9:30 AM on Wednesday, January 12, 2022, in the Supervisors' Auditorium 205 W. Jefferson
Phoenix, AZ 85003, with the following members present: Bill Gates, Chairman, District 3; Clint
Hickman, Vice Chairman, District 4 (remote); Jack Sellers, Supervisor, District 1; Thomas Galvin,

INVOCATION - INVOCACIÓN
Chairman Gates introduced Father Bob Fambrini from St. Francis Xavier Church and
School. He said Father Fambrini has also been very active with the Valley Interfaith
Project, which has been great partners with their services during the pandemic. Father
Fambrini offered the invocation.

Father Bob Fambrini led the assemblage in the Pledge of Allegiance to the flag.

PET SHOWCASE BY MARICOPA COUNTY ANIMAL CARE AND CONTROL -
PRESENTACIÓN DE ANIMALES DOMESTICOS POR EL DEPARTAMENTO DE
CONTROL Y CUIDADO DE ANIMALES
Chairman Gates introduced John Reynolds, Animal Care and Control, and Deacon. Mr.
Reynolds said Deacon came in as a stray and is very friendly. He is one and a half
years old and fully vaccinated, neutered, microchipped and is ready to be adopted at
no charge. A generous donor paid all of Deacon’s adoption fees. Please contact Animal
Care and Control at pets.maricopa.gov.
Chairman Gates asked if there were any announcements or corrections to the agenda.
The Clerk stated that agenda item #8 is being moved to the February 9, 2022 formal
meeting.

Site Location: Generally located 750 feet southeast of the southeast corner of 43rd Ave. and

Commission Recommendation: On 12/9/21, the Commission voted 8-0, to recommend
approval of Z2021073 subject to conditions ‘a’ – ‘g’:
a. Development of the site shall be in substantial conformance with the Narrative Report
entitled “M & J Group, LLC Phoenix, AZ”, consisting of seven pages, dated October 2021,
and stamped received October 18, 2021, except as modified by the following conditions.
b. A Plan of Development is approved subject to the site plan entitled “RV & Boat Storage
for M & J Group, LLC” consisting of three full-size sheets, dated October 15, 2021, and
stamped received October 18, 2021 and narrative report entitled “M & J Group, LLC Phoenix,
AZ”, consisting of seven pages, dated October 2021, and stamped received October 18,
2021. The Plan of Development may be amended administratively under separate
application subject to zoning ordinance regulations.
c. The following Planning Engineering conditions shall apply:
1. At the time of application for building permits, the design engineer must analyze the
north/south drainage between storage units to verify flow depths will be below the finished
floor elevations of the downhill units (0.5% away from buildings).
2. Retention basins must drain within 36 hours.

3. Based on the conceptual design nature of the information submitted, changes to the site
layout may be necessitated by the final engineering design of the site’s drainage
infrastructure.
4. Detailed Grading and Drainage (Site Development) Plans indicating that the site will drain
to the retention basin(s) must be submitted with the application for Building Permits.
5. Engineering review of planning and/or zoning cases is for conceptual design only. All
development and engineering design shall be in conformance with Section 1205 of the
Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain
Regulations for Maricopa County; MCDOT Roadway Design Manual; and current
engineering policies, standards and best practices at the time of application for construction.

d. The following C-3 CUPD standards shall apply:
1. The use of the site shall be restricted to the commercial storage of RVs, boats and related
materials.
2. There shall be a front yard of zero feet.
3. There shall be a west interior side yard of zero feet.
4. There shall be no required parking for the site, except for the required ADA accessible
parking for the site.
e. Prior to issuance of a building permit, written confirmation will be required from the
emergency fire protection jurisdiction having authority that the facility has been designed in
accordance with their regulations and requirements, and that emergency fire protection
service will be provided to the facility. Prior to issuance of the certificate of occupancy, local
fire protection jurisdiction review and approval will be required.
f. The property owner/s and their successors waive claim for diminution in value if the County
takes action to rescind approval due to noncompliance with conditions.
g. The granting of this change in use of the property has been at the request of the applicant,
with the consent of the landowner. The granting of this approval allows the property to enjoy
uses in excess of those permitted by the zoning existing on the date of application, subject
to conditions. In the event of the failure to comply with any condition, the property shall revert
to the zoning that existed on the date of application. It is, therefore, stipulated and agreed
that either revocation due to the failure to comply with any conditions, does not reduce any
rights that existed on the date of application to use, divide, sell or possess the property and
that there would be no diminution in value of the property from the value it held on the date
of application due to such revocation of the Zone Change. The Zone Change enhances the
value of the property above its value as of the date the Zone Change is granted and reverting
to the prior zoning results in the same value of the property as if the Zone Change had never

