Supervisor Gallardo introduced Amanda Chua.
Amanda Chua offered the Invocation.
2.
PLEDGE OF ALLEGIANCE - JURO FIDELIDAD A LA BANDERA
Amanda Chua, led the assemblage in the Pledge of Allegiance to the Flag
Supervisor Gallardo thanked Ms. Chua for her presence and noted virtual meetings 
were still in effect. Supervisor Gallardo stated Ms. Chua was a star in the community. 
She is a Phoenix attorney and the newest member of the Justice Court Pro Tem team. 
She previously served as President of the Asian State Bar. He reached out to Ms. Chua 
to welcome her to the Maricopa County family and Justice Court, but also for her 
advocacy of the Asian community that has been under attack since the beginning of 
the pandemic.  He said elected officials such as himself have been working with the 
Asian community and it is important to continue talking about some of the challenges 
and fears that many of the Asian communities are facing right now. This has been Ms. 
Chua’s passion – creating these types of dialogs. Supervisor Gallardo asked Ms. Chua 
to share her experiences within the laws and court systems. 
Ms. Chua thanked Supervisor Gallardo for the opportunity to speak before the Board of 
Supervisors (BOS). She noted she is still on the Asian American Bar Association for 
Arizona. She said she has been a resident of Maricopa County since 2007. She is 
currently a liaison for Arizona Collaborative Bar which is made up of 10 sister bar 
organizations. She is still on the Maricopa County Diversity Committee. She stated it 
was sad that it was now the Asians that are to be harassed and targeted. She said 
when she first moved to Arizona it was the most welcoming community. The Hispanics 
have had to deal with illegal immigration, there is the Black Lives Matter movement, 
and now the Asian community has been suffering discrimination since March 2020. 
They have been encouraged to share experiences and report these crimes through 
aapih.org, Asian American Pacific Islander Hate. Most Asians do not speak out as they 
are quiet people and seek their support at home. She spoke about an Asian Bar 
community event moderated through a psychologist. She said children are being told 
to get out of the country and are hurting without cause.  There must be some 
acceptance and healing. Words do hurt and people are creating violence in the 
communities. She stated that if Maricopa County could do something to increase 
resources available to individuals so they can heal and figure out what to do. She 
thanked the Board for allowing her to speak and noted that May is Asian Pacific 
American Heritage Month. She said the Asian community is just now realizing they are 
not alone and are beginning to share their experiences.
Supervisor Gallardo thanked Ms. Chua for her words. He said he has spent his career 
standing up for justice and equality. He stated he will stand with the Asian community 
and from a government standpoint we must continue this dialog and continue to stand 
together. 
Chairman Jack Sellers noted a significant presence of the Asian community in Chandler 
and the timeliness of this message.

The Board of Supervisors of Maricopa County, Phoenix, Arizona, convened in Formal Session at 
9:30 AM on Wednesday, April 7, 2021, in the Supervisors' Auditorium 205 W. Jefferson Phoenix, 
AZ 85003, with the following members present:  Jack Sellers, Chairman, District 1; Bill Gates, Vice 
Chairman, District 3; Steve Chucri, Supervisor, District 2 (remote); Clint Hickman, Supervisor, 
District 4; Steve Gallardo, Supervisor, District 5 (remote). Also present: Joy Rich, County Manager; 
Juanita Garza, Interim Clerk; Emily Craiger, Legal Counsel (remote); Maria Ceaglske, Minutes 
Coordinator.
Chairman Jack Sellers announced he wanted to recognize and remember Gustov 
Danielson, a MCDOT employee who was killed, and another employee who was injured 
after being struck by a hit and run driver while working an accident scene. He said Mr. 
Danielson moved to the Phoenix area shortly after his 30th birthday. Mr. Danielson saw 
Phoenix was bigger than where he originally lived and wanted more opportunities for 
his four daughters. Mr. Danielson was part of MCDOT for nearly 7 years and 
encouraged peers to be involved with the opportunities offered by MCDOT. He often 
spoke of values and the importance in being a professional. Jerod Carrell was also 
struck, and he sustained serious injuries but has been released from the hospital and 
is recovering at home.
Chairman Jack Sellers requested the assemblage to stand for a moment of silence.

