The applicant seeks a Special Use Permit (SUP) Major 
Amendment with a Plan of Development to develop 10 
additional rowhome casitas and parking for an existing senior 
living facility. The subject facility is part of an assisted living 
center consisting of one building with 160 units on an approx. 
6.4 acre property.  The subject amendment will add 10 
additional units and two new buildings on an approx. 1.37 
acre expansion. The proposal complies with the land use 
designation of Multi-Neighborhood Commercial in the Daisy 
Mountain/New River Area Plan (Anthem DMP).  Staff received 
comments from Daisy Mountain Fire Prevention (DMFP) about 
fire service requirements to the site to be addressed during 
the construction permitting process.  ADOT ROW Project 
Management had no concerns with the proposal.  There is no 
known opposition or support from members of the public. 
 
Commission  
 
Recommendation: 
On 6/16/22, the Commission voted 7-0 to recommend 
approval of Z2022027 subject to conditions ‘a’ – ‘g’: 
 
a. 
Development of the site shall be in substantial conformance with the Site Plan 
entitled, “The Enclave at Anthem Senior Living Casitas” consisting of nine pages 
dated May 10, 2022, and stamped received May 13, 2022, except as modified by 
the following conditions.

b. 
Development of the site shall be in substantial conformance with the Narrative 
Report entitled, “Enclave at Anthem”, consisting of 7 pages, dated, revised May 
2, 2022, and stamped received May 2, 2022, except as modified by the following 
conditions. 
 
c. 
The Owner or Developer shall address and respond to all recommendations of the 
Daisy Mountain Fire District (DMFD) included in the correspondence dated March 
7, 2022 at the time of construction permitting.  A ‘will serve’ letter shall be required 
prior to approval of construction permits. 
 
d. 
Prior to final approval of construction permits, the Owner or Developer shall 
process a lot combination or record a cross-access easement between APN 203-
04-481 and APN 203-04-549.  Recordation of a cross-access easement may alter 
required setbacks on the site and require a SUP Modification of Conditions. 
 
e. 
The following Planning Engineering conditions shall apply:  
 
1. 
Off-site Hydrology – The grading plans submitted for building permit 
acquisition shall identify the peak run-off flow rate for the wash adjacent to 
the site.  
 
2. 
Onsite Hydrology – The onsite hydrology calculations shall utilize County 
values as indicated in Table 6.3 of the Maricopa County Drainage Policies 
and 
Standards 
Manual.

commercial/industrial areas. For first flush, a coefficient of 1.0 shall be used 
for the entire site.  
 
3. 
Onsite Retention – The required retention volume for the site shall be the first 
flush volume or the pre vs post runoff volume, whichever is greater.

Retention Disposal – All retention must drain within 36 hours. Bleed-off to the 
existing drainage channel along the southeast side of the site may be used 
in lieu of drywells to drain the underground retention. Drywells are required 
to drain the first flush volume of runoff unless a storm water quality device if 
provided on the bleed-off.  
 
5. 
Engineering review of planning and/or zoning cases is for conceptual 
design only. All development and engineering design shall be in 
conformance with Section 1205 of the Maricopa County Zoning 
Ordinance; Drainage Policies and Standards; Floodplain Regulations for 
Maricopa County; MCDOT Roadway Design Manual; and current 
engineering policies, standards and best practices at the time of 
application for construction. 
 
6. 
Based on the conceptual design nature of the information submitted, 
changes to the site layout may be necessitated by the final engineering 
design of the site’s drainage infrastructure. 
 
7. 
Detailed Grading and Drainage (Improvement) Plans must be submitted 
with the application for Building Permits.

8. 
Work within N Venture Drive (sidewalk, utility connections, and 
landscaping) will require a MCDOT ROW permit issued concurrent with the 
building permit.  Any landscaping with the MCDOT right-of-way must meet 
the applicable  standards listed in the MCDOT Roadway Design Manual.   
 
9. 
The subject premises is located within the County’s Urbanized Area and will 
disturb more than one (1) acre. A Storm Water Pollution Prevention Permit 
(SWPPP), issued by the County (PND), will be required prior to issuance of 
any building permits required for site development. 
 