Commission Recommendation: On 12/9/21, the Commission voted 8-0, to recommend
approval of Z2021116 subject to conditions ‘a’ – ‘k’:
a. Development and use of the site shall comply with the site plan entitled “Imagination
Childcare” consisting of one (1) full-size sheet, dated March 24, 2021, and stamped received
September 28, 2021, except as modified by the following stipulations.
b. Development and use of the site shall be in substantial conformance with the narrative
report entitled “Little Ranch School DBA Imagination Childcare & Preschool” consisting of
five (5) pages and stamped received September 28, 2021 except as modified by the following
stipulations.
c. All trees shall be double-staked when installed.
d. The canopy shade structure must be painted to match the existing building.
e. The number of students attending the school shall not exceed 82.
f. The applicant or his successor shall obtain approval of any development plans from the
Office of the Arizona State Fire Marshal prior to any construction.
g. All transformers, back-flow prevention devices, utility boxes and all other utility related
ground equipment shall be painted to compliment the development and shall be screened
with landscape material where possible. All HVAC units shall be ground-mounted or
screened.
h. This Special Use Permit shall expire on January 12, 2042, or upon termination of the use
for a period of 90 days, whichever occurs first.
i. Major changes to this Special Use Permit shall be processed as a revised application in
the same manner as the original application, with final determination made by the Board of
Supervisors following recommendation by staff and the Planning and Zoning Commission.
Minor changes may be administratively approved by staff of the Planning and Development
Department. Major changes to the Special Use Permit may require a new Citizen
Participation Process as determined by the Planning and Development Department.
j. Non-compliance with the regulations administered by the Maricopa County Environmental
Services Department, Maricopa County Department of Transportation, Drainage Review
Division or the Maricopa County Flood Control District may be grounds for initiating a
revocation of this Special Use Permit as set forth in the Maricopa County Zoning Ordinance.
k. Noncompliance with the conditions of approval will be treated as a violation in accordance
with the Maricopa County Zoning Ordinance. Further, noncompliance of the conditions of
approval may be grounds for the Commission to take action in accordance with the Maricopa

Pursuant to A.R.S. § 48-261 and § 48-263, convene the scheduled public hearing on the
impact statement for the proposed Mesa Linda North Irrigation Water Delivery District.
The Board of Supervisors will hear those who appear for and against the proposed district
and shall determine whether the creation of the district will promote public health, comfort,
convenience, necessity, or welfare.

OFFICE OF THE COURTS EACCESS
Approve the eAccess Web Portal Memorandum of Understanding (MOU) between the
Constables of Maricopa County (“Government Agency”) and the Arizona Supreme Court,
Administrative Office of the Courts (AOC) that formalizes a relationship between the parties
concerning use of Local Government Agency Use of the Arizona Supreme Court eAccess
Web Portal. Government Agency’s eAccess Web Portal subscription will provide access to
certain Arizona superior court records for general civil and criminal cases filed on or after
July 1, 2010 at no cost. The AOC may offer access to additional case types in the future.
This is a non-financial agreement with no additional cost to be assessed to either party. The
agreement shall begin upon execution and shall remain in effect until such time as the parties

Approve the Scope of Work amendment and extend the term one year in the MOU between
New Life Center and the Maricopa County Attorney’s Office for the provision of Sexual
Assault training activities for members of the Multi-Disciplinary Team, law enforcement
personnel, prosecutors, hospital staff, and advocates. The training activities are funded by
the National Sexual Assault Kit Initiative grant awarded in FFY2018 and extended through
September 30, 2022.
The MOU outlines the expectations between MCAO and New Life Center in relation to the
training coordination, development of new training activities, evaluation of trainings

Approve the application and acceptance of grant funds from the Office of Justice Programs
(OJP), 2021 BJA FY 21 Prosecuting Cold Cases Using DNA, in the amount not-to-exceed
$535,000 for the purpose of increased cold case homicide investigations through overtime
for existing investigators and the hiring of an additional cold case analyst.
The grant award begins on October 1, 2021 (retroactively) and ends on September 30, 2024.

The Maricopa County Attorney’s Office (MCAO) indirect rate for FY22 is 20.3%. Total grant

This grant provides critical overtime funding for our homicide investigations team. The grant
also provides funding for a full-time cold case analyst to assist in cold case homicide
investigations. Devoting resources at this level will expedite and ultimately lead to the
identification of suspects and increase the number of homicides brought forward for
prosecution within Maricopa County. This grant award is competitively bid, and other eligible
agencies may or may not bid on this grant award. If awarded, the department will absorb the
costs of the grant award totaling $89,278.10.
Funding for this agreement is provided by a Grant from OJP. The overall grant budget will
be adjusted as necessary to accommodate this grant through a future reconciliation. Grant