PET SHOWCASE BY MARICOPA COUNTY ANIMAL CARE AND CONTROL - 
PRESENTACIÓN DE ANIMALES DOMESTICOS POR EL DEPARTAMENTO DE 
CONTROL Y CUIDADO DE ANIMALES
Monica Gery introduced Rascal, a 7-year-old dog with a pep in his step. He is house 
trained and a possible Basenji mix. His adoption fees are sponsored this weekend 
during their Active Dog Weekend Special. This includes the vaccinations, microchip, 
and licensing.
Rascal is available at the West Valley Shelter and public may visit adoptable pets by 
making an appointment by calling 602-506-PETS (7387).

a. Development of the site shall be in substantial conformance with the Site Plan entitled “AZ 
Game and Fish WCF “, consisting of five full-size sheets, dated January 11, 2021, and 
stamped received January 27, 2021, except as modified by the following conditions
b. Development of the site shall be in substantial conformance with the Narrative Report 
entitled “AT&T AZ Game & Fish WCF”, consisting of four pages, dated January 21, 2021, 
and stamped received January 27, 2021, except as modified by the following conditions.
c. The following Planning Engineering condition shall apply:

Minimum setback the Wireless Communication Facility from any property line shall 
be 23 feet.

Maximum diameter of the antenna array of the wireless communications tower shall 
be 12½ feet; unless increased height for an Eligible Facilities Request per Federal Rule can 
be accommodated with maintenance of integrity of stealth design.
    4.
Maximum diameter of the wireless communications tower’s base shall be 44 inches, 
unless increased height for an Eligible Facilities Request per Federal Rule can be 
accommodated with maintenance of integrity of stealth design.
    5.
Maximum height for the Wireless Communications Facility perimeter fences shall be 
12 feet.  
e. The wireless communication tower shall retain the stealth properties as originally 
designed. Any damaged or missing faux cactus shrouds shall be replaced within 60 days of 
such damage occurring. 
f. A Minor Amendment approved administratively shall be required to co-locate future carriers 
on the Wireless Communication Facility. 
g. This Special Use Permit is valid for a period of 20 years and shall expire on April 7, 2041, 
or upon termination of the use for a period of 90 or more days, whichever occurs first. All site 
improvements associated with the special use permit shall be removed within 90 days of 
such expiration or termination of use.  
h. Noncompliance with any Maricopa County Regulation shall be grounds for initiating a 
revocation of this Special Use Permit as set forth in the Maricopa County Zoning Ordinance. 
i. The granting of this change in use of the property has been at the request of the applicant, 
with the consent of the landowner.  The granting of this approval allows the property to enjoy 
uses in excess of those permitted by the zoning existing on the date of application, subject 
to conditions.  In the event of the failure to comply with any condition, and at the time of 
expiration of the Special Use Permit, the property shall revert to the zoning that existed on 
the date of application.  It is, therefore, stipulated and agreed that either revocation due to 
the failure to comply with any conditions, or the expiration of the Special Use Permit, does 
not reduce any rights that existed on the date of application to use, divide, sell or possess 
the property and that there would be no diminution in value of the property from the value it 
held on the date of application due to such revocation or expiration of the Special Use Permit. 
The Special Use Permit enhances the value of the property above its value as of the date 
the Special Use Permit is granted and reverting to the prior zoning results in the same value