10. 
If the entitlement is approved, existing building permits B202105759 & 
B201905761 will need to be terminated and new building permits will need 
to be applied for the construction of the improvements contemplated with 
this submittal. Review fees must be paid prior to termination. 
 
f. 
Noncompliance with any Maricopa County Regulation shall be grounds for 
initiating a revocation of this Special Use Permit as set forth in the Maricopa County 
Zoning Ordinance. 
 
g. 
The granting of this change in use of the property has been at the request of the 
applicant, with the consent of the landowner.  The granting of this approval allows 
the property to enjoy uses in excess of those permitted by the zoning existing on 
the date of application, subject to conditions.  In the event of the failure to comply 
with any condition, and at the time of expiration of the Special Use Permit, the 
property shall revert to the zoning that existed on the date of application.  It is, 
therefore, stipulated and agreed that either revocation due to the failure to 
comply with any conditions, or the expiration of the Special Use Permit, does not 
reduce any rights that existed on the date of application to use, divide, sell or 
possess the property and that there would be no diminution in value of the 
property from the value it held on the date of application due to such revocation 
or expiration of the Special Use Permit.  The Special Use Permit enhances the value 
of the property above its value as of the date the Special Use Permit is granted 
and reverting to the prior zoning results in the same value of the property as if the 
Special Use Permit had never been granted.

Project Summary: 
 
1. 
Berry-Riddell, LLC is requesting a Special Use Permit Major Amendment to expand an 
existing senior living facility to allow for ten additional rowhome casitas and related 
parking.  The subject property is located in the Daisy Mountain/New River Area Plan, 
which designates the subject property as Anthem DMP.  This property is also part of the 
City of Phoenix Municipal Planning Area.  The City of Phoenix General Plan designates 
the property as Undesignated Land.  The undesignated land use category denotes areas 
located within the unincorporated Maricopa County adjacent to the City of Phoenix 
municipal boundaries.  
 
2. 
Prior to the proposed amendment, the Board approved a number of cases beginning 
with the Anthem Development Master Plan and resulting in later C-O zoning.  The shape 
of the lot is established via a final plat (S2000067) and two replats (S2002077 and 
S2008024). Initially, developers planned for the site to be a commercial office 
condominium site.  The office condominium use never developed and instead 
developers sought a SUP for an assisted living facility.  The site is zoned C-O SUP from when 
the Board approved the original SUP under case Z2014098 and a subsequent major 
amendment in case Z2019017.  The original SUP covered approx. 6.4 acres with a 
subsequent amendment adding an additional 1.37 acres.  No development standards 
present in the C-O zoning district were altered with SUP approval and subsequent 
amendments. 
 
3. 
The existing SUP area entitles approximately 6.4 acres (APN 203-04-549).  The Board also 
voted to allow the SUP to have no expiration.  The proposed request is to expand the SUP 
area approximately 1.37 acres to cover a new phase of development for the assisted 
living facility (APN 203-04-481).   
 
4. 
The proposed expansion of the development will allow for an additional 10 rowhome 
casitas and related parking.  Twenty parking spaces are being added along with 
associated infrastructure.  Once developed, the additional units will be integrated into 
the larger facility and seniors will occupy the units and have access to the amenities of 
the community. The site will be accessed through an internal road leading from an 
existing development which has its primary access from Venture Dr.

Daisy Mountain/New River Area Plan (adopted 2019): The Daisy Mountain/New River 
Area Plan identifies this site as Anthem DMP.  The Anthem Development Master Plan is a 
planned community with a variety of home types and densities ranging from apartments 
to large-lot, single-family homes, reflective of other suburban developments within the 
County. The DMP specifies land uses specific to the DMP area and the land use 
associated with this site is Multi-Neighborhood Commercial and Mixed Use Center.   
 
The Multi-Neighborhood Commercial category denotes areas providing for the sale of 
convenience goods (food, drugs and sundries) and personal services which meet the 
daily needs of a multi-neighborhood trade area.  A broader number of activities may be 
provided than those in a Neighborhood Commercial category.  A community sewer and 
water system will be required for development. The Mixed Use Center category denotes 
areas for the location of major employment centers which would have minimal impacts 
on surrounding areas outside of increased traffic demands.  Uses permitted in this 
category would include offices, light industrial parks, business parks, research parks, 
government facilities, post-secondary educational facilities, hospitals and major medical 
facilities.  A community sewer and water system will be required for development.

Public Participation Summary:

The applicant has complied with the Maricopa County Citizen Review Process with the 
required posting of the site and notification by first class mail to adjacent property owners 
and HOA’s within 300’ of the subject parcel and notification to interested parties.  Two 
signs were posted on site in accordance with applicable regulations.  A Public 
Participation Results Report was submitted to Staff in accordance with County 
requirements.

The applicant did schedule a public meeting with the Anthem Community Council; 
however, this meeting will be conducted following the scheduled Planning and Zoning 
Commission meeting.  Results from the meeting will be reported in the report to the Board 
of Supervisors if the Commission moves the proposal forward.

