The applicant is proposing a major amendment of the
approved IND-2 IUPD development standards with a precise
plan of development for a light industrial and manufacturing
center on approximately 74-acre site. The site is generally
located ¼ mile northwest of the northwest corner of Olive
Ave. and Reems Rd. in the Glendale area. This location is
adjacent to the state-delineated high noise and accident
potential zone of the adjacent Luke Air Force Base and is in
area transitioning from agricultural to light industrial uses that
are compatible with the daily operations of the air base.
There are no outstanding concerns from reviewing agencies.
The site is within the City of Glendale’s Municipal Planning
Area and the City’s General Plan designates the site as Luke
Compatible Land Area, which promotes agricultural,
industrial or commercial uses in a region where residential
uses are discouraged. Moreover, the White Tank – Grand
Ave. Area Plan, which was amended for this site by
CPA2020005, designates the site as Industrial Park. The
proposed manufacturing/distribution center is in concert with
both Glendale’s General Plan and amended White Tank-
Grand Ave. Area Plan for this site.
Staff have received one opposition letter against this request
to increase the height of structures on the site. The property

owner is against the increase in height of any structure on the
site, due to privacy concerns. To address these concerns the
developer will not add any windows on the north side of the
north building and with the buffering measures implemented
in this plan the increase in height will have a minimal impact
on the adjacent existing/planned residential uses.
Commission
Recommendation:
On 5/12/22, the Commission will vote on this case to either
recommend approval or denial of this zone change major
amendment. If the recommendation is to approve Z2021155,
staff recommend the following conditions ‘a’ – ‘l’:
a.
A Plan of Development is approved subject to site plan entitled “Indicap – Olive
and Reems” consisting of ten full-sized sheets, dated March 28, 2022, and stamped
received March 29, 2022. The Plan of Development may be amended
administratively under separate application as long as the amendment complies
with the established IND-2 IUPD development standards approved by the Board
of Supervisors. Staff may determine slight refinements to remain in substantial
conformance with the approved site plan. Minor and major amendments to the
approved site plan will be determined in accordance with Chapter 3 of the
Maricopa County Zoning Ordinance.
b.
Development of the site shall be in substantial conformance with the Narrative
Report entitled “Indicap, Inc. – Olive Ave. & Reems Rd.”, consisting of ten pages,
dated March 28, 2022, and stamped received March 29, 2022, except as modified
by the following conditions.
c.
Development of the site shall be generally consistent with the Landscape Plan
entitled “Indicap – Olive and Reems”, consisting of nine pages, dated March 28,
2022, and stamped received March 29, 2022, except as modified by the following
conditions.
d.
The following Planning Engineering comments shall apply:
1.
Earthen berms used to retain or convey runoff must contain an eight-foot-
wide top width. Use of concrete lined channels negate this requirement.
2.
Surface retention basins deeper than one foot must contain one foot of
freeboard.
3.
Retention basins, including underground retention systems, must drain
within 36 hours.
4.
The areas identified to provide access from Reems Road contain Special
Flood Hazard Areas (FEMA Zone A); and also contain lands owned or
encumbered by the Flood Control District (FCD). In addition to floodplain
use permitting, ROW permitting will be required by the FCD, see
https://www.maricopa.gov/5657/Permits#row for more information. The
FCD ROW permit must be procured prior to issuance of any building
permit(s).