of Arizona statute ARS §28-8481. Your house should include sound attenuation measures 
as directed by State law. You will be subject to direct over flights and noise by Luke Air Force 
Base jet aircraft in the vicinity.
Luke Air Force Base executes over 200,000 flight operations per year, at an average of 
approximately 170 overflights per day. Although Luke's primary flight paths are located within 
20 miles from the base, jet noise will be apparent throughout the area as aircraft transient to 
and from the Barry M. Goldwater Gunnery Range and other flight training areas.
Luke Air Force Base may launch and recover aircraft in either direction off its runways 
oriented to the southwest and northeast. Noise will be more noticeable during overcast sky 
conditions due to noise reflections off the clouds.
Luke Air Force Base's normal flying hours extend from 7:00 a.m. until approximately 
midnight, Monday through Friday, but some limited flying will occur outside these hours and 
during most weekends.
Such notification shall be recorded on all Final Plats, be permanently posted on not less than 
a 3 foot by 5-foot sign in front of all home sales offices, be permanently posted on the front 
door of all home sales offices on not less than an 8½ inch by 11-inch sign, and be included

above the ground. You will be subject to direct overflights and noise by Luke Air Force Base 
jet aircraft in the vicinity.

Luke Air Force Base executes an average of approximately 165 overflights per day. 
Although Luke’s primary flight paths are located within 20 miles from the base, jet noise will

in front of all leasing offices and be permanently posted on the front door of all leasing offices 
on not less than 8½ inch by 11-inch sign.
i. Zoning approval is conditional per Maricopa County Zoning Ordinance, Article 304.6, and 
ARS § 11-814 for five (5) years, within which time all parcels within the R 5 RUPD zoning 
district shall be subject of an approved plan of development or final subdivision plat, and an 
issued infrastructure permit for ultimate residential development. If this term is not met the 
Planning and Development Department may present the R-5 RUPD zoning for Z2020078 to 
the Board of Supervisors (Board), upon recommendation by the Planning and Zoning 
Commission (Commission), for consideration of amendments or revocation of zoning for

STATE RETIREMENT SYSTEM GOVERNMENT PROPERTY LEASE TAX
Under A.R.S. § 42-11102(C), the Arizona State Retirement System (ASRS) may elect to 
have the taxes on its income producing properties based upon their full cash value as 
determined by this Office ("voluntary contributions") or pursuant to A.R.S. § 42-6201 et seq., 
it may provide for a government property lease tax ("GPLET"). The ASRS has timely notified 
the Assessor's Office that it is electing to have its sole property in Maricopa County taxed 
under the GPLET framework for tax year 2021. That property is a high-rise office building 
located at 3300 N. Central Ave, Phoenix (APN #118-37-021P). The computed tax due on or

ADDITION TO FLEET-HORSE TRAILER
Approve a permanent addition to fleet of a horse trailer to be used by the Sheriff's Lake Patrol 
Mounted Unit to transport horses to events and demonstrations.   The trailer will have a 
bumper-pull style hitch, a capacity to haul a maximum load of 4 horses, double axles and be 
equipped with trailer brakes.  The trailer will be a slant load, with front tack room with pull out 
saddle rack and water tank.  The estimated cost of this trailer is $8,895 plus tax to be paid

RESOLUTION APPROVING THE SUBMISSION OF PROJECTS FOR CONSIDERATION 
IN ARIZONA’S 2022 GOVERNOR'S OFFICE OF HIGHWAY SAFETY PLAN AND ONE 
TIME ADDITION TO FLEET
Adopt a Resolution approving application and acceptance of up to $645,760 in reimbursable 
grant funding from the Governor’s Office of Highway Safety (GOHS). This pass-through 
federal funding will be used for overtime, training, and equipment to accomplish projects 
related to highway safety. 
This resolution for Maricopa County specifically authorizes the filing and acceptance of grant 
funding from the priority Program areas: 1) a. Impaired Driving (DUI Enforcement; Underage 
Drinking Enforcement; officer training for recognizing impairment and enforcing the law) 
$456,733; and b. Impaired Driving (Warrant Details) $42,000; 2) Accident Investigation, 
$65,200; and 3) Police Traffic Services (Reckless/Aggressive Driver education and 
enforcement, speed related patrol enforcement, DUI enforcement/alcohol violations and 
school speed zone and construction zone enforcement) $86,828. The anticipated term of the 
funding is October 1, 2021, through September 30, 2021.

