The Board of Supervisors of Maricopa County, Phoenix, Arizona, convened in Formal Session at 
9:30 AM on Wednesday, November 3, 2021, in the Supervisors' Auditorium, 205 W. Jefferson, 
Phoenix, AZ 85003, with the following members present: Jack Sellers, Chairman, District 1; Bill 
Gates, Vice Chairman, District 3 (remote); Steve Chucri, Supervisor, District 2 (remote); Clint 
Hickman, Supervisor, District 4 (remote); Steve Gallardo, Supervisor, District 5. Also present: 
Juanita Garza, Clerk; Joy Rich, County Manager; Andrea Cummings, Legal Counsel; Maria

INVOCATION - INVOCACIÓN
Chairman Sellers noted today the Board was going to honor veterans and that 10% of 
Maricopa County employees are currently serving or have served in the U. S. armed 
forces. He said we would hear from our two U.S. Senators and some of our own County 
employees who served in the military and then stepped up during the pandemic to make 
a difference in our local community. Chairman Sellers introduced Jeff Fine, an Air Force 
veteran and the County’s Clerk of the Superior Court.

PLEDGE OF ALLEGIANCE - JURO FIDELIDAD A LA BANDERA
Jeff Fine, Clerk of the Court, led the assemblage in the Pledge of Allegiance to the flag.
4.
VETERANS DAY RECOGNITION

Chairman Sellers began today’s recognition with short videos from Senators Kyrsten 
Sinema and Mark Kelly.
Chairman Sellers stated it is often said that service requires sacrifice. We saw firsthand 
when COVID-19 came into our community and took hold of our lives. Here at the 
County, dedicated public servants worked seven days a week, planning, gathering 
data, protecting the most vulnerable and informing the public. Many of these heroes are 
also active-duty military or veterans. Serving in the armed forces prepared them to cope 
with the unexpected and the last two years have given us nothing but the unexpected.
The Chairman introduced Rob Rowley, Director of the Maricopa County Department of 
Emergency Management, and Kip Schlum, Emergency Planning Supervisor with the 
Department of Public Health.
Chairman Sellers gave a brief biography about Mr. Rowley, noting his training in the 
Russian language and psychological operations. He served more than 14 years in the 
Army Reserve and California National Guard.
Rob Rowley stepped up to make a few comments and started by acknowledging his 
team members hard work and said their success was his success. He said he enlisted 
at 19 on impulse, but it had a profound impact on his life.  He shared some of his 
experiences while serving. He then noted that 19 months ago, the Unified Command 
was started to better organize the County’s response to the pandemic. He shared how

