INVOCATION - INVOCACIÓN

Supervisor Chucri introduced Robin Schaeffer, Board of Health appointee representing
District 2. She has been a nurse for 40 years and has led the Nurses Association in
Arizona for 10 years. He said there is a special purpose as to why he chose Robin.
Tomorrow is National Nurses Day. Ms. Schaeffer gave the invocation.

2.
PLEDGE OF ALLEGIANCE - JURO FIDELIDAD A LA BANDERA

Robin Schaeffer led the assemblage in the Pledge of Allegiance to the flag.

Chairman Sellers stated he gained a better appreciation for her profession since his
son-in-law is a nurse practitioner. He knows what his son-in-law has gone through this
past year. He has been sent to New York and Texas to assist during this pandemic.

Monica Gery, Public Information Officer, MCACC introduced Moscow, who is
approximately 8 years old. She described his attributes and noted his adoption fees are
sponsored by the Bissell Pet Foundation. The Foundation is helping to empty the
shelters by sponsoring an adoption event for both shelters from May 5 through May 9,
2021. For more information, please visit pets.maricopa.gov.

Chairman Jack Sellers asked if there were any announcements or corrections. The
Clerk responded that there were none.

PRESENTATIONS AND ACTIONS - PRESENTACIÓNES

APPOINTMENT OF A CONSTABLE FOR THE WEST MCDOWELL PRECINCT

Pursuant to ARS §11-251(16), consider a nomination for appointment of a Constable for the
West McDowell Precinct to fill the vacancy created by the resignation of Rudy Santa Cruz,
the previous Constable. This appointment shall be to fill the vacancy for the remainder of the
term which ends December 31, 2022.

The recommended salary for the newly appointed Constable is $48,462.00, consistent with
A.R.S. §11-424.01(C)(5) and the Board of Supervisors’ action related to Constable salaries.

Supervisor Gallardo spoke of the resignation of Rudy Santa Cruz and thanked him for
his service. He spoke of the vacancy in the wake of Mr. Santa Cruz’s resignation, and
the applications received.

Motion to approve appointment of Byron L. Rhymes, Jr. as Constable for the West
McDowell Precinct was made by Supervisor Steve Gallardo, seconded by Supervisor
Bill Gates

The Clerk administered the oath.

Supervisor Gallardo congratulated Mr. Rhymes and thanked him for his willingness to
serve. He has been an outstanding individual within the community, attended high
school in the area and is active with the youth. Supervisor Gallardo spoke of Mr.
Rhymes' community involvement and noted he coaches basketball.

A photo was then taken with the Board.

Constable Byron Rhymes thanked the Board for the appointment and noted he plans
to do his best and will walk by his faith in God to use his best judgement.

CONTEST

Stormwater Pollution Prevention Poster Contest noting the program has been running for
12 years. The program is specifically for students from 3rd to 6th grade. Ms. Kober noted

and the posters were projected on the screens in the room.

Ms. Kober congratulated the winners and thanked the Board for their involvement. She
noted the posters may be viewed on the Environmental Services website. She stated the
calendar would be released later in the year.

Chairman Sellers thanked Ms. Kober and said the program receives a lot of positive
feedback from schools.

Supervisor Gallardo stated there are a lot of young, talented children in the valley.

7.
RECOGNITION AWARD FOR INTERNAL AUDIT

Recognize Internal Audit for their assistance with the Small Business COVID-19 Relief
Program. (C-06-21-602-X-00)

Chairman Jack Sellers acknowledged Michael McGee, Internal Auditor, who accepted
the award which recognized Internal Audit for their assistance with the Small Business
COVID-19 Relief Program. This has been in support of the Board’s efforts to provide
economic relief in the County. The department assisted the Finance Department
reviewing applications from small businesses seeking assistance. The Chairman noted
the department reviewed over 5,000 applications, averaged a 1–2-day turnaround time
for up to 100 applications per day, they developed a database to coordinate the final
grant, and reported program progress. They reported $70 million in rent payments
impacted by the pandemic, in addition to other economic highlights for applicants.

Mr. McGee spoke on behalf of Internal Audit and thanked the Board for this recognition
award. He thanked everyone in Internal Audit for their hard work on this endeavor. He
especially thanked Padra Carroll who organized and led the department’s efforts. He
said this project was a team effort across multiple departments. He acknowledged
Bridget Harper, Robert Harwood, and their team for working hand-in-hand to process
documents. He noted the efficient use of resources and the positive outward impact on
the community. He said the process opened their eyes to drastic pandemic effects on
businesses. He said going forward as Maricopa County continues to assist, the
department will continue to assist. He thanked the Board for their leadership in
response to pandemic.

All Board members congratulated the Mr. McGee and the departments for their work.

8.
COMMEMORATIVE PRESENTATION BY THE NATIONAL ASSOCIATION OF
COUNTIES

Jonathan Shuffield, representing the National Association of Counties, will present the Board
of Supervisors and the Maricopa County Attorney's Office with commemorative pens to
acknowledge Maricopa County's leadership during the election. (C-06-21-625-X-00)

Chairman Sellers recognized the presence of Jonathan Shuffield who came up to the
podium to speak.

