuance of building permits, the applicant shall address the 
following requirements set forth by Rural Metro: all plans (including those 
for the automatic fire suppression system) must be submitted to the Fire 
Department for permit approval; directional signs must identify the site; all 
access must be 6” ABC; a Knox padlock must be used at the entrance 
gate which must be 20’ wide; and an approved fire department apparatus 
turn around must be provided. In addition, the applicants must obtain 
written assurance that Rural Metro can service the Special Use Permit site 
with access via an off-site 12’ access easement from Rockaway Hills 
Drive.
e. The onsite 20’ driveway and parking area must be paved or surfaced with
6-inch ABC in compliance with Department of Transportation and Rural 
metro requirements.
f.
The Special Use Permit shall expire on ________, which is 25 years 
from the date of approval by the BOS, or upon expiration of the lease to 
the applicant(s), whichever occurs first. The site improvements, including 
the monopole, shall be removed within 60 days of termination or expiration 
of the lease.
g. Major changes to this Special Use with regard to use and intensity must be 
processed as a revised application with approval by the Board of 
Supervisors upon recommendation by the Commission. Minor changes to 
the Special Use may be administratively approved by the Planning 
Division of the Department of Planning and Development. Co-location of 
other cellular communication facilities on this site shall be considered 
minor changes.
h. Noncompliance with the conditions of approval will be treated as a 
violation in accordance with Article XXIX (Violation and penalty). Further, 
noncompliance of the conditions of approval may be grounds for the 
Commission to take action in accordance with Article XXVII of Section 
2806 (Conditional Zoning).

DESCRIPTION OF THE PROPOSAL & PROJECT BACKGROUND 
The existing WCF was originally entitled by Z39 with subsequent Zoning cases 
Z2000028, Z2002103, Z2004115, Z2006045, Z2009037 &  Z2015047 for 
antenna modifications. 
This SUP request is to continue an SUP for a WCF that has been in operation for 
25 years providing network coverage for multiple carriers for the neighboring 
community and traffic along US60. 
The WCF is on a 3/4acre parcel that abuts the railroad track on the east and also 
has a residential home to the south.  
RELATIONSHIP TO SURROUNDING PARCELS 
The surrounding parcels, north, south, east and west are mixed use zoning. The 
development status of each adjacent parcel is as follows: 
North: APN#503-22-025M subject parcel is developed  
South: APN#503-26-006B subject parcel is undeveloped.  
East: APN# 503-22-001 subject parcel is undeveloped. 
West: APN# 503-22-025Q subject parcel is developed. 
The existing WCF parcel is not located in an Airbase Overlay District. 
The WCF provides the benefit of wireless communication services to the 
surrounding rural community as a primary means for telephone and internet 
resources. In addition, the WCF provides network coverage for emergency 
services along US60 and SR74 in the high traffic corridor. 
LOCATION AND ACCESIBILITY  
The WCF is accessed from Gates Rd off of US 60 then over an existing gravel 
road to the site. 
CIRCULATION SYSTEM 
The WCF has the use of a dedicated 12’ wide access route from Gates Rd to 
the site. The traffic generated by the WCF is minimal, with a monthly service 
technician visit as standard. 
DEVELOPMENT SCHEDULE 
The WCF is existing. There are no planned modifications to the tower at this 
time.

The Maricopa County Environmental Services Department (MCESD) has reviewed 
documents received from the Maricopa County Planning and Zoning Department for 
the above referenced project. This project is request for a modification of SUP 
condition 'f' of Z97-39 to extend the timeframe of the SUP at APN # 503-22-025H. 
According to the submitted documentation, there are no water or sewer utilities for 
this project. MCESD has no objections to this project. 
 
Based on the above, MCESD raised no objections to the Planning & Development 
Department in Accela Automation on March 8, 2022. 
 
 
It should be noted that this document does not approve the referenced project.  
Comments are provided only as advisory to Maricopa County Planning and 
Development Department to assist staff to prepare a staff report.  Other Maricopa 
County agencies may have additional requirements. Final review and approval will be 
made through Planning and Development Department procedures. Applicant may 
need to submit separate applications to the Maricopa County Environmental Services 
Department for approval of proposed facilities regulated by the Department.  Review 
of any such application will be based on regulations in force at the time of 
application.

PND engineering plan review (DPR, FCD and PND Transportation) has reviewed the 1st 
submittal of the POD application routed for review on January 25, 2022. PND Engineering 
has no comments or objections subject to the following conditions: 
 
1. All development and engineering design shall be in conformance with Section 1205 
of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; 
Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual; 
and current engineering policies, standards and best practices at the time of 
application for construction.