AGREEMENT WITH THE DRUG ENFORCEMENT ADMINISTRATION (DEA) FOR
ORGANIZED CRIME DRUG ENFORCEMENT TASK FORCES (OCDETF) - FFY2022
Approve the Agreement and acceptance of grant funds to the Sheriff’s Office from the Drug
Enforcement Administration (DEA), Organized Crime Drug Enforcement Task Force
(OCDETF) Investigative/Strategic Initiative # MN-20-0001/SWAZ P0904 in the amount of
$485,556.94 for the award period beginning October 1, 2021 and terminating on September
30, 2022. This Agreement may be terminated by any of the parties by written notice to the
other parties ten (10) business days prior to termination.
The funding award is recurring and has been awarded to the Sheriff’s Office the past ten (10)
years. There is no match requirement. The Sheriff’s Office indirect cost rate for FY22 is
14.74%, applicable to the award amount of $485,556.94 less capital expenses of $84,318
for an indirect cost base of $401,238.94 and indirect costs of $59,142.62 which will be
absorbed by the General Fund. There are no future or ongoing contributions required after
the grant period ends; however, property (items) purchased with these funds must remain
available to the Strike Force/Strategic Initiative for the duration of its existence.
This is not a mandated function although it supports the MCSO public safety mandate and
provides a benefit to the citizens by disrupting the illicit drug trafficking organizations in
Maricopa County and the State of Arizona resulting in a more safe and secure community.
This is a non-competitive award. The Maricopa County Sheriff’s Office is one of several local
law enforcement agencies in the Phoenix metro area that participate in this effort. This is
reimbursement funding that will be used to purchase capital and non-capital equipment; to
lease and operate a vehicle; to secure subscription technical service; to pay monthly data
charges relating to several types of equipment; and to secure contracted analyst service.

Approve Supplement #1 to the Agreement with the Office of National Drug Control Policy
(ONDCP) Award Number G20SA0005A, for the High Intensity Drug Trafficking Area (HIDTA)
Program, retroactive to December 1, 2021. The amount of the supplement is $16,000,
increasing the amount from $652,796 to $668,796. The term of this funding is unchanged,
January 1, 2019 to December 31, 2021.
The Sheriff’s Office indirect cost rate for FY22 is 14.74%. Unrecoverable indirect costs have
been calculated as $2,358. The unrecoverable indirect cost of $2,358 will be covered by the
department General Fund.
This funding supports of the Sheriff’s public safety mandate through efforts to reduce illegal
drug use with the interruption of drug trafficking. The funding is recurring and has been
awarded to the Sheriff’s Office for over twelve years. There is no matching requirement and
there are no future or ongoing contributions required after the grant period ends. This is a
competitive award.

DISABILITIES EDUCATION ACT (IDEA) BASIC ENTITLEMENT
Approve acceptance of $264.29 from the Arizona Department of Education for a revised
amount of $33,952.17 in continued grant funding from the Arizona Department of Education,
for the FY2022 Individuals with Disabilities Education Act (IDEA) Basic Entitlement. The
original amount of $33,687.88 was approved by the Board of Supervisors on April 7, 2021
(C-50-21-151-X-00). This funding has been awarded the last eighteen (18) years and
provides contracted special education consulting services for staff training and IDEA
implementation along with a variety of contracted professional services for juvenile inmates.
The term of this funding is from July 1, 2021 through June 30, 2022.
The Sheriff’s Office indirect cost rate for FY2022 is 14.74%. Total indirect costs associated
with this award increase are estimated to be $38.96 of which zero ($0.00) is recoverable.

INTERGOVERNMENTAL SERVICE AGREEMENT WITH MADISON ELEMENTARY
SCHOOL DISTRICT #38, FEDERAL DIESEL EMISSIONS REDUCTION ACT (DERA)
STATE CLEAN DIESEL GRANT PROGRAM
Approve and authorize the Chairman to execute an Intergovernmental Service Agreement
(IGA) between the Maricopa County Air Quality Department (MCAQD) and Madison
Elementary School District #38 for MCAQD to provide up to $205,886 in federal DERA sub-
award funding to Madison Elementary School District #38 for the replacement of one diesel
powered school bus.
The Agreement is effective from October 1, 2021 to September 30, 2022. This agreement
will provide up to $205,886 in funds to support the State Clean Diesel Grant Program and
benefit air quality by replacing one legacy diesel bus. One 2005 model year Thomas Built
diesel school bus will be replaced with one 2021 zero emissions all electric bus. Matching
funds of 55% will be provided by Madison Elementary School District #38. The project term
is upon final agreement signature and expires September 30, 2022. An amount of up to
$205,886 from this award will be passed through to the sub awardee(s) for vehicle
replacement or retrofit during the state grant period from October 1, 2021 to September 30,
2022.