tools he acquired from his military experience helped him at the Unified Command. He 
said the lessons he learned in the Army served him well in 2020.
Chairman Sellers provided a brief biography for Kip Schlum noting he served as an Air 
Force Lieutenant Colonel for 24 years. Mr. Schlum served in combat deployments to 
Iraq and Kuwait where he worked closely with local communities. The Chairman noted 
Mr. Schlum’s work with the Unified Command and shared his accomplishments.
Kip Schlum shared some of his experiences in the military and the lessons he learned.  
He also shared his transition from the military to employment with Maricopa County. 
His mission support group experience assisted him with his job today. He thanked 
everyone for the response to the pandemic and thanked the Board for the support. 
Chairman Sellers reminded everyone how valuable the military experience was that 
assisted these men in their work today.
Supervisor Chucri commented that it was clear the military experience helped shape 
these men. This is something that should be celebrated today. He thanked Chairman 
Sellers for the opportunity to hear from the state’s senators. We are celebrating 
Veterans Day in a different way this year giving us a reason to contemplate and 
appreciate the celebration.
Supervisor Gates noted the County always has a special Veterans Day celebration, to 
recognize and celebrate our veterans. He noted the military experience that made these 
men key members of the COVID response team and represent so many veterans in 
Maricopa County. He shared his thoughts of his grandfather and his service during 
World War II. The new generation of veterans have been challenged by 911 and now 
by COVID-19 and their response was shaped by their military service. He thanked all 
the veterans of Maricopa County.
Supervisor Hickman noted the benefits of leading a County with so many employees 
that have served or are serving in the armed forces. He recognized that their 
experiences in the military helped prepare them as key members of the Maricopa 
County COVID-19 response. He was thankful for the military men and women who put 
their lives on the line to protect our country.
Supervisor Gallardo echoed many of the comments of his colleagues.  He was thankful 
for Mr. Rowley’s and Mr. Schlum’s experience with the military that transformed into 
service for Maricopa County. He saluted these men for speaking this morning and the 
men and women who have served our country.  He noted that many of our veterans 
are struggling everyday with homelessness and medical issues. He hears stories from 
constituents on the challenges they face with the Veterans Administration, etc. He said 
we need to keep the veterans in mind, and he thanked them for their service.
Chairman Sellers said he was impressed with what a great organization Maricopa 
County is and that we have been able to hire veterans to contribute. He thanked the 
speakers for their service and commitment to Maricopa County. 
5.
PET SHOWCASE BY MARICOPA COUNTY ANIMAL CARE AND CONTROL - 
PRESENTACIÓN DE ANIMALES DOMESTICOS POR EL DEPARTAMENTO DE

John Reynolds from Maricopa County Animal Care and Control (MCACC) introduced 
Harley noting he is a barrel shaped senior dog weighing approximately 90 pounds.  He 
is house trained, microchipped, neutered and ready for a loving home.  As a senior dog,

he is available for adoption at the West Shelter and is part of the Senior Program and 
his adoption fees have been paid for by donations from the Bissell Pet Foundation 
during the month of November.  Please contact pets.maricopa.gov for more

Request: Zone Change from C-S CUPD to R-3 RUPD for a future multi-family development
Site Location: Generally located at the NEC of Happy Valley Rd. and El Mirage Rd. in the 
Peoria area
Commission Recommendation:  On 10/7/21, the Commission voted 9-0 to recommend 
approval of Z2021045 subject to conditions ‘a’ – ‘i’:   
a. Development of the site shall be in substantial conformance with the Narrative Report 
entitled “Hancock Communities Vistancia West”, consisting of 12 pages, stamped received 
on August 25, 2021, except as modified by the following conditions.
b. The following Planning Engineering conditions shall apply: 
1. Without the submittal of a precise plan of development, no development approval is 
inferred by this review, including, but not limited to number of proposed building lots/units, 
drainage design, access and roadway alignments. These items will be addressed as 
development plans progress and are submitted to the County for further review and/or 
entitlement.
2. A traffic impact study must be submitted with future entitlement (POD) application(s).
3. Engineering review of re-zone cases is conceptual in nature. All development and 
engineering design shall be in conformance with Section 1205 of the Maricopa County 
Zoning Ordinance; Drainage Policies and Standards; Floodplain Regulations for Maricopa 
County; MCDOT Roadway Design Manual; and current engineering policies, standards and 
best practices at the time of application for construction.
c. This R-3 RUPD zoning district shall have a maximum of 198 residential units. 
d. The following R-3 RUPD standard shall apply: 
1. Minimum Rear Yard Setback (north): 20’
e. Zoning approval is conditional per Maricopa County Zoning Ordinance, Article 304.6, and 
ARS § 11-814 for five (5) years for the initial phase and an additional five (5) years for each