5.
Access to the site will be though a private parcel. The applicant must
demonstrate it has legal access to the site prior to the issuance of building
permit(s).
6.
Access to 159th Avenue shall be gated and be used only for emergency
access.
7.
Prior to issuance of building permit(s), the owner/ developer must
contribute $118,820.00 towards the cost of new traffic signal at the Olive
Avenue / Reems Road intersection which is planned to be part of MCDOT
TIP Project TT0562.
8.
A dedicated southbound right-turn lane and northbound left-turn lane at
Access A (Reems Road & Hatcher Road alignments) must be constructed
as part of the site’s development. MCDOT permit(s) for said work shall be
issued prior to or concurrent with any building permit(s).
9.
The owner/developer must coordinate with MCDOT and City of Glendale
DOT for the new traffic signal design and installation along with the final
geometry of Access A and Hatcher Road alignment for review and
approval. Traffic signal design and installation will be based on the
approval from the City of Glendale. Such approvals (emails, letters etc.)
must be demonstrated prior to building permit issuance.
10.
Detailed Grading and Drainage (Site Infrastructure) Plans must be
submitted with the application for Building Permits to demonstrate how flow
from each respective drainage area will be directed to its designated
retention basin. This shall include the requirement to provide calculations to
substantiate the storm drain design; and retention basin slope protection at
areas that will receive direct inflow from paved areas and at concentrated
inflow locations.
11.
Based on the conceptual design nature of the information submitted,
changes to the site layout may be necessitated by the final engineering
design of the site’s drainage infrastructure.
12.
Engineering review of planning and/or zoning cases is for conceptual
design only. All development and engineering design shall be in
conformance with Section 1205 of the Maricopa County Zoning
Ordinance; Drainage Policies and Standards; Floodplain Regulations for
Maricopa County; MCDOT Roadway Design Manual; and current
engineering policies, standards and best practices at the time of
application for construction.
e.
All buildings subject to noise attenuation as per ARS § 28-8482(B).
f.
The master developer shall notify future tenants or owners that they are located
within the state-defined “territory in the vicinity of a military airport” with the
following language:

“You are in the ‘vicinity of a military airport’ as described by State of Arizona statute
ARS §28-8481. Structures should include sound attenuation measures as directed by
State law. You will be subject to direct over flights and noise by Luke Air Force Base
jet aircraft in the vicinity.
Luke Air Force Base executes over 200,000 flight operations per year, at an
average of approximately 170 overflights per day. Although Luke's primary flight
paths are located within 20 miles from the base, jet noise will be apparent
throughout the area as aircraft transient to and from the Barry M. Goldwater
Gunnery Range and other flight training areas.
Luke Air Force Base may launch and recover aircraft in either direction off its
runways oriented to the southwest and northeast. Noise will be more noticeable
during overcast sky conditions due to noise reflections off the clouds.
Luke Air Force Base's normal flying hours extend from 7:00 a.m. until approximately
midnight, Monday through Friday, but some limited flying will occur outside these
hours and during most weekends.
g.
The following IND-2 IUPD development standards shall apply:
1.
There shall be a maximum height of 49’ for any structure.
2.
There shall be no screening along the site’s eastern and southern
boundaries.
3.
Outdoor industrial uses or enclosures shall encroach into any required street
side yard.
4.
There shall be a minimum side yard of 25-feet adjacent to any rural or
residential zoning district.
5.
All structures shall be prohibited within 100-feet from both the R1-35 and R1-
6 RUPD zoning boundary to the north portion of the site.
6.
Any outdoor light sources within the 100-foot buffer area shall have a
maximum height of 12-feet and fully shielded.
7.
There shall be a minimum 25-foot deep landscape buffer along the length
of the northern site boundary.
8.
Adult oriented businesses, retail cannabis businesses, and residential uses
shall be prohibited.
h.
The developer shall create a lot combination of the two parcels of the site prior to
submitting for building permits.
i.
Continued compliance with the approval of CPA2020005 and Z202012 as
applicable.

j.
Amendments to the site plan and narrative report shall be processed as a revised
application in accordance with Maricopa County Zoning Ordinance Article 304.9.
k.
The property owner/s and their successors waive claim for diminution in value if
the County takes action to rescind approval due to noncompliance with
conditions.
l.
The granting of this change in use of the property has been at the request of the
applicant, with the consent of the landowner. The granting of this approval allows
the property to enjoy uses in excess of those permitted by the zoning existing on
the date of application, subject to conditions. In the event of the failure to comply
with any condition, the property shall revert to the zoning that existed on the date
of application. It is, therefore, stipulated and agreed that either revocation due
to the failure to comply with any conditions, does not reduce any rights that
existed on the date of application to use, divide, sell or possess the property and
that there would be no diminution in value of the property from the value it held
on the date of application due to such revocation of the Zone Change
amendment. The Zone Change amendment enhances the value of the property
above its value as of the date the Zone Change amendment is granted and
reverting to the prior zoning results in the same value of the property as if the Zone
Change amendment had never been granted.