The Sheriff’s Office has received this funding for approximately 20 years. It is competitive 
and recurring. There is no match requirement. The funding limits employer related expense 
reimbursements to 40% and the Sheriff’s Office is required to fund the difference ($103,923) 
from its general fund appropriation.
This funding does not allow indirect cost recovery. The Sheriff’s Office indirect cost rate for 
FY2021 is 14.6%. This funding is earmarked primarily for overtime expense, training, and 
the purchase of program related equipment. Capital equipment purchases comprise $98,139 
of the $645,760 total, for an indirect cost base of $547,621 and estimated unrecoverable 
indirect costs of $79,953. There are no future or ongoing contributions required after the 
grant ends. This funding supports and enhances the Sheriff’s Office public safety mandate. 
Also approve a one-time addition to fleet of two Patrol Vehicles that will be equipped with 
radios, MDC and docking stations to be funded through the DUI Enforcement component of 
this project. Specific vehicle information to be provided following acquisition.   The vehicles 
will be retired at the end of useful life with no funding for replacement from the General Fund.
Grant revenues are not local revenues for the purpose of the constitutional expenditure 
limitation, and therefore, expenditures of these revenues are not prohibited by the budget 
law.
This funding is earmarked primarily for overtime expense, training, services, and the 
purchase of program related equipment items that include two patrol vehicles with radios

WHEREAS the Governor’s Office of Highway Safety is seeking proposals from state 
and local jurisdictions for projects relating to all aspects of highway safety; and
WHEREAS, the Maricopa County Board of Supervisors, through the Maricopa County 
Sheriff's Office is interested in submitting projects to be considered for funding in the 
form of reimbursable grants from the National Highway Traffic Safety Administration;
NOW, THEREFORE, BE IT RESOLVED that the Maricopa County Board of 
Supervisors hereby:
• Approves the filing and acceptance of grant funding from the priority Program areas 
of Accident Investigation, Impaired Driving (DUI Enforcement & Underage Drinking 
Enforcement), Police Traffic Services/Speed Control and Buckle Up AZ Enforcement 
Campaign in an amount not to exceed $645,760 and
• Authorizes the Sheriff, or his designee, to submit all financial and other reporting 
documents required in connection with such grants.

ARIZONA DEPARTMENT OF EDUCATION FUNDING FOR FY2022 INDIVIDUALS WITH 
DISABILITIES EDUCATION ACT (IDEA) BASIC ENTITLEMENT
Approve acceptance of $33,687.88 in continued grant funding from the Arizona Department 
of Education, for the FY2022 Individuals with Disabilities Education Act (IDEA) Basic 
Entitlement. This funding provides contracted special education consulting services for staff 
training and IDEA implementation along with a variety of contracted professional services for 
juvenile inmates.  The term of this funding is from July 1, 2021, through June 30, 2022. 
This funding award is re-occurring and has been awarded for last eighteen (18) years 
allowing MCSO to meet its mandate concerning jailed juveniles and inmates under 21that 
are eligible for special education.  The Sheriff’s Office indirect cost rate for FY2021 is 14.6%. 
Indirect costs associated with this funding are estimated to be $4,918.43 of which $4,042.55 
is recoverable because the grantor permits 12% indirect cost recovery.  There is no match 
requirement and there are no future or on-going contributions associated with this funding. 
This funding is eligibility based and is non-competitive.

Supervisor Clint Hickman said he had read a story about the federal government 
auditing CARES Act funds.  He thanked Lee Ann Bohn and her staff for their work. He 
said he was glad Ms. Bohn was present for so many of the decisions being made. He 
said he is confident the BOS has been correct in their decisions.