subsequent phase, within which time the subdivision infrastructure permit or construction 
permit for each phase must be obtained. The applicant shall submit a written report every 
five years from the date of Board of Supervisors approval of Z2021045 which details the 
status of this project, including progress on obtaining subdivision infrastructure and/or 
construction permits. The status report to be administratively reviewed by Planning and 
Development with the ability to administratively accept or to carry the status report to the 
Board of Supervisors (Board), upon recommendation by the Planning and Zoning 
Commission (Commission) for consideration of amendments or revocation of zoning for 
undeveloped parcels. Status reports will be required until completion of the initial subdivision 
infrastructure and/or construction permits for each zoning parcel (R-3 RUPD). 
f. Administrative approval of a Plan of Development will be required prior to approval and 
issuance of construction permits to develop and establish use of the site. Prior to issuance 
of a building permit, written confirmation will be required from the emergency fire protection 
jurisdiction having authority that the facility has been designed in accordance with their 
regulations and requirements, and that emergency fire protection service will be provided to 
the facility. Prior to issuance of the certificate of occupancy, local fire protection jurisdiction 
review and approval will be required.
g. Noncompliance with any Maricopa County Regulation shall be grounds for initiating a 
revocation of this Zone Change as set forth in the Maricopa County Zoning Ordinance. 
h. The property owner/s and their successors waive claim for diminution in value if the County 
takes action to rescind approval due to noncompliance with conditions. 
i. The granting of this change in use of the property has been at the request of the applicant, 
with the consent of the landowner.  The granting of this approval allows the property to enjoy 
uses in excess of those permitted by the zoning existing on the date of application, subject 
to conditions.  In the event of the failure to comply with any condition, the property shall revert 
to the zoning that existed on the date of application.  It is, therefore, stipulated and agreed 
that either revocation due to the failure to comply with any conditions, does not reduce any 
rights that existed on the date of application to use, divide, sell or possess the property and 
that there would be no diminution in value of the property from the value it held on the date 
of application due to such revocation of the Zone Change. The Zone Change enhances the 
value of the property above its value as of the date the Zone Change is granted and reverting 
to the prior zoning results in the same value of the property as if the Zone Change had never

ESTATES IRRIGATION WATER DELIVERY DISTRICT
Pursuant to A.R.S. § 48-261, § 48-3423 and § 48-3424, convene the scheduled public 
hearing regarding the petitions filed for the formation of the proposed Del Monte Estates 
Irrigation Water Delivery District, as they have been determined to be signed by a majority 
of the owners of the acreage within the proposed district.
Pursuant to A.R.S. § 48-3424, any landowner within the boundaries of the proposed district 
may appear and object to the organization thereof, or to the inclusion of the landowners’ 
property therein. The Board will hear and consider all comments in favor or against the 
organization of the district and decide whether to approve or reject the organization of the 
district within the boundaries proposed in the petition or with modified boundaries.
If the Board decides to proceed with the organization of the district, the Clerk is directed to 
publish a notice and post copies of the notice describing the boundaries of the proposed 
district and fix a date of November 23, 2021, a date not less than 20 days after the 
publications and postings are completed. Written protests against the organization may be 
filed by owners of a majority of the acreage with the proposed district boundaries. If no protest 
is filed, or if one is filed and found insufficient, an order establishing the district shall be 
entered and will include the appointment of the following three (3) Trustees of the district as

BUDGET ADJUSTMENT FOR THE EXTENSION OF FUNDING AGREEMENT FOR 
FELONY PRE-TRIAL INTERVENTION PROGRAM
Approve the acceptance of an extension of the funding agreement for Felony Pre-Trial 
Intervention Program, in the amount of $34,069.
Also approve the following budget adjustment:
Pursuant to A.R.S. §42-17106, increase the revenue and expenditure authority for the FY 
2022 County Attorney (D190) County Attorney Grants Fund (219) Non-Recurring Non-
Project (NRNP) by an amount of $34,069.
Grant revenues are not local revenues for the purpose of the constitutional expenditure 
limitation, and therefore, expenditure of the funds is not prohibited by the budget law. The 
approval of this action does not alter the budget constraining the expenditures of local 
revenues duly adopted by the Board pursuant to A.R.S. §42-17105.