Daisy Mountain Fire Prevention (DMFP) sent staff comments about fire service 
requirements to the site.  These comments are related to the precise development of the 
site and will be addressed during the construction permitting process.  ADOT ROW Project 
Management had no concerns with the proposal.

Staff is supportive of the applicant’s request for a Special Use Permit Major Amendment.  
The request represents an extension of a development that is existing, established and 
appropriate in terms of use on the subject site.  The site is subject to the Anthem 
Development Master Plan land use designations of Multi-Neighborhood Commercial and 
Mixed Use Employment.  The proposed amendment is consistent and compliant with the 
land use designation of Multi-Neighborhood Commercial as an assisted living facility is a 
commercial use providing elder care services to the Anthem area.  Additionally, the use 
provides a benefit to the area as it provides a quality elder care option for family 
members of seniors that allows for aging in place, socialization, centralized services, 
activities and amenities.   
 
16. 
Staff believes that the applicant has acted in good faith to notify the Anthem community 
of the expansion.  Staff routed this proposal to Anthem Community Council members 
and registered representatives of the community from District 3.  Staff received no public 
opposition and reviewing agencies have no objection to the request. 
 
Recommendation:

For the reasons outlined in this report, staff recommends the Commission motion for 
Approval, subject to conditions ‘a’ – ‘g’.

Special Use Permit Major Amendment 
PURPOSE OF REQUEST 
 
The  purpose  of  this  request  is  to  obtain  approval  of  a  Special  Use  Permit  Major 
Amendment  for  the  Enclave  at  Anthem  assisted  living  facility.  The  Major 
Amendment is requested to permit the addition of 10 rowhome casita units and 20 
covered  parking  spaces,  including  1  accessible  space  on  parcel  203‐04‐481  (the 
“Site”).  To maintain consistency with the original SUP approval, no time limitation 
is  included  as  part  of  this  request.  The  Site  is  located  within  the  County’s 
Commercial Office Zoning District (C‐O) in the Anthem Master Planned Community.   
 
In  June  of  2015,  the  Board  of  Supervisors  approved  Special  Use  Permit  case 
Z2014098  for  an  indefinite  length  of  time  (later  amended  through  Z2015084  to 
permit  additional  height)  for  parcels  203‐04‐479  and  203‐04‐480  to  permit  the 
Enclave at Anthem Senior Living Facility outlined below in red (the “Enclave SUP”). 
At the time, the Site, the adjacent property shown outlined below in blue was held 
by  a  different  land  owner.  Spectrum  Retirement  Communities,  LLC,  as  Spectrum 
Anthem Acquisition, LLC subsequently acquired the Site. 
 
 
 
In June 2019, the Board of Supervisors approved a major amendment to the Enclave 
SUP  (case  Z2019017)  in  order  to  construct  two  duplex  cottages  and  additional 
parking.  
 
Through  this  request,  the  use  will  remain  the  same,  but  Spectrum  Retirement 
Communities  is  seeking  to  expand  on  the  success  of  Enclave  at  Anthem  by 
constructing  10  rowhome  casita  units  and  20  covered  parking  spaces  to 
accommodate  independent  living  residents.  A  concurrent  application  to  Anthem 
Community Council will seek Design Review approval.

DESCRIPTION OF PROPOSAL  
 
The  proposal  is  for  10  new  rowhome  casita  units  to  accommodate  independent 
living residents. 20 additional parking spaces, including 1 accessible parking space 
will serve residents living in the rowhomes as well as the existing facility.  
 
The Site is currently vacant and consists of one parcel (APN 203‐04‐481) comprising 
approximately  1.37  gross  acres.  The  existing  assisted  living  center  includes  160 
rental  units  and  184  beds.    It  operates  24  hours/day,  7  days/week  and  has 
approximately 40 employees, with no more than 25 staff on site at any time.   
 
Anthem Senior Living offers seniors over the age of 55 an affordable way to live a 
healthy and fulfilling life through its month‐to‐month rental program. Their three‐
tier  system  includes  Independent  Living,  Assisted  Living  and  Memory  Care,  and 
provides  seniors  with  the  lifestyle  options  to  best  suit  their  needs.    It  is  not  a 
nursing home or apartment community.  Spectrum Retirement Communities has a 
national  reputation  for  building  high  quality  communities.    With  home  offices  in 
Denver, Colorado they have 47 facilities in 10 states.  Their typical location is in or 
adjacent to an established residential area, on an infill site, on or near a boundary 
between  commercial  and  residential  uses  and  near  shopping  and  amenities.    The 
Site is characterized by all of these features.   
 
