Additionally, LAFB commented favorably and staff is supportive of the POD. There are no outstanding concerns from reviewing agencies. Commission Recommendation: On 4/21/22, the Commission voted 8-0 to recommend approval of Z2021136 subject to conditions ‘a’ – ‘f’: a. Development of the site shall be in substantial conformance with the Site Plan entitled “Liberty Utilities Marvella Well Site No. 2“, consisting of 7 full-size sheets, dated February 11, 2022, and stamped received February 11, 2022, except as modified by the following conditions. b. Development of the site shall be in substantial conformance with the Narrative Report entitled “Liberty Utilities Marbella Well Site No. 2 Plan of Development Narrative Report - Revised”, consisting of 7 pages, dated February, 2022, and stamped received February 11, 2022, except as modified by the following conditions. c. The following Planning Engineering conditions shall apply: 1. The building Permit for Marabella wellsite No 2 cannot have the Final Inspections until after the Building Permit B20200905 and its MCDOT Permits have been finaled. 3. Drainage review of planning and/or zoning cases is for conceptual design only and does not represent final design approval nor shall it entitle applicants to future designs that are not in conformance with Section 1205 of the Maricopa County Zoning Ordinance and the Maricopa County Drainage Policies and Standards. 4. All development and engineering design shall be in conformance with Section 1205 of the Maricopa County Zoning Ordinance and current engineering policies, standards and best practices at the time of application for construction. 5. Any construction in MCDOT Right-of-Way of Northern Avenue must have a MCDOT Right-of-way Permit. d. The property owner/s and their successors waive claim for diminution in value if the County takes action to rescind approval due to noncompliance with conditions. e. Prior to issuance of a building permit, written confirmation will be required from the emergency fire protection jurisdiction having authority that the facility has been designed in accordance with their regulations and requirements, and that emergency fire protection service will be provided to the facility. Prior to issuance of the certificate of occupancy, local fire protection jurisdiction review and approval will be required. f. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, the property shall revert to the zoning that existed on the date of application. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation of the Plan of Development. The Plan of Development enhances the value of the property above its value as of the date the Plan of Development is granted and reverting to the prior zoning results in the same value of the property as if the Plan of Development had never been granted. The applicant is seeking a Plan of Development for a second well site to feed water to existing treatment equipment, which is an allowed use within the base Rural-43 zoning district. There is an existing well site with water treatment equipment located approximately 1,800 feet north of the subject site. No additional treatment equipment will be included at the new well site. The purpose of the second well is to be able to increase flow to the existing treatment equipment located at the initial well site to the north. 2. The subject site was included with UC2019006 and MCP2020002, the later of which was approved by the Board of Supervisors (BOS) by a vote of 5-0 on October 7, 2020. The Pre- application meeting for the subject project was held October 12, 2021. The subject case was formally submitted on October 29, 2021. 3. The site will be surrounded by a 8 foot high masonry wall for ample screening and will be accessed through an electrified gate with security access pad. Besides the pumping equipment itself, the site will have electrical equipment, a backup generator, lighting, and on site retention. The site will be mostly unmanned with only the occasional maintenance worker on site. Public Participation Summary: 8. The applicant sent initial mailers out to all properties within 300’, areas of interest, as well as other local jurisdictions. The applicant did not receive any responses or comments as a result of the Public Participation. Staff notes that there are no parcels with active residential uses within 300’ which may have contributed to the lackluster public response. Outstanding Concerns from Reviewing Agencies: 9. N/A. Staff Analysis: 10. The subject site was previously subject to the approved UC2019006 and MCP2020002, of which utility uses where identified as a compatible use on the site. The proposed Plan of Development is for a well site to be operated by Liberty Utilities, which is conducive to the prior approvals. Furthermore, the determination that utility uses are compatible on the site by the previous approvals adheres to the area plan land use designation of “Military Compatible”. To further strengthen the compatibility of the proposed POD Luke Air Force Base was informed of the proposed POD and provided favorable comments. 