Maricopa County Animal Care and Control.

Supervisor Hickman asked the Clerk about corrections to the agenda. The Clerk said

Request: Zone Change from Rural-43 to C-1 CUPD with a Plan of Development (POD) for 
a new QT convenience store and gas station
Site Location:  Generally located at the SEC of Happy Valley Rd. & 115th Ave. in the Peoria 
area
Commission Recommendation: On 12/10/20, the Commission voted 8-0 to recommend 
approval of Z2019009 subject to conditions ‘a’ – ‘h’: 
a. Development of the site shall be in substantial conformance with the Site Plan entitled 
“QuikTrip Store #0424“, consisting of 7 full-size sheets, dated October 16, 2020, and 
stamped received November 18, 2020, except as modified by the following conditions.
b. Development of the site shall be in substantial conformance with the Narrative Report 
entitled “QuikTrip #0424”, consisting of 8 pages, dated November 12, 2020, and stamped 
received November 12, 2020 except as modified by the following conditions.
c. The following Planning Engineering conditions shall apply:
 
1. Drainage review of planning and/or zoning cases is for conceptual design only and does 
not represent final design approval nor shall it entitle applicants to future designs that are not 
in conformance with Section 1205 of the Maricopa County Zoning Ordinance and the 
Maricopa County Drainage Policies and Standards.
2. All development and engineering design shall be in conformance with Section 1205 of the 
Maricopa County Zoning Ordinance and current engineering policies, standards and best 
practices at the time of application for construction.
3. The entire site and adjacent half-streets’ runoff shall be retained onsite.  The 115th Avenue 
half-street runoff south of the southerly site entrance shall drain into the wash without 
retention.  Otherwise, the adjacent half-streets’ runoff shall be retained unless separately 
addressed by the City of Peoria.
4. Sufficient retention volume shall be provided onsite to retain the required 95% 100-year, 
2-hour runoff from all contributing areas.  Retention basins with stormwater depths exceeding 
one foot shall provide one foot of freeboard.
5. All retention basins shall drain within 36 hours per County requirements.
6. The developer shall provide an approval of the latest traffic study from the City of Peoria 
to the County as the site traffic accesses Happy Valley Pkwy Road, and impacts the Happy 
Valley Pkwy and 115th Avenue signalized intersection that is under City of Peoria jurisdiction.
7. The ultimate half-width improvements on 115th Avenue shall be constructed per County 
Standards, unless waived by MCDOT.
d. All abandonments shown on the site plan must occur prior to the issuance of construction 
permits.
e. The following C-1 CUPD Zoning District standards shall apply: 
1. Screening/Buffering – Drought-tolerant landscaping areas provided in lieu of site 
screening requirements

2. Landscaping – Landscaping areas shall comply with the approved site plan in lieu of 10’ 
landscaping “strips” and be landscaped with drought tolerant flora for aesthetics.

3. Sight Visibility Triangles - Modified sight visibility triangles required at 3 driveway locations 
per MCDOT design criteria.  Waiver of sight visibility triangle at the northwest corner of the 
site
4. Service Station Signs – May be freestanding, monument or pole type and may identify 
current price(s) of fuel sold, car wash service prices or any promotional material in 
connection with the service station use
5. Max. Height of Freestanding Sign – 20’
6. Max. Height of Freestanding Pole Sign – 25’
7. Max. Area/Size of Freestanding Pole Sign – 134 sq. ft.
f. Noncompliance with any Maricopa County Regulation shall be grounds for initiating a 
revocation of this Zone Change as set forth in the Maricopa County Zoning Ordinance. 
g. The property owner/s and their successors waive claim for diminution in value if the County 
takes action to rescind approval due to noncompliance with conditions. 
h. The granting of this change in use of the property has been at the request of the applicant, 
with the consent of the landowner.  The granting of this approval allows the property to enjoy 
uses in excess of those permitted by the zoning existing on the date of application, subject 
to conditions.  In the event of the failure to comply with any condition, and at the time of 
expiration of the Zone Change, the property shall revert to the zoning that existed on the 
date of application.  It is, therefore, stipulated and agreed that either revocation due to the 
failure to comply with any conditions, or the expiration of the Zone Change, does not reduce 
any rights that existed on the date of application to use, divide, sell or possess the property 
and that there would be no diminution in value of the property from the value it held on the 
date of application due to such revocation or expiration of the Special Use Permit.  The Zone 
Change enhances the value of the property above its value as of the date the Zone Change 
is granted and reverting to the prior zoning results in the same value of the property as if the