Mr. Shuffield, Associate Legislative Director for the National Association of Counties
(NACo) thanked Chairman Sellers for the opportunity to speak. He said he was
speaking on behalf of NACo and as a resident of the County. He thanked the Board
and the County Attorney’s Office for their tremendous service, leadership, and
statesmanship during last year’s election. He noted it took true political courage, putting
our democracy first. Mr. Shuffield presented the Board with handcrafted pens for their
service during this divisive time in American history. NACo appreciated the leadership

shown by this Board. He said Maricopa County is home and he personally thanked the
Board for standing up for his rights. A photo was taken with the Board.

Tom Liddy, County Attorney’s Office, stated there has been a lot of work since
November 3, 2020. It has not just been the County Attorney’s Office involved and he
thanked the following individuals: Jon’Nett Barksdale, Veronica Sisneros, Sonja
Kautzman, Joe Branco, Joe Vigil, Joe LaRue, and Emily Craiger who led the team to
represent County employees who have worked hard not only on election day but for
months and months prior to an election. He said it has been an honor to represent the
Board of Supervisors and the County employees.

Supervisor Gates said he was speechless and thanked Mr. Shuffield for his words
because it means a lot. He said it has been an honor, particularly over the last 6 months,
to serve on this Board. He thanked the entire legal team and the work that has been
done. He said it has been hard work when always doing what is right and upholding the
rule of law.

Supervisor Gallardo thanked NACo for coming and recognizing the Board of
Supervisors. He was so pleased with the remarks from Mr. Shuffield. He thanked Tom
Liddy and Allister Adel and noted this has not been an easy year. It has been very tense
for the last 6 months as they have stood up for our fundamental right to a democracy,
the right to vote, and to choose who sits as the Board of Supervisors. He is a lone
Democrat amongst Republicans, and he could not have picked four classier individuals
to work with. As a former election employee, he knows the work election employees
must put into an election. They miss vacations and children’s’ events because they are
putting elections together. These employees have been under attack and have put
everything into it. He said it was not over yet, but democracy will prevail.

Supervisor Chucri concurred with his colleagues’ comments. The County Attorney’s
Office has faced many challenges in keeping the ship going in the right direction, but
they have kept their focus when the direction to take is not always easy. The Board has
agreed on principal and has moved forward as one Maricopa County family. He
thanked NACo for their recognition.

Supervisor Hickman said he echoed the comments of all his colleagues. He stated he
would look back on the year, not with the eyes of a critic, but with eyes of appreciation
for those he has served with. He reminded everyone there were three elections held
during the pandemic and he will always look back with appreciation on this
achievement., He stated the Board will take information under advisement and act
accordingly, in a professional, service-oriented manner. Our democracy calls all to be
American and Maricopa County stood up for democracy. He stated he appreciated the
NACo award. The County Attorney’s office has been fantastic throughout, staying
within the Constitution. He appreciated there are counties looking to Maricopa County
and seeing this Board administering elections with integrity.

Allister Adel stated Tom Liddy and his team did a tremendous amount of work. She was
proud to support her Board of Supervisors, the rule of law, and she thanked NACo for
their recognition.

Chairman Sellers concurred with comments of his colleagues. He noted how gratifying
it was to hear positive reinforcement for the effort being made. He said they have been
careful to follow the rule of law and he is proud of this accomplishment. He reiterated
Supervisor Chucri’ s comment about Maricopa County being one team, as there were
multiple offices involved in this effort.

ABBOTT COTTAGE INDUSTRY SUP

Request: Special Use Permit to allow operation of a sign installation company in the R1-6
Zoning District

Site Location: Generally located approx. 700’ west of the NWC of Orangewood Ave and
75th Ave. in the Glendale area.

Commission Recommendation: On 4/8/21, the Commission voted 9-0 to recommend
approval of Z2020057 subject to conditions ‘a’ – ‘j’:

a. Development of the site shall be in substantial conformance with the Site Plan entitled
“Abbott Cottage Industry”, consisting of 1 full-size sheet, dated December 10, 2020, and
stamped received January 19, 2021, except as modified by the following conditions.

b. Development of the site shall be in substantial conformance with the Narrative Report
entitled “Abbco Glendale”, consisting of 8 pages, dated January 14, 2021, and stamped
received January 19, 2021, except as modified by the following conditions.

c. The following Planning Engineering conditions shall apply:

1.
At the time of the Building Permit, the plans must be updated to show the freeboard
for all retention basins with a depth more than 1.0-ft.

2.
At the time of the Building Permit, use C=0.95 for Commercial Use. C=0.50 can be
used for the retention basins, but the perimeter must be the top of slope of the retention
basins. The runoff coefficient for the entire property cannot be used for the individual
contributing areas.

3.
Building permits for structures, including block wall fence, on all 5 parcels could not
be located. At the time of the Building Permit, provide permit numbers for all current
structures on the entitlement properties. If no permit was obtained for this construction,
building permits will be required as a condition of this entitlement.

4.
At the time of the Building Permit, identify all drainage openings in the block wall
fence. If there are no drainage openings in the block wall fence, show how the water will be
travel around the block wall fence.

5.
Drainage review of planning and/or zoning cases is for conceptual design only and
does not represent final design approval nor shall it entitle applicants to future designs that
are not in conformance with Section 1205 of the Maricopa County Zoning Ordinance and the
Maricopa County Drainage Policies and Standards.

6.
All development and engineering design shall be in conformance with Section 1205
of the Maricopa County Zoning Ordinance and current engineering policies, standards, and
best practices at the time of application for construction.