Approve an agreement between Rocky Mountain Cocker Rescue and Maricopa County, 
administered by Maricopa County Animal Care and Control, to allow said rescue to transfer 
animals that have been deemed eligible for the New Hope program. Maricopa County will 
provide a rabies vaccination, dog license tag, and new owner transfer fee within the first year 
of transfer for each dog three months of age or older at no cost to the Contractor. The cost 
for these services is $52 for each animal transferred in FY 2021 and thereafter. Animal Care

DONATION TO HEAD START PROGRAM
In accordance with County Policy A2508, accept the donation report from the Human 
Services Department. 
The Human Services Department, Early Education Division - Head Start program applied for 
and received a $2,000 donation (Grant) from The Church of Jesus Christ of Latter Day Saints 
Deseret Industries for Head Start program families to receive vouchers to obtain household 
furniture and household items.
The Head Start program will issue vouchers to families that identify a need for household 
items. The Head Start program can utilize the vouchers through March 31, 2022, as long as 
the vouchers issued do not exceed the $2,000 dollar limit issued to the County.
Receipt of the donations does not require in-kind, match or future or ongoing contributions 
by the County. The Head Start program will encourage recipients of the vouchers to 
volunteer in their community to enhance safe communities through civic engagement.

Approve Amendment No. 2 to the revenue Agreement between Arizona Department of

The purpose of Amendment No. 2 is to address the following:
A. ADOH award increase to the County Low Income Home Energy Assistance Program 
(LIHEAP) Coronavirus Aid, Relief, and Economic Security (CARES) Act funds. Increase 
includes $20,343 in Administrative Funds and $233,863 in Project Funds for a total increase 
of $254,206. Total LIHEAP CARES funds are $872,215. LIHEAP CARES Act funding is to 
be expended prior to other LIHEAP funding. Contract expiration remains the same. The 
funds will be utilized to provide Weatherization Assistance Program measures in dwellings 
occupied by low-income households in Maricopa County outside of the City of Phoenix and 
the City of Mesa. The County will be required to serve twenty-three (23) additional units, 
totaling (104) units with LIHEAP-CARES Act funds.

The purpose of this Amendment is to address the following: 
a) Extend the term of the Agreement for three (3) years commencing on July 1, 2021, through 
June 30, 2024, at a monthly gratis rent during the extended term; 
b) Amend Renewal Term; 
c) Allow for Sublessee Improvements to fill a large hole (from previous tree removal) located 
next to the playground with concrete at a one-time cost of up to $950;

Bylaws of the Maricopa County Parks and Recreation Advisory Commission

WHEREAS, according to its Bylaws, the Commission shall act in an advisory role to the 
Board and recommend broad policies and long-range programs for the acquisition, 
planning, development, maintenance, and operation of the County parks, and
WHEREAS, the Commission and the Board recognize the quality of life, natural 
resource, and economic benefits provided by a strong and vibrant County system of 
regional parks, trails and programs and further recognize the desirability and 
responsibility of providing quality natural resources for current and future County 
residents, and
WHEREAS, the Commission and the Board recognize the importance, desirability, and 
responsibility of being good stewards of park lands as well as educating the public about 
caring for all natural resources in the region, and
WHEREAS, the Maricopa County Parks and Recreation Department has established a 
partnership with the national nonprofit organization Leave No Trace Center for Outdoor 
Ethics, created in 1994 between the U.S. Forest Service, National Park Service, Bureau 
of Land Management, National Outdoor Leadership School, and Outdoor Recreation 
Summit, and
WHEREAS, the mission of the Leave No Trace organization is to provide innovative 
education, skills, and research to help people care for the outdoors, and
WHEREAS, Leave No Trace works with the public, tourism industry and land managers 
at the city, county, state, and federal level to educate, train, and provide information on 
the most effective and least resource-intensive solutions to land protection.
NOW, THEREFORE, BE IT Resolved that:
1. The Maricopa County Board of Supervisors, based on advice from the Parks and 
Recreation Advisory Commission, directs the Parks and Recreation Department to 
adopt the environmental goals, principles, and policies included in the Leave No Trace 
Program in park planning, development, operations, and public education, where 
practicable.
2. The Parks and Recreation Department shall cooperate and collaborate with other 
interested parties for the implementation of the Leave No Trace Program.