November 9, 2020, except as modified by the following conditions. Within 30-days of 
approval, a revised site plan shall be submitted to staff showing the additional screening 
(wall) requirements. 
b. Development of the site shall be in substantial conformance with the Narrative Report 
entitled “Cazarez Small Event Venue”, consisting of 4 pages, dated stamped received 
November 9, 2020 except as modified by the following conditions.
c. The following Engineering conditions shall apply:
1. All landscaping and construction within right-of-way shall conform to MCDOT design 
standards.
2. Drainage review of planning and/or zoning cases is for conceptual design only and does

of use. There shall be a status report submitted at the 1-year anniversary of this SUP and 
every year following that details how the SUP conditions of approval are being met including 
the tracking of special event dates and attendance.
e. The following SUP requirements shall apply: 
1. Limited to 30 events per year, maximum of 150 guests per event 
2. Operation hours shall be from 10:00 a.m. to 10:00 p.m. (open to the public) on event days
3. Parking lot lighting and related venue lighting shall be shut off by 10:00 p.m. and meet 
Maricopa County Zoning Ordinance requirements.
4. There shall be no amplified music or speakers allowed
5. Pavement for parking spaces and internal driveways shall be used
6. Pioneer St. shall be improved with chip seal in front of the property extending west to 
169th Ave. and north to Lower Buckeye Rd. Otherwise, a dust control plan acceptable to the 
Maricopa County Air Quality Department shall be allowed
7. A minimum 6’ (h) solid wall shall be constructed along the west, east, and north property 
lines. 
f. This Special Use Permit approval does not grant any entitlement to buildings, structures 
or fencing that encroaches onto adjacent properties, easements or rights-of-way.
g. Noncompliance with any Maricopa County Regulation shall be grounds for initiating a 
revocation of this Special Use Permit as set forth in the Maricopa County Zoning Ordinance. 
h. The property owner/s and their successors waive claim for diminution in value if the County 
takes action to rescind approval due to noncompliance with conditions.

Regulations for Maricopa County; MCDOT Roadway Design Manual; and current 
engineering policies, standards and best practices at the time of application for construction.
4.  Engineering review of planning and/or zoning cases is for conceptual design only and 
does not represent final design approval nor shall it entitle applicants to future designs that 
are not in conformance with Section 1205 of the Maricopa County Zoning Ordinance and 
Drainage Policies and Standards; Floodplain Regulations for Maricopa County; and the 
MCDOT Roadway Design Manual.
5. Detailed Grading and Drainage Plans and Final Drainage Report showing the new site 
improvements must be submitted for approval and acquisition of building permits.
d. The following Maricopa County Environmental Services Department (MCESD) conditions 
shall apply: 
1. The proposed project is located within the unincorporated urbanized area regulated by the 
Maricopa County Stormwater Quality Program and may need a stormwater approval and 
permit (SWPPP) prior to any construction permit been granted.  For further information, go 
to www.maricopa.gov/stormwater.
2. The applicant must obtain NOID prior to construction permit approval.
e. The following C-2 CUPD zoning district standards shall apply: 
1. Front (south) setback: 3 ft. 
2. Sight Visibility Triangles: 5 ft. x 5 ft.
f. The zone change CUPD overlay is applied to restrict the use of the site. Until such time as 
the site is served by sewer, uses on the site shall only be those acceptable to the Maricopa 
County Environmental Services Department (MCESD) that can be accommodated by septic 
systems. A public water system and public sewer system shall be required prior to 
establishment of any non-residential use that requires potable water.
g. Noncompliance with any Maricopa County Regulation shall be grounds for initiating a 
revocation of this Zone Change as set forth in the Maricopa County Zoning Ordinance. 
h. The property owner/s and their successors waive claim for diminution in value if the County 
takes action to rescind approval due to noncompliance with conditions. 
i. The granting of this change in use of the property has been at the request of the applicant, 
with the consent of the landowner.  The granting of this approval allows the property to enjoy

a. Development of the site shall be in substantial conformance with the Site Plan entitled 
“18503 W Van Buren Street”, consisting of 1 full-size sheet, dated stamped received 
November 5, 2020, except as modified by the following conditions. 
b. Development of the site shall be in substantial conformance with the Narrative Report 
entitled “18503 W Van Buren Street”, consisting of 4 pages, dated stamped received 
September 30, 2020 except as modified by the following conditions.
c. The following Engineering conditions shall apply:
1. Prior to the issuance of building permits, the Drainage Report will need to provide the 
retention basin drain down calculations.
2. Prior to the issuance of building permits, the new building will need to be elevated to be at 
or above the Flood Control District Pending Zone AE Floodplain. The grading and elevation 
of the building will need to be updated for the Building Permit.
3. Any changes, including internal improvements, to the buildings or site disturbance will 
require a floodplain use permit from the District.
4. When building alterations reach the 50% substantial improvement threshold, the entire 
structure must be brought into compliance with the Floodplain Use Regulations (i.e. FFE at 
or above the regulatory flood elevation or the (non-residential) structure must be flood 
proofed).
5. Van Buren Street is a MCDOT maintained roadway classified as a principal arterial 
roadway. The MCDOT Right-of-Way (R/W) requirement for an arterial roadway is 65 feet 
(half-width). Dedication of an additional 25 feet of R/W (40 feet existing) will be required 
unless otherwise waived by MCDOT.