Project Summary:
1.
The applicant is proposing a major amendment of the approved Z2020102 - IND-2 IUPD
development standards with a precise plan of development on an approximately 74-
acre site. The site is generally located ¼ mile northwest of the northwest corner of Olive
Ave. and Reems Rd. in the Glendale area. The site is located adjacent to the noise
contours (high noise and accident potential zone) of Luke Air Force Base and is in an
area transitioning from agricultural to light industrial uses that are compatible with the
daily operations of the air base. Once this request is approved the development for the
site will be a light industrial and manufacturing distribution center.
2.
Main access to the site will be from Reems Rd. via a new private roadway that will cross
the property to the east and traverse through the middle of the site. Indicap will be an
industrial park with three separate buildings which will be speculative office and
warehousing structures. The buildings will be constructed on-site and left in a shell
condition for future tenants. Each building will have their own separate loading docks
and parking areas. The largest building, at 564,329 ft², will be in the north of the future
private road. The smaller buildings (one at 212,160 ft² and the other at 243,360 ft²), will be
to the south of the private road. The entire development will provide a 100-foot deep
landscaped buffer between the industrial uses and residential uses to the north, with the
nearest building to existing/planned residential areas setback 250-feet away from the
north site boundary.
3.
For over a century, the site has been used primarily for agriculture. On May 5, 2021, the
Board of Supervisors approved CPA2020005, which amended the original White
Tank/Grand Ave. Area Plan land-use designation from Agricultural to Industrial Park on
the southern part of the property and Small Lot Residential for the northern part of the
property. Simultaneously, the Board approved Z2020102, which rezoned the southern
portion of the property to IND-2 IUPD for a future industrial developments and the northern
portion of the property to R1-6 RUPD for a future residential subdivision. These entitlements
included provisions to separate the two land use areas of the property with a 25-foot
deep minimum landscape buffer along the northern boundary of the industrial site, and
barring any structure within 100-feet of the industrial site’s northern boundary. This
proposed amendment will be in conformance with CPA2020005 and Z2020102, except
for the requested modifications.
4.
Currently, the site is zoned IND-2 IUPD and this amendment request is to vary three of the
approved Z2020102 - IND-2 IUPD development standards, allowing for industrial buildings
that meets today’s standards. The primary request is to vary the maximum structure
height from the required 40-feet to 49-feet to accommodate a manufacturing
distribution center to be constructed to today’s industrial standards. However, even with
the requested nine-foot additional height of the structures on this site, this change would
be hardly noticeable with the generous landscape buffer and large parking area in the
northern portion of the site. Another request is to eliminate the screening requirements
along the site’s eastern and southern boundary. The reason for this request is that the
area east of the site is a flood control facility and a vacant site that is within the noise
contours (high noise and accident potential zone) of Luke Air Force Base where new
residential uses are prohibited. Moreover, south of the site is a railroad, Olive Ave., and
the Woolf Crossing PAD in Glendale, that is designated for light industrial uses, since this
area is also within the high noise and accident potential zone. Finally, there is a request

to allow industrial uses within the required yards of the site adjacent to any street or
reserved right-of-way. The reason for this request is that the properties to the east along
the recorded roadway easement and properties to east are within the high noise and
accident potential zone, where new residential uses are prohibited. Therefore, having
industrial uses or storage inside these required yards will not have a negative effect to the
east or west neighboring lots.

