KNOW ALL MEN BY THESE PRESENTS:
We, Dakota Creek LLC, an Arizona limited liability company, all successors and assigns,
hereinafter called the GRANTOR , for and in consideration of the dedication of property by
GRANTOR to serve the public good and other valuable consideration, receipt of which is hereby
acknowledged, do hereby convey to Maricopa County, a political subdivision of the State of
Arizona, the following real property situated in Maricopa County, Arizona:
SEE ATTACHED EXHIBIT "A" FOR LEGAL DESCRIPTION
Subject to current taxes and other assessments, reservations in patents and all easements, rights of
way, encumbrances, liens, covenants, restrictions, obligations and liabilities as may appear of
record, the GRANTOR warrants the title against all persons whomsoever. Further subject to the
agreements set forth on Exhibit “B” attached hereto.

Exhibit “B”
WHEREAS in consideration hereinafter set forth, it is agreed, that this instrument
contains the entire agreement between the Grantor and Maricopa County. No further
consideration is being paid than described in this contract.
THE GRANTEE AGREES:
A. To use the real property described in Exhibit "A" for the general welfare and benefit of
the public.
B. That, if in the opinion of the Transportation Director it becomes necessary, private
structures will be relocated in kind to the Grantor's property, clear of the property
described herein, at no expense to the County.
C. With respect to the development/redevelopment of the property prior to any roadway
construction, Grantor will be responsible only for the costs of improvements required by
the County or a municipality as part of a regulatory approval related to
development/redevelopment of the property.
THE GRANTOR AGREES:
1. To grant a Warranty Deed for the real property described in Exhibit "A" to the County of
Maricopa for the general welfare and benefit of the public.
2. That acceptance of this property in no way obligates Maricopa County to construct or
maintain a roadway within the Right of Way granted by this document.
3. To be responsible for maintenance of the dedicated right of way until such time if and
when a roadway is built, to minimum county standards, and the roadway is open and
declared into the Maricopa County Transportation System.