The ROW dedication must be completed before the Building Permit approval.
6. The driveways along Van Buren Street must be paved for the full width/length within the 
right-of-way. Driveways that access multiple properties, such as the easement along the 
west property line, must have a minimum width of 24-ft.
7. The new driveways must connect in front of the block wall. A WB50 size truck must be 
able to turn around using both driveways with the gates closed and without backing into the 
MCDOT R/W.
d. The following Environmental Services condition shall apply:
1. Minor plan review for septic system – Notice of Intent to Discharge (NOID) must be 
submitted and approved. 
e. This Special Use Permit shall expire on January 13, 2031, or upon termination of the use 
for a period of 120 or more days, whichever occurs first. All site improvements associated 
with the special use permit shall be removed within 120 days of such expiration or termination 
of use.  
f. The following SUP development standards and requirements shall apply: 
1. Screening Transparency: 55%
2. Setbacks: 30’ front (west)
3. Site Visibility Triangle (SVT): waive requirement for SVT west of ingress/egress easement
g. Noncompliance with any Maricopa County Regulation shall be grounds for initiating a 
revocation of this Special Use Permit as set forth in the Maricopa County Zoning Ordinance. 
h. The property owner/s and their successors waive claim for diminution in value if the County 
takes action to rescind approval due to noncompliance with conditions.

EAGLE MOUNTAIN BOARDING STABLE

Request: Renewal of an expired Special Use Permit (SUP) for an equestrian boarding 
operation in the Rural-43 zoning district
Site Location:  Northwest corner of Dean Rd. & Narramore Rd. in the Rainbow Valley area
Commission Recommendation:  On 12/10/20, the Commission voted 8-0 to recommend 
approval of Z2020059 subject to conditions ‘a’ – ‘n’: 
a. Development and use of the site shall be in general conformance with the site plan entitled 
"Z2020059 - Eagle Mountain Boarding Stables”, consisting of one (1) full size sheet, dated 
September 25, 2020, and stamped received September 25, 2020, except as modified by the 
following conditions. 
 
b. Development and use of the site shall be in substantial conformance with the narrative 
report entitled “Eagle Mountain Boarding Stables”, consisting of ten (10) pages, dated August 
31, 2020, and stamped received September 25, 2020, except as modified by the following 
conditions.
c. The maximum number of horses kept on site an any given time shall not exceed 62.
d. A Temporary Use Permit shall be obtained prior to any events as identified under MCZO 
Article 1302.2.2.
e. On-site advertising shall be limited to a single four (4) foot by eight (8) foot freestanding 
sign.  Said sign shall not encroach into any required sight visibility triangle.  Advertising for 
any special events may only be allowed as permitted by an approved Temporary Use Permit.
f. Animal waste shall be removed two (2) times a week.
g. A fly control system shall be installed and properly maintained.
h. Development and use of the site shall comply with requirements for fire hydrant placement 
and other fire protection measures as deemed necessary by the applicable fire department. 
The applicant shall seek review and comment from the applicable fire protection agency, and 
within 90 days of approval of this Special Use Permit request by the Board of Supervisors 
shall provide written confirmation to the Planning and Development Department that the site 
has been developed in accordance with their requirements.
i. Within 90 days of approval of this Special Use Permit request by the Board of Supervisors, 
the applicant shall establish emergency fire protection services, covering all real property

ADMS. Deviations from the ADMS must be documented, and an engineering analysis 
provided that shows the deviations do not increase downstream flood peaks, volumes or

e. The following Maricopa County Department of Transportation conditions shall apply: 
1. For any equipment (conduit F/O, etc.) or work that will be extended to, or within the

systems. A public water system and public sewer system shall be required prior to 
establishment of any non-residential use that requires potable water.
h. Phoenix-Mesa Gateway Airport Authority condition shall apply:
1. Any proposed permanent, or temporary, structure is subject to an FAA filing for review in 
conformance with CFR Title 14 Part 77 (Form 7460) to determine any effect to navigable 
airspace and air navigation facilities. If an FAA filing is requested, an FAA determination 
notice of no hazard to air navigation shall be provided.
i. The applicant/property owner shall submit a ‘will serve’ letter for fire protection services for 
the project site. A copy of the ‘will serve’ letter shall be required as part of the initial 
construction permit submittal.

j. Noncompliance with any Maricopa County Regulation shall be grounds for initiating a 
revocation of this Zone Change as set forth in the Maricopa County Zoning Ordinance. 
k. The property owner/s and their successors waive claim for diminution in value if the County 
takes action to rescind approval due to noncompliance with conditions.
l. The granting of this change in use of the property has been at the request of the applicant, 
with the consent of the landowner.  The granting of this approval allows the property to enjoy 
uses in excess of those permitted by the zoning existing on the date of application, subject 
to conditions.  In the event of the failure to comply with any condition, the property shall revert 
to the zoning that existed on the date of application.  It is, therefore, stipulated and agreed 
that either revocation due to the failure to comply with any conditions, does not reduce any

Approve the application for and acceptance of the Title I - Delinquent – LEA from the Arizona 
Department of Education in the amount of $98,405.64.  The purpose of this grant is to provide 
prevention and intervention programs for children and youth who are neglected, delinquent, 
or at-risk.  The Grant period is from July 1, 2020 to June 30, 2021.
MCESA’s indirect rate for 2021 is 20.5%. MCESA's approved indirect cost rate for this grant 
is 0.%. The estimated unallowable indirect costs are $20,173,16. Grant revenues are not 
local revenues for the purpose of the constitutional expenditure limitation, and therefore, 
expenditures of these revenues are not prohibited by the budget law.  This action does not 
alter the budget constraining the expenditures of local revenues duly adopted by the Board 
pursuant to A.R.S. §42-17105. 
The grant award is reoccurring. The department has no in-kind match requirement during 
the grant award period. The grant award does not require ongoing cash contributions. The 
grant award is for a mandated function as it goes to the jail school education for 16 to 18 
year old's already in county jail. This award is non-competitive and the grant award is a 
federal entitlement grant award. If awarded, there are no dollars that will need to be absorbed 
by the department operating budget. This award is in addition to the current budget provided.