 
 
 
The  new  rowhome  casitas  will  accommodate  Spectrum  Retirement  Communities’ 
Independent  Living  residents  and  ensure  that  their  specific  needs  are  met,  while 
maintaining  their  independence  and  enhancing  their  quality  of  life.    This  option 
allows  seniors  to  enjoy  the  privacy  of  a  detached  residence,  but  with  the  added 
convenience of the wide variety of amenities provided at the Enclave at Anthem. 
Services and amenities featured at the Enclave at Anthem include fitness classes, 
creative  workshops,  social  gatherings,  a  theatre,  library,  salon,  greenhouse,

outdoor swimming pool, their At Your Service® concierge desk, and more.   
 
DEVELOPMENT STANDARDS AND DESIGN 
 
Spectrum Retirement Communities does not intend to vary any of the Development 
Standards  set  forth  in  the  C‐O  zoning  category.  The  design  of  the  addition  with 
feature  consistent  colors  and  materials  to  those  high‐quality  building  materials 
used in the main building, shown in the graphic below, which utilizes warm colors 
of stucco, stone veneer, accents of stained wood and a tile roof.  The facades are 
given  interest  with  varying  roof  transitions,  vertical  columns,  pop‐out  areas  and 
scoring patterns.

RELATIONSHIP TO SURROUNDING PROPERTIES 
 
The Site is surrounded by the following uses and zoning:  
 
Northeast: Enclave at Anthem Assisted Living Facility. C‐O SUP Zoning  
Northwest: Office complex across Venture Drive. C‐2 Zoning  
Southwest: Office complex. C‐O Zoning  
West: Vacant, planned for HonorHealth hospital. C‐2 Zoning  
Southeast: Desert open space, then Anthem Marketplace commercial retail center 
and multiple‐family residential neighborhood. C‐2 Zoning and R‐3 Zoning  
 
As outlined above, this Site is located adjacent to the existing assisted living facility 
and in an established residential and commercial area with a variety of supporting 
retail and service uses nearby.  Also in close proximity are the Anthem Community 
Center  and  Community  Park.    These  facilities  include  a  variety  of  amenities 
including  a  lounging/game  area,  a  health  and  fitness  center  with  group  fitness 
classes,  amphitheater,  and  picnic  ramadas.  The  Anthem  Community  Center  is 
conveniently  located  in  proximity  to  the  assisted  living  center  and  provides 
amenities and programs for Anthem residents of all ages and their guests to connect 
with one another, stay active, and learn new skills.

Special Use Permit Major Amendment 
Spectrum  Retirement  Communities  originally  chose  this  location  due  to  its 
demographics,  existing  and  projected  demand  for  senior  living  and  the  mix  of 
supportive land uses in the surrounding area.  As evidenced by the success of the 
Enclave  at  Anthem,  the  expanded  facility  will  continue  to  serve  the  elderly 
demographic  of  Anthem.    Additionally,  the  cottages  will  provide  a  residential 
lifestyle option appropriate for independent seniors, but with access to the wealth 
of  amenities  and  services  provided  by  Spectrum  Retirement  Communities.  The 
location  chosen  for  Anthem  Senior  Living  is  appropriate  given  the  mixture  of 
compatible uses in the immediate vicinity and the demographics in the surrounding 
area. 
 
LOCATION, ACCESSIBILITY, AND CIRCULATION 
 
The 1.37‐acre Site is located on Venture Drive just south of Anthem Way near the 
major entrance to the Anthem Master Planned Community from Interstate 17.  West 
Anthem Way is an arterial roadway with 156’ of right‐of‐way (ROW), while Venture 
Drive is a collector roadway having an 80’ ROW. Vehicular access to the Site will be 
via the existing 36‐foot‐wide two‐way driveway from Venture Drive. A cross access 
agreement  will  be  executed  to  provide  circulation  between  the  Site  and  the 
adjacent existing Enclave at Anthem. No new curb cuts will be created as a result 
of this proposal. Venture Drive is fully improved with paving, curb and gutter.  On‐
site circulation includes paved parking and service aisles 360° around the building. 
 
DEVELOPMENT SCHEDULE 
 
This  project  is  anticipated  to  be  completed  in  one  phase  commencing  on  or 
before December 2022, and complete by the end of 2023. 
 
