Contract No. C-22-22-052-X-01 Amendment No. 1 City of El Mirage Page 1 of 3 AMENDMENT NO. 1 TO THE INTERGOVERNMENTAL AGREEMENT BETWEEN MARICOPA COUNTY ADMINISTERED BY ITS HUMAN SERVICES DEPARTMENT AND THE CITY OF EL MIRAGE I. Maricopa County (“County”), administered by its Human Services Department, entered into a financial Intergovernmental Agreement (“Agreement”) with the City of El Mirage (“Subrecipient”) on or about December 1, 2021. The purpose of the Agreement is for the Subrecipient to construction a twelve (12) foot wide multi-use trail connecting West Cactus Road, west of North El Mirage Road to North Dysart Road, north of West Sweetwater Road. The County has provided the Subrecipient with $500,000 in U.S. Department of Housing and Urban Development (HUD) Community Development Block Grant CARES Act (CDBG-CV) funds. The Agreement term began on December 1, 2021 through March 31, 2023. The County and the Subrecipient collectively are referred to as the “Parties.” II. The Parties agree to amend the Agreement by this Amendment No. 1 as follows: A. The County shall provide the Subrecipient with an additional $450,000 to complete construction of a twelve (12) foot wide multi-use trail connecting West Cactus Road, west of North El Mirage Road to North Dysart Road, north of West Sweetwater Road. B. The Agreement amount shall now be increased to a total not-to-exceed amount of$950,000. Funding for Amendment No. 1 is provided by Assistance Listing Number (ALN) 14.218, U.S. Department of Housing and Urban Development (HUD) Community Development Block Grant CARES Act (CDBG-CV) funds. C. Revise Section 2 (Special Provisions) Paragraph 7.0 (ADMINISTRATIVE REQUIREMENTS) to address the following Sub-subparagraphs: 1. Sub-subparagraph 7.4.2, delete in its entirety and replace with the following: 7.4.2 All Subrecipients that receive federal funding must obtain a Unique Entity Identifier (UEI) number. The Subrecipient must also register and remain current with the System for Award Management (SAM) www.sam.gov/SAM/ a database of basic business information for subrecipients and contractors that receive federal funds. 7.4.2.1 To obtain a UEI Number use this link through http://fedgov.dnb.com/webform. The Subrecipient shall provide their UEI Number to the County. 7.4.2.2 For additional information on System for Award Management (SAM) and, UEI use this link: https://www.sam.gov/SAM/pages/public/generalInfo/about SAM.jsf. 2. Sub-subparagraph 7.7.2, delete in its entirety and replace with the following: Contract No. C-22-22-052-X-01 Amendment No. 1 City of El Mirage Page 2 of 3 7.7.2 UEI Number: All Subcontractors shall have a valid UEI number and an active profile in the federal System for Award Management (SAM). D. Revise Section 3 (Work Statement) Paragraph 2.0 (SCOPE OF WORK) to address the following: 1. Revise Subparagraph 2.1 (Project Description) delete in its entirety and replace with the following: 2.1 Project Description: The Subrecipient shall provide pre- development and construction management activities for the construction of a twelve (12) foot wide multi-use trail connecting West Cactus Road, west of North El Mirage Road to North Dysart Road, north of West Sweetwater Road Expand. 2. Add the following new Subparagraph: 2.6 Implementation Schedule: Activity Duration Start End Scope of Work 188 days March 1, 2022 September 5, 2022 Bidding & Contract Approval 69 days September 5, 2022 November 13, 2022 Construction 120 days November 14, 2022 March 14, 2023 Closeout 16 days March 15, 2023 March 31, 2023 E. Revise Section 4 (Budget and Compensation) Paragraph 1.0 (BUDGET) as follows: Activity Budget Pre-development, Construction, and Construction Management $950,000.00 Total $950,000.00 III. Section II above contains all the changes made by this Amendment No. 1. All other terms and conditions of the Agreement shall remain unchanged and in full force and effect as executed by the Parties. IV. The Parties have authorized the undersigned to execute this Amendment No. 1 on their behalf, and it shall be effective upon approval and signature by both Parties.