APPLY AND ACCEPT THE ELEMENTARY AND SECONDARY SCHOOL EMERGENCY 
RELIEF (ESSER) GRANT
Approve the application for and acceptance of $50,000 for the Elementary and Secondary 
School Emergency Relief (ESSER) Fund. The Elementary and Secondary School 
Emergency Relief (ESSER) Fund is authorized under Section 18003 of the Education 
Stabilization Fund per the CARES Act to aid LEAs to prevent, prepare for and respond to 
the coronavirus (COVID-19). Funds for this program have been allocated per Section 
18003(c) to local educational agencies (LEAs) in the State in Proportion to the amount of 
funds such local educational agencies received under Title I-A in the most recent fiscal Year 
(FY20). Funds for this program have also been allocated per Section 18003(e) to LEAs in 
the State that did not Receive funds under Title I-A in the most recent fiscal year (FY20). 
The term of this grant March 13, 2020 to September 30, 2022. 
Authorize the Chairman to sign all documents related to these grant funds, as applicable. 
The grant award is a formula grant CFDA 84.425D. The cash or in-kind match is not 
applicable. MCSS’s indirect rate for FY 2021 is 20.5 percent. The indirect cost rate allowed

by this grant source is .67 percent. Total indirect costs on this award are $332.77. Ongoing 
cash contributions not applicable. MCSS serves as the fiscal agent for the jail education

that will need to be absorbed by the department’s operating budget.

Approve a five-year non-financial, Data Sharing Memorandum of Understanding (“MOU”) 
with Flock Group and Maricopa County.   This MOU allows MCSO access to data captured 
on FLOCK security cameras.  Flock cameras are used in certain municipalities that contract 
for MCSO Law Enforcement Service and potentially in other communities and locations 
where MCSO is the Law Enforcement provider.  Flock may terminate for convenience with 
a 30-day written notice and the County can terminate for convenience with a 90-day notice.

$272,470.77, including estimated tax, beginning July 5, 2021. Edmentum “Plato 
Courseware” has been used in the jails for juvenile education/GED adult basic education for 
several years.  This courseware fosters academic achievement throughout the K-12, higher 
education, and adult education.  Edmentum has the right to sell, distribute, and market Plato 
Courseware and, with limited exceptions, is the sole source and sole provider of Plato

IGA WITH CITY OF BUCKEYE PD DETENTION TRAINING ACADEMY
Approve an Intergovernmental Agreement between City of Buckeye by and through the City 
of Buckeye Police Department (Buckeye PD) and Maricopa County by and through the 
Sheriff's Office (MCSO) for Buckeye PD Detention Officer recruits to attend MCSO Detention 
Academy for a cost of $250 per academy registrant.    This IGA is effective November 1, 
2020 through October 31, 2022 and when signed by the parties.   Following the initial term, 
it will automatically renew for up to two, one-year terms unless canceled or terminated.
This Agreement can be amended by mutual written consent by authorized parties and can

ANNUAL RENEWAL OF DEEP UNDERCOVER VEHICLE REGISTRATIONS CY 21
Approve renewal of deep undercover registrations and exemptions from markings which 
includes non-government license plates, per A.R.S. 38-538-03, for Sheriff’s RICO vehicles 
that are used for conducting investigations into major felony crimes, narcotics operations, 
and organized crime activity throughout Maricopa County. 
The Sheriff’s Office maintains a fleet of RICO deep undercover vehicles that are approved 
by the Board on a case by case basis as one-time additions to fleet with exemptions from 
markings and non-governmental plate registrations. 
Annual approval by the Board is required per A.R.S. 35-538-03 in order to renew these 
undercover vehicle registrations.   A confidential list will be provided the Clerk of the Board 
in a sealed envelope to be opened only in the presence of a designated Sheriff’s Deputy,

ACCEPTANCE OF ENTITLEMENT FUNDS FROM ARIZONA DEPARTMENT OF 
EDUCATION FOR THE 2021 COUNTY JAILS EDUCATION PROGRAM
Approve acceptance of $59,310.44 in continued funding from the Arizona Department of 
Education, 2021 County Jails Education Program for the Maricopa County Sheriff’s Office 
Jail Education Program.
This funding is recurring and has been awarded to the department for at least twenty years. 
A cash or in-kind match is not applicable. There is no future or ongoing contribution required 
following termination of the grant period. The Sheriff’s indirect cost rate is 14.6% for a total 
of $8,659.32 of which zero is recoverable. This funding is for a mandated function and 
provides supplies and services used for the Sheriff’s Office Jail Education Program that is 
mandated for all prisoners who are under the age of 18 and prisoners with disabilities who 
are under the age of 21 or younger who are confined in the County jail. The funding is 
legislated, formulaic and is non-competitive.

