RELEASE AND EXTINGUISHMENT OF EASEMENT

This Release and Extinguishment of Easement (“Release”) is made by the Flood Control 
District of Maricopa County (“District”), a political subdivision of the State of Arizona, 
and is effective as of the date of recordation. 
 
RECITALS 
 
WHEREAS, the District acquired a permanent easement and right of way (“Easement”) 
over a portion of land in Section 13, Township 1 North, Range 4 East of the Gila and Salt 
River Base and Meridian. 
 
WHEREAS, said easement rights were created by Easement and Agreement for Flood 
Control District Purposes which was recorded on December 24, 1997 as Document No. 
1997-0901711 records of Maricopa County, Arizona (“MCR”) for the benefit of District 
Parcels known as Parcels 7-6020, 7-6335, 7-6336, 7-6336-A, 7-6337, 7-6338, 7-6614-A, 
7-6616, 7-7562, and 7-7563 (portions).  
 
WHEREAS, District has determined that the easement area more particularly described 
on EXHIBIT “A” attached hereto and incorporated herein by this reference (the “Easement

Area”) is no longer needed for the purposes stated therein and desires to release and 
extinguish said easement. 
 
NOW, THEREFORE, District hereby forever releases, extinguishes and disclaims any 
and all interest in and rights to the portion of land over which the District has easement 
rights described in EXHIBIT “A” attached hereto which are areas described in the 
Easement recorded as Instrument No. 1997-0901711 in the MCR.