COMMUNITY FACILITIES AND SERVICES 
 
The mix of supportive and compatible land uses in the immediate vicinity played a 
role in site selection for the main facility constructed in 2016 (completed in 2017).  
Spectrum  Retirement  Communities  prefers  to  locate  in  close  proximity  to  civic, 
residential,  and  commercial  land  uses.  This  Site’s  proximity  to  the  Anthem 
Community  Center  with  its  variety  of  amenities  described  earlier  will  enable 
Anthem Senior Living’s residents to participate in all the activities the community 
offers. This synergistic blend of land uses will continue to contribute to the success 
of  the  casitas  and  the  additional  parking  will  serve  the  overall  site.  It  is  not 
anticipated that this proposal will have any deleterious impacts on the community 
facilities or public utilities that serve this Site.

Engineering Review has reviewed the first documents for the subject application and

1. OFFSITE HYDROLOGY 
 
a. The grading plans submitted for building permit acquisition shall identify the 
peak run-off flow rate for the wash adjacent to the site.   
 
2. ONSITE HYDROLOGY 
 
a. The onsite hydrology calculations shall utilize County values as indicated 
in Table 6.3 of the Maricopa County Drainage Policies and Standards 
Manual. A value of 0.95 shall be used for commercial/industrial areas. For 
first flush, a coefficient of 1.0 shall be used for the entire site.

a. The required retention volume for the site shall be the first flush volume or 
the pre vs post runoff volume, whichever is greater. 
 
4. RETENTION DISPOSAL 
 
a. All retention must drain within 36 hours.  Bleed-off to the existing drainage 
channel along the southeast side of the site may be used in lieu of drywells 
to drain the underground retention.  
 
b. Drywells are required to drain the first flush volume of runoff unless a storm 
water quality device is provided on the bleed-off.

5. The subject premises is located within the County’s Urbanized Area and will 
disturb more than one (1) acre. A Storm Water Pollution Prevention Permit 
(SWPPP), issued by the County (PND), will be required prior to issuance of 
any building permits required for site development. 
 
6. If the entitlement is approved, existing building permits B202105759 & 
B201905761 will need to be terminated and new building permits will need to 
be applied for the construction of the improvements contemplated with this 
submittal. Review fees must be paid prior to termination.

The Maricopa County Environmental Services Department (MCESD) has reviewed 
documentation for the above referenced project.  This project is for a Major 
amendment to the existing Enclave at Anthem SUP to allow 4 additional units. (APNs 
203-04-479 and -480). The project will consist of 160 units on three levels totaling 
approximately 150,000 sq ft on the 6.4 acre parcel. According to previously submitted 
documents, water and wastewater services will be provided by EPCOR (formerly 
Arizona American Water Company). MCESD has no concerns.  
 
Based on the above, MCESD raised no objections to the Planning & Development 
Department in Accela Automation on February 23, 2022 and will allow the project to 
proceed at this time subject to the following stipulations:

Comments are provided only as advisory to Maricopa County Planning and 
Development Department to assist staff to prepare a staff report.  Other Maricopa

This e-mail serves as notification of an application we have received from Berry Riddell, LLC for a SUP

Major Amendment for Enclave at Anthem (10 additional senior living units and 20 additional covered
parking spaces).  Applicable documents for review are available on the Online Permit Manager at:
https://accela.maricopa.gov/CitizenAccessMCOSS/Default.aspx.  You can search for the case by using
the SUP Major Amendment case number Z2022027. 
 
A virtual TAC meeting has been scheduled for Tuesday, March 15, 2022 at 11:15 a.m.  If you would

Plan Review Requirements
All plans and specifications for new commercial construction, remodeling, and alterations or Operational Permits 
within the Daisy Mountain Fire District (DMFD) shall be submitted to the Department for review and approval 
prior to any construction or operations. The plans will be reviewed with the approval and recommendations 
forwarded to the County Planning and Development department. Plans shall comply with the 2012 I.F.C. with 
DMFD revisions.
Submittal information shall include, but is not limited to the following:
1.
A copy of the County Building Permit.
2.
One copy of the approved drawings including site plan, civils, architectural, structural, mechanical and electrical.
3.
Submittal of plans for the fire protection systems which require Engineering or N.I.C.E.T. approval.
4.
Water supply and fire flow requirements for the building and Fire Protection Systems required.
5.
Three drawings and one spec sheet submited. Electronic submittal may be acceptable depending on format.
6.
A single 8.5" x 11" drawing of each buildings fire escape plan showing occupant load, use of each room and exit routes.
7.
Show the location of the main fire alarm control panel, fire sprinkler riser room, F.D.C. and Knox lock box.