11. The well site will serve as a companion well for an existing well site and treatment facility. It is also in close proximity to an existing water canal and the Morton Salt facility. The proposed use meshes well with these and other area land uses. For these reasons staff is of the opinion that the proposed POD for a well site is compatible with the area and Luke Air Force Base Operations. Recommendation: 12. Staff recommends the Commission adopt a motion recommending that the Board of Supervisors approve Z2021136 subject to the following conditions ‘a’ – ‘f’. a. Development of the site shall be in substantial conformance with the Site Plan entitled “Liberty Utilities Marvella Well Site No. 2“, consisting of 7 full-size sheets, dated February 11, 2022, and stamped received February 11, 2022, except as modified by the following conditions. b. Marbella Well Site No. 1 is currently in construction. The Marbella Well Site No.2 will include equipping of an existing well, an on-site retention basin, a standby generator, electrical equipment housed under a shade canopy, two paved access roads, one motor operated access gate, and a fenced in area for APS access and equipment with a swinging access gate. A transmission waterline will convey the raw discharge from well no. 2 to the well no. 1 site for treatment and connection back to the distribution system. The purpose of this request is to apply for a Military Compatibility Permit with Plan of Development for the Marbella Well Site No. 2, located near the intersection of Northern Parkway and Dysart Road (the “Property”). The site address is 12749 West Northern Avenue, Glendale, AZ 85335. Please reference the Legal Description included on the Design Plan cover sheet for the Property’s exact location. 2.0 Existing Site Conditions The site is vacant and undeveloped. There are no unique topographical conditions and the Property is not within a floodplain. The Property falls within the 65 decibel noise level lines (LDN 65) on the County’s land use plan and zoning maps. 3.0 Description of Proposal 3.1 Proposed Use Marbella Well Site No. 2 with onsite retention, Marbella Well No. 2, standby power and electrical equipment. A 6-inch transmission waterline will bring Well 2 raw water to treatment at Well Site No. 1. Treatment for Well No. 2 will be at Well No. 1 Site and will include arsenic treatment, chlorine disinfection, and pH adjustment. The requested Military Compatibility Permit with a precise Plan of Development for the Well Site No. 2 water utility campus use will enable the property owner to develop an approximate 0.46 acre water campus in order to serve the area. Liberty Utilities Marbella Well Site No. 2 Plan of Development Narrative Report 2 3.2 Business Operations The site will be run by Liberty Utilities, with designated personnel coming to check the functionality and performance after build out. Personnel on site will be for maintenance purposes and will be minimal, as the well site itself is not a permanent place of employment. It is expected that there will be a maximum of three (3) maintenance employees assigned to the well site. Hours of operation shall be from 8 a.m. to 5 p.m., Monday through Friday. 3.3 Building Location and Description The Marbella Well Site No. 2 will not have any buildings. Electrical equipment will be housed under a shade canopy. 3.4 Site Signage Site signage will be mounted on the perimeter walls and the front entry gate. Details for these signs are included with the design plans in this application. 3.5 Site Perimeter Wall The site will be fenced by a block wall along all perimeter sides with a motor operated sliding access gate on the southern perimeter to allow entry. A manual swinging access gate will be on the southern perimeter and will allow entry to the APS equipment. 4.0 Relationship to Surrounding Properties The property is northwest of the Morton Salt Facility, south of Agricultural and industrial uses and east of vacant land. The requested use is a water campus for Liberty Utilities to be able to serve the existing and emerging growth and development in this area. The Property is currently zoned Rural-43 with LDN 65 noise level. It is within the White Tank Grand Avenue Area Plan with a Land Use Category of Military Compatible. The requested Military Combability Permit with Plan of Development is to allow for Well Site No. 2 to be used as a Water Campus (Utility Use) on the Property which is compatible with the land uses permitted under Section 1010.6 of the Maricopa County Zoning Code, ARS §28-8281 and the approved Use Compatibility and Consistency Determination (UCCD), included with this application. Liberty Utilities Marbella Well Site No. 2 Plan of Development Narrative Report 3 The Property is within the Mixed Use Employment Land Use Category of the White Tank Grand Avenue Area Plan and is within the City of Glendale’s Planning Area. The Envision