SALT RIVER PROJECT LAND USE LICENSE FOR MARICOPA TRAIL - BUSH 
HIGHWAY TRAILHEAD
Approve and execute the Salt River Project Land Use License (“License”) between Maricopa 
County (“Licensee”) and Salt River Project Agricultural Improvement and Power District 
(“Licensor”) for the Maricopa Trail Bush Highway Trailhead (“MT”) as part of the Maricopa 
County trail system.
The purpose of this License is to use a certain section of Licensor’s property, as shown on 
Exhibit A, that includes a portion of Granite Reef Dam Road for the construction of a parking 
lot, trailhead area, trail, signage, and to clarify maintenance responsibilities of the parties.

District 2 – Dissolve the Maricopa County Aggregate Mining Operations Zoning District #2 
(a.k.a. Twin Knolls Aggregate Mining Operations Zoning District).  It was established by the 
Maricopa County Board of Supervisors on January 27, 2021, encompassing an area 
bounded by the Boise St. alignment on the north, 85th Pl. on the east, Apache Trail on the 
south, and 81st St. on the west.  The Board never subsequently appointed a Maricopa 
County Aggregate Mining Operations Zoning District #2 Recommendation Committee. The 
Board has learned that the area within the designated district boundaries is not inventoried 
and mapped as an area of known reserves and/or does not include an existing aggregate 
mining operation, and as such there is no statutory warrant for the district at this time. The 
Board may revisit this issue in the event an aggregate mining operation is created. (C-44-

ADDITIONAL REVENUE TO CONTRACT WITH ARIZONA DEPARTMENT OF HEALTH 
SERVICES FOR HIGH-RISK PERINATAL PROGRAM/NEWBORN INTENSIVE CARE 
PROGRAM COMMUNITY HEALTH NURSING PROGRAM
Approve additional funds for the ADHS Contract for Community Nursing Services 
CTR046941 between the Arizona Department of Health Services (ADHS) High Risk 
Perinatal Program (HRPP) and Maricopa County by and through its Department of Public 
Health (MCDPH).  The additional revenue is in the amount of $9,957.52 for the budget period 
ending June 30, 2020.  The contract term is from August 1, 2019, through July 31, 2022.
The HRPP NICP grant award is reoccurring and has been awarded to the department since 
1988. This grant does not require an in-kind match, indirect cost is fully recoverable and 
ongoing cash contributions are not required. The grant award is not a mandated function but 
provides a benefit to the citizens by providing developmental follow-up through home-based 
services for families whose children received intensive or special care immediately after birth 
and for children with identified special health care needs.  The grant award is competitive. 
All program costs are allocated to the grant so there will be no additional burden on the 
department’s operating budget. 
The Department of Public Health indirect rate for FY2020-21 is 18.8%.  The indirect costs 
are estimated at $1,575.77 and are fully recoverable. 
Grant revenues are not local revenues for the purpose of the constitutional expenditure 
limitation and therefore expenditure of the revenues is not prohibited by the budget law.  This 
action does not alter the budget constraining expenditures of local revenues duly adopted 
by the Board pursuant to A.R.S. §42-17105.  The overall grant budget will be adjusted as 
necessary to accommodate this grant through a future reconciliation.  Funding for this grant 
will be provided by ADHS and will not affect the County’s general fund. (C-86-20-008-3-04)

AMENDMENT TO IGA WITH CITY OF TEMPE FOR MASS IMMUNIZATION SERVICES 
AND ADMINISTRATION
Approve an amendment to the IGA between Maricopa County, through its Department of 
Public Health (MCDPH) and City of Tempe, Fire Medical Rescue Department, for the 
continued provision and administration of seasonal flu vaccine (as well as COVID-19 and 
other types of vaccines, as needed) to those 6 months of age and older.  Funding is in the 
amount of $50,000 for the period beginning July 1, 2021, through March 31, 2022. The 
cumulative amount is $100,000 for the project period beginning September 11, 2020, and 
ending March 31, 2022.
This agreement will be CARES Act funded and was approved for this purpose on June 8, 
2020, as C-86-20-552-M-00. CARES Act funding is set to expire 12/31/2021. Should that