IGA AND REVISED MULTI-PARTY MOU FOR A CONTINUITY OF THE ECONOMY
PLAN
Approve Intergovernmental Agreement (IGA) to accompany the multi-party Memorandum of
Understanding (MOU) approved by the Board of Supervisors on December 8, 2021 and
approve the revised MOU.
The Office of Enterprise Technology (OET) has been asked to participate in a project
sponsored by the Center of Cyber and Technology Innovation at the Foundation for Defense
of Democracies to develop a Continuity of the Economy plan. The MOU approved on
December 8, 2021 allows OET to participate with Arizona Department of Administration,
Northern Arizona University, and Arizona State University.
The IGA associated with this MOU is between Maricopa County and the Arizona Board of
Regents for and on behalf of Arizona State University (ASU). The purpose of the IGA is to
provide a non-disclosure agreement for provision of certain confidential or proprietary

AMENDMENTS AND SUPPLEMENTS TO LEASE-PURCHASE AND TRUST
AGREEMENTS, AND FOR THE ISSUANCE OF CERTIFICATES OF PARTICIPATION
Adopt a Resolution authorizing the Lease and Lease-Purchase of certain real property and
the delivery and execution of amendments and supplements to lease-purchase and trust
agreements for the issuance of tax exempt securities, consisting of certificates of
participation (COPs), in an amount sufficient to finance not to exceed $142,500,000, plus
cost of issuance, to finance, or to reimburse the County for costs related to the construction,
acquisition and equipping of County capital projects scheduled for fiscal years 2020-21,

2021-22, 2022-23, and 2023-24. The COPs would finance capital projects for General Fund
and Special Revenue Fund departments. Exhibit A shows the proposed capital project
expenditures by anticipated fiscal year.
In accordance with A.R.S. §42-17106(B), authorize the following amendments to the fiscal
year 2022 Non-Departmental (D470) budget:
a) Decrease the revenue and expenditure appropriation authority in the Non Departmental
(D470) Non Departmental Grant Fund (249) Non Recurring Non Project (NRNP) budget by
$1,500,000.
b) Increase revenue appropriation in Non-Departmental (D470) County Improvement COPs
Series 2022 Fund (443) Non-Recurring (1001) not to exceed $144,000,000
c) Increase expenditure appropriation in Non-Departmental (D470) County Improvement
COPs Series 2022 Fund (443) Non-Recurring (1001) not to exceed $1,500,000.
On July 22, 2020, and June 23, 2021, the Board of Supervisors approved the Authorization
Resolutions and Declarations of Intent to Reimburse required for the issuance of tax exempt
securities (C-18-21-003-X-00 and C18-21-094-X-00) to reimburse prior expenditures related
to the construction, acquisition and equipping of County capital projects scheduled for fiscal
years 2020-21, 2021-22, 2022-23, and 2023-24. The maximum principal amount of the

COVID 19 VACCINE INCENTIVE EXTENSION
Extend the COVID 19 vaccine incentive that was approved by the Board on 9/1/2021 (C-31-
22-118-X-00) to 3/31/2022.
Employees must submit proof of being fully vaccinated to Human Resources by close of
business 4/6/2022. It is anticipated that the $100 incentive and hours for the day off will
appear on the 4/20/2022 paycheck. The hours for the day off must be used by 12/31/2022.
This incentive applies to the County’s elected offices, appointed departments, and the Flood
Control District of Maricopa County and the Maricopa County Library District (Special
Districts). The Board of Supervisors is authorized to jointly adopt policies applying to the
Special Districts under the Intergovernmental Agreement, C-06-18-393-6-00, approved on

EMERGENCY SHELTER SERVICES
Approve Amendment No. 8 to the Agreement between Native American Connections
(Subrecipient), a community based non-profit organization and Maricopa County (County)
administered by its Human Services Department. The purpose of the Agreement is to provide
emergency shelter services for individuals and families experiencing homelessness in
Maricopa County.
The purpose of the Amendment is to address the following items:
1. Extend the Agreement termination date retroactively from January 1, 2022 through June
30, 2022.
2. The County shall provide the Subrecipient with an additional not-to-exceed amount of
$221,784 in American Rescue Plan Act, Coronavirus State and Local Fiscal Recovery Funds
(CSLFRF) under CFDA number 21.027. Subrecipient shall continue to provide emergency
shelter services. The funding availability period shall begin retroactively on January 1, 2022
through June 30, 2022.
3. Revise Section 4 (Compensation) to address the Reimbursement process.
All other terms and conditions of the Agreement and previously approved Amendments not
amended by this Amendment No. 8 shall remain unchanged and in full force and effect as
executed by the Parties.

AMENDMENT TO THE AGREEMENT WITH COMMUNITY BRIDGES, INC. FOR
TEMPORARY HOMELESS SHELTER OPERATIONS
Approve financial Amendment No. 8 to the Agreement between Community Bridges, Inc.
(Subrecipient), a community-based organization and Maricopa County (County)
administered by its Human Services Department. The purpose of the Agreement is for the
operation of temporary emergency shelter services for homeless individuals experiencing
homelessness in Maricopa County in an effort to protect them from exposure to COVID-19.
The Subrecipient and the County shall be referred to as the “Parties.”
The purpose of the Amendment is to address the following:
1. Correct the funding referenced in Amendment 7. The Amendment incorrectly listed CFDA
No. 81.135. The correct CFDA No. is 21,027.