FUNDING FROM THE ARIZONA GAME AND FISH COMMISSION – FOR LAW 
ENFORCEMENT BOATING SAFETY FUND FY20
Accept $2,639 in additional funding from the State of Arizona Game and Fish Commission 
for Boating Law Enforcement and Safety increasing the funding amount to $407,639. The 
BOS approved an action on June 26, 2019 accepting $405,000 in funding for this program. 
This funding will be used to pay for personnel costs, purchase equipment, 
maintenance/repair and/or replacement of watercraft patrol boat(s) to continue effectively 
patrolling the waterways in Maricopa County.

The Sheriff’s indirect cost rate for FY21 is 14.6%.  These funds are the result of A.R.S. § 5-
383 and indirect cost recovery is not allowed.  Thus, the unrecoverable indirect cost impact 
of this funding is ($385.29). This funding in reoccurring, non-competitive, with no match 
requirement.  There are no future or ongoing contributions required when the funding period 
ends.  This funding supports Sheriff’s Office public safety mandate which encompasses 
patrolling waterways in Maricopa County.

These non-cash donations were designated for the MASH (Maricopa County Sheriff’s Office

Approve and authorize the Chairman to execute an Intergovernmental Services Agreement 
(IGA) between the Maricopa County Air Quality Department (MCAQD) and the Avondale 
Elementary School District #44 for MCAQD to provide up to $40,000 in federal DERA sub-
award funding to Avondale Elementary School District #44 for the replacement of one diesel 
powered school bus.
This Agreement will provide up to $40,000 in funds to support the State Clean Diesel Grant 
Program and benefit air quality by replacing one 2008 model year diesel school bus with one 
2021 ultra-low sulfur diesel school bus.  Matching funds of 75% will be provided by Avondale 
Elementary School District #44.

DESIGNEE FOR EXPENDITURE LIMITATION REPORT
Approve Cynthia Goelz, Chief Financial Officer, as the designated individual to submit and 
certify the accuracy of the expenditure limitation report (ELR) as annually prepared by the 
Department of Finance for the Auditor General.
Pursuant to Arizona Revised Statutes §41-1279.07(E), each political subdivision shall 
provide to the Auditor General by July 31 each year the name of the chief fiscal officer 
designated by the governing board of the political subdivision to submit the current fiscal 
year's expenditure limitation report. The political subdivision shall notify the auditor general 
of any changes of individuals designated to file the required reports. The designated chief 
fiscal officer shall certify to the accuracy of the annual expenditure limitation.

Approve an Administrative Correction to the address the name of the Intergovernmental 
Agreement (Agreement) between Maricopa County (County) and Scottsdale Unified School 
District (District). 
On November 18, 2020, the Board of Supervisors approved the Agreement with the 
Scottsdale Unified School District, however, the title of the Agreement was incorrectly 
referenced as IGA G-30220 WITH SCOTTSDALE UNIFIED SCHOOL DISTRICT. 
Approving the Administrative Correction will recognize the Agreement as IGA G-30219 WITH

RECEIPT OF FUNDS FROM ARIZONA DEPARTMENT OF EDUCATION FOR THE 
CHILD AND ADULT CARE FOOD PROGRAM
Approve the acceptance of funds from the Arizona Department of Education (ADE) Child 
and Adult Care Food Program (CACFP). CACFP funds are provided to Maricopa County 
and administered by the Human Services Department Early Education Division, Maricopa 
County Head Start Program. The Head Start Program submitted a funding application to 
ADE for $458,400 for the period of October 1, 2020 through September 30, 2021. ADE 
provided electronic notification on November 23, 2020, that the Head Start application was 
approved.
CACFP funds are reimbursement for meals that are provided to Head Start program 
participants. The County contracts with Mesa Unified School District (C-22-20-008-3-00) and 
Scottsdale Unified School District (C-22-20-009-3-00) to provide Food Catered Meals and 
snacks that meet 1/3 to 2/3 of the daily nutritional needs of the program participants.
Also request authorization for the Human Services Department Director to sign all 
documents related to acceptance of funds and any additional awards issued subsequently 
up to the estimated funding amount, as noted in the Permanent Agreement with ADE fully 
executed in October 26, 2013 (C-22-14-027-G-00) and amended on February 12, 2020 (C-
22-14-027-G-07). CACFP funds may be increased throughout the budget year as additional 
funds are made available to cover unanticipated food costs. If the Head Start program is