7.
Carole Lane and the north half of Orangewood Avenue are Operated and Maintained
by Maricopa County Department of Transportation (MCDOT). At the time of the Building
Permit, a MCDOT permit for the paved driveways for APNs 142-24-018H and 142-24-009A
could not be located. Please identify the driveways as paved per MCDOT requirements and
provide the permit numbers for the driveways. If no permit was obtained for this construction,
a MCDOT permit will be required as a condition of this entitlement.

d.
Property owner shall apply for all required building permits within 1 year from the
date of Board of Supervisors approval and complete all necessary construction within 2 years
from the date of Board of Supervisors approval.

e.
This special use permit shall expire on May 5, 2026, or upon termination of the use
for a period of 90 or more days, whichever occurs first. All site improvements associated with
the special use permit shall be removed within 90 days of such expiration or termination of
use.

f. No non-resident employees, customers, clients, shall be permitted on the premises for
business purposes between the hours of 6:00 p.m. and 6:00 a.m. for all except truck drivers,
who may arrive from 5:00 a.m. Monday through Saturday.

g.
Any outdoor storage shall be completely fenced with a solid masonry wall or view
obscuring materials/landscaping to obstruct the view to a height equal to the elevation of the
tallest materials to be stored not to exceed 10 feet in height.

h. Deliveries to and from commercial suppliers (vehicle weight greater than 10,000 lbs.) shall
not restrict traffic circulation and shall only occur between 6:00 a.m. and 6:00 p.m., Monday
through Saturday.

i.
Noncompliance with any Maricopa County Regulation shall be grounds for initiating
a revocation of this Special Use Permit as set forth in the Maricopa County Zoning
Ordinance.

j. The granting of this change in use of the property has been at the request of the applicant,
with the consent of the landowner. The granting of this approval allows the property to enjoy
uses in excess of those permitted by the zoning existing on the date of application, subject
to conditions. In the event of the failure to comply with any condition, and at the time of
expiration of the Special Use Permit, the property shall revert to the zoning that existed on
the date of application. It is, therefore, stipulated and agreed that either revocation due to
the failure to comply with any conditions, or the expiration of the Special Use Permit, does
not reduce any rights that existed on the date of application to use, divide, sell or possess
the property and that there would be no diminution in value of the property from the value it
held on the date of application due to such revocation or expiration of the Special Use Permit.
The Special Use Permit enhances the value of the property above its value as of the date
the Special Use Permit is granted and reverting to the prior zoning results in the same value
of the property as if the Special Use Permit had never been granted. (C-44-21-248-X-00)

Transitional Lot (3-5 d.u./acre) on approx. 105 acres and Industrial Park on approx. 75 acres.
CPA approval is by Resolution

Site Location: Generally located approx. 277’ southwest of the SWC of Reems Rd. and
Peoria Ave. in the Glendale area.

Commission Recommendation: On 4/8/21, the Commission voted 10-0 to recommend
approval of CPA2020005 subject to conditions ‘a’ – ‘d’:

a. Development and use of the site shall be in substantial conformance with the Narrative
Report entitled “Richmond American”, consisting of 26 pages, dated March 10, 2021, and
stamped received March 10, 2021, except as modified by the following conditions.

b. Development and use the site shall be in general conformance with the land use exhibit
entitled “Reems & Peoria” dated March 9, 2021, and stamped received March 10, 2021,
except as modified by the following conditions.

c. The following Luke Air Force Base condition shall apply:

Richmond American Homes and successive owners shall notify future owners/tenants that
they are located near a military airport with the following language:

“You are locating in a residential dwelling inside the State Statute defined “territory in the
vicinity of a military airport,” which means that aircraft flying in this area are authorized to fly
as low as 1,500 feet above the ground. You will be subject to direct overflights and noise by
Luke Air Force Base jet aircraft in the vicinity.

Luke Air Force Base may launch and recover aircraft in either direction off its runways
oriented to the southwest and northeast. Noise will be more noticeable during overcast sky
conditions due to noise reflections off the clouds.

Luke Air Force Base’s normal flying hours extend from 7:00 a.m. until approximately
midnight, Monday through Friday, but some limited flying will occur outside these hours and
during most weekends.

For further information, please check the Luke Air Force Base website at
www.luke.af.mil/urbandevelopment or contact the Maricopa County Planning and
Development Department.”

Such notification shall be permanently posted on not less than a 3 foot by 5-foot sign in front
of all sales and/or leasing offices and be permanently posted on the front door of all sales
and/or leasing offices on not less than 8½ inch by 11-inch sign.

d. The granting of this change in use of the property has been at the request of the applicant,
with the consent of the landowner. The granting of this approval allows the property owner
to enjoy uses in excess of those permitted by the land use existing on the date of the
application, subject to conditions. In the event of the failure to comply with any condition of
approval, the property shall change to the land use designation that existed on the date of
the application. It is, therefore, stipulated and agreed that revocation due to the failure to
comply with any conditions does not reduce any rights that existed on the date of application
to use, divide, sell or possess the property and that there would be no diminution in the value
of the property from the value it held on the date of application due to such revocation. The
Comprehensive Plan Amendment enhances the value of the property above its value as of
the date the Comprehensive Plan Amendment is granted and changing to the prior land use
designation results in the same value of the property as if the Comprehensive Plan

Jennifer Pokorski, Planning and Development Director, and Darren Gerard, Planning
and Development Assistant Director approached.