Approve an Intergovernmental Agreement (“IGA”) between Valleywise (“Contractor”) and 
Maricopa County (the “County”).
The purpose of the Agreement is to provide funding to Valleywise to make capital 
improvements to its Desert Vista facility and to create a new SMI direct care site in the west 
valley. 
Funding of this Agreement is through the American Rescue Plan Act, Coronavirus State and 
Local Fiscal Recovery Funds under the CFDA number of 21.027. The Agreement amount 
shall not exceed $16,000,000.

ECONOMIC DEVELOPMENT FUNDING IN FY 2022
Approve a Contract between Greater Phoenix Economic Council (GPEC) and Maricopa 
County, administered by the Office of Budget and Finance, in an amount not-to-exceed 
$685,941. The purpose of this Contract is to provide FY 2022 non-profit economic 
development funding to the Greater Phoenix Economic Council (GPEC) for purposes to 
include regional marketing and promotion to improve the region's business image, industry 
prospecting to diversify the economy through the attraction and expansion of desirable 
business and industry in key economic clusters, facilitating regional economic development 
collaborations to build a strong business climate and develop an effective regional economic 
development network of organizations with a common vision and mission, and coordinating 
Foreign Trade Zone requests. This Contract is effective from July 1, 2021 through June 30, 
2022.
The Greater Phoenix Economic Council (GPEC) will conduct economic development 
activities in accordance with A.R.S. §11-254.04(c). The contract contains performance goals 
and reporting requirements. GPEC will provide quarterly reports to the County identifying its 
efforts during the Fiscal Year. An annual report on performance will be due no later than 
September 30, 2022.
The Board of Supervisors is authorized to approve financial support up to $1,500,000 
annually from the General Fund for the purpose of economic development programs which 
are operated and maintained within the boundaries of Maricopa County for government 
agencies and non-profit organizations pursuant to ARS §11-254 and related statutes. The

Approve a financial Intergovernmental Agreement (Agreement) between the City of Mesa

County are collectively referred to herein as the “Parties” and individually as “Party.”
The purpose of this Agreement is to integrate the County’s workforce development system 
into the City’s social and community services resource network. The Parties agree to support 
workforce development and training efforts that will enable the City’s employers to attract 
and retain top talent and to provide adult and youth services. The integrated service delivery 
model will be located at the New Leaf/Mesa CAN building located at 635 East Broadway

The appropriation adjustments are related to the ADHS funding as described below.
Approve a cost reimbursement Intergovernmental Agreement (IGA) CTR057220, between 
ADHS and Maricopa County by and through its Department of Public Health (MCDPH), to 
provide funding for the COVID-19 Funding for K-12 School Reopening grant. The purpose 
of this project is to reduce transmission off COVID-19 disease and related deaths in students, 
and faculty through four targeted functional activities, including implementation of a COVID-

19 module within student information systems; COVID-19 testing and mitigation outreach; 
temporary staffing assistance to support testing, investigation, and disease mitigation; and 
establishing a grant coordination and management unit. Funding is in the amount of 
$27,422,755 for the budget period beginning May 1, 2021 and ending May 31, 2022. The 
term will not exceed 5 years. 
This is a new grant and it is uncertain whether it will occur beyond the initial term. It was non-
competitive and there is no cash or in-kind match required. The grant award is not a 
mandated function but provides a benefit to our citizens by continuing COVID-19 related 
services. Should funding be discontinued, on-going contributions should not be required.
This grant deviates from County Policy A2505 and does not allow for full indirect cost 
reimbursement, but a maximum of 10% of salaries and employee related expenses: Salaries 
and employee related expenses are estimated to be $731,788.  The Department of Public 
Health’s indirect rate for FY22 is 17.97%.  Total indirect expenses are estimated to be 
$4,479,881 of which $73,179 is recoverable and $4,406.702 is not recoverable. Cost not 
covered by the grant and will be absorbed by the departments indirect cost pool.