TERMINATE LEASE AGREEMENT L-7493
Agree to and approve the termination of lease L-7493 (Agreement) between Maricopa 
County and The New Foundation, an Arizona non-profit corporation, Lessor, for 
approximately 9,000 rentable square feet. This site was secured for the purpose of temporary 
emergency shelter for the homeless and associated activities to support this use/service at 
1200 North 77th Street, Scottsdale, AZ  85257. Pursuant to Section 12.3 of the Agreement, 
The New Foundation provided County with a minimum of thirty (30) days’ prior written notice 
to terminate the lease effective December 18, 2020. The Agreement was otherwise 
scheduled to expire January 7, 2021. The facility is no longer needed for its intended purpose

AMENDMENT TO IGA WITH ARIZONA DEPARTMENT OF HEALTH SERVICES FOR 
STD CONTROL SERVICES
Approve an Amendment to Intergovernmental Agreement (IGA) Contract No. CTR040486 
between Arizona Department of Health Services (ADHS) and Maricopa County by and 
through its Department of Public Health to provide continued funding for the Sexually 
Transmitted Diseases (STD) Services Program.   The amendment is in the amount of 
$582,327 for the budget period January 1, 2021 through December 31, 2021.  The term of 
the Contract is January 1, 2019 through December 31, 2023.
The STD grant award is reoccurring and non-competitive and has been awarded to the 
Department for several years. There is no cash or in-kind match required and indirect cost 
is fully recoverable. Should this grant be discontinued, ongoing cash contributions may be 
required as this is a mandated function. At this time, there are no costs to be absorbed by 
the department’s operating budget. 
The Department of Public Health indirect rate for FY21 is 18.8%.  Indirect costs are estimated 
at $92,153 and are fully recoverable.
Grant revenues are not local revenues for the purpose of the constitutional expenditure 
limitation, and therefore expenditure of the revenues is not prohibited by the budget law. This 
Amendment does not alter the budget constraining expenditures of local revenues duly 
adopted by the Board pursuant to A.R.S. 42-17105. The overall grant budget will be adjusted 
as necessary to accommodate this grant through a future reconciliation. (C-86-19-027-3-04)

Approve amendment 2 to the Sole Source (SS) Contract between The Arizona Partnership 
for Immunization (TAPI) and Maricopa County by and through its Department of Public 
Health (MCDPH). The program coordinates public health clinics so that Maricopa County 
can be compensated for immunizations administered to clients with current health insurance. 
This amendment is amended to add COVID-19 vaccination billing to the Scope and is 
anticipated to generate revenue in the amount of $2,800,000 for budget period January 1, 
2021 through December 31, 2021.  The term of the contract is January 1, 2019 to December 
31, 2023.  Fund (265) has been appropriated in FY21. 
Budget for indirect rate for Fee Funds for FY21 is 15.5%.  The full indirect costs are estimated

The appropriation adjustment is related to the Intergovernmental Agreement (IGA) 
Agreement No. IGA2021-073, COVID-19 Case Investigations & Contact Tracing between 
Arizona Department of Health Services (ADHS) and Maricopa County by and through its

response.
The total amount of the IGA price sheet is $8,400,117 and was approved as C-86-21-100-x-
00 on 12/9/2020.

CONTRACT FOR COMMUNITY HEALTH NEEDS ASSESSMENT WITH BANNER 
HEALTH
Approve a Contract for Services between Banner Health and Maricopa County by and 
through its Department of Public Health (MCDPH) to participate in a Community Health 
Needs Assessment (CHNA). Banner Health shall pay the County for the services described, 
in the amount of $60,000 for year one, and $62,000 for year two. The total not-to-exceed 
amount for the term of the contract is $122,000.  The two-year term of this Contract is from 
January 1, 2021 through December 31, 2022. The Contract may be extended for one (1) 
additional term, not to exceed a total extended term of four (4) years.
The Department of Public Health’s FY20 indirect rate is 15.5%, indirect costs are estimated

Approve and execute Lease Agreement, L-7488, with City of Mesa for use of ninety-one (91) 
parking spaces located at 240 North Pasadena Street (Centennial Way Surface Parking Lot), 
Mesa, Arizona (APN: 138-61-093).  The Term of this agreement shall commence 
retroactively as of September 1, 2020 and be effective for a period of ten (10) years, expiring 
August 31, 2030.  Consideration for the leased premises which consists of 44 covered and 
47 uncovered parking spaces shall be $3,132.00 per month plus rental taxes.  The 
agreement may be extended for up to three (3) renewal terms for a maximum of five (5) 
years each on the same terms and conditions as in effect immediately prior to the then-
current expiration except the rental fee which shall be re-negotiated at the time of renewal.

AGREEMENT AND EXECUTION OF ASSOCIATED DOCUMENTS
Lease Number MC-2020-001 (C-78-21-013-X-00) was inadvertently processed through the 
Board as a Real Estate Department Consent Agenda Item on October 7, 2020.  Said Lease 
is hereby being resubmitted to the Board for ratification as a Department of Transportation 
Agenda Item.  In addition, subsequent to the execution of the Lease, Western Refining 
Wholesale, LLC (Lessee) has agreed to sell Flyers Energy LLC all unmanned fueling center 
sites, and has requested the County’s consent to an assignment of the Lease, effective as 
of the date of sale.  Please approve the ratification of the Lease, as well as approve and 
execute a Memorandum of Lease and an Assignment of Lease to Flyers Energy LLC.
 