2. Extend the term of the Agreement retroactively from January 1, 2022 through June 30,
2022.
3. Add that the County shall increase funding by a not-to-exceed amount of $530,862.
Funding availability period shall begin retroactively on January 1, 2022 through June 30,
2022. The Agreement total shall be increased from $3,096,656 to a not-to-exceed amount
of $3,627,518. Funding for Amendment No. 8 is provided under CFDA number 21.027

Monthly invoices shall not exceed $88,477.

(“County”), administered by its Human Services Department, and Human Services Campus,
Inc., (“Subrecipient”). The County and the Subrecipient are referred to collectively as the
“Parties.”
The Parties agree to enter into this Amendment No. 14 to amend the Agreement as follows:
1. Extend the Agreement termination date retroactively from January 1, 2022 through June
30, 2022.

2.1 $472,784 for the Subrecipient to continue emergency weather relief services at the
Human Services Campus overflow shelter, identified in the attached Human Services

Maricopa County General Funds. The funding availability period is retroactively from January
1, 2022 through June 30, 2022.
2.2 $407,000 to continue Emergency Shelter Operations at a County Leased Travelodge
Motel located at 600 West Van Buren, Phoenix, Arizona 85003. The funding for the services
shall be provided by American Rescue Plan Act, Coronavirus State and Local Fiscal
Recovery Funds (CSLFRF) under the CFDA number of 21.027. The funding availability
period is retroactively from January 1, 2022 through June 30, 2022.
3. The County shall provide the Subrecipient with a total of $879,784 for Amendment No. 14
services.
All other terms and conditions of the Agreement and previously approved Amendments not
amended by this Amendment No. 14 shall remain unchanged and in full force and effect as
executed by the Parties.

Approve Amendment No. 1 to the Intergovernmental Agreement (“Agreement”) between the
City of Avondale (“City”) and Maricopa County (the “County”) administered by its Human
Services Department. The purpose of the Agreement is for the City to provide down payment,
closing costs, principal reduction, and other appropriate assistance to eligible first-time
homebuyers. The County and the City collectively are referred to as the “Parties.”
The purpose of the Amendment is to address the following:
A. Extend the Agreement termination date from September 30, 2024 through September 30,
2025.
B. Add two additional Work Statements:
i. Add an additional Work Statement hereinafter referred to as “2021 Work Statement A”,
attached and incorporated into the Agreement. The 2021 Work Statement A is for the City to
provide single family, owner-occupied housing rehabilitation assistance to qualified low-
income households. The County shall provide the City with $179,706 for the 2021 Work
Statement A activities. All work performed or costs incurred or expensed shall be
reimbursable through September 30, 2024.
ii. Add an additional Work Statement hereinafter referred to as “2021 Work Statement B”,
attached and incorporated into the Agreement. The 2021 Work Statement B is for the City to
provide down payment, closing costs, principal reduction, and other appropriate assistance
to eligible first-time homebuyers. The County shall provide the City with $31,590 for the Work
Statement B activities. All work performed or costs incurred or expensed shall be
reimbursable through September 30, 2025.

C. The increase amount for this Agreement is $211,296. The funding for Amendment No. 1
is provided by (Program Year 2021 (PY21)) HOME Investment Partnerships Program
(HOME) from the U.S. Department of Housing and Urban Development (HUD) funds, CFDA

D. The Agreement amount shall now be increased to a total not-to-exceed amount of
$417,666.

AMENDMENT TO LEASE AGREEMENT WITH SON RISE FAITH COMMUNITY
CENTER, INC.
Approve and execute Amendment No. 5 to Lease Agreement L-7457 with Son Rise Faith
Community Center, Inc., for the use of leased premises located at 800 West Galveston St,
Chandler AZ 85225 to provide Head Start Services.
The purpose of the amendment is to address the following:
(A) redefine premises; (B) modify and replace Exhibit “A”; (C) approve certain Lessee
improvements at a cost not to exceed $350,000; (D) extend Lease term for ten (10) years
from the Commencement Date of the Agreement; (E) provide an option to renew; (F) update
and replace termination language; (G) modify rental and utility rates for a monthly rate of
$6,080.25; and (H) allow for counterpart signatures.
The Agreement is subject to termination pursuant to the provisions of A.R.S. 38-511. After
five (5) years from the Commencement Date, either Lessor or Lessee may terminate the
Lease by giving no less than 12-month’s prior written notice of termination to the other Party.
All other terms and conditions remain the same.
Upon Lessee’s acceptance of the Tenant Improvements as complete, the parties will execute
the Memorandum of Commencement Date, in substantially the same format as the attached

Exhibit “C” (“Commencement Date”), and the monthly rental rate shall increase to five
thousand three hundred ninety-five dollars and 25/100 ($5,395.25) and the monthly utility
reimbursement rate shall increase to six hundred eight five ($685.00) dollars for the duration
of the Extension Period.
The monthly Lease amount shall remain at $990 and $407 for utility reimbursement until the
Memorandum of Commencement Date is fully executed.