CARE PROGRAM COMMUNITY HEALTH NURSING PROGRAM
Approve additional FY22 funds for the ADHS Contract for Community Nursing Services # 
CTR046941 awarded by the Arizona Department of Health Services (ADHS) High Risk 
Perinatal Program (HRPP).  The PO is in the amount of $665,000, $625,000 of which was 
approved previously, resulting in an increase of $40,000 for the budget period July 1, 2021 
thru June 30, 2022.  The contract term is from August 1, 2019 through July 31, 2022.
The HRPP NICP grant award is reoccurring and has been awarded to the department since 
1988. This grant does not require an in-kind match, indirect cost is fully recoverable and 
ongoing cash contributions are not required. The grant award is not a mandated function but 
provides a benefit to the citizens by providing developmental follow-up through home-based 
services for families whose children received intensive or special care immediately after birth 
and for children with identified special health care needs.  The grant award is competitive. 
All program costs are allocated to the grant so there will be no additional burden on the 
department’s operating budget. 
The Department of Public Health indirect rate for FY22 is 17.97%.  The indirect costs are 
estimated at $6,093.00 and are fully recoverable. 
Grant revenues are not local revenues for the purpose of the constitutional expenditure

not to exceed amount of $280,000 for the budget period January 1, 2022 through December 
31, 2022. The RWPB portion is in the not-to-exceed amount of $821,400 for the budget 
period April 1, 2021 through March 31, 2022. The IGA term is January 1, 2018 through 
December 31, 2022.  In addition, Component 3 adds funds int the amount of $1,037, 927 for 
the budget period August 1, 2021 through July 31, 2022. Component C is new funding for 
the purpose of conducting patient navigation services as part of the linkage to care activities. 
In addition, authorize Board signature for the anticipated Amendment 2, in which the revised 
Price Sheet will be a part.
The not-to-exceed total of this amendment is $2,139,327.
This HIV Prevention grant award is reoccurring and has been awarded to the department in 
previous years. It is non-competitive and there is no cash or in-kind match required. The 
grant award is a mandated function, should it be discontinued on-going contributions may be 
required.

HIV Prevention Program in Maricopa County. The goals are to provide access to quality HIV 
testing and Linkage to Care (HTL) for persons residing in Arizona, to conduct partner 
services (PS) expanded testing activities, and to provide PS in public and private sectors to 
all persons newly diagnosed with HIV or previously positive with a new sexually transmitted 
disease (STD) diagnosis, and to all HIV positive persons or their medical providers

County Air Pollution Control Regulation VI - Rule 600 (Emergency Episodes) and the 
associated proposed revision to the Arizona State Implementation Plan (SIP). Following the

approve submission of the amended rule as a revision to the Arizona SIP.
Rule 600 establishes criteria to determine when air pollutant concentrations are significantly

air pollutant concentrations which would cause significant harm to the health of persons. The 
Maricopa County Air Quality Department is proposing to amend Rule 600 to align the rule 
with the episode level criteria and significant harm levels with the criteria listed in Arizona 
Administrative Code R18-2-220 (Air Pollution Emergency Episodes) which was amended by

These actions will have a net zero impact on the overall County budget.
The budget adjustments are to provide funding to departments for employees who received 
market adjustments effective November 1, 2021. The attached “FY 2022 Market

Approve a Non-Procurement Contract #220160, between Maricopa County (County), a 
political subdivision of the State of Arizona, through its Department of Public Health 
(MCDPH) and Arizona Alliance for Community Health Centers (“Contractor”) for grant 
assistance program. The program will support Maricopa County-based Federally qualified 
healthcare centers and address their need to provide expanded services as a result of the 
COVID-19 Pandemic. The term of the contract is for three (3) years and two (2) months, 
beginning November 1, 2021 and ending December 31, 2024. The total cost of the services 
is not expected to exceed $25,000,000.  The County may, at its option and with the 
agreement of the Contractor, renew the term of this Contract up to a maximum of two (2) 
additional times for a period of six (6) months each, provided however, that Contractor is in

