KNOW ALL MEN BY THESE PRESENTS:
THAT WHEREAS Maricopa County Municipal Water Conservation District Number One,
a political subdivision of the State of Arizona, hereinafter called the GRANTOR, for and in
consideration of the dedication of property by GRANTOR to serve the public good and other
valuable consideration, receipt of which is hereby acknowledged, do hereby grant and convey to
MARICOPA COUNTY, a political subdivision of the State of Arizona, hereinafter called the
GRANTEE, and to its agents, successors and assigns, a drainage easement, legally described on
Exhibit “A” and depicted in Exhibit “B” attached hereto and incorporated herein (“Easement
Area”), for the purpose of performing all things necessary to ensure proper drainage upon, over,
under, across, through and along a portion of the premises set forth in instrument number 04739-
0093 in the official records of Maricopa County (“Burdened Property”).

LEGAL DESCRIPTION
A portion of land being situated within the Southeast Quarter of Section 4,
Township 2 North, Range 2 West of the Gila and Salt River Meridian, Maricopa
County, Arizona, being more particularly described as follows:
COMMENCING at a found 3 inch Maricopa County brass cap in hand hole
accepted as the Southeast corner of said Section 4 from which a found 2 inch
Maricopa County aluminum cap accepted as the South Quarter corner thereof
bears South 89°58'24" West, 2622.83 feet;
Thence South 89°58'24" West, 302.39 feet along the south line of the Southeast
Quarter of said Section 4;
Thence leaving said south line, North 00°01 '36" West, 55.00 feet to the POINT
OF BEGINNING;
Thence South 89°58'24" West, 38.21 feet along a line which is 55.00 feet north of
and parallel with the south line of the Southeast Quarter of said Section 4;
Thence leaving said parallel line, North 00°01 '36" West, 34.65 feet;
Thence North 90°00'00" East, 38.21 feet;
Thence South 00°01 '36" East, 34.63 feet to the POINT OF BEGINNING.