THE CITY FOR SERVICES TO HOMELESS INDIVIDUALS
Approve Amendment No. 7 to the Competition Impracticable Contract (“Agreement”)
between Circle the City (“Contractor”) and Maricopa County administered by its Human
Services Department (“County”).
The purpose of the Amendment is to address the following:
1. Extend the Termination Date, retroactively from December 31, 2021 through June 30,
2022.
2. Revise Section 2.0 (Purpose), by addressing the following:
2.1 Continue to provide medical care and nursing care services (“Services”) to individuals
experiencing homelessness who are either COVID-19 positive or symptomatic (or both).
Contractor shall provide Services at the following locations:
2.1.1 Travelodge Phoenix Downtown located at 600 W. Van Buren Street, Phoenix, 85003
through December 21, 2021; and
2.1.2 Extend A Suites Hotel owned by North Black Canyon Hospitality, LLC (“Hotel”) located
at 8101 North Black Canyon Hwy Phoenix, 85021 from December 20, 2021 through June
30, 2022.
3. Revise Section 10.0 (Funding, Invoicing, and Payment) to address the following:
10.6 The County shall provide the Contractor with additional funding in the amount not to
exceed $1,367,000 to continue providing Services at the locations listed in Subparagraph
2.1. The funding availability period is from January 1, 2022 through June 30, 2022. Funding
is provided under CFDA number 21.027 American Rescue Plan Act, Coronavirus State and
Local Fiscal Recovery Funds (CSLFRF).
10.7 The Agreement amount shall now be increased to a total amount of $6,207,804.
10.8 The Contractor shall submit monthly invoices no later than the 15th calendar day of
each month.
10.9 The Contractor shall submit the December 2021 invoice no later than January 15, 2022.
10.10 The June 2022 invoice shall be submitted no later than July 15, 2022.
All other terms and conditions of the Agreement and previously approved Amendments not
amended by this Amendment No. 7 shall remain unchanged and in full force and effect as
executed by the Parties.
The Agreement shall become effective upon approval and signature by both Parties.

IGA WITH CITY OF CHANDLER FOR THE DELIVERY OF EMERGENCY RENTAL
ASSISTANCE ACTIVITIES
Approve a financial Intergovernmental Agreement (IGA) between City of Chandler (City) and
Maricopa County, administered by its Human Services Department (County or Subrecipient).
The purpose of this Agreement is for the City to provide the County with U.S. Department of
Treasury Emergency Rental Assistance, Catalog of Federal Domestic Assistance (CFDA)
21.023, for the provision of ERA 1.0 and ERA 2.0 rental and utility assistance services to
City of Chandler and its unincorporated areas residents that have been impacted by the
COVID pandemic.
The term of the Agreement shall begin on December 6, 2021 and end on June 30, 2024.
The City shall provide the County with the total funding of $13,150,000 ($6,850,000 ERA 1.0
and $6,300,000 ERA 2.0) for the provision of services. A maximum amount of $550,000 ERA
1.0 funds to be spent for administrative costs through June 30, 2022.

AFFILIATION AGREEMENT WITH THE BOARD OF TRUSTEES OF ILLINOIS STATE
UNIVERSITY FOR INTERNSHIP PROGRAM
Approve a non-financial Affiliation Agreement (Agreement) with The Board of Trustees of
Illinois State University (“School”) for Internship Student Placement and Maricopa County
(“Facility”) administered by the Human Services Department. Through this Agreement,
School Interns shall be provided with supervised practice educational experiences with the
Head Start program in the nutrition program activities.
The term of this Agreement shall be for a period of five (5) years from the effective date
(January 12, 2022 through January 12, 2027). The County may, at its option and with the
agreement of the School, renew the term of this Agreement for additional terms up to a
maximum of five (5) years.
Approval of this item will not impact the County General Fund.

Under this Intergovernmental Agreement, Queen Creek will act as the lead agency for all
aspects of the design of the project.
The project plan is to shift the Germann Road alignment to the north but still maintain the
current alignment of Sossaman Road. It will maintain the north-south connectivity that

Maricopa County Department of Transportation (MCDOT) project TT0600 Northern
Parkway: Agua Fria to 99th Ave.

MCDOT is the lead agency for the Northern Parkway program which includes City of El
Mirage, City of Peoria, and City of Glendale. This project will provide added capacity along
Northern Avenue as part of the improvements identified as necessary by the Northern
Parkway Executive Committee, and in coordination with the Maricopa Association of
Governments and the Arizona Department of Transportation. The project design will include
a six-lane roadway with raised medians, and a new bridge crossing New River for eastbound
traffic, south of the existing bridge. The existing New River bridge will remain and serve
westbound traffic. The contract includes the engineering services for final design of the
project in preparation for construction as well as post-design services during construction.