The site is not adjacent to any MCDOT-maintained rights-of-way. The developer will be
conditioned to contribute a portion of the cost of a new traffic signal at the Olive
Ave./Reems Rd. intersection. The developer will also be conditioned to dedicate both a
right-turn lane and northbound left-turn lane where the proposed private access road
will meet the intersection of Reems and Hatcher Roads. All of these conditions will be
coordinated with both MCDOT and the City of Glendale DOT.
Adopted Plans:

White Tank / Grand Ave. Area Plan (adopted December 6, 2000): The area plan
designates the site as Agriculture; however, on May 5, 2021, the Board of Supervisors
approved CPA2020005, which changed the land-use designation of the site to Industrial
Park. This designation is for areas planned for industrial development in regions outside
of or on the edge of residential development. The proposed use of the site as an industrial
park development is compatible with the current amended land use designation.
9.
Envision Glendale 2040 (adopted September 30, 2016): The current general plan of
Glendale designates the site as Luke Compatible Land Use Area and is a designation
envisioned for agricultural, industrial, or commercial uses that do not interfere with the
daily operations of Luke Air Force Base. This portion of Glendale’s Municipal Planning Area
is within the Luke Air Force noise contours where residential uses are discouraged and
majority of the adjacent sites are existing/planned manufacturing centers, thus this
proposed land use for this site is compatible with surrounding land uses in this part of
Glendale. The City was provided the opportunity to review and comment on this
proposal; however, to date Glendale has not provided comment on this request.
Public Participation Summary:

The applicant notified property owners within 300-feet of the site and to area interested
parties. During the applicant’s Citizen Participation process staff received one letter of
opposition by a neighboring parcel. The property owner is against the increase in height
of any structure on the site, due to privacy concerns. As a result of this concern, the
developer is not planning to add any windows on the north side of the north building and
with the buffering measures implemented in this plan the increase in height will have a
minimal impact on the adjacent existing/planned residential uses. Staff did receive
comments from Luke Air Force Base with no objections to the proposed height increase
of the new structures.
Outstanding Concerns from Reviewing Agencies:

There are no outstanding concerns from reviewing agencies.
Staff Analysis:

Staff is in support of this major amendment of the approved Z2020102 - IND-2 IUPD for this
site. The request to increase the maximum building height by nine feet (to a maximum
of 49-feet) would be indistinguishable from the adjacent properties of this site and not
having screening on a side of the site that abut land not appropriate for residential uses

is reasonable. The plan to develop the site as an industrial park with structures ready for
industrial tenant’s will be appropriate for an area with existing and planned industrial uses.
Furthermore, this type of development will add skilled manufacturing and employment
opportunities that will foster a strong regional economy in this part of the County. The
developer will add screening and landscaping to the north part of the site that will be
closest to residential uses which is an appropriate buffer between the two land-uses. The
architectural design of each structure will match the City of Glendale’s aesthetics for
these types of buildings and will blend in well with the adjacent existing industrial buildings
in this area.
Recommendation:
13.
Staff recommends the Commission adopt a motion recommending that the Board of
Supervisors approve Z2021155 subject to conditions ‘a’ - ‘l’:

I.
Introduction & Purpose of Request
This is a request for a modification of the approved IND-2 IUPD development standards in order to
develop a light industrial and manufacturing distribution center on an approximately 77-acre portion
of Assessor Parcel Number 501-41-006N and 501-41-008G generally located west of the northwest
corner of Olive Ave. and Reems Rd (the “Property”).
Further, this is a request to seek approval of a precise plan of development for the Property.
II.
Description of Proposal
The Property is zoned IND-2 IUPD and this modification request of the approved IND-2 IUPD
development standards is requested due to the industrial nature of the proposed uses on the Property.
The primary request is to vary the maximum structure height to 49’ from the required 40’ to allow
the proposed manufacturing distribution center to be constructed to industry standards.
The Property is currently vacant and is underutilized. The Property has no structures and was used
for agricultural uses in the past. There is a water retention area towards the southeast corner of the
Property which was used to assist the agricultural uses. The Applicant intends to develop the
Property into a manufacturing distribution center.
The proposed uses for the Property will utilize Reems Rd. for access and the proposed
development will have numerous circulating roads within the Property to allow the trucks and
company vehicles to negative through the Property with ease. As indicated on the site plan,
contained herein, there will be three separate buildings on the Property. The Property will have
multiple retention areas and adequate parking for the proposed use. Each building will have
its individual separate loading dock(s) and truck traffic will circulate throughout the Property
using the proposed drive isles indicated on the site plan.
An IUPD overlay modification is requested to allow for the following variations from the existing
IND-2 zoning category (changes are in bold).