Chairman Jack Sellers asked if there were any speaker forms or comments filed. The
Clerk responded there was one registered speaker, William Lally, representing the
applicant, who wished to speak in favor. There were two comments received in
opposition. She said the speaker form and comments have been shared with the Board:
one from Kristopher Healey and one from David Haase.

Jennifer Pokorski reviewed item #10 noting this was a comprehensive plan amendment
to change a land use designation from agricultural in the White Tank Grand Avenue
area plan to single family transitional lots. Located at the southwest corner of Reems
Road and Peoria Avenue. She then continued to review the next item, item #11, noting
this was a corresponding zoning change from Rural-43 and R1-35 to R1-6 RUPD on
approx. 105 acres and IND-2 IUPD on approx. 75 acres. She said there have been 24
letters of opposition received. The opposition is about proposed density, the industrial
use, noise, and traffic. The applicant has agreed to additional stipulations including a
buffer along the western border, limiting homes to one story along the western border,
and a 100-foot setback for industrial use. This is in the vicinity area of Luke Air Force
Base and will not negatively affect flight operations.

Mr. Lally provided a background on the case. He noted that before the case was filed,
he hosted a virtual meeting as part of the outreach efforts and sent notice letters to
property owners within a 2,000-foot area. A website was created where the site plan
and application were posted. He stated after the meeting and community input, they
then filed the case. He said after hearing some of the comments from the community,
significant changes were made to the site plan, and he explained the changes.

Supervisor Hickman thanked the Board and the Planning Commission for working hard
on these items. He stated the homes in the market for starter homes continues to get
smaller and smaller. He said with more and more business growth in the west valley,
there is a need for more housing for the people who will be working for these
businesses. He noted his concern with the growth in the west valley and growth in

unincorporated areas is the ability to provide services such as law enforcement, fire,
and medical. He said at some point the developers will need to understand the impact
this will have on the Sheriff's Office. He said at some point it will be an issue.

Kristopher Healy, Twelve Oaks resident, spoke in opposition and stated Richmond
Homes said they reached out and sent letters, but some did not understand what was
going on. He said they were surprised that the Commission approved this. He stated
his main concern was about the impact this will have on the area. He commented on
lot sizes and said he did not want to live next to an industrial park. He stated it seemed
like the case is being pushed through rather quickly and he thought there could be a
better plan.

Supervisor Hickman asked if appropriate signage was posted. He appreciated the
outreach that went beyond the required 300 feet. Ms. Pokorski confirmed all required
postings were met and the applicant exceeded the requirements with their outreach.

Supervisor Hickman expressed his concern about the roadways, as traffic is a concern
in all the districts. Mr. Lally responded that the application was routed through MCDOT,
and they made recommendations for any changes or improvements. Accommodations
were made for additional traffic.

Supervisor Hickman thanked Mr. Lally, the Planning and Zoning staff, and the residents
in attendance this morning.

Motion to concur with the recommendation of the Planning Commission subject to
stipulations “a” through “d” for approval by Supervisor Clint Hickman, seconded by
Supervisor Steve Chucri

14. Min. Open Space: Not less than 19 acres of the R1-6 RUPD zoning district shall be
developed as recreational open space. At the time of each preliminary plat submission, the
developer shall include a description of the status, cumulative acreage and proposed
amenities as identified with this condition.

d. The following IND-2 IUPD Zoning District standards shall apply:

Min. Side Yard: 25’ adjacent to rural or residential zoning
2.
Prohibited Uses: Adult oriented businesses, medical marijuana and residential
(single-family, two-family, or multi-family)
3.
Buffering: All structures shall be prohibited within 100’ of the R1-6 RUPD and R1-35
zoning boundary to the north and light sources within this buffer shall be a maximum 12 feet
in height and shielded.
4.
There shall be a minimum 25’ landscape buffer along the length of the northern
boundary of the IND-2 IUPD zoning district.

e. The following Planning Engineering conditions shall apply:

1.
Access to the industrial portion as depicted is dependent upon a separate access
agreement that would be required from the Flood Control District of Maricopa County. Any
approval of this zone change does not imply approval of any access agreement.

2.
Without the submittal of a precise plan of development, no development approval is
inferred by this review, including, but not limited to number of proposed building lots/units,
drainage design, access, and roadway alignments. These items will be addressed as
development plans progress and are submitted to the County for further review and/or
entitlement.

3.
A traffic impact study (TIS) must be submitted with future entitlement (preliminary
plat or POD) application(s). This TIS must also be submitted to the City of Surprise since
Peoria Avenue is under their jurisdiction. Approval from the City will be required prior to

approval of any building plans. If the Industrial portion is to be accessed from Olive Avenue
approval from MCDOT for the TIS will also be required.

4.
A Drainage Report discussing the offsite flow from the Twelve Oaks development
channel must be submitted with future entitlement (preliminary plat or POD) application(s).