The Consultant shall be paid for work under this contract a Cost-Plus Fixed Fee Not to
Exceed amount of $2,863,721 for design, plus a not-to-exceed fee amount of $327,702 for
construction post design services in accordance with the contract Scope of Work.

SETTING OF HEARING FOR THE PROPOSED TERRELL TERRACE IRRIGATION
WATER DELIVERY DISTRICT IMPACT STATEMENT
1. Pursuant to A.R.S. § 48-261 and § 48-263, set a hearing date to receive the impact
statement for the proposed Terrell Terrace Irrigation Water Delivery District. The hearing
date is set for Wednesday, February 9, 2022 at 9:30 a.m., 205 W. Jefferson, Phoenix, AZ
85003.
2. Pursuant to A.R.S. § 48-261(C), approve a bond in the amount of $250 to be filed with
the Board by the persons proposing the district to cover cost incurred by the County.
The Clerk of the Board of Supervisors shall post a notice of the hearing in at least three
conspicuous public places in the area of the proposed district and shall publish a notice twice
in a daily newspaper at least ten days before the hearing. A notice of hearing will be sent to
each property owner within the proposed district boundaries.
At the hearing on February 9, 2022, the Board will hear those who appear for and against
the proposed district and shall determine whether the district will promote public health,
comfort, convenience, necessity, or welfare. If the Board of Supervisors determines that the
public health, comfort, convenience, necessity, or welfare will be promoted, it shall approve
the impact statement and authorize the persons proposing the district to circulate petitions
within the following proposed boundaries of the district:
The North half of the Southeast Quarter of the Southeast Quarter of Section 27, Township 2
North, Range 3 East, of the Gila and Salt River Base and Meridian, Maricopa County,
Arizona;
EXCEPT the West 166.09 feet of the South 330.23 feet of the North half of the Southeast
Quarter of the Southeast Quarter of said Section 27;
EXCEPT the East 498.30 feet of the South 330.27 feet of the North half of the Southeast

AQ-2019-003-RULE 370 (FEDERAL HAZARDOUS AIR POLLUTANT PROGRAM)
Set a public hearing, as required by Arizona Revised Statutes (A.R.S.) § 49-479(b), for
February 23, 2022, at 9:30 a.m. to solicit comments on the proposed revisions to Maricopa
County Air Pollution Control Regulation III - Rule 370 (Federal Hazardous Air Pollutant
Program). Following the public hearing, the Board is requested to adopt the proposed
revisions to the rule.

Rule 370 establishes performance standards for federally listed hazardous air pollutants.
Most of the performance standards in Rule 370 are National Emission Standards for
Hazardous Air Pollutants (NESHAP) which are promulgated by the U.S. Environmental
Protection Agency (EPA) and are incorporated by reference into Rule 370. Section 301.9 of
Rule 370 incorporates the asbestos NESHAP by reference and includes additional
requirements for demolition and renovation projects in Maricopa County.
The Maricopa County Air Quality Department is proposing to revise the local asbestos
provisions in Section 301.9 of Rule 370 to clarify the requirements for demolition and
renovation projects in Maricopa County and to remove requirements that are not protective
of public health. Additional revisions are also being proposed under Sections 100 and 200
of the rule. With these revisions, Maricopa County will improve and enhance the rule as it
pertains to the regulation of asbestos.

AQ-2021-003 - P-35 (FIREWORKS RESTRICTION ORDINANCE)
Set a public hearing, as required by Arizona Revised Statutes (A.R.S.) § 49-479(b), for
February 23, 2022, at 9:30 a.m. to solicit comments on proposed Ordinance P-35 (Fireworks
Restriction Ordinance). Following the public hearing, the Board is requested to adopt the
proposed ordinance.
Currently, Maricopa County does not have a regulation in place to regulate the sale and use
of fireworks in unincorporated areas of the county. The Maricopa County Air Quality
Department is proposing to create Ordinance P-35 (Fireworks Restriction Ordinance) to
regulate the sale and use of fireworks within unincorporated areas of the county following
the requirements and provisions in the Arizona Revised Statutes - A.R.S. §36-1601 to A.R.S

Chairman Gates asked the Clerk if there was anything to report regarding Public
Comment email responses. The Clerk said there were two comments regarding COVID
and one regarding item 91 and added all comments have been shared with the Board
offices.