The proposed IND-2 IUPD development standards will allow the Property to be developed into
speculative office and warehousing buildings. The end user is unknown at this point in time but
typical industry work hours are 8 AM to 5 PM, Monday through Friday. Because the buildings are
speculative and the tenants are unknown, the total number of employees cannot be determined at
this point in time. Nonetheless, the buildings will be constructed in a shell condition with a
professional, corporate image.
These variations are requested in order to allow the proposed distribution buildings to be built to
industry standards. The permitted height of forty (40) feet is too small and would not allow the
proposed use to flourish. Therefore, a minor increase of nine (9) feet is requested. Further, the mere
nine (9) foot increase will not have a negatively impact upon the surrounding properties because
the underlying entitlement stipulations require increased landscaping and setbacks to the
neighboring residential uses. The increased landscaping and setback requirements are so great and
so substantial that a mere nine (9) foot will be unnoticeable to the human eye. See Exhibit 1.
Therefore, because the increase will be unnoticeable to the human eye and is necessary to ensure the
success of the Property, the amendment development standard is appropriate for this site.
Additionally, representatives from Luke Air Force Base have been contacted about the proposed
height increase. The representatives responded indicating the base has no objections to the
proposed nine (9) foot increase and 49-foot maximum height. See Exhibit 2.
Further, the shielding and screening wall variation is requested because the installation of a shielding
or screening wall along the Property’s eastern and southern boundaries would serve no purpose. The
property located to the east of the Property is owned by the Flood Control District and is a known
floodplain. Therefore, residential uses cannot be developed east of the Property. Further, the property
east of the Property and east of Reems Rd. is zoned for industrial uses and currently house the Red
Bull and White Claw distribution centers. Therefore, no residential uses will develop on the property
east of the Property and east of Reems Rd. Accordingly, requiring a screening or shielding wall
along the Property’s eastern boundary is nonsensical and serves no justifiable purpose. Moreover,
the same reasoning can be used to justify the variation for the Property’s southern boundary. The
property south of the Property and south of Olive Ave. is within the City of Glendale’s municipal
jurisdiction is zoned according to the Woolf Crossing PAD. The Woolf Crossing PAD permits a
multitude of industrial uses. Therefore, residential uses will not develop south of the Property.
Furthermore, a railroad easement runs the length of the Property’s southern boundary. The railroad
easement further buffers the Property from Olive Ave. and the property south of the Property.
Therefore, additional screening and shielding is unnecessary at best.
Moreover, this request seeks to vary the standard that forbids industrial uses in the required yards
adjacent to any street to permit industrial uses in the required yards. The same justification that is