5.
Engineering review of re-zone cases is conceptual in nature. All development and
engineering design shall be in conformance with Section 1205 of the Maricopa County
Zoning Ordinance; Drainage Policies and Standards; Floodplain Regulations for Maricopa
County; MCDOT Roadway Design Manual; and current engineering policies, standards, and
best practices at the time of application for construction.

f. All outdoor lighting shall conform to the Maricopa County Zoning Ordinance.

g. Development of the site shall be in compliance with all applicable Maricopa County Air
Quality rules and regulations.

h. Prior to zoning clearance or Final Plat approval, developer(s) and/or builder(s) shall
establish emergency fire protection services, covering all real property contained within the
project area during course of construction and shall obtain a ‘will serve’ letter substantiating
coverage from the applicable fire service provider.

i. All habitable buildings constructed within this subdivision shall be constructed to attain a
noise reduction level as per ARS § 28-8482(B).

j. Amendments to the site plan and narrative report shall be processed as a revised
application in accordance with Maricopa County Zoning Ordinance Article 304.9.

k. Noncompliance with the conditions of approval will be treated as a violation in accordance
with the Maricopa County Zoning Ordinance. Further, noncompliance of the conditions of
approval may be grounds for the Planning and Zoning Commission to take action in
accordance with Chapter 3 (Conditional Zoning).

l. Non-compliance with the regulations administered by the Maricopa County Environmental
Services Department, Maricopa County Department of Transportation, Drainage Review
Division, Planning and Development Department, or the Flood Control District of Maricopa
County may be grounds for initiating a revocation of this Zone Change as set forth in the
Maricopa County Zoning Ordinance.

m.
The granting of this Zone Change has been at the request of the applicant, with the
consent of the landowner. The granting of this approval allows the property owner to enjoy
uses in excess of those permitted by the land use existing on the date of the application,
subject to conditions. In the event of the failure to comply with any condition of approval, the
property shall change to the land use designation that existed on the date of the application.
It is, therefore, stipulated and agreed that revocation due to the failure to comply with any
conditions does not reduce any rights that existed on the date of application to use, divide,
sell or possess the property and that there would be no diminution in the value of the property
from the value it held on the date of application due to such revocation. The Zone Change
enhances the value of the property above its value as of the date the Zone Change is granted
and changing to the prior land use designation results in the same value of the property as
if the Zone Change had never been granted.

AND SECURITY SERVICES AT STATE FARM STADIUM (FORMERLY UNIVERSITY OF

Approve Amendment 1 to the Intergovernmental Agreement Between City of Glendale and
Maricopa County (C18-0873-1) to extend the term for three years beginning July 1, 2021,
through June 30, 2024, so that the Maricopa County Sheriff’s Office can continue
participating in providing law enforcement, security, and traffic management services to the
City of Glendale at the State Farm Stadium, formerly the University of Phoenix Stadium.

Approve the Talk Groups Memorandum of Understanding (MOU) between the Constables
of Maricopa County and the Maricopa County Sheriff’s Office that formalizes a relationship
between the parties concerning use of Trunked Radio System (TRS) and County Wireless
for interoperability and radio dispatch service under emergency situations. This is non-
financial agreement with no additional cost to be assessed to either party. The term of this
agreement will be 2 years from date of MOU with automatic renewal for 2 additional years,
unless terminated by written notice. Termination can occur with 60 days written notice by

helicopter transportation when the contracted commercial vendor is unable to deliver service.
The understanding is retroactively effective to July 1, 2020, and will continue through June

Inc., of Tewksbury, Massachusetts in the amount $115,100 to purchase the Gemini Unit
which will provide the Bomb Squad with a hand-held dual chemical analyzer that will be used
to identify unknown chemicals and powders. The Gemini Unit, manufactured by Thermo
Fisher, is the only unit available with dual analysis technology. Thermo Scientific Portable
Analytical Instruments, Inc. is the only supplier of the Gemini which uses proprietary

DETENTION OFFICER EMPLOYEE REFERRAL INCENTIVE

Approve the MCSO Detention Officer Employee Referral Incentive Pilot Program and
authorize the MCSO to provide cash incentives of up to $1,000 to current, eligible MCSO
employees (eligibility as defined in the attached program materials) that refer quality
candidates suitable for consideration for the position of Detention Officer. Incentives will
be disbursed as follows: $500 at the time of successful hire (starts employment) and $500
at the time of initial probation completion. The plan also includes a $1,500 monetary
incentive to be paid to current, eligible MCSO employees that refer a Lateral Detention
Officer candidate who is subsequently hired and successfully completes initial probation (12
months or 18 months, if extended). This incentive will be disbursed as follows: $750 at the
time of successful hire (starts employment) and $750 at the initial probation completion.

This program is expected to be implemented in FY 2022 and be in effect through FY 2023.
The estimated salary and benefits compensation are expected to total $411,330, or $205,665
per fiscal year. The funds will be absorbed by the MCSO and the source will be detention

ARIZONA

Accept the donation of 25,000 personal protective equipment (masks) to the MCSO from the
100 Club of Arizona. These items are valued at $.08 each for a total non-cash value of
$2,000.

The Fund 100 Club donated these masks to MCSO for use by first responders in appreciation
for their work and to protect them and help minimize risk during the COVID 19 crisis. The
donation was part of an initiative to provide 70,000+ masks to over 55 departments and

Approve an agreement between Tucson Cold Wet Noses Fosters, Inc., and Maricopa
County, administered by Maricopa County Animal Care and Control, to allow said rescue to
transfer animals that have been deemed eligible for the New Hope program. Maricopa
County will provide a rabies vaccination, dog license tag, and new owner transfer fee within
the first year of transfer for each dog three months of age or older at no cost to the Contractor.
The cost for these services is $52 for each animal transferred in FY 2021 and thereafter.
Animal Care and Control estimates twenty (20) New Hope transfers over the term of the
agreement for a total of $1,040. The term of this agreement shall commence upon approval

AMENDMENT TO LEASE AGREEMENT WITH HOUSING FOR HOPE, INC.