The Lessee and Maricopa County originally entered into an unrecorded Lease Agreement 
on October 1, 2004 for occupancy of a portion of the property located at 11320 East Germann 
Road, Chandler, AZ, also identified as Maricopa County Assessor Parcel Number 303-28-
017D.  The original Agreement was for a term of five years with options to renew two 
additional five years.  The Lessee exercised both options and on September 19, 2019, was 
granted the right to continue to occupy the property in a hold-over status until a new 
agreement could be executed.  Lease Number MC-2020-001 memorializes the terms and 
conditions under which the Lessee may continue to occupy the property in exchange for 
continued monthly rent payments.
The Memorandum of Lease describes the basic terms of the Lease and upon recordation,

IGA WITH THE CITY OF MESA FOR RIGHT-OF-WAY ASSISTANCE FOR SIGNAL 
BUTTE ROAD FROM WILLIAMS FIELD ROAD TO PECOS ROAD
Approve the Intergovernmental Agreement between Maricopa County (County) and the City 
of Mesa (City) for assistance in acquiring right-of-way and related easements within County’s 
jurisdiction; authorize the County’s Legal Representative to perform all acts in the manner 
required by law to condemn property necessary for the City’s project.
The purpose of this Intergovernmental Agreement is to identify and define the respective 
roles and responsibilities of the County and the City for the project, including rights-of-way 
acquisition and annexation of the project and project area.
The City is currently developing a project to improve Signal Butte Road, from Williams Field 
Road to Pecos Road (Project). The City is currently seeking Real Estate Support from the 
County to acquire right-of-way and related easements within the County’s jurisdiction related 
to the City’s project. Arizona State Statue §§ 9-241 prohibits Cities and Towns from acquiring 
right-of-way within the jurisdictional boundaries of the County. The City will reimburse the 
County for all costs associated with the right-of-way acquisition. When completed, the City’s 
project will consist of two travel lanes and align with the Arizona Department of 
Transportation‘s future improvements for State Route 24.
The terms of the agreement are in effect as of Board of Supervisors approval and shall 
remain in full force and effect until all stipulations have been satisfied, except that it may be

As stated in the Resolution, a 31,964 square foot (0.734 acre) portion of 401-87-001T 
(Property), which is improved as part of the MCDOT Southwest Maintenance Yard, was 
inadvertently sold by the County in 2017.  Within the Resolution cited above, the Board 
approved the purchase of the 31,964 square feet (SF) of land in fee simple estate together 
with an Access Easement over an additional 3,768 SF (0.087 acre) portion of the Property 
to provide access for maintenance of the County’s wall.  
The fully executed Special Warranty Deed and Access Easement will be recorded to provide 
record notice of the purchase.

INSTITUTE OF AUTOMATED MOBILITY (IAM) BOARD MEMBERSHIP
Approve request for the Maricopa County Department of Transportation (MCDOT) to 
participate in the Governor’s Institute of Automated Mobility (IAM), authorize the MCDOT 
Director to sign the Membership Agreement and pay annual dues of $15,000 per calendar 
year. 
Funds for participation are programmed in the Department of Transportation Operating Fund 
(fund 232) for Sub-project TE024, MCDOT Intelligent Transportation System (ITS). 
The IAM is part of the Arizona Commerce Authority. The IAM is a consortium of global 
industry, academic, and government members committed to embracing innovation, 
collaborating in state-of-the-art research, development, testing, and evaluation that 
advances safety, science, and policy associated with automated driving systems (ADS-
equipped vehicles). 
Participation in the IAM will allow MCDOT to have ‘adopter’-level access to the Implementers 
Forum, participation in the Directed Research Focus Area, as well as access to the IAM Test

Pursuant to A.R.S §11-419 (C), approve the appointment of Ingrid Garvey as Chief Deputy

The Clerk stated there were two comments received regarding Covid and 16 comments 
regarding elections.  All comments have been shared with the Board.

Supervisors'/County Manager's summary of current events - Resumen de temas de 
actualidad de los Supervisores/Administrador del Condado
Supervisor Steve Gallardo spoke of the passing of City of Phoenix Councilman Calvin 
Goode. He was a pillar in the community and left a positive legacy. He spoke of the 
unfortunate events of virtual hackers comments during his virtual services.

Chairman Jack Sellers noted his appreciation of Supervisor Steve Gallardo’s 
comments.
Supervisor Steve Chucri wished Supervisor Clint Hickman a happy birthday.
Supervisor Gates wished Supervisor Clint Hickman a happy birthday as well and 
concurred with Supervisor Steve Gallardo’s comments. He also mentioned the Board 
received a subpoena to appear at the Senate and thanked Chairman Jack Sellers for 
appearing on behalf of the Board and thanked Recorder Richer for appearing as well 
to address concerns regarding the election integrity.
Chairman Jack Sellers thanked Supervisor Bill Gates for the comments and wished 
Supervisor Clint Hickman a happy birthday.
Supervisor Clint Hickman stated he did not know Calvin Goode on a personal  level but 
he did great things for the community.  He echoed Supervisor Gates’s comments 
regarding the subpoena and thanked Chairman Jack Sellers for representing the Board.
Chairman Jack Sellers made a brief comment regarding the subpoena and noted his 
willingness to speak to anyone on the integrity of the elections held in Maricopa County.