outlined above is applicable to this variation. Namely, the Property will host industrial uses that are
already isolated from any existing or potential residential zoning district. Further isolation or
elimination is not necessary because the Property is already shielded from every current or proposed
residential subdivision.
Outdoor lighting shall be in conformance with the provisions contained in Chapter 11, Section 1112,
of the Maricopa County Zoning Ordinance, and shall be placed and oriented so as to reflect light
away from any adjoining rural or residential zoning districts unless otherwise stated in the underlying
entitlement stipulations.
Any and all signage will conform with the industrial signage regulations of Chapter 14 of the
Maricopa County Zoning Ordinance.
III.
Relationship to Surrounding Properties
The Property was recently rezoned to IND-2 IUPD pursuant to Z2020102. Z2020102 contained
multiple stipulations specifically impacting the IND-2 IUPD zoning district. In relevant part,
Z2020102 contained the following stipulations:
1. Min. Side Yard: 25’ adjacent to rural or residential zoning.
2. Prohibited Uses: Adult oriented businesses, medical marijuana and residential
(single-family, two-family or multi-family)
3. Buffering: All structures shall be prohibited within 100’ of the R1-6 RUPD and R1-
35 zoning boundary to the north and light sources within this buffer shall be a
maximum 12 feet in height and shielded.
4. There shall be a minimum 25’ landscape buffer along the length of the northern
boundary of the IND-2 IUPD zoning district.
The Property is adjacent to or nearby the following land uses and zoning districts:
•
North: Vacant land is north of the Property and was zoned R1-6 RUPD pursuant to
Z2020102. As stated above, this IUPD overlay will only apply to the IND-2 portion
of APN: 501-41-006N and 501-41-008G. Moreover, the Twelve Oaks Estates
subdivision is located to the northwest of the proposed development. The proposed
development will be adequately screened from the Twelve Oaks Estates subdivision
according to the stipulations contained in Z2020102.
•
South: Olive Ave. runs parallel to the Property’s southern boundary. The land south
of Olive Ave. is vacant and is zoned as a Planned Area Development (“PAD”)
pursuant to the Woolf Crossing PAD. The land south of Olive Ave. is within the City
of Glendale’s municipal limits.
•
East: The land east of the Property is owned by the Flood Control District of
Maricopa County, the Applicant, NWRO, LLC, and TGC Investments, LLC. The
land east of the Property is vacant and is zoned RU-43. Access to and from the
proposed development is anticipated over the land east of the proposed development.
•
West: The land west of the Property is vacant and is owned by Suburban Land
Reserve, Inc. The land west of the Property is zoned RU-43.
The existence of numerous industrial developments and the existence of numerous industrially zoned
parcels in the surrounding area support the requested IND-2 IUPD modification for the Property.
The proposed modification and subsequent development will seamlessly blend into the already
existing and proposed industrial developments located throughout the 303-corridor.

IV.
Location and Accessibility
Access to the Property will be through APN 501-41-006U and over land controlled by the Flood
Control District. Access to the Property will traverse the aforementioned parcels after exiting
Reems Rd. Access to the Property is not anticipated off of Olive Ave. due to the existing railroad
tracks. Access to the Property is being purchased by the current land owners of APNs 501-41-
006T. The development team is discussing access over the land controlled by the Flood
Control District and will provide a cross-access agreement prior to building permit approval.
Reems Rd. is a paved roadway with one travel lane in each direction.
The developer will improve and dedicate the necessary right-of-ways to ensure the proposed
development is adequately served. Moreover, the developer will work with the Flood Control
District to ensure access of their parcel is feasible.
V.
Circulation System
As noted above, access to the Property will be via Reems Rd. through proposed drive isles.
Further, as stated above, no access is proposed for Olive Ave.
Onsite parking and circulation roadways will be paved and will be in compliance with all
applicable Zoning Ordinance regulations and requirements.
All parking and loading docks will adhere to the requirements contained in the Maricopa County
Zoning Ordinance and will be based off of the proposed uses depicted in the site plan.
VI.
Development Schedule
Phasing is not anticipated at this time. However, the Applicant reserves the right to phase their
development if the proposed uses and/or tenants necessitate phasing.
At this point in time, no annexation into the City of Glendale is contemplated or planned.
VII.
Community Facilities and Services
The proposed industrial use and subsequent development will have no adverse impact on the
neighboring area or the schools within the area. The proposed development will have no negative
impact of the neighboring residential uses because the proposed development will be adequately
screened and shielded from the residential uses.
VIII.
Public Utilities and Services
This application request will not adversely affect municipal or private facilities and services will
not have an adverse effect on existing or future public and private open space, recreation, school,
or library facilities. The following identifies public and private services for the development:

I don’t see any objections we would have at 49 feet – we appreciate the ask.
Please have the developer submit the FAA Form 7460-1 (Type 1A Survey) as soon as possible in the
development process as that FAA analysis is the most definitive way to determine any obstructions
or RADAR issues.
We have had several buildings evaluated for 54 ft in that general area with no issues reported; but
each parcel is different based on a number of factors, so the FAA/OEAAA process is critical.