Approve and execute Amendment No. 8 to Lease Agreement L-7410 with Housing for Hope,
Inc, for the use of approximately 1,890 square feet of classroom space and certain
playground area located at 466 South Bellview Street, Mesa, Arizona to provide Head Start
Services.

This purpose of the amendment is to address the following: (A) ratify approval of certain
Lessee Improvements to replace the flooring, at a one-time cost of up to $5,000; (B) amend
Alterations provisions; (C) amend Notices; and (D) provide for lease administration authority.
The Agreement is subject to termination pursuant to the provisions of A.R.S. 38-511. Either
Lessor or Lessee may terminate the Lease by giving not less that ninety (90) days prior
written notice of termination to the other Party. All other terms and conditions remain the
same.

Improvements to the Leased space will be paid through the U.S. Department of Health and
Human Services (DHHS)/Administration for Children and Families (ACF), Office of Head
Start (OHS), Grant No. 09CH010385. The improvements will not impact the County General
funds.

Approve and execute Amendment No. 14 to Lease Agreement L-7271 with First Presbyterian
Church of Mesa, for the use of approximately 1,583 square feet of classroom space located
at 161 North Mesa Drive, Mesa, Arizona to provide Head Start Services.

This purpose of the amendment is to address the following: (A) ratify approval of certain
Lessee Improvements to the existing sandbox will be replaced with 585 sf of turf on the East
side and 600 sf of concrete on the West side, when this project is complete there will no
longer be a sandbox at a one-time cost of up to $45,000; (B) amend alterations provisions;
(C) amend Notices; and (D) provide for lease administration authority. The Agreement is
subject to termination pursuant to the provisions of A.R.S. 38-511. Either Lessor or Lessee
may terminate the Lease by giving not less than sixty (60) days prior written notice of
termination to the other Party. All other terms and conditions remain the same.

COMPETITION IMPRACTICABLE WITH RSM US LLP

Approve a Competition Impracticable with RSM US LLP for a total of $1,100,000 to permit
the continuation of the project began under contract SERIAL 171074-S PROJECT BASED
TECHNOLOGY CONSULTANTS. The original contract has an expenditure limit of
$1,000,000 per project and newly identified components will increase the project to
$2,100,000.

The Human Services Department procured RSM US LLP through a Task Order for a Case
Management System. The Task Order allows for up to $1,000,000, and therefore a
Competition Impracticable was processed through the Office of Procurement Services for
the additional $1,100,000 for the new required components, including those related to federal
requirements for case management and data tracking for COVID related assistance.

Upon approval for the increase to the Contract with RSM US LLP, the Human Services
Department will be authorized to expend an additional $1,100,000 above the task order limit.
FY2021: $1,100,000 Expenditures - This will be paid for by grant funds awarded by the
Kresge Foundation (C-22-20-006-G-00) and from funds from the Emergency Rental

ACCEPTANCE OF CARRYOVER FUNDS FROM THE U.S. DEPARTMENT OF HEALTH
AND HUMAN SERVICES FOR FY2021 FOR THE EARLY HEAD START PROGRAM
GRANT

Accept the receipt of funds from the U.S. Department of Health and Human Services
(DHHS)/Administration for Children and Families (ACF), Office of Head Start (OHS), Grant
No. 09HP000200 for Fiscal Year 2021 Carryover funds. The Maricopa County Head Start
program submitted an Application for Federal Assistance Standard Form SF-424 in
December 2020.

The Office of the Head Start provided a Notice of Award (09HP000200-02-02) for the funding
amount of $33,549. The period of funding availability is July 1, 2020, through June 30, 2021.
The funding for FY2021 is increased to $3,478,322. The Grant requires Non-Federal Share
(NFS) (In-Kind Match) of $673,423.

The Office of Head Start awarded Maricopa County Grant No. 09HP000200 for Early Head
Start for the project period began July 1, 2019, through June 30, 2024. With this NOA, the
overall Grant amount is increased to $6,312,622. Future or ongoing contributions are not
required after the grant period ends.

The FY2021 Carryover funds are a one-time award and provided to the County through a
non-competitive process since the County is a current recipient of Grant No. 09HP000200.

DEPARTMENT VEHICLE FLEET

The Maricopa County Human Services Department is requesting the following actions:

1.
Request authorization to dispose of a vehicle asset assigned to the Human Services
Department, Early Education Division-Head Start program fleet.

Approve and execute Revocable License Agreement P-50360 between City of Mesa and
Maricopa County for the continued use of the Mesa Library. The new License Agreement
will allow County the non-exclusive use of 3,190 square feet of office space (Premises) at
the Mesa Library located at 64 East 1st Street, Mesa, Arizona 85201. There is no cost to the
County for the space.

Term of the Agreement shall commence upon execution by both parties and expire on June
30, 2022. Either party may terminate this Agreement with 60 days’ written notice to the other
party and is subject to A.R.S. § 38-511. The term may be extended by mutual written

TRANSPORTATION SERVICES

Request approval to submit a grant application on behalf of Maricopa County to the Arizona
Lottery Funds (ALF) for FY2021 transportation services for individuals with Americans with
Disabilities Act (ADA) certifications. Transportation services shall be provided by Valley
Metro and administered by Public Transportation Authority (RPTA). Grant application
requested amount is $818,075, all funds shall be utilized for the provision of transportation
services and do not contain Administrative or Indirect funds.