Avenue Drainage Improvements Project (Project) between the City of Peoria (City) and the 
Flood Control District of Maricopa County (District). This IGA is for the design, rights-of-way 
acquisition, and utility relocations for the Project. The estimated total Project cost for these 
activities is $5,300,000. The District’s estimated share of the Project cost is $2,650,000 and 
the City’s estimated share of the Project cost is $2,650,000. This Agreement shall become 
effective as of the date it has been executed by all PROJECT PARTNERS and shall expire 
two years from that date, or upon completion of these Project activities, whichever occurs

Storm Drain 43rd to 51st Avenue Project (Project) between the City of Glendale (City) and 
the Flood Control District of Maricopa County (District). The estimated total Project cost is 
$1,600,000. The District’s estimated share of the Project cost is $800,000 and the City’s 
estimated share of the Project cost is $800,000. This Agreement is for the design, rights-of-
way acquisition, and utility relocations for the Project, and shall become effective as of the 
date it has been executed by all PROJECT PARTNERS and shall expire two years from that 
date, or upon completion of these Project activities, whichever occurs first. This Agenda Item

IGA FOR THE PARADISE RIDGE DRAINAGE IMPROVEMENTS PROJECT
Approve Intergovernmental Agreement (IGA) FCD 2020A030 for the Paradise Ridge 
Drainage Improvements Project (PROJECT) between the City of Phoenix (CITY) and the 
Flood Control District of Maricopa County (DISTRICT).   This Agreement shall become 
effective as of the date it has been executed by all PROJECT PARTNERS and shall expire 
ten years from that date, or upon Project completion, whichever occurs first.
The Paradise Ridge Channel (extending from the southwest corner of Pinnacle Peak Road 
& Scottsdale Road, south approximately 2.5 miles to State Route 101) was identified in the 
Pinnacle Peak West Area Drainage Master Study as being a necessary component to control

the alluvial fan flooding in the area.  This PROJECT will reduce the flood hazard in the area 
and complete the final step of a comprehensive solution to this drainage corridor.  This is a 
joint project with the CITY and the estimated total PROJECT cost is $32,000,000. The cost 
will be shared 50/50 with the CITY making the DISTRICT’s estimated share of the PROJECT 
cost $16,000,000.  The CITY will operate and maintain the completed PROJECT. This 
Agenda Item impacts Supervisorial District 3. (C-69-21-056-X-00)

IGA WITH THE CITY OF PHOENIX FOR 19TH AVENUE AND DOBBINS ROAD 
PROJECT
Approve Intergovernmental Agreement (IGA) FCD 2019A010 for the Design, Construction, 
Utility Relocations, Rights-of-Way Acquisitions, Construction Management, and Operation 
and Maintenance of 19th Avenue and Dobbins Road Flood Mitigation Project (PROJECT) 
between the City of Phoenix (CITY) and the Flood Control District of Maricopa County 
(DISTRICT). 
This Agreement shall become effective as of the date it has been executed by all PROJECT 
PARTNERS and shall expire ten years from that date, or upon PROJECT completion, 
whichever occurs first. 
The Laveen watershed is bounded by the Salt River on north, South Mountain on the south, 
on approximately the 7th Avenue alignment to the east, and Gila River Indian Community to 
the west.  
The PROJECT is bounded on the west by 27th Avenue, on the south by Dobbins Road, on 
the east by 15th Avenue, and on the north by South Mountain Avenue. The PROJECT 
includes regional basins, storm drains and inlets, lateral pipes and outfall pipes. This Agenda 
Item impacts Supervisorial District 5. (C-69-21-049-X-00)

CONTRACT FOR QUEEN CREEK/EAST MESA AREA DRAINAGE MASTER 
STUDY/PLAN UPDATE
Award Contract FCD 2020C003 On-Call Services for the Queen Creek/East Mesa Area 
Drainage Master Study/Plan Update (QC/EM ADMS/P U) to JE Fuller to provide professional 
engineering services. The contract will be effective for 730 calendar days from the date of 
execution or the expenditure of $750,000.00, whichever comes first. The Flood Control 
District of Maricopa Country (District) and JE Fuller will mutually agree to a detailed scope 
of work for each work assignment. This is a qualifications-based selection in accordance with 
the Maricopa County Procurement Code, Article 5, Paragraph 504 and Article 5 Procurement 
Procedures Manual, Chapter II – Section 2.
The QC/EM ADMS/P U will identify and quantify the flood hazards and risks in a 110-square 
mile area in southeastern Maricopa County. The QC/EM ADMS/P U is located within the City 
of Mesa, Towns of Queen Creek and Gilbert, unincorporated Maricopa County, and 
unincorporated Pinal County. This watershed has been studied before; however there has 
been significant growth and development since the original studies were completed in the 
late 1980s through the mid-2010s.  This Agenda Item impacts Supervisor Districts 1 and 2.