The Maricopa County Environmental Services Department (MCESD) has reviewed
documents received from the Maricopa County Planning and Development
Department for the above referenced project. This project is a Rezoning to IND-2 at
APN# 501-41-006N & 8G. Water provider is EPCOR and Sewer provider EPCOR.
MCESD have to approve the ATC for the utilities prior to final IUPD approval.
Based on the above, MCESD raised no objection to this project to the Planning &
Development Department on December 6, 2021 and the project may proceed at this
time subject to the following stipulations:

Comments are provided only as advisory to Maricopa County Planning and

Engineering Review has reviewed the 2nd plan and report routed for review on 2/7 and
2/9/2022, for the subject application and has no objections subject to the following
conditions:
a. Earthen berms used to retain or convey runoff must contain an 8 foot wide
top width. Use of concrete lined channels negate this requirement.
b. Surface retention basins deeper than one (1) foot must contain one (1) foot
of freeboard.
c. Retention basins, including underground retention systems, must drain
within 36 hours.
d. The areas identified to provide access from Reems Road contain Special
Flood Hazard Areas (FEMA Zone A); and also contain lands owned or
encumbered by the Flood Control District (FCD). In addition to floodplain
use permitting, ROW permitting will be required by the FCD See Permits |
Maricopa County, AZ for more information. The FCD ROW permit must be
procured prior to issuance of any building permit(s).
e. Access to the site will be though a private parcel. The applicant must
demonstrate it has legal access to the site prior to the issuance of building
permit(s),
f. Access to 159th Avenue shall be gated and be used only for emergency
access.
g. Prior to issuance of building permit(s), the owner/ developer must
contribute $118,820.00 towards the cost of new traffic signal at the Olive
Avenue / Reems Road intersection which is planned to be part of MCDOT
TIP Project TT0562.

h. A dedicated southbound right-turn lane and northbound left-turn lane at
Access A (Reems Road & Hatcher Road alignments) must be constructed
as part of the site’s development. MCDOT permit(s) for said work shall be
issued prior to or concurrent with any building permit(s).
i.
The owner/developer must coordinate with MCDOT and City of Glendale
for the new traffic signal design and installation along with the final
geometry of Access A and Hatcher Road alignment for review and
approval. Traffic signal design and installation will be based on the approval
from the City of Glendale. Such approvals (emails, letters etc.) must be
demonstrated prior to building permit issuance.
j.
Detailed Grading and Drainage (Site Infrastructure) Plans must be
submitted with the application for Building Permits to demonstrate how flow
from each respective drainage area will be directed to its designated
retention basin. This shall include the requirement to provide calculations
to substantiate the storm drain design; and retention basin slope protection
at areas that will receive direct inflow from paved areas and at concentrated
inflow locations.
k. Based on the conceptual design nature of the information submitted,
changes to the site layout may be necessitated by the final engineering
design of the site’s drainage infrastructure.
l.
Engineering review of planning and/or zoning cases is for conceptual
design only. All development and engineering design shall be in
conformance with Section 1205 of the Maricopa County Zoning Ordinance;
Drainage Policies and Standards; Floodplain Regulations for Maricopa
County; MCDOT Roadway Design Manual; and current engineering
policies, standards and best practices at the time of application for
construction.