Also request authorization for the Chairman to sign all documents related to the grant funding
and authorize the Chief Financial Officer to sign financial documents related to this grant.

The Human Services Department shall submit the grant application on behalf of the County.

If the grant application is approved and Maricopa County is awarded the ALF grant, funds

will oversee the delivery of transportation services provided by Valley Metro.

Dietetic Internship Program. The term of this Agreement is from October 1, 2019, through
September 30, 2024. The revised price sheet is for a total not-to-exceed amount of $154,000

The Department of Public Health’s Indirect Rate for FY-21 is 18.8%. Indirect costs are
budgeted at $24,370 which are fully recoverable. Departmental indirect rates are
reestablished at the beginning of each fiscal year and the future indirect rates will be collected
at the corresponding rates.)This grant award is reoccurring and has been awarded to the
department for many years. There is no cash or in-kind match required and indirect costs

a mandated function but provides a benefit to the citizens by increasing the number of
Women, Infant and Children (WIC) Registered Dieticians to provide high risk nutrition

an Arizona non-profit charitable corporation, for County use of approximately 3,026 square
feet of retail office space located at 6850 West Indian School Road, Phoenix, to operate a
regional WIC facility.

The purpose of this amendment is to address the following: (A) extend the term of the
agreement for five (5) years commencing on June 1, 2021 through May 31, 2026; (B) adjust
the annual rent schedule to reflect the predetermined Base Rent annual increases shown in
2.1 of original agreement; (C) authorize approval of certain tenant improvements; (D) amend
the renewal option; (E) allow for counterpart signatures of the Agreement as amended; (F)
update delegation authority; (G) provide for notice of sale; and (G) acknowledge the
Commencement date of original Agreement. This Agreement may be terminated by Tenant
at the end of any fiscal year due to non-appropriation of funds without any penalty or liability

Supervisors'/County Manager's summary of current events - Resumen de temas de

Supervisor Chucri provided an update on the Rio Verde DWID formation. He stated he
will be meeting with the opposition and applicant next week.

Supervisor Hickman noted he attended a Rotary Club meeting in Wickenburg. He talked
with business owners and retired business owners who have settled in Wickenburg. He
said they were well aware of what was happening downtown and had questions. He
reported they appreciated how the Board of Supervisors behaved in following the path
of the law. He reminded everyone that the County line runs through Wickenburg, with
part of the town in Maricopa County and part in Yavapai County. A home builder stated
he wished he would have purchased in Maricopa County because the treatment of
businesses was different in Yavapai County. Supervisor Hickman said Maricopa
County is viewed in such a great light. He noted there were more permits issued during
the pandemic than the year before. He wanted staff to know someone feels Maricopa
County has done well.

Supervisor Gallardo thanked Supervisor Hickman for attending remotely today so he
could attend in person to make the appointment of a new constable. Since they do not
get to make many appointments, he wanted to be present. He noted it was Cinco de
Mayo and said it was a nice time to celebrate with family and friends. He said he has
been working with urban farming partners in the west valley. They are partnering with
schools to get kids engaged in urban farming. Urban farming has been great during the
pandemic providing food boxes and they are now working directly with schools. He
recognized Rudy Santa Cruz who stepped down as the constable for the West
McDowell Precinct and he congratulated Byron L. Rhymes, Jr. for his appointment. It is
an important position, and he noted all constables do a great job and Mr. Rhymes will
be another great addition.

Supervisor Gates commented on the great work being done in Planning and
Development. He noted the incredible amount of permits in April and is grateful for
those investing in Maricopa County. He stated he served as one of the judges for the
Regents Cup competition on April 24, 2022, and he noted the level of competition was
so impressive. Arizona is in good hands. Arizona State University won, and they
continue to move forward in a virtual environment, and it was seamless. He stated this
is a competition that is here to stay, and the winners won a $15,000 scholarship.

Chairman Sellers reported he attend an event called Asian American Pacifica Islander
vaccination event that was put together with the Korean Nurses Association and the
Maricopa County Public Health Department. This was an effort to reach people having
difficulty getting appointments for vaccinations. He said there were a number of people
who approached him to thank the Public Health Department. He said he also attended
an Asian American Association meeting in Mesa. There were over 200 people who
attended, and they were having to turn people away. He said the Asian community

makes up more than 10% of his district and they are an involved and committed group
of people. He also attended a Work Zone Awareness Week press conference at
MCDOT. The need for work zone safety was emphasized due to the loss of a Maricopa
County employee; He appreciated all that MCDOT does and how well Work Zone
Awareness is publicized.

BIDS AND AWARD FOR EAST MARICOPA FLOODWAY LOW FLOW CHANNEL

Authorize the advertisement of the Invitation for Bids for the East Maricopa Floodway Low
Flow Channel from Guadalupe Road to Ray Road (Project [#121]) and award of the contract
to the lowest responsible bidder, if the bid is not more than ten percent (10%) over the
engineer’s estimate.