Supervisors'/County Manager's summary of current events - Resumen de temas de 
actualidad de los Supervisores/Administrador del Condado
Joy Rich thanked our veterans here today.
Supervisor Chucri noted this was his last formal board meeting as the Supervisor for 
District 2. He reflected on his nine years in this role and said there was one prevailing 
memory that came to mind and that was the Maricopa County family. He said family is 
everything and it is no different in this case. The question he has been asked the most 
about his departure is what he was going to miss the most and his response was the 
Maricopa County family. He said the County has been able to cut through red tape, 
streamline personnel processes, be more reflective of the private sector, and not let 
tenure and other factors compromise good talent. One example is turning a one-time 
jail into office space. He said the business mindset in government has kept Maricopa 
County best in class. He said it has been an honor to serve his constituents. He said 
many have approached him and asked him to reconsider his resignation, but it is time 
to turn the page to the next chapter. He plans to bring civility back to public service in 
the political arena and still the serve the community as a private citizen.

Supervisor Gates thanked Supervisor Chucri for his remarks and wished him the best 
in the future.
Supervisor Hickman said it had been a pleasure and honor to serve with Supervisor 
Chucri on the Board of Supervisors.  He thanked him for his service in District 2 and 
wished him the best of luck. He wished Nicole Bendle and Page Gonzales well.
Supervisor Gallardo echoed the comments of Supervisors Gates and Hickman. He said 
he knows their paths will cross again. He shared when he was first elected to the Board 
of Supervisors, the only Board member he had a relationship with was Steve Chucri. 
Fortunately, Supervisor Chucri helped guide him in the County administration and 
operations. He congratulated Page on her new venture and thanked Nicole for her help. 
He wished Supervisor Chucri well and he will always be a friend.
Chairman Sellers said he would second the remarks of his colleagues. He noted that 
he knew Supervisor Chucri before they were colleagues at Maricopa County when 
Supervisor Chucri and he worked with General Motors supporting them in the 
community. He wished Supervisor Chucri the best.
Chairman Sellers shared that yesterday he toured election headquarters and it was an 
education to observe the processing of an election including signature verification. He 
spoke with those doing the work and anyone who witnessed how it worked would never 
question the integrity of the operation. He said it is impressive and it was no wonder 
our election process has won national recognition. He said it is the best of the best.
Supervisor Gallardo noted he went to the polling site in Tolleson because he wanted to 
see how things operated.  He said he could not be more pleased with the process and 
how hard-working the poll workers were. Supervisor Chucri talks about best in class 
and an example is the Maricopa County Election Department. 
Chairman Sellers shared how impressed he is with Recorder Stephen Richer. Mr. 
Richer knows every detail and how efficient the group was and recognized the group’s 
expertise. Chairman Sellers noted his appreciation that Mr. Richer is a strong advocate 
for the group. He said Recorder Richer had visited 15 voting sites and understands 
what they are doing.
Supervisor Hickman thanked Chairman Sellers for bringing up Recorder Richer 
because last night Mr. Richer was at MCTEC still making sure the election rolling 
smoothly.  He thanked Chairman Sellers for being a great Chairman during the election 
making sure it was progressing smoothly.

Inspection Services for the District’s various construction projects. The Contract will be 
effective for 730 calendar days from the date of execution or the expenditure of $1,000,000, 
whichever comes first.  As an option, the Contract may be extended by change order for an 
additional period up to 1,095 calendar days, or expenditure of the remaining funds, 
whichever comes first.
The Flood Control District of Maricopa Country (District) and Consultant Engineering, Inc., 
will mutually agree to a detailed scope of work for each work assignment.  This is a 
qualifications-based selection in accordance with the Maricopa County Procurement Code,