Glendale 2040 General Plan Land Use Map indicates the Property is designated as Luke Compatible Land Use Area. 5.0 Location and Accessibility The Property is located in the western portion of Maricopa County. The property will be accessed via two access roads off of Northern Parkway which serve as entry points to the Marbella Well Site No. 1. An existing utility easement extends from Well Site No. 1 to the Well No. 2 Site. Two paved access roads will serve as entry points and extend from the existing easement to the site. The Loop 101 is approximately 3 miles to the east and the Loop 303 is approximately 4 miles to the west. The Property has access to the I-10 via Dysart Road, approximately 6 miles to the south. The easy access to the freeways allows connections to various municipalities and services in Avondale, Buckeye, Glendale, Surprise and Phoenix. 6.0 Circulation System Access is proposed utilizing Northern Parkway and its frontage road and the access roads to Marbella Well Site No. 1. Northern Parkway is also half improved with a two-lane roadway and is within the future extension of the Northern Parkway and expanded right-of-way, which is planned to become an access controlled, six lane parkway. 7.0 Development Schedule Immediate development of the Property in a single phase is anticipated shortly after approval of this application. Figure 1 provides the project schedule for the Marbella Well Site No. 2 Design and Construction. Design is anticipated to be completed in December of 2021. Construction is anticipated to begin in January of 2022 and be completed by April of 2022. 8.0 Community Facilities and Services The Property is within the Dysart Unified School District. As there are no residential uses proposed within the site, the development will not add any Liberty Utilities Marbella Well Site No. 2 Plan of Development Narrative Report 4 children to nearby schools. The District will be notified in accordance with standard County requirements. Additionally, because the site is non- residential in nature, the proximity of amenities such as parks and recreational facilities is immaterial to the proposed use and application. 9.0 Public Utilities and Services At this time the Property is adjacent to the water service areas of two private water companies, Liberty Utilities and Valley Utilities. Liberty Utilities will be developing the site as a Water Campus. Z2021136 The Maricopa County Environmental Services Department (MCESD) has reviewed revised documents received from the Maricopa County Planning and Development Department for the above referenced project. The purpose of this request is to apply for a Military Compatibility Permit with Plan of Development for the Marbella Well Site No. 2, at APN # 501-53-010F. Water and sewer services will be provided by Liberty Utilities. MCESD has concerns, ATC for the water and sewer infrastructure must be obtained prior to the construction permit be approved. NSA (new source approval) also will be required prior to ATC approval for potable water infrastructure from drinking water program of MCESD (602-506-6935). Based on the above, MCESD raised no objections to the Planning & Development Department in Accela Automation on November 5, 2021. It should be noted that this document does not approve the referenced project. Comments are provided only as advisory to Maricopa County Planning and Development Department to assist staff to prepare a staff report. Other Maricopa County agencies may have additional requirements. Final review and approval will be made through Planning and Development Department procedures. Applicant may need to submit separate applications to the Maricopa County Environmental Services Department for approval of proposed facilities regulated by the Department. This application requests a Military Compatibility Permit with Plan of Development for the Marbella Well Site No. 2. The Marbella Well Site No.2 will include equipping of an existing well, an on-site retention basin, a standby generator, electrical equipment housed under a shade canopy, two paved access roads, one motor operated access gate, and a fenced in area for APS access and equipment with a swinging access gate. The site is located near the intersection of Northern Parkway and Dysart Road and is inside the Luke AFB 1988 JLUS 65 Ldn, “high noise or accident potential zone” as defined by A.R.S. § 28-8461 and is inside the “territory in the vicinity of a military airport” also defined by A.R.S. § 28-8461. As described in the application, this request will not have a negative impact on Luke AFB Flight Operations. Since the site will be located inside the “territory in the vicinity of a military airport,” it will be subjected to approximately 165 over flights per day, as low as 1,500 feet above the ground. We recommend you review the sound attenuation requirements found in A.R.S. § 28-8482. In addition, a strong notification program on the part of the applicant is essential to inform users about Luke AFB operations.