Services and Maricopa County by and through its Department of Public Health (MCDPH) to 
provide continued funding for WIC Services, Breast Feeding Peer Counseling Services 
Program (BFPC), and WIC Special Projects.  
The combined total revised Price Sheet is in the not-to-exceed amount is $9,813,175.00, a 
total of which reflects a decrease in WIC special services occupancy and indirect expenses 
totaling -$32,355, and an increase of $63,023 in additional local agency project funds for

Approve and execute Intergovernmental Agreement G-30228 (IGA) with Maricopa County 
Special Health Care District, dba Valleywise Health (“District”) for approximately 3,552 
square feet of space located within a portion of the building (Premises) located at 8088 W. 
Whitney Drive, Peoria, Arizona 85345.
The purpose of this IGA is to: (A) establish the terms and conditions for which Maricopa 
County Public Health can operate the Women Infant and Children program (WIC) and an 
Office of Vital Records (OVR) satellite location at the Premises, (B) confirm the amount 
Maricopa County will reimburse the District for Tenant Improvements as an amount not to 
exceed $575,000.00, and (C) to provide for administration authority to the Deputy County 
Manager and/or the Director of the Maricopa County Real Estate Department. 
This agreement will commence upon Substantial Completion of the Tenant Improvements 
or when Maricopa County begins operating out of the Premises (either of which is anticipated 
to happen no later than April 1, 2021) and continue for sixty months at a monthly, full-service 
facility Use Fee of $1,950.00 plus rental tax per month. The Commencement Date shall be 
memorialized by the Parties via execution of a Commencement Date Confirmation Form. 
Maricopa County shall have the option to renew this IGA for three additional terms of sixty 
months each at the predetermined rate as reflected in the IGA.  In addition to the Use Fee, 
Maricopa County will also be responsible to pay for and/or reimburse the District for electric 
to the Premises and janitorial services.  This Agreement is subject to A.R.S. § 38-511 and 
may be terminated by either party at any time upon one hundred-eighty (180) days’ prior 
written notice to the other party. The parties may also mutually agree to terminate this 
Agreement on an agreed upon date. This item is in Supervisory District 4.

continued funding for Home Visitation (HM) using the Nurse Family Partnership (NFP)

Set a hearing for June 9, 2021, for Road File No. PAB-0151 to consider the request to 
abandon a portion of a Federal Patent Easement Number 1147082 lying in the Southwest 
quarter of Section 6 – T4N, R2E of the Gila and Salt River Meridian, Maricopa County, 
Arizona. Located in the general vicinity of Parsons Road and 16th Avenue and known as 
Assessor Parcel Number 210-10-021L. 
Pursuant to provisions in A.R.S. §11-251.16, Maricopa County Ordinance No. P-34 and

hearing by certified mail shall be sent to the applicant and all abutting property owners no

AGREEMENT FCD 2021G001 AMONG THE FLOOD CONTROL DISTRICT AND 
MARICOPA COUNTY AND DIAMONDBACK SAND AND ROCK NORTH, LLC, AND 
RESOLVE CONSENT JUDGMENT ON CV 2019-015408
Approve and authorize the Chairman to execute Agreement FCD 2021G001 among The 
Flood Control District of Maricopa County and Maricopa County and Diamondback Sand and 
Rock North, LLC for Resolution of Outstanding Violations Involving APN 201-22-008B.
On May 26, 2020, a Consent Judgment was entered in the matter of Maricopa County v. 
Brown, CV 2019 015408. The Consent Judgment provided for agreed upon penalties and a 
compliance schedule for Planning and Development, Air Quality and Flood Control 
violations.  Although some progress has been made in resolving the violations, the Brown’s 
have contended that they lack the funds to bring the property into compliance.  
The Browns are now under contact with Diamondback Sand and Rock North, LLC for the 
conveyance of the property. Closing of escrow is pending.  Diamondback has been made 
aware of the violations on the property and has negotiated with Maricopa County and the 
District to bring the property into compliance. 
This agreement will resolve all issues in this matter and will replace the existing Consent 
Judgment.