General Project Summary:
The proposed development is planned to include a total of 937,920 square
feet of general light industrial / warehousing uses in three separate buildings
on approximately 70.6 acres. The opening and full build out of the site is
expected by 2023. The project site is located on north side of Olive Avenue
approximately quarter mile west of Reems Road in Unincorporated Maricopa
County.
The project site will be served by one (1) proposed full “Access A” driveway
on Reems Road, located at Hatcher Road alignment. As per the TIA,
proposed development is anticipated to generate a total of 2,677 daily
weekday trips, with 395 total AM peak hour trips, 228 PM peak hour trips on a
typical weekday.
General Comments:
The project site is within the Maricopa County jurisdiction. However, Maricopa
County DOT maintains only west side of Reems Road. East side of the
proposed access A at Hatcher Road alignment / Reems Rd intersection, is
under City of Glendale jurisdiction. The below review comments are limited to
roadways within the County jurisdiction. Developer must submit this TIA to the
City of Glendale for its approval.
Review Comments:
Future functional classification of Olive Avenue along sites’ southern frontage
is principal arterial. Therefore, developer must provide a 65 feet R/W
dedication on the sites’ southern frontage.
As part of half-street improvements, developer is required to construct (or pay
appropriate in-lieu payment as directed by MCDOT) Olive Avenue (along sites’ southern
frontage) roadway matching with the roadway planned under MCDOT TIP Project
TT0562.

and install) at Olive Avenue / Reems Rd intersection, which is planned to be
part of MCDOT TIP Project TT0562.

Lydia Warnick at MCDOT to determine the payment in lieu for Olive Ave/Reems Rd signal
improvements
As recommended in the study, provide dedicated southbound right-turn lane
and northbound left-turn lane at Access A / Reems Road & Hatcher Road
alignment.

Potential Hatchet Road alignment at west of Reems Road, shall be a private
road. MCDOT will not accept this as a public roadway. Developer must seek
R/W permits from MCDOT Flood Control District to cross west of Reems Road
as the properties along this potential Hatcher Road alignment are owned by
the MCDOT Flood Control District.

Developer must coordinate with MCDOT and City of Glendale for the new
traffic signal design and installation along with the final geometry of Access A
and Hatcher Road alignment for their review and approval. Traffic signal
design and installation will be based on the approval from the City of Glendale.
Such approvals (Emails, Letters etc.) must be included in the final TIA
submittal to MCDOT.

Hi Martin,
Thank you for allowing Luke AFB to make comments on the Technical Advisory Committee
Meeting. This request is to modify maximum building height on parcel 501-41-006N from 40’ to 49’ and
modify screening requirements. The site is located at the northwest corner of Olive Ave and Reems Rd
in Surprise, AZ. It is adjacent to the Luke AFB 1988 JLUS 65 Ldn, “high noise or accident potential zone”
as defined by A.R.S. § 28-8461 and is inside the “territory in the vicinity of a military airport” also defined
by A.R.S. § 28-8461.
As described in the application, this request will not have a negative impact on Luke AFB Flight
Operations; however, please have the developer submit the FAA Form 7460-1 (Type 1A Survey) as soon
as possible in the development process as that FAA analysis is the most definitive way to determine any
obstructions or RADAR issues. Since the site will be located inside the “territory in the vicinity of a
military airport,” it will be subjected to approximately 165 over flights per day, as low as 1,500 feet
above the ground. We recommend you review the sound attenuation requirements found in A.R.S. §
28-8482. In addition, a strong notification program on the part of the applicant is essential to inform the
tenant about Luke AFB operations.

I am part of the Twelve Oaks community in Waddell. We are constructing our home at what is
currently the "end" of 159th Ave in the Twelve Oaks community. Tiffany & Bosco, PA recently
filed a rezoning request to modify the standards of the southernmost 77 acre portion of the
parcel. Because we are a residence I would strongly request that the building height not be
raised. I value the privacy that a backyard can and should provide. I have three girls, and my
bride, that I would prefer not be subject to leering views over the fence from the proposed
buildings. While I recognize that even at 40' the building height does present some
opportunities to peer over walls - 49' makes it easy to do so. I would also request that we
maintain the screening requirements to shield the eastern and southern perimeters. We have a
great neighborhood. We're excited for job creation and a more vibrant and diverse economy.
Those things can all still happen without the proposed rezoning. Please feel free to contact me .