Supervisors'/County Manager's summary of current events - Resumen de temas de

Chairman Gates wished Supervisor Hickman a happy birthday. Supervisor Hickman
said we all should look forward to celebrating each one. He stated that the public being
allowed back into the auditorium is something he looks forward to. Whether working
remotely or in person, County employees are still doing the job and we are wanting to
keep everyone safe. Supervisor Hickman said he is at home during this meeting
because his son has COVID, so he is affected. He stated he is pleased with the way
the County has responded to the pandemic.
Supervisor Galvin also wished Supervisor Hickman happy birthday. He stated that
COVID is still raging and is the most important issue in the County. He urged everyone

to get the vaccination and the booster. He addressed complaints of shutdowns stating
the goal is saving our health. County workers continue to go out and perform their jobs.
He said if you know elderly citizens, reach out and help them. We need to look out for
our neighbors. He noted this is the first week of the legislative session. He hopes they
look forward to issues on water, transportation, and education.
Supervisor Sellers wished Supervisor Hickman happy birthday. He said the focus
through the pandemic has been how can we get through this and get back to normal.
He has been out and about in District 1 and still sees how much work needs to be done.
He said Recorder Stephen Richer, Assessor Eddie Cook, and himself attended the
Chandler Chamber Meet the Elected Officials breakfast and other events around the
County. His message has been the same – to get past the pandemic and other issues
that have taken our eyes off the needs of being the fastest growing county in the nation.
Supervisor Gallardo wished Supervisor Hickman and David Galaviz a happy birthday.
He said the COVID issue continues to dominate the news and all of us. Schools are
struggling and we all must do our part in wearing masks and social distancing. He stated
we need leadership from Governor Ducey to do something about the COVID crisis.
Chairman Gates noted that this Board remains unified on the big issues. Maricopa
County is involved in many things that run concurrently. He stated the budget season
is upon us and all departments are participating in the process. He invited all to tune in
to discover how their tax dollars are being spent. He said that customer service and tax
relief are issues on the minds of those working through the process.

AMENDMENT TO AUTHORIZATION TO AWARD FOR SUN CITY DRAINS
IMPROVEMENT
Authorize the Director of the Flood Control District of Maricopa County (DISTRICT), through
the Maricopa County Office of Procurement Services, to award contract FCD 2021C015 for
the Sun City Drains Improvement – Grand Avenue, Del Webb to Agua Fria (Project
[#337.01.31]) to the lowest bidder, whose bid amount is 12.9% above the engineer’s
estimate, and who is responsible and responsive in meeting the contract requirements. The
original authorization for award of the contract requires that the award be to the lowest
responsible bidder if the bid is not more than ten percent (10%) over the engineer’s estimate.
The costs of construction components have increased recently and are leading to increased
costs.
This Construction Contract will remove and replace the existing trapezoidal gunite lining,
built in the 1960’s which is in distressed condition. It will be replaced with a twin fifty-four-
inch (54”) pipe system.
Project will reduce fall hazard by changing the open trapezoidal channel into a subterranean
piping system.
This channel is owned and maintained by the Flood Control District of Maricopa County
(FCDMC), and the project is 100% funded by FCDMC.

IGA WITH THE CITY OF PHOENIX FOR 51ST AVENUE AND DOBBINS ROAD
PROJECT
Approve Intergovernmental Agreement (IGA) FCD 2021A006 for the Design, Rights-of-Way
Acquisitions, and Utility Relocations for 51st Avenue and Dobbins Road Storm Drain Project
(PROJECT) between the City of Phoenix (CITY) and the Flood Control District of Maricopa
County (DISTRICT).
This Agreement shall become effective as of the date it has been executed by all PROJECT
PARTNERS and shall expire ten years from that date, or upon PROJECT completion,
whichever occurs first.
The Laveen watershed is bounded by the Salt River on north, South Mountain on the south,
on approximately the 7th Avenue alignment to the east, and Gila River Indian Community to
the west.
The PROJECT is bounded on the west by 59th Avenue, on the south by Sunrise Drive, on
the east by 47th Avenue and on the north by Dobbins Road. The PROJECT includes regional
basins, storm drains and inlets, lateral pipes and outfall pipes.

RESOLUTION FOR THE GILA BEND DRAINAGE IMPROVEMENTS PROJECT
Adopt Resolution FCD 2022R001 for the Gila Bend Drainage Improvements Project
(PROJECT), authorizing the Director of the Flood Control District of Maricopa County
(District) to include funds for PROJECT implementation in the District’s current and future
Five-Year Capital improvement Program; to advertise, select, negotiate, and award contracts
for PROJECT engineering and construction services, and to negotiate Intergovernmental
Agreements as appropriate.
The Gila Bend Drainage Improvement Project area is located within the Town of Gila Bend
approximately bounded by Scott Avenue Wash on the west, Bender Wash on the east and
from approximately Indian Road on the north to I-8 to the south. The proposed improvements
were identified in the Gila Bend Area Drainage Master Plan Update as being a necessary
component to control flooding in the area. Once implemented, this PROJECT will reduce
the flood hazard by constructing a series of levees, channels, basins and other drainage
improvements in the area. Estimated costs for this Project is $20,000,000.
