RESOLUTION NO. 42-22 
 
A RESOLUTION OF THE MAYOR AND COUNCIL OF THE CITY OF 
BUCKEYE, ARIZONA, APPROVING THE TRANSFER OF CERTAIN 
RIGHT-OF-WAY AND ROADWAY ON JACKRABBIT TRAIL. 
 
WHEREAS, A.R.S. § 9-471(O) provides that county right-of-way or roadway may be 
transferred to an adjacent city or town by mutual consent of the governing bodies of the county 
and the receiving city, if the city and the county each approve the proposed transfer as a 
published agenda item at regular public meetings of their respective governing bodies; and 
 
WHEREAS, pursuant to A.R.S. § 9-471(O), property so transferred shall be treated as 
though it were newly annexed territory; and 
 
WHEREAS, the right-of-way and roadway to be transferred pursuant to this resolution is 
a portion of Jackrabbit Trail, adjacent to the City of Buckeye, between Blue Horizons Parkway 
and the Roosevelt Irrigation District Canal, as depicted and described in Exhibit A; and  
 
WHEREAS, this resolution has been acted upon as a published agenda item at a regular 
public meeting of the Buckeye City Council; 
 
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF 
THE CITY OF BUCKEYE, ARIZONA, as follows: 
 
Section 1.  The recitals above are hereby incorporated as if fully set forth herein. 
 
Section 2.  Pursuant to the provisions of A.R.S. § 9-471(O), the City of Buckeye (the 
“City”) does hereby approve and consent to the transfer by Maricopa County to the City of 
certain right-of-way and roadway on Jackrabbit Trail, as depicted and described in Exhibit A. 
 
Section 3.  Upon approval by the Maricopa County Board of Supervisors, the Roadway 
shall be treated by the City as newly annexed territory. 
 
Section 4. The Mayor, the City Manager, the City Clerk, and the City Attorney are 
hereby authorized and directed to take all steps necessary to carry out the purpose and intent of 
this resolution, and to ensure that a copy of this resolution, together with documentation of 
approval by the Maricopa County Board of Supervisors, is recorded in the Office of the 
Maricopa County Recorder. 
 
PASSED AND ADOPTED by the Mayor and Council of the City of Buckeye, Arizona, 
this 3rd day of May, 2022.

LEGAL DESCRIPTION 
 
A portion of land being situated within the Southwest quarter of Section 9, 
Township 1 North, Range 2 West of the Gila and Salt River Meridian, Maricopa 
County, Arizona, being more particularly described as follows:  
 
BEGINNING at a found brass cap in hand hole accepted as the West Quarter 
corner of said Section 9 from which a found Town of Buckeye brass cap in hand 
hole accepted as the Southwest corner thereof bears South 00°02’10” West, 
2647.07 feet; 
 
Thence South 89°57'28" East, 65.00 feet along the North line of said Southwest 
quarter to a line that is parallel with and 65.00 feet east of the west line of said 
Southwest quarter; 
 
Thence leaving said north line and along said parallel line, South 00°02'10" West, 
932.29 feet to the northerly line of Roosevelt Irrigation District Canal; 
 
Thence along said Northerly line, South 67°29'02" West, 70.38 feet to the west line 
of said Southwest quarter; 
 
Thence along said west line, North 00°02'10" East, 959.29 feet to the POINT OF 
BEGINNING. 
 
The above described parcel contains a computed area of 61,476 sq. ft. (1.4113 
acres) more or less and being subject to any easements, restrictions, rights-of-way 
of record or otherwise.