The Clerk reported the following public comment emails were received and shared with 
the Board: 816 comments regarding elections; 2 comments regarding masks
Supervisor Hickman asked the Clerk how many were watching the meeting. 
Debra Schaffer, Deputy Clerk, responded there were three people that were non-
County staff watching the meeting. She said she did not know how many were watching 
on Facebook or the Clerk's website.
Supervisor Hickman stated meetings are available to the public and he has recently 
seen comments in the public about the Board holding closed sessions. He said he will 
continue to ask how many are viewing the meeting as we continue holding broadcasted 
meetings. He said the BOS was unable to meet as it did pre-COVID and said people 
have several options to watch and the Clerk of the Board of Supervisors Office 
continues to receive comments at agenda.comments@maricopa.gov.
Chairman Jack Sellers noted if more people watched the meetings there may be fewer 
emails.

Supervisors'/County Manager's summary of current events - Resumen de temas de

Joy Rich thanked Chairman Sellers for his comments on the MCDOT incident. She said 
everyone needs to slow down. This type of tragedy happens often, and motorists must 
be aware of these MCDOT workers exposed to traffic. She stated it is a significant 
problem.
Supervisor Chucri concurred with Ms. Rich's comments and thanked Chairman Sellers 
for his respectful recognition of these employees who were injured and/or killed in the 
line of duty. 
Supervisor Hickman spoke of the far west valley and the growth in the area. Hickman 
Farms’ corporate office is located off Jackrabbit Road and Southern Ave. along a county 
road.  He noted he sees County construction crews along his path often. He said there 
are so many construction projects occurring for the greater good of the community and

he has witnessed driving behavior of individuals that is horrifying.  He asked the 
community to slow down. He shared that his 16-year-old is becoming aware of 
construction sites as he is currently working towards driving privilege. He said the best 
thing to do to avoid an accident is to drive slow in construction zones so a driver has 
the ability to stop if needed. His heart goes out to both families especially the Anderson 
family on the loss of their family member.
Supervisor Gates thanked Chairman Sellers for his heartfelt condolences and noted 
other employees that are first responders and the positions they put themselves into for 
the growth of the County. He expressed heartfelt condolences to the Anderson family.
Chairman Sellers spoke of a working group meeting he and Supervisor Gates  recently 
attended regarding the extension of Proposition 400. Chairman Sellers spoke about the 
prioritized needs in the County and how to fund these needs for the next 20 years.

Authorize the advertisement of the Invitation for Bids of the Oak Street Basin and Storm

if the bid is not more than ten percent (10%) over the engineer’s estimate.
The Oak Street Detention Basin and Storm Drain project involves construction of a basin at 
Oak Street and Hawes Road, and storm drains east along Oak Street and north along Hawes 
Road. The project will provide protection in conjunction with drainage infrastructure 
constructed by the Hermosa Vista/Hawes Road and McDowell Road projects. 
The Basin and Strom Drain will be maintained by the Flood Control District of Maricopa 
County (FCDMC), and the project is 100% funded by FCDMC.

Approve the application and acceptance of grant funds from the Arizona State Library, 
Archives and Public Records in the amount not to exceed $25,000 for the purpose of 
professional development of staff and providing access to digital resources for customers. 
The grant award begins July 1, 2020, and ends on June 30, 2021.  Authorize the Chairman 
to sign all documents related to these grant funds as applicable.  The Library District indirect 
rate for FY21 is 11.27%.  Total grant indirect costs are estimated to be $2,817.50 and are 
not recoverable.  The grant award is reoccurring and has been awarded to the Library District 
in previous years.  The Library District does not have an in-kind match, or ongoing 
contributions requirement.  The grant award is not a mandated function but provides a benefit 
to the citizens by training staff and allowing access to resources to better meet the needs of 
the Library District customers.  The grant award is competitively bid, or non-competitive – 
not applicable.  There are no costs that will need to be absorbed by the Library District’s