The Project will construct a small concrete low flow channel within the grass lined East
Maricopa Floodway (EMF) that was constructed in the 1980’s. This segment of the EMF has
an extremely low longitudinal slope, resulting in very low flow velocities and long-lasting
ponding water and muddy bottom conditions. Also, complaints regarding mosquitos/vectors
have been received from adjacent neighborhoods.

The concrete low flow channel will eliminate most of the ponding and muddy conditions and
facilitate sediment and debris removal from the EMF.

The project is 100% funded by the Flood Control District of Maricopa County. This Agenda

UPDATE

Approve Intergovernmental Agreement (IGA) FCD 2020A017 with the City of Chandler to
evaluate existing conditions and identify deficiencies and areas of flooding for their
Stormwater Management Master Plan Update. The estimated total Project cost is $800,000.
The district’s estimated share of the Project cost is $400,000 and the City’s estimated share
of the Project cost is $400,000. This Agreement shall become effective as of the date it has
been executed by all PROJECT PARTNERS and shall expire two years from that date, or
upon completion of these Project activities, whichever occurs first.

The Flood Control District is empowered by Arizona Revised Statutes Section (A.R.S.) 48-
3603, to enter into this Agreement. The City of Chandler is empowered by A.R.S. Section
11-952 as amended, to enter into this Agreement.

The City of Chandler Stormwater Management Master Plan Update will evaluate existing
conditions and identify deficiencies and areas of flooding, including known areas of concern
along Hunt Highway. The Comprehensive Master Plan Update may result in future Capital

BASIN AREA DRAINAGE IMPROVEMENTS PROJECT

Approve Intergovernmental Agreement (IGA) FCD 2021A001 for the Design, Rights-of-Way
Acquisition & Utility Relocations of the Detroit Basin Area Drainage Improvements Project
(PROJECT) between the City of Chandler (CITY) and the Flood Control District of Maricopa
County (DISTRICT). This Agreement shall become effective as of the date it has been
executed by all PROJECT PARTNERS and shall expire ten years from that date, or upon
Project completion, whichever occurs first.

The PROJECT area is within the CITY bounded by Chandler Boulevard on the south,
Ivanhoe Place to the north, Hamilton Street to the east, and Delaware Street on the west.
The proposed improvements will consist of new storm drain and other conveyance facilities
to convey water to the existing Detroit Basin and then drain to an existing storm drain in
Chandler Blvd. This PROJECT will reduce the flood hazard in the area by providing a 10-yr
level of protection. This is a joint project with the CITY and the estimated total PROJECT
cost is $1,200,000. The cost will be shared 50/50 with the CITY making the DISTRICT’s
estimated share of the PROJECT cost $600,000. The CITY will take the lead for the
PROJECT. This Agenda Item impacts Supervisorial District 1. (C-69-21-089-X-00)

IGA WITH ADOT FOR DEVELOPING DEPTH-AREA REDUCTION FACTORS FOR
ARIZONA

Approve the Intergovernmental Agreement (IGA) between Arizona Department of
Transportation (ADOT) and the Flood Control District of Maricopa County (District) for the
development of updated depth-area reduction factors for Arizona. As part of the agreement
the district will fund the costs of the study that benefit watersheds affecting Maricopa County
and ADOT will fund the costs of the study that benefits watersheds that affect Arizona, but
outside Maricopa County watersheds. The district will fund $380,000 of the study and ADOT
will fund $60,000.

Engineers use rainfall depths developed by NOAA to complete studies that identify and
evaluate flood hazards. These values are also used to design drainage facilities (culverts,
basins, bridges, etc.). A depth-area reduction factor (DARF) is one of the factors used in the
rainfall determination.

The current Drainage Design Manual, Hydrology Volume includes reduction factors
developed in 1974 for the 6-hr storm event and 1984 for the 24-hr storm event. Recent
studies have been compared to gage data and other storm evidence and have shown that
updates are needed. Proper factors for determining rainfall are important to properly size
drainage facilities. This Agenda Item impacts all Supervisor Districts. (C-69-21-087-X-00)

AMENDMENT TO IGA WITH THE UNITED STATES GEOLOGICAL SURVEY FOR
WATER RESOURCES INVESTIGATION

Approve the amendment to the Intergovernmental Agreement (IGA) FCD 2020A015A,
between the United States Geological Survey [Agreement #20ZFJFA3000 (USGS)] and the
Flood Control District of Maricopa County (District), to extend the study to September 30,
2021, for collection and analysis of ground and surface water quality and quantity data on
lower Gila River. The amendment shall also increase FCD’s total costs of the IGA by
$90,000 and will not exceed $180,000. The USGS contributing the remaining funding up to
$180,000. Payments from the District are to be made quarterly.

To reduce the flood hazards in the Gila River, one of the strategies is to remove the dense
non-native salt cedar (i.e., tamarisk) from the river. Removing salt cedar from the Gila River
corridor and replacing it with native vegetation will help prevent salt cedar from growing back
and may reduce the extent of the floodplain. The survivability of cottonwoods, willows, and
desert shrubs is dependent upon soil chemistry and water quality and quantity. Such soil
and water data are lacking within the Gila River. Monitoring soil and water under this
agreement will provide data that can be used by the district and others to strategically target
areas where revegetation efforts have the highest potential for success. Partnering with the
USGS allows the district to leverage the USGS’s funding and expertise on water quality and
monitoring to obtain this data on the Gila River. This agenda item impacts Supervisorial
Districts 4 and 5. (C-69-20-027-3-01)